So everyone is aware of what we are talking about, the
proposed line that the Citv Council and the Planning and

line B", which is this line. This is line "A",
"C" and line "D"..

changed at this time. We understand from the Department
of Highways if the bridge does not cross on Route "S"

that there will be a minimum of a two-year delay over
what is now anticipated, and probably longer. The time
3
schedule now is to begin construction in the summer of
n=ext year, and completion in two building seasons. If
4
all the public hearings have to be done over again,
this could increase the time to four years, but we are
5
saying, conservatively, two years.

We have to weigh, and I think the Coast guard is going
to have to weigh in their decision, whether the seven
7
thousand snow geese, which may, in the future, not stop
as a Lesting placa r{oing north --they do not rest
8
going south, b\7 the wa_,7. in the Kenai River_ Flats -- but
going north, wether requiring them to find a new
9
resting area will be -- whether it is more beneficial
10
to require these geese to find new resting areas, or
whether it is more beneficial to delay construction of
this bridge for two or three years and maybe hold up a
11
conuuunity, or an area that serves seven thousand
people, which Kenai and North Kenai does.

This is a decision out of our hands now. This is in the
13
hands of the U. S. Coast Guard Department who have to
say yes, or no, to the application.

As the Payor indicated, the City Council and the
15
Planning Commission have indicated that they are very
much concerned about the environment. And they have
16
dedicated an area around the proposed bridge as an
environmental habitat area. An area that will be
17
restricted for any construction. We propose that this
restriction would not only be imposed by the Planning
18
Commission but possibly also by the State. They have a
two -hundred foot right-of-way on each side of the
19
centerline so that certainly is an area where no
construction can take place.

Also, within the total area, by the Corps of Engineers
21
within the flood plain of the Kenai River. This does
not mean that anv industrial expansion cannot take
22
place there. This just means that if a fellow wants to
invest a few hundred thousand dollars in that area for
23
capital improvement, that he will not be able to get
anv insurance on this investment that he makes. And
24
it is kind of unrealistic to say that a person would do
this.

proposed a small boat harbor. It will remain somewhat
virgin for waterfowl and wildlife habitat. tie, in the
City, are dedicated to do this. We feel that this is of
utmost importance.
Again, I would just like to state that you, the people
of this community, have indicated to your elected
officials what route you feel should be taken. `i'hev
have indicated to the Department of Hight:,a.vs, to thc.
Federal agencies, and the other State agencies, �-,,hat
their preference is.
We feel that, for the benefit of this co:llr;,unity, that
Route "B" should be built. We don't feel that the
delav and the cost that would be involved to pick
another route are justified.
Gentlemen, this is the end of rnv statement,"hut I
would like the opportunity to continue with my
statement after the people from the Federal Fish and
Wildlife have made their statement.

Borough. And I would like to take this opportunity to
thank the Highway Department and the people working for.
the State Highwav in their cooperation with the Kenai
Peninsula Borough, both myself and the Planning
Department and the Planning Commission. It has been a
real welcome situation in the past three years to see
the way that our planning and their planning can be
etied together for the benefit of people in the area.
Yi The Kenai Peninsula Borough Planning Department has
reviewed this project in relationship to our land use
and comprehensive highway program. This project does
fit into the land use development along the lines of
our comprehensive land use program. It also ties in

the year you can see more game in Iowa than you can
along the highways of Alaska. And I do not want to get
in necessarily to the cow moose situation, but that is
an area which I think needs some -- probably not more
words, but a little more studv.
I think that this Kenai River bridge is an excellent
opportunity for the Federal, State, and local people
to create an area within the -- what vou can see from
the bridge, where people can get out and look at these
wonderful wildlife resources as they come through our
area. I will wader to say that half the people. in
Kenai have never seen a sandhill crane, even though they
do come in and nest in the flats.- Likewise, the snow
geese and the swans, and'this sort of thing. It seems
,___to me, if it is handled correctly -- I would hope t1777
hunting would be prohibited in the restricted area
which you can see from the bridge. And it would be
a tremendous opportunity and advance so that the people
who own the wildlife, the people of the United States,
could see it. 0-11

I am Betty Warren, and I'm a homesteader from North
Kenai. I have lived in this area since 1962. I.
previously lived here in '55 and '56. 1 have been in
Alaska for many long years. Note the gray hairs.
That's from the long winters.
I have worked in the City of Kenai selling real estate
for the past six or seven years. I won't speak on the
wildlife and the fish and the fowl because that is not
the line I am interested in. I do believe that we need
to protect our environment. We need to protect the
environment from man, and perhaps we need some
protection of man from the environment. It would seem
that the Alaskans have lived in Alaska and because this
is their State and their country, they should have
some privileges. In the Bible I believe it says that
the beasts are here to serve man. And perhaps they've
served us too well. But I do believe that with some
care and some thought, and certainly some natural

are of concern on any highway project. We have covererec'
fire protection. And, as you know, the Federal Aid
Highway Act of 1956, one of the major reasons for the
construction of the highways is National Defense. We
have talked about the movement of vehicles in the event
of some type of a national defense emergency. And we
have talked about a lot of these other things that do
make for a good package to put together a good job.

friend Nel.s Kjelstad here.
NELS KJELSTAD:
Thank you, Bob. I was hoping someone else would bring
up the one main point that I have.
My name is Nels Kjelstad. I live in Kenai.
During the first hearing on the route designation, I
believe we mentioned that there was a necessity to
have utility crossings in this area, preferably planned
for in the design of the bridge. So I would ask that
question, and maybe we will hear the answer afterwards
whether or not, at this time, you have planned for
possible waterlines, or other utility lines, such as
power and telephone and so on.
The area south of the river, of course, is not
developed yet. There are not a great amount of people
living in the area, or no industry with the exception
Of the gas wells. I would imagine that after
construction of the bridge, there will be considerably
more development in that area. Particularly, if there
is industry in the area, they will be needing water.
Therefore, I would think that plans should be made to
include provisions for a fairly large waterline on this
bridge. In fact, the City of Kenai, at this time, is
talking about providing industrial water to the area.
I should say the City of Kenai and the City of Soldotna
are planning a project that would provide industrial
water. So we hope that you are planning this too.
I would like to say also that I would be in favor of
having a closed area -- we are talking about birds now
--
alongythis route, through the.flats, so that the bird
population could be preserved as much as possible. And
also I go along with those people who say that they
would like to be able to observe these -- the wildlife

C. Kalifonsky Beach Industrial Park (Preliminary)
Mr. Best presented the staff report noting this subdivision
is located approximately 1 mile south and .6 mile east of
Kalifonsky Beach Road where it turns south along Cook Inlet.
The letter from the subdivider, which is on file, was read.
The planning staff has reviewed the plat and recommends pre-
liminary approval subject to:
1. The final plat being oriented so that north is
. toward the top of the plat.
2. The streets be named.
Commissioner Holly moved, seconded by Commissioner Palm, to
approve the plat subject to the staff's recommendations and
that a note be placed on the plat stating the water table is
very near the surface. The motion carried unanimously.
D. Jaynes Subdivision (Preliminary/Final)
Mr. Best presented the staff report noting this subdivision
is located in the City of Kenai at the intersection of 9th
Avenue and G Street, just off of Beaver Loop Road. The
letter from the subdivider, which is on file, was read.
The City of Kenai reviewed the plat at their December 13, 1972
meeting. The subdivision was unanimously approved.
The staff has reviewed the plat and recommends final approval
subject to:
1. Inclusion of the City of Kenai's covenant for
improvements on the plat.
Commissioner Dimmick moved, seconded by Commissioner English,
to approve the plat subject to the staff'' -s recommendation.
The motion carried unanimously.
E. Halcyon Subdivision, Lot 5, Block 1 (Final) - - --- - ---- — -
In presenting the staff report Mr. Best notee this sub-
division is located on the Girves Homestead within the City
of Soldotna. The background was reviewed and it was noted
the preliminary was submitted December 2, 1968 and tabled at
the January 5, 1969 meeting for further information. The
plat was resubmitted January 5, 1970 at which time the pre-
liminary plat as revised was approved. Lot 1, Block 1 was
approved June 17, 1970.
The planning staff has reviewed the plat and recommends final
approval subject to the following being placed on the plat
as requested by the City of Soldotna: "The lot hereon shall
be subject to assessment for improvement required by ordinance
of the City of Soldotna, when installed by the City of Soldotna".

I. Hermann Subdivision (Final)
The staff report was presented by Mr. Best noting this sub-
division is located east of Feuding Lane approximately 3/4
mile south of the Sterling Highway. The letter from the
subdivider, which is on file, was read.
The planning staff has reviewed the plat and recommends the

approval subject to the following:
1. The street named on the north (Getman Drive) and

Mr. Best presented the staff report noting this subdivision
is located on the east side of Forest Lane approximately
1/4 mile north of the junction with North Road within the
City of Kenai. The letter from the surveyor, which is on
file, was read.
The planning staff has reviewed the plat and recommends pre-
liminary/final approval subject to:
1. Lot 1 be labeled Lot lA and the old lot line
be dotted in to clarify the intent of the replat.
2. After the words "Legal Description" under the
name, add the words "Replat of".
3. Label which monuments were recovered or set.
4. The assessment covenant required by the City of
Kenai be added.
5. The continuation of 24th Avenue as requested by the
City of Kenai.
Commissioner Hursh asked if there were some buildings or
trailers where the City of Kenai requested the continuation
of 24th Avenue.
Mrs. Gibbs was not sure and went to check.

was read. The property was excepted in the Bailey Subdivision
filed in 1965 in Homer.
The planning staff has reviewed the plat and recommends pre-
liminary/final approval as submitted.
Commissioner Dimmick moved, seconded by Commissioner English,
to approve the plat as submitted. The motion carried unanimously.
J. CONTINUED - Gilbertson Subdivision
Mrs. Gibbs returned with a map showing there are three buildings
located in the Gilbertson Subdivision where the City of Kenai
requested the continuation of 24th Avenue.
Commissioner Holly moved, seconded by Commissioner Hursh, for
reconsideration of item 3 -J. -Gilbertson Subdivision. The motion
carried unanimously.
Commissioner Holly moved, seconded by Commissioner Hursh, to
table the plat until the City of Kenai reconsidered the plat
due to three trailers being situated where the City of Kenai
requested the continuation of 24th Avenue. It was also noted
that some other possibilities are contained in "Guidelines
for Street Planning Kenai, Alaska 1969". The motion carried
with no objections.

plat at its January 3, 1973 meeting. The plat was approved
subject to the 33' section line right-of-way being shown or
vacated.
The planning staff has reviewed the plat and recommends pre-

2. Block 3, Lot 6 the street radius should be
eased. The same comment applies to Block 1,
Lot 15.
3. Delete Chinook and spinnaker court. These
are superfluous as all lots could be numbered
from the roads.
4. Portside Way appears to be unneeded and could
just be a continuation of Banner Lane.
5. An easement to provide for maintenance of
drainage is required along the common lot line
of lots 7 & 8 of Block 3. 10' on each lot
would be sufficient.
6. It is requested the following statement be

is Beaver Loop Laundromat for which the original survey was
made in 1962. The letter from the surveyor, which is on file,
was read.
The planning staff has reviewed this plat and recommends ap-
proval subject to:
1. Approval by the City of Kenai.
2. Long & Cone Subdivision being shown as No. 3 Cone
K-1639.
3. The tract being shown as Cone Tract "A".
4. BLM corner being shown as found.
For the benefit of the new commissioners, Mr. Best explained
a deed of record plat.

and vacation of section line public hearing was September 11, 1972,
plus conditions - i.e. approval of the Department of Environmental
Conservation and other on lot size. On November 27, 1972, the

Dear Property Owner,
The City of Kenai Planning Commission needs your help. We
have been asked to consider rezoning a portion of the old
Kenai Townsite from Urban Residential to Central Commercial.
At a most recent planning commission meeting, the members
seemed to have mixed feelings on this question and felt that
an indication from the individual property owners in that
area would be most helpful in assisting the Planning Commission
come to a decision on this matter.
This action, if approved by a majority of the owners in the
area in question, (shown on attached map) would create more
central commercial property within the City of Kenai in
private hands. Your land would then become saleable as
commercial property if you so desired to sell. Your response
in the areas indicated below does not mean that this area
will be changed to Central Commercial, it merely indicates
your preference to either leave the zoning as it is, or change
it to Central Commercial.
In the event a large majority wish the change, a public
hearing will be held at which time you will have the opportunity
to present any testimony either for or against the proposed
rezoning. You will be notified by mail of this public
hearing. In addition, the public hearing will be advertized
in the local newspapers, prior to the public hearing.
The City Planning Commission wished to act in this matter
according to the wishes of the majority of the property
owners in that area, and therefore requests that you check
one of the two areas indicated below showing your desires.

RE: Vacation of Alley, vicinity of "Kenai Korners"
It is my understanding the vacation of the alley contigious to they
Kenai Korners retail sales building and warehouse is proposed to
facilitate replacement of the existing structure with a different
type of structure which would have beneficial results for fire
insurance rates as well as an alternative service available to the
City.
The actions should probably best be outlined as follows:
1. The Borough Planning Commission will have to hold vacatiol
hearings because under the new municipal code it is the agent,,
vested with authority for platting or replatting.
2. In practice the Kenai Peninsula Planning Commission will
adopt reasonable recommendations of the Kenai Planning Comm-
ission --at any rate the Kenai Commission would probably have
veto over anything carried on throught the Kenai Peninsula
Borough Agency.
3. The authority for the Borough Agency to act is found in
A.S. 29.33.150 (and since it is an area wide power will be
exercised even in home rule cities because it is already
being exercised).
4. The replatting which will be required is initiated pursuaiit
to A.S. 29.33.200 which provides in part "no platted street
may be vacated, except upon petition,ofthe municipality or
owners of the majority of the front feet of the land fronting:
the part of the streets sought to be vacated." There are other
requirements but the statute is probably best to view rather
thaR my repeating it here.
S. A.S. 29.33.210 requires a notice of hearing which should
probably be 30 days after notice but not longer then 60 days
after notice.
6. Pursuant to A.S. 29.33.202 "no vacation of a city street
may be made without the consent of the city council" --in other
words authorization to vacate the alley could be vetoed by the'
Kenai City Council (it is my understanding that that would not
be the recommendation since the beneficial results would flow
from the proposed use after platting was accomplished.
7. A.S. 29.33.204 specifies who gets title to the vacated
area.
8. Provisions should be made for any utilities which are in
the vacated section to be either terminated, rerouted or othei
disposition. It is suggested that possibly the City as an
incentive to the over all proposed improvement of the property
in question might assist with relocation of the utilities.
This memo is not intended to be an exhaustive discription of all
of the steps which must be taken. It is a generalized, in some
.respects specific, outline of the requirements for this type of

Dear Mr. Hudson,
The City of Kenai Planning Commission has considered the vacation
of an Alley between Peninsula Avenue and the Kenai Spur Highway
Frontage Road.
At the time you discussed this petition by Mr. Fred Korpinen,
we discussed the problem of turning snow removal equipment,
and so forth in that particular area if the northern portion
of the alley were vacated.
At your last Planning Commission meeting, you instructed me to
work with Mr. Korpinen to bring back to the Planning Commission
an agreement between the City and Mr. Korpinen for transfer
of property in exchange for the closure of the alley. I have
discussed the problem with Mr. Korpinen, and he agrees to
dedicate to the City of fifty (50) foot radius right-of-way
from his lot immediately south of the area to be vacated. This
lot more commonly known as the Knight lot is 123 foot long and
100 foot wide. I have attached a drawing to the back of this
letter indicating what our agreement was.

Myself, and Mr. Korpinen also discussed the problem of utilities

within the right-of-way vacated. Mr. Korpinen agreed that the
cost of removal of the utilities from the alleyway would be
borne by himself and that he would make the arrangements to do
this.
As indicated by our discussions at the last Planning Commission
meeting, I have also placed a signature block on the bottom of
the agreement for the signature of the Fire Chief. This
agreement should be in your hands prior to the next Planning
Commission meeting.

ITEM 3: OLD BUSINESS
(a) Cemetery
Red Jaynes brought a map showing the existing cemetery with
the proposed expansion. The map showed the realignment of
the road by the cemetery, which would improve the cemetery
site, utilize part of the existing road for a parking area
and be further from the gas line.
After some discussion, Elson moved and. Cruver seconded to
adopt the Master Plan of the cemetery showing the realign-
ment of First Av^nue and utilizing the existing road as
part of the parking area. There were no objections to
unanimous consent and was so ordered.
(b) Subdivision plat - Gilbertson S/D
This subdivision plat was approved by the Commission
providing 24th Avenue was extended. The Borough tabled
the matter and sent it back to the Kenai Planning Commission
because of three trailers located on 24th Avenue.
Red Jaynes recommended one of .the following actions be
followed: ✓
1. The owner be requested to show how he proposed
to provide other areas with proper subdivison poss-
ibilities.
2. Insist on the continuation of 24th Avenue. This
would require the removal of the trailers at some time
in the future.
After some discussion, Elson moved and Malston seconded for
the extension of 24th Avenue. There were no objections to
unanimous consent and was so ordered.

(c) Subdivision plat - Robin SID
Mr. Jaynes went through the subdivision plat check list
and found everything in order except the building set back
line. It is shown as 20 ft. and in suburban residential
areas 25 ft. is required.
Elson moved and Malston seconded to approve the sub-
division plat - Robin SID with a 25 ft. set back. There
were no objections to unanimous consent and was so ordered.
(d) Expiration of terms of office - Jim Elson & Ruby Coyle.
Jim Elson and Ruby Coyle expressed their desire to continue
serving on the Kenai Planning & Zoning Commission. The
secretary was directed to write a letter to the Mayor so
stating.
(e) Deed of Record Plat - Chester Cone
Malston moved and Elson seconded to approve the Deed of
Record Plat - Chester Cone. There were no objections to
unanimous consent and was ordered.
(b) Alley vacation - Kenai Korners
Fred Korpinen is requesting the vacation of the portion of
the alley that separates his lumber yard.
Oscar Thomas, of Kenai Utility Service Corporation, wrote
the Commission a letter requesting a perpetual covenant
be provided that if, in the opinion of our management,
abandonment of our facilities is indicated, the cost of such
abandonment is to be borne by the owner of the property at
the time of abandonment.
W. Koprinen has no objections to this perpetual covenant.
The Administration would request some time to study this
before making any, recommendation.
Mr. Korpinen stated he has talked with the Fire Chief
regarding this and he indicated no objection.

they asked for the alley vacation before but he has no

1. meets with the approval of Administration
2. meets with the approval of the Fire Chief
3. meets with the approval of the City Attorney with
reference to Ordinance 115.
4. providing the action meets with procedures as
outlined by Ordinance.
5. if there are any objections be brought back to the
Planning Commission.
The motion carried unanimously by roll call vote with
Korpinen abstaining.
(a) Rezoning of a portion of Old Townsite
Chairman Al Hudson reported this rezoning was referred to the
Commission by the Council.
Mr. Jaynes brought a map colored as he interpreted the
Comprehensive Plan. A portion of the land is already
central commercial.
After some discussion, Korpinen moved and Poppin seconded
this item be dropped until such time as someone desirous of
rezoning brings this to the Planning Commission.
After more discussion Korpinen withdrew his motion with
consent of second.

After much discussion, Elson moved and Malston seconded to
send form letters to the property owners stating the Planning
& Zoning Commission have been asked to consider rezoning
a portion of Old Townsite to central commercial and would
like them to indicate if they feel their property should be
rezoned from Urban Residential to Central Commercial as per
attachments and that should the response from the requests
indicate a need for rezoning, they will be notified of the
date the public hearing will be held. The motion carried
unanimously by roll call vote.

within the subdivision. For example, what are we going to
require of each subdivider within the City of Kenai. Possibly
we should be considering, rather than changes in the existing
ordinances, a new improvement ordinance? I mention this only
as a possibility.
Included in this packet are the proposed changes to Ordinance
# 26, the Kenai Peninsula Borough Ordinance relating to sub-
division plats and platting. On page 22 of this Ordinance,
Article 6, Improvement requirements, it would appear that this
Ordinance delegates the authority to each first class city to
require improvement standards, including streets, electric,
drainage system facilities, water service, sanitary sewer
systems, street names, signs, walkways and street lighting.
And, in addition, the City may require improvements, such as
curbs and gutters, sidewalks and other improvements. Additionally
in your packet are several excerpts from the City Code. Your
attention is directed to Section 1.4-20, Minimum Improvements
required; Section 18-14, Street Improvements; Section 18-15,
Street Drainage;, Section 17-52, Private Water vystems; Section
17-59, Private Sewers; Section 17-64, Connection of Private
Sewer Systems to the City, and Section 17-68, Connection of
Private Water Systems to the Public System.
It would appear that this bodge-podge might be better outlined
in a single ordinance rather than scattered throughout the City
Code as it is now. For your information, I have bracketed the
section that requires covenants be placed ren a subdivision plat,
if for any reason the improvements required are not installed at
the time the subdivision was platted. For your additional
information, I will not be at your February 28th Planning
Commission meeting, but will be at the meeting on March 14. 1
hope this information has been helpful to you in your deliber-
ations. It you have questions, please contact me, and I will

AGREEMENT

1, Fred Korpinen, agree to the following items. In the event that the
City of Kenai Planning Commission and Council agree to vacate the
Northerly portion of the Alley between Peninsula Avenue and the Kenai
Spur Frontage Road, that Alley more specifically described as the Alley
between the Kenai Korners Store and the Kenai Korners Wharehouse and
Lumber Supply Yard. I will agree to the following:
I will dedicate to the City of Kenai a fifty (50) foot radius
right-of-way on the Northern portion of the remaining unvacated
Alley Way. Such fifty (50) foot right-of-way will come from my
private property and will be approximately as shown on the
attached drawing. I also agree that in exchange for the closure
of the Alley, that I will make arrangements with the private
Utilities Companies, more specifically described as Kenai
Utility Service Corporation, Glacier State Telephone Company,
and Homer Electric Association, Inc., to have any and All
utilities from this Alley Way removed or if not removed,
protected by me in such a manner as to create a protection to
those utilities for the public. It is understood that this
protection to the utilities in the vacated right-of-way will
in no manner create any liability to the City or its citizens
and will be a permanent agreement for the protection of those
utilities.
It is further agreed that 'should the City of Kenai Planning
Commission and the City of Kenai Council agree to the vacation,
that this agreement is based on the proposal that a new building
would be locatdd in the vacated area and that should this
building not be built within a two (2) year period that the
vacation of this Alley be set aside and the property returned
to the public use as an Alley Way.

approve the plat subject to the staff's recommendations, to
grant the 3:1 depth to width exception request and reserve
the walkway adjacent to Lot 1 Block 1 for property owners of

C. Gilbertson Subdivision (Preliminary/Final)
Mr. Best presented the staff report noting this subdivision
is located on the east side of Forest Lane, approximately
1/4 mile north,of the junction with North Road, within the
City of Kenai. In reviewing the background it was noted
the planning commission tabled this plat at their January
8, 1973, meeting due to some buildings (trailers) being in
the city requested right-of-way extension of 24th Avenue,
to allow the city time for further review. The City of
Kenai Advisory Planning commission reconsidered the plat
at their January 24, 1973, meeting and recommended the right-
of-way for the extension of 24th Avenue be dedicated with
the stipulation that the buildings (trailers) can remain until
construction is imminent.
The planning staff has reviewed the plat and recommends pre-
liminary/final
reliminary/final approval subject to:
1. Lot 1 be labeled Lot 1A and the -old lot line
be dotted in to clarify the intent of the
replat.
2. After the words "Legal Description" under the
'
name, add the words "Replat of".
3. Label which monuments were recovered or set.
4. The assessment covenant required by, the City
of Kenai added.
5. The continuation of 24th Avenue as requested
by the City of Kenai.
Commissioner Holly, seconded by Commissioner English, moved
to remove the plat from the table. The motion carried. (Com-

AGENDA ITEM 4. ADL Timber Sale - SC -268
Commissioner Dimmick returned to the meeting.
Mr. Best presented the staff report noting this request is
located approximately four miles SE of Ninilchik, off Oilwell
Road. The letter from the Alaska Division of Lands was read.
The sale is proposed on two 40 -acre parcels which are under
selection application by the borough.
The planning staff has reviewed, the request and suggests the
planning commission recommend to the assembly that the timber
sale be granted and administered under the state regulations
and the borough's land management agreement with the state,
provided that before final release of the contract and any
roads are put to bed, the borough staff be allowed to inspect
and approve of the clean-up and decide which roads remain
and which are to be put to bed.

The Chugach National Forest is in the process of revising its long .
range land use plans for the Kenai Peninsula area. Since this repre-
sents a total land area of 1.4 million acres of public land, we feel
you would be interested in knowing of, or contributing; to, the planning
process.
On the Chugach National Forest, we all have a unique opportunity to
make vital decisions before the full impact of future demands is felt.
Because of the i,spoitauce we place on this land use planning, we want
to do it wr'th full public awareness. We hope to avoid developing, a
program just as we see it, and saying, "Here it is." We want to say,
".'his is what we've done so far; let's talk about it."
Through listening sessions scheduled throughout the Forest, we intend
to explain our plans as they are developed and receive your comments
and suggestions. These sessions will be informal. ide will not be
asking you to make our decisions for us, but to guide us while we're
making them.
We previously have held listening sessions on the other portions of
the Chugach National Forest. As you probably know, the Forest Service
has designated a 600,000 acre area in western Prince William Sound as
the Nellie Juan Wilderness Study Area. For this reason, we will not
include this portion in our planning program at this time.
We have scheduled the following public listening sessions and hope to
see you at the one most convenient to you.

In reference to our discussion at the Planning & Zoning meeting
of March 18, in regard to my request for a "Conditional Use
Permit", the following are plans pertaining to the property
described as the westerly and northerly portion (as per drawing
of NW 1/4, NE 1/4, and W 1/2, NE 1/4, NE 1/4, North of Beaver
Loop Road, Section 10, TSN, R11W, SM):
1. Expand the present gravel pit to approximately 27 acres,
as per drawing.
2. Leave a minimum of 100' of trees between the highway
right-of-way and area of excavation.
3. Remove existing buildings and debris and smooth present
pits for improved appearance.
4. Overburden will be stacked for future reclamation of the
property as soon as working space permits.
5. Avoid a deep unsightly hole in the ground and, with drain-
age, stay above the water table so ground may be reclaimed
for future development.
6. The pit will be operated in compliance with the Bureau of
Mines regulations.
As regards a development schedule, it is impossible at this time
to determine the yardage production which will be on the basis
of supply and demand.

the construction season after the pit is fully operative.

parked on church property across the street from Superior
Lumber Company is hereby denied.
The City Administration will grant a special use permit for
the trailer until 1 July 1973. At that time we would hope
that the trailer will have been moved to a location that
would comply with our ordinance.
We hope that this denial will not create an inconvenience
on the people now occupying the unit and that the church
understands that enforcement of our ordinances are the
responsibility of the City Administration. We will give
every consideration for the special use permit so that
a hardship is not created on either the residents of the
trailer or the church. We hope that the time that we have
granted in the use permit is adequate. If, is not, an
additional request would be approved because of a late

Dear Mr. Jaynes:
All of Section 26 in Township 6 North, Range 11 West, Seward Meridian was
patented to the State under the Mental Health Grant, As such, they are not
available for borough or city selection. A 1964 Attorney General's opinion
Number 7 states that Mental Health, School and University lands are
appropriated and reserved lands and hence not subject to selection.
Our records reveal that the City of Kenai received approximately 3,067
acres of State lands which was patented on March 16, 1964 via State
patent number 114 and 115. It is our opinion that these lands would be
Included in any future city selections of vacant unappropriated State land
lying within the corporate boundaries.

using an example from the "Environmental Atlas of Greater
Anchorage Area Borough", just completed, Mrs. Se ' lkregg showed
the commission the various possibilities of how a parcel of
land could be subdivided providing the best use of the land
and being more economical in the installation of water and
sewer lines. The Planning Unit Development (PUD) concept
allows for flexibility.
Mr. Rick Wright advised the I commission that the University
of Alaska can arrange to bring experts in to help with the
context of specific areas.
Commissioner Dimmick stated the Kenai Peninsula Borough is
almost entirely rural, which many planners don't seem to take
into account.
Mrs. Ruby Coyle stated planning is a necessity in everyone's
life and is definitely needed. When comprehensive plans are
changed, such questions as; how much change, what direction
and what goals are trying to be reached, need to be answered.
0 Mrs. Coyle believed if proper planning had been within the
state when the industries went in at North Kenai, there wouldn't
be a water shortage in that areaasthere now is.
Mr. Best stated that at some time, all the members of the
planning commissions feel they are dealing with the mechanics
and not really doing any planning.
Commissioner Hursh sta*--Id planning regulations can be made;
but how can flexibility within these regulations be provided
for such a vast area as the Kenai Peninsula Borough.
Mrs. Selkregg stated the Planning Unit Development concept al-
lows for flexibility. When planning, the federal, state,
borough, private and native lands all have.-to.be considered
and looked at.
Some of the concerns mentioned by the planning commission to
be discussed at future workshops were planning, platting
and zoning and meeting with the Greater Anchorage Area Borough
and Mat -Su Borough Planning Commissions to.discuss similar
problems encountered.
Chairman Peck suggested the planning commissioners write down
what they would like to have discussed and present it to the
staff with the idea seminars or workshops would be set up
quarterly.
Mr. Best added these seminars will be not only for the borough
planning commission; but also the city planning commissions
and anyone who might be interested in planning.
Chairman Peck thanked Mrs. Selkregg and Mr. Wright for attending
the meeting and the information they provided.
AGENDA ITEM 5. Public Hearings:
A. Lot 1A, Deshka Subdivision (Rezoning)
The staff report was presented by Mr. Best noting this request
is located south of the Kenai Spur Road, east of Glacier State
Telephone offices in the City of Kenai. The letter from the
City of Kenai, which is on.file, was read and it was noted
that they also want to include Lot 1B. Mr. Best read the
notice of public hearing, which was published in the Cheechako
News in three consecutive issues. It was noted that all *receipts
from the certified mail notices have been returned. One notice
was returned unclaimed.

The City of Kenai Advisory Planning & Zoning Commission held
their public hearing on April 25, 1973 and recommended the
rezoning be granted for both Lots lA and 1B.
The planning staff has reviewed the request and suggests the
planning commission recommend to the assembly that the re-
zoning be granted for Lot 1A and to include Lot 1B.
Chairman Peck opened the hearing to the public. Mrs. Garner
and Mrs. Brewster were present for the hearing and asked
the commission to act favorably on the rezoning. There being
no one else to present testimony, the public hearing was
closed.
Chairman Peck asked if enough certified mail notices had been
sent out to include the rezoning of Lot 113. Mr. Best replied
when notices are mailed to those owning property adjacent
to or within 300 feet of the petition area, the staff makes
sure the full 300 feet, plus, are notified.
Commissioner Hursh asked if these lots are served or can be
served by water and sewer. Mr. Best stated the lines go
right by the lots.
Commissioner Mai asked the present zoning of the lots. Mr.
Best replied they are presently zoned Urban Residential and
are on the edge of the General Commercial District.
Commissioners Dimmick/Hursh moved and seconded to recommend
to the assembly that Lot lA and Lot 1B be rezoned to General
Commercial. There being no objection, it was so ordered.
(Commissioner English was not present to vote on this item.)
B. Lots 2, 4-10, Blk. 4; Lots 1-23, Blk.. 5; Lots 4 & 5,

4. The Planning, Commission shall set a date for and hold a oublic hear-
ing upon each properly submitted application. Such hearing shall be
held not later than thirty days following the date of filing of such
application and all parties interested and all property owners with-
in 300 feet of the property involved shall be notified at least ten
days before the date of such hearing.
S. From the time of filing such application until the time of such
hearing, the application, together with all plans and data sub-
mitted, shall be available for public inspection in the office of
the administrative official.
6. The Planning Commission shall study the request and within thirty
days after the filing of the application, shall grant or reject the
request for a conditional use permit. The Planning Commission's
decision shalI'be base' on the compliance of the request with the
conditions listed in the ordinance for the specific use requested.
The decision of the Planning COmmission and the reasons therefore
shall be entered in the records of the Commission.

The staff report was•presented by Mr. Best noting this sub-
division is located at the junction of East Hill Road and
Mission Road in the Homer area. The preliminary plat was
conditionally approved -October 30, 1972. Vacation of section
line was approved November 27, 1972. The final was submitted
for approval April 23, 1973 and was tabled and returned to
the subdivider for modification; i.e. that the staff work out
the problem with the subdivider concerning underground utilities.
The subdivider has reached an agreement with HEA as contained
in the letter from Homer Electric Association. This letter,
a copy of which is on file, was read.
The planning staff has reviewed the letter of agreement and
recommends the plat be removed from the table and be given
final approval.
Commissioners Dimmick/Suszka moved and seconded to remove the
plat from the table. The motion carried unanimously.
Commissioners Amundson/Suszka moved and seconded to approve
the final plat. The motion carried unanimously.
E. V.I.P. Park Estates Sub. (Preliminary)
Mr. Best presented the staff report noting this subdivision
is located within the City of Kenai between Kenai River and
Kalifonsky Beach Road, south of the canneries. The letter
from the surveyor for the subdivider, which is on file, was
read.
The planning staff has reviewed the plat and recommends granting
of the 3:1 depth to width exception and preliminary approval
subject to:
1. The section line right-of-way vacation be
resolved by due process (the staff needs
advertising fees and a letter of petition
signed by the owner) .

F. Snug Harbor Homesites Lots 14A & 14B (Preliminary/

The staff report was presented by Mr. Best noting this subdi-
vision is located between the Sterling Highway and Kenai River
just west of the Kenai River Bridge at Cooper Landing. The
letter from_thesurveyor for the subdivider, which is on file,
was read.
The staff has reviewed the plat and recommends approval sub-
ject to:
1. The original and present mean high water meanders
as well as approximate flood. stage high water line

AGENDA ITEM 4. Public Hearings:
A. Coyle (Conditional Use Permit)
Mr. Best presented the staff report noting this request is
for a conditional use permit for development and extraction
of natural resources (borrow pit for gravel). The proposed
site is just easterly of the junction of the new Kenai River
Bridge approach and Beaver Loop Road in the SW1/4NW1/4 of
Sec. 10, TSN, R11W, S.M., within the City of Kenai. The
letter from the owners, which is on file, was read. It was
noted that all receipts from the certified mailing list of
the public notices have been returned. The City of Kenai
held its public hearing on June 1, 1973, and recommended the
use permit be granted.
The staff has reviewed the request as shown by the documents
and recommends approval subject to:
1. The buffer strips, as provided, be retained.
2. Upon completion of the contract, the slopes
on the perimeter of the excavation do not
exceed 2:1.
Chairman Peck opened the hearing to the public.
Mrs. Ruby Coyle was in attendance and asked if a use permit
would be required if a batch plant was to be placed at the

location. Chairman Peck stated if the zoning was Rural Resi-
dential a use permit would be required. There being no other
testimony, the public hearing was closed.

the request for the conditional use permit subject to the
staff's recommendations. There being no objection, it was
so ordered.
B. Lake Salamatof Crescent Subdivision (Vacation of
Right-of-way)
The staff report was presented by Mr. Best noting this petition
for vacation is located within Lot 1, Lake Salamatof Crescent
Subdivision and is a portion of Cottonwood Drive. The pro-
posed vacation is for a portion of the cul-de-sac turnaround
of Cottonwood Drive. The letter from the owner by the surveyor,
which is on file, was read.
The staff has reviewed the request and recommends approval
subject to recordation of a final plat.
Chairman Peck opened the hearing to the public. There being
no one in attendance to present testimony, the hearing was
closed.

AGENDA ITEM 5. Consideration of Submitted Plats:
A. J. Moss Subdivision (Preliminary/Final)
The staff report was presented by Mr..Best noting this sub-
division is located on a narrow neck of land between Peterson's
Bay and China Poot Bay, across Kachemak Bay from the Homer
Spit.
The staff has reviewed the plat and recommends approval sub-
ject to the existing HEA power lines being shown on the plat
as defined by the easement statement and requested by HEA.
Commissioners Dimmick/Amundson moved and seconded to approve
the plat subject to the staff's recommendations. There being
no objection, it was so ordered.
B. Birch Side Acres Subdivision Unit 3 (Final)
Mr. Best presented the staff report noting this subdivision
is located approximately 3 miles northeast of the east city
limits of Homer on Fritz Creek Drive. The background was
reviewed noting the preliminary approval of Birch Side
Acres Subdivision was June 7, 1971. The road grades and cuts
were held to requirements by widening the road right -o£ -way.
The final of Unit 1 was approved July 2, 1971. A resubmittal
of the preliminary was approved July 26, 1971 with the note
regarding road grades and slopes. Unit 2 final, based on
the revised preliminary plan, was%approved August 23, 1971.
The preliminary of Unit 3, also based on the revised pre-
liminary plan, was approved January 8, 1973. The letter from
the subdivider, which is on file, was read.
The staff has reviewed the plat and recommends at)proval.

Construction Company contractors to the State of Alaska on the Kenai River
Crossing Project were extracting material from the Michael Pelch homestead
in Kenai in violation of the Kenai Zoning Ordinances. As I pointed out to you
in our telephone conversation, the Burgess Construction Company have not
yet applied for or received a conditional use permit as required in Section
1412 of the City of Kenai's Zoning Ordinance, which requires a use permit
be obtained for the development and extraction of natural resourses In all
zones.

According to our information, R. Lee Seafoods has submitted a request
to have a parcel of land adjacent to the Kenai River rezoned from Rural
Residential to Heavy Industrial. This parcel of land is 6601 wide and
800' deep and would be identified as Borough Parcel No. 49-10-21. It
is also my understanding that this rezoning request will be considered
at public hearings on September 6, 1973 by the City of Kenai Planning
and Zoning Commission and on September 10, 1973 by the Borough Planning
Zoning Commission.
The City of Kenai, therefore, ,,reAuests that this parcel be rezoned from
Rural Residential to Heavy -16dustrial. The question has been asked
whether we wished additional lands in this same area, zoned Heavy
Industrial and it would be my suggestion that this would be a good
question for the two Planning Commission to consider at the time of
the public hearing.

Mr. Best react the Xenai Zoning Ordinance, section 14-12 A and
B, and advised the commission this should also be taken into
consideration as well as the public's testimony which has
a been heard.
- Commissioner Dimmick moved to grant the use permit subject to
the staff's recommendations and requested a roll call vote to
be taken. The motion died for lack of a seon-d.
Chairman English and Mr. Best stated the motion would.. have to
be seconded before discussion could take place.
Commissioner Dimmick, seconded by Commi�c i.or..c !.::. a.)\)ed to
grant the use permit subject to the staff's recommendations.
Commissioner Poppin asked what the basis was for dropping the
screening to 200 ft. and 150 ft.
Mr. Best replied these figures were used for granting the Coyle
use permit; but by the Coyles' volition, they left 300 ft. of
screening along Barabara Drive.
Commissioner Poppin believed there was no choice but to deny
the use permit in light of the public's response.
Commissioner Palm agreed with Commissioner Poppin and added
if the contractor misjudged the amount of .gravel, the people
should not be the ones to pay.
A roll call vote was taken. These voting negative: Commissioners
Dimmick, English, Hines, Palm, Poppin and Suszka. Those voting
affirmative: None. Commissioner Amundson abstained as he is
a btar.e of Aiasxa enipioyee and weighs the truck's. loaded w1r_li
the gravel. The motion failed.
Mr. Best advised that the petitioner could appeal the decision
to the Board of Adjustment, being the. Kenai City Council in this
case.
Mr. Keen inquired of the protection the residents may have if
a gravel pit was expanded under grandfather rights.
Mr. Best stated grandfather rights is a rather nebulous term.
The meaning would be stretched however if someone were to try
to put in an asphalt plant where only gravel had been extracted
prior.
Mr. Johnson asked what effect agenda item 7, Ordinance 73-46
Land Use within 300 ft. of Property Line, would have.
Mr. Best replied the ordinance is before the plannincq commission
tonight for a recommendation. The assembly willnot hold hearing
on this ordinance until October 9th. If passed, it will be
areawide.
Mr. Elson added that if Ordinance 73-46 is adopted, it will
supercede any conditional use permit.
B. R -Lee Fisheries, Inc. (Rezoning)
This petition to rezone was requested by R -Lee Seafoods, Inc.,
leasee, and the City of Kenai, owner of the .property and lessor,
from Rural Residential to Heavy Industrial. Public notice was

The City of Kenai Advisory Planning Commission held its public
hearing on the request, September

Mrs. Doris Schmidt, leasee of the property involved, stated

A. Pelch Conditional Use Permit (Gravel.Extraction)
This request is located along Beaver Loop Road, approximately
half way between the two junctions with the Spur Road, within
the City of Kenai.
The letter of request for the conditional use permit received
from Mr. Michael J. Pelch was read by Mr. Best. Public notice,
which was published in the Cheechako News August 30 and Sep-
tember 6, 1973, was read. All certified mail receipts (20
total) from the mailing of the notice have been returned but
four. We have received one protest by phone from Elva S.
Colyer on the issuance of a use permit and one letter in favor
of the use permit from Mr. Ed Hollier, which was read.

The.City of Kenai Advisory Planning Commission held its ad
vertised public hearing on September 6, 1973, and recommended
"that.the use permit be denied on the basis of the overwhelming
objection of the residents of the area and if the permit is
issued that the ordinance be fully followed and that a develop-
ment plan for the rehabilitation, including time schedule for
the pit, to be brought before the City and Borough Planning
Commissions and public hearings be held".
The planning staff has reviewed the request and the use of
the area in the past, noting that historically the surrounding
and nearby areas are an excellent source of gravel and have been
used as such prior and after zoning. It appears the use will
continue and that zoning a large area Heavy Industrial to pro-
vide for this continued development is not necessarily the
answer; however, use permits issued within the terms of the
ordinance and containing the same provisions as the Coyle use
permit could provide for extraction of the natural resource
now, with future Rural Residential use without the planning
commission becoming involved in any competition between owners.
The staff recommends the use permit requested within SW1/4 SE1/4
west of Beaver Loop Road and the N1/2 SE1/4 of Sec. 2, T5N, R11W,
S.M. be granted subject to:

A. Minimum screen and buffer strip of
200 feet along Beaver Loop Road and
150 feet from any other property line

B. Upon completion of the present contract,

Chairman English opened the hearing to the public.
Mr. Henry Johnson, a resident of the Beaver'Loop%Ames Road
area, protested the issuance of a use permit stating the popu-
lation appears to have doubled in the past several years in
this area. The people are trying to upgrade their'homes; but
a gravel pit would only lower the property's value. From Ames
Road to the Kenai Spur Road, less than four miles, there are
ten pits, of which only two have grandfather rights. The other
pits don't have 2:1 slopes, are unsightly, a danger to children,
could fill with water, and become breeding grounds for mos-
quitoes in the stagnant water. He felt it should be considered
that people buying homesites put out more in taxes and the
purchase of various commodities than a gravel pit. As a tax
base, the community would be losing although an immediate
benefit from the use of a pit would be recognized. The City
of Kenai has land in the area which is swamp, but there is
gravel underneath, and this land could be used for a gravel
pit. The residents of the area are not against the better-
ment of the community, but do feel the pit to.be detrimental.
Even if the pit were to be rehabilitated, from where would
the fill be obtained. The only pit on Beaver Loop Road that
is screened is the Coyle pit. Mr. Johnson believed the In-
dustrial zoned areas should be used before a Rural Residential
area. The dump trucks travel at an excessive speed, create
dust and throw rocks. This would be an unsightly gravel pit,
would never be rehabilitated and Beaver Loop Road would never
get paved due to the number of pits located on it.
Mr. Wyman Keen, a resident of Ames Road, agreed with Mr.
Johnson and felt the safety factor with children should be
considered.

Mr. Nick Miller agreed with Mr. Johnson and Mr. Keen, also.
Mr. Jay Worley, living at the corner of Ames Road and Beaver
Loop Road, agreed with Mr. Johnson and added he is not pleased
with the speed of the trucks nor the dust created by them.
Mrs. Janice Hutchings believed some of the existing pits should
be used•without creating an unsightly mess.
Mr. Glen Bilderback voiced his protest of the issuance of the
use permit.
Mr. Jim Elson, a member of the Kenai Advisory Planning Commission,
advised the City has pushed for the bridge for years and also
knew of the shortage of gravel. Due to the growth of the Beaver
Loop Road area and the protests of the residents in the area, the
City Advisory Planning Commission was opposed to the granting
of the use permit. But, if the permit was issued, there should
be rehabilitation so it will still conform to the area's Rural
Residential zoning. The advisory planning commission does not
feel the use is as valid as the protests of the people. Mr.
Elson noted the application for the permit was applied for
after material was already being taken out. The City of Kenai
had zoning before the borough was in existence. The borough
has adopted the City of Kenai's zoning ordinance and by state
law, the borough is the enforcer of this ordinance.
Mrs. Ruby Coyle advised the commission she has a contract with
.the contractor for extraction of 250,000 cu. yds. of material
for which she.requested and was granted a conditional use permit.
When the contractor began extracting from the Pelch property,
Mrs. Coyle complained to the borough administration. The emer-
gency ordinance which the assembly pass,:d was num lu, al as iL
was not passed with a three-fourths majority. The contractor
is extracting from the Pelch property illegally. There is
a fine applicable and Mrs. Coyle stated she would like to
see 'the fine enforced for each day the contractor is hauling
from the Pelch pit.
Mr. Elson stated the Kenai Advisory Planning Commission based
its decision on the peoples' objections and not on the basis
of who owns the property.
Mr. Johnson read the letter, which the Planning Director sent
to Burgess Construction, the Alaska Department of Highways,
Mr. Ed Hollier and Mr. Michael Pelch, and was also posted at
the site, August 17, 1973, ordering the contractor to cease
and desist the extraction of gravel.
Mr. Best advised the commission and members of the audience
the matter had been turned over to the borough attorney as
a normal sequence of events.
Commissioner Poppin inquired if the Coyle pit was out of
material.
Mrs. Coyle replied 159,000 cu. yds. has been extracted and
there is still ample gravel available.
There being no further testimony from the public, the hearing
was closed by Chairman English.

Mr. Best read the Kenai Zoning Ordinance, section 14-12 A and
B, and advised the commission this should also be taken into

consideration as well as the public's testimony which has
been heard.
Commissioner Dimmick moved to grant the use permit subject to
the staff's recommendations -and requested a roll call vote to
be taken. The motion died for lack of a second.
Chairman English and Mr. Best stated the motion would have to
be seconded before discussion could take place.
Commissioner Dimmick, seconded by Commissioner Palm, moved to
grant the use permit subject to the staff's recommendations.
Commissioner Poppin asked what the basis was for dropping the
screening to 200 ft. and 150 ft.
Mr. Best replied these figures were used for granting the Coyle
use permit; but by the Coyles' volition, they left 300 ft. of
screening along Barabara Drive.
Commissioner Poppin believed there was no choice but to deny
the use permit in light of the public's response.
Commissioner Palm agreed with Commissioner Poppin and added
if the contractor misjudged the amount of gravel, the people
should not be the ones co pay.
A roll call vote was taken. Those voting negative: Commissioners
Dimmick, English, Hines, Palm, Poppin and Suszka. Those voting
affirmative: None. Commissioner Amundson abstained as he is
a State of Alaska employee and weighs uiie trucks loaueu with
the gravel. The motion failed.
Mr. Best advised that the petitioner could appeal the decision
to the Board of Adjustment, being the Kenai City Council in this
case.
Mr. Keen inquired of the protection the residents may have if
a gravel pit was expanded under grandfather rights.
Mr. Best stated grandfather rights is a rather nebulous term.

-to put in an asphalt plant where only gravel had been extracted
prior.
Mr. Johnson asked what effect agenda item 7, Ordinance 73-46
Land Use within 300 ft. of Property Line, would have.
Mr. Best replied the ordinance is before the planning commission
tonight for a recommendation. The assembly will not hold hearing
on this ordinance until October 9th. If passed, it will be
areawide.
Mr. Elson added that if Ordinance 73-46 is adopted, it will
supersede any conditional use permit.

On September 25, 1973, at the request of Mrs. Carolynn Nickel,
a fire/safety inspection was made on a dwelling (duplex)
located on Kenai Spur (Block 8, Beaver Loop subdivision) for
the purpose of operating a Montessori School.
The one major deficiency noted was that there was not a one-
hour separation of this school and the apartment. We feel this
would not interfere with the safety of the children, since this
would be strictly a daytime operation, and there are two exits
provided. The boiler room is in a room on the exterior of the
building. This is within the code.
A Class "A" 2h gallon, pressurized water -fire extinguisher or
equivalent shall be provided and installed, so the top of the
unit is not more than 5' feet from the floor. Since the occu-
pant load of this facility would be under fifty persons, a
fire alarm is not required.
The square footage of this facility to be occupied is approxi-
mately 500 square feet, giving it an occupant load of ten persons.
Due to the fact that this facility will be confined to the ground
level and the requirements are met, this department has no objec-
tion to the school being operated in this structure.

A. Description of Business - This is to be a 12 lane bowling complex with
bar and lounge, snack counter, billard parlor, steam, sauna, and exercise
rooms (one for men and one for women). The building will house 12 lanes
now, with room for expansion to 20 lanes at a future date.
B. Description of New Facility - This facility is to provide recreation
for families of the area. It will be of cement block construction with
glu-lam roof trusses and hot tar mop roof. It will be 110 feet by
140 feet by 26 courses and will take approximately five months for
construction. The primary contractor is to be the Steinbeck Construction
Company.
C. The project will be built on city owned land with a 30 -year lease with
renewal option. The lease cost will be 2.5 cents per square foot per
year. Drawing of lot and subdivision attached.
D. Market - The primary use of this facility wil be by local patrons, with
some organized tournaments drawing people from other areas and even
statewide.
E. Labor Force - The establishment will employ approximately eight employees
in the different facets of business.
F. Site - The building will be located in the business district of Kenai.
It is on Willow Street and all city utilities are readily available.
The size of the lot will provide adequate parking sp.1ce for the facility.
G. Land Fill and Clearing - The property is sparsely populated with spruce
trees of small diameter. The plot is relatively level, requiring
approximately 2 feet of top soil removed to get to sand for footings.
The area for the building and parking lot will be backfilled with gravel.

B. Irons Subdivision Lot 9 Block 9 (Final)
This subdivision is located west: of the Kenai Spur Road, ap-
proximately one-half mile north of the Soldotna City Limits
in Ridgeway. Portions of Irons Homestead subdivision plats
predate the formation of boroughs. The preliminary of the
balance of the homestead was considered and approved Septem-
ber 8, 1967. This plat is of a lot which is a continuation
of Block 9.
The planning staff has reviewed the plat and recommends final
approval subject to:
1. A 25 foot utility easement along the
north boundary as requested by Anchorage
Natural Gas.
2. The Kenai Peninsula Borough Planning Commission
policy concerning the Alaska Department of
Environmental Conservation Wastewater Disposal
regulations.
Commissioners Elson/Hines moved to approve the final plat sub-
ject to the staff's recommendations. The motion carried unan-

C. Point Lookout Subdivision Tract A (Preliminary/Final)
This subdivision is located in North Kenai, north of the North
Road and North Kenai School. The letter from the subdivider,
which is on file, was read.
The parcel is the solution to a difficult topo problem and
the staff recommends preliminary/final approval subject to:
1. Utility easements as requested by HEA.
2. The Kenai Peninsula Borough Planning Commission
Policy concerning the Alaska Department of Environ-
mental Conservation Wastewater Disposal regulations.
Commissioners Hines/Palm moved to approve the plat subject
to the staff's recommendations. The motion carried unanimously.
D. First Baptist Church ASLS No. 73-95 (Preliminary/Final)
This is a property survey from the State of Alaska located,.
just west of Larry's Club in the City of Kenai. The purpose
of the plat is to provide for the conveyance of land by the
State to the First Baptist. Church.

Beach Road in North Kenai. It is a resubdivision of the two
lots to provide for the conveyance of an existing building.
The planning staff has reviewed the plat and recommends an
exception be granted of the 3:1 lot depth to width ratio due
to the commercial nature of the area and the location of the
existing structures and preliminary/final approval granted
subject to:
1. The basis of bearing be labeled.

AGENDA ITEM 6. Alaska Municipal League Proposed 1974 Policy
Statement
Prior to the meeting, the commissioners had each received a
copy of the proposed policy statement. Mr. Best went briefly
through the policies dealing with planning.
The Alaska Municipal League meeting is in Fairbanks this year,
November 5th -9th.

AGENDA ITEM 8. Director's Report
Mr. Best advised the commissioh a representative from the
' firm of Tryck, Nyman & Hayes will be at the November 19th
meeting to discuss and receive public input on the total plan
of the borough's water quality management study.
�. APPLICATION. Since the intent of the Regulations deals with domestic
wastewater treatment and disposal from residential or recreational sub-
divisions and the prevention of pollution entering both waters of the State
and water supply wells, the submission of engineering reports, plans, and
specifications is waived for subdivisions:
(1) with lot sizes of two and onehaif acres or larger.
(2) of five lots or less.
(3) not intended for residential or recreational uses.

Regulations, the following two documents have been informally used as
guidelines for several years.

The location of test situs should, in so far as possible, approxi-
mate the estimated installation areas of septic tank systems. Generally,
test the downhill sections of lots and avo{d�thosa areas in which septic
tanks cannot be installed, such as the zone 100 feet from bodies of
^ .
Water and in areas of high water table and shallow soil over bedrock or ^'
other impermeable strata. One major purpose of testing is to locate and
define these areas that are unsuitable for sewage disposal and, there-
fore , the. unsuitable areas should be markd8 and noted as such on the
subdivision plans. Locations of test sites shall be noted on the plans
and since retesting may be necessary, holes should be covered but not
be filled in after testing, except in those situations where large holes
may present safety hozards.
The type of tests and testing methods can be flexible and need not
duplicate approplatw existing data from previous tests such as well
drillers and geologists logs and so forth. For purposes of evaluating
soil absorption system applications, depth of testing need not exceed the
local depth of annual frost penetration plus eight feet. The specific

Other criteria for rejection, although not quite so hard-and-fast, is
use of soil absorption systems in coarse nock or over shallow strata of
fractured or fragmented bedrock, In such soils, filtering action is extremely

limited and sewage may travel underground very long distances in a vary short
time with no attenuation of bacteria] organisms or chemical qualities. Many
recent disease ep/dcmacis have been traced to such situations and distances
involved have approached several miles. Special caution is required with
water supply wells located "downhill", although the direction of underground
travel is unpredictable in such cases.
SIZING SOIL ABSORPTION SYSTEMS. Although the standard percolation test
'
(per PHS Manual 526) or various modifications is yet being accepted, its ap-
plication is widely falling into dYsfavpr. Lack of reproducibility , lack of
'
standardization, time required to perform it by the book, and high rates of
failures associated with systems sized thereby have resulted in the move
toward other techn|�u�� to sY�� soil a��c�����o� �y�Loms. �ur1he-r` where cold
stress -requires deep burial of soil absorption systems, it's difficult to
perform percolation tests at the depth at v�)|ch the soil absorption systems
will be buried.
Except in areas served by municipal water systems with service lYxo '
freezing problems, sewage production rates can be assuniz�d to be the standard
textbook value of 100 -gallons per capita day. However, in areas where taps
are left open overnight to prevent freezing of water service lines, sewage
production can be anywhere from 200 to 1000 or more gallons per capita day.

In such cases, soil absorption systems should be sized on a square foot per
gallon per day basis and septic tanks sized to hold 24 hour flow.
}
LOT DIAGRAM. T 'j'fot diagram serves to estobli' , the minimum lot size
based upon soil conditions which determine the size of soil absorption systems.
In addition, the lot diagram serves as a guide for the eventual orientation
of -on -lot water supply and sewage disopsal by the lot owners. Since the free-
dom of sewage disposal placement on one lot is often restricted by Well plaoa-
ment,o the adjacent lots, the lot diagram serves to organize placement of
'
water and sewage disposal facilities so that a maximum number of lots in a
subdivision can be developed. Without such direction, and unless lot sizes
are ' larger than the bare -bones mlnlmum,,haphazard development will result in
some lots being unst:pble. This becomes even more true with the reality that
adequate water production may not be yielded at the optimum location "suggested"
on the plat.
Experience has demonstrated that life expectancy of soil absorption
systems in Alaska can be oxtimatod a 7 years, with 50% of the 152 septic tank
systems studied surviving between 3 and 8 years'. Some 10% failed in the first

to be needed or not, effectively prolongs -the life of soil absorption systems.

years of sludge storago. Cold stress may reduce this figure since anaerobic
digestion essentially ceases below 50 degrees F.
