S. PUBLIC HEARINGS
a. PZ13 -20 -- An application to modify the development plan for PZ11 -36 a Conditional Use
Permit for Dena'ina Medical Clinic, located at 508 Upland Street (Tract A, Block 5, Townsite
of Kenai Kenaitze Addition Subdivision). The modification would remove sidewalks from
Overland Avenue and Mission Avenue from the development plan. Application submitted by
Peter Klauder, Klauder & Company Architects, Inc. for Kenaitze Indian Tribe, P.O. Box 988,
Kenai, Alaska.
Acting Planner Carver reviewed the staff report included in the packet.
MOTION:
Commissioner Knackstedt MOVED to approve Resolution No. PZ13 -20 and Commissioner
Peterson SECONDED the motion.
Twat read the rules of public hearings and opened the meeting to public comment.
Tonya Holiday, Owner of Dental Clinic on Overland — spoke against the resolution, siting
safety issues.
Peter Klauder, Architect & Applicant — spoke in favor of resolution, suggested giving the
money to the City for a sidewalk study.
Rick Koch, City Manager — spoke against the resolution.
There being no one else wishing to speak, the public hearing was closed.
Commissioner Bryson revealed a possible conflict of interest, noting he was partial owner of the
engineering firm on the project. Twait ruled there was no conflict.

the project.
City Attorney suggested bringing the resolution back at the next meeting.

Commissioner Knackstedt requested Administration place the resolution on the next meeting's
agenda.

ANALYSIS
This plat combines three (3) lots into one large parcel, and vacates a ten -foot (10') utility

eliminate any possible code violations.

General Information:
Applicant is applying for a Conditional Use Permit to install nine (9) portable cabins for
the purpose of housing seasonal personnel involved in the property tenant activity of
commercial fish processing. Cabin rentals must meet the requirements of KMC
14.20.150.
hi 2005, the Commission approved Conditional Use Permit PZ05 -34 to develop a
recreational vehicle park on the 16.5 -acre parcel zoned Heavy Industrial. This site is
located off Bridge Access Road on Childs Avenue. This is the location of the original
Dragnet Fisheries cannery. The plan is to operate seasonally from May through
September of each year. Utilities are currently available in the adjacent main processing
facility and will partially serve cabin occupants. Domestic water and electrical utilities
will be extended from the main plant to serve the cabin site. A dedicated shower /toilet
building will be erected near the cabins following standard City setback requirements.
Wastewater from the shower building will be routed to the existing septic system.
The site will maintain the original cannery building with parking for that building and the
boat storage yard, and the RV park shown on the drawing. The site is fully fenced.
Landscaping will be minimal and will be identified through a landscape /site plan when
PZ13 -14 Comments
Port of Kenai, LLC Paget
KMC 14.20.150 details the intent and application process for conditional uses. The code
also specifies the review criteria that must be satisfied prior to issuing the permit. The
Commission must determine that the application meets the following:
i The use is consistent with the purpose of this chapter and the purposes and intent
of the zoning district. The intent of the Heavy Industrial zone is, "The IH Zone is
established to allow for a broad range of industrial and commercial uses. It is
intended to apply to industrial areas which are sufficiently isolated from
residential and commercial areas to avoid any nuisance effect." The cabins will
house seasonal employees that are working at the processing plant. The area is
isolated from residential areas and appears consistent with the intent of the zone.
r The value of the adjoining property and neighborhood will not be significantly
impaired. The value of the adjoining property should not be impaired. The
cabins will blend in with the existing fish processing plant and RV Park.
➢ The proposed use is in harmony with the Comprehensive Plan. The proposed
use should be an asset to the commercial /recreational fishing in the area. The
Plan notes that, "The decline of the commercial fishing industry has suspended,
perhaps ended, the useful economic life of the local fish process plants." The
addition of the cabins should extend the economic viability of this parcel. The use
appears in harmony with the Plan.
➢ Public services and facilities are adequate to serve the proposed use. The
installation of on -site water, sewer, and electricity will meet the needs of the
proposed use.
> The proposed use will not be harmful to the public safety, health or welfare. The
proposed use will not be harmful to public safety, health or welfare.
Any and all specific conditions deemed necessary by the commission to fulfill the
above - mentioned conditions should be met by the applicant. These may include,
but are not limited to measures relative to access, screening, site development,
building design, operation of the use and other similar aspects related to the
proposed use. Dedicated wash facility must be installed and operational prior to
cabins receiving a Certificate of Occupancy.
Building Official:
Alaska Department of Environmental Conservation (DEC) approval of added demand on
existing on -site water and sewer systems is required. Plans, permits and approval off all
new construction is required.
RECOMMENDATIONS
The proposed application to install nine (9) cabins appears to meet the requirements of
the Kenai Municipal Code and the Comprehensive Plan. Due to the location, it appears
that impact will be minimal to surrounding properties. Recommend approval with the
following requirements:
a. DEC approval for additional demand on existing onsite water and sewer

b. Building permit must be obtained for dedicated mash facility and cabins.
c. Dedicated wash facility must be installed and operational prior to cabins receiving a
Certificate of Occupancy.

General Information:
The City of Kenai has received an application for a Conditional Use Permit from Alaskan
Crude Corporation, for subsurface extraction of natural resources on property owned by
Clifton W. & James A. White. The existing site is accessed from a private driveway off
Beaver Loop Road. The property is zoned Rural Residential. This type of development
is allowed by conditional use. The Conditional Use Permit covers continued work,
completion and production of natural gas from an existing well that was re- entered in
PZ13 -23 (88 -14)

History
The existing gas well was originally installed at this site in 1980, by Union Oil Company
of California. The well is located on 5 acres within a 26 acre parcel. There is a private
thirty -foot (30') wide gravel road from Beaver Loop Road to the gravel pad. The well
site has sufficient distance and natural buffering between the site and the nearest existing
homes to minimize any adverse effects on existing development. On February 27, 1980,
the Planning and Zoning Commission approved Union Oil Company's application for a
Conditional Use Permit for what was then known as Cannery Loop Unit Well #2 (PZ80-
3). On May 22, 1980, the City of Kenai issued a drilling permit for this location.
In May and June, 1986, drilling permits were inadvertently issued to Far North Oil and
Gas to reopen the well known as Cannery Loop Unit Well #2. The original Conditional
Use Permit (PZ80 -3) had expired. On August 29, 1988, an application for a Conditional
Use Permit was submitted by James White, Far North Oil and Gas, Inc. On September
28, 1988, the Planning and Zoning Commission approved Far North Oil and Gas's
application for Oil & Gas Extraction from Cannery Loop Unit Well #2 (PZ88 -14).
r KMC 14.20.150 details the intent and application process for conditional uses.
The code also specifies the review criteria that must be satisfied prior to issuing
the permit. The criteria are:
1. The use is consistent with the purpose of this chapter and the purposes and
intent of the zoning district.
The property is zoned Rural Residential. Rural Residential district includes
areas that, due to location or site conditions, are best suited for large -lot
single-family residential development. Homes in this district typically rely on
individual on -site water supply and wastewater disposal systems. Compatible
institutional uses such as churches, schools, and daycare facilities may be
intermixed if they comply with zoning design guidelines. Small home -based
businesses may be accommodated within certain design guidelines.
Subsurface extraction of natural resources is provided for as a conditional
use in this zone.
This area is zoned Rural Residential. The zoning appears consistent with the
property. There has been a Conditional Use Permit for Oil & Gas Extraction
on this property since the early 80's.
2. The value of the adjoining property and neighborhood will not be significantly
impaired.
The well is located on 5 acres within a 26 acre parcel. There is a private

development, There is no evidence that this development has impaired the
value of adjoining property.
3. The proposed use is in harmony with the Comprehensive Plan.
This property is classified as Rural Residential. The Rural Residential district
includes areas that, due to location or site conditions, are best suited for
large -lot single-family residential development. Homes in this district
typically rely on individual on -site water supply and wastewater disposal
systems. Compatible institutional uses such as churches, schools, and
daycare facilities may be intermixed if they comply with zoning design
guidelines. Small home -based businesses may be accommodated within
design guidelines.
This property is privately owned by the applicants. The Whites have
subsurface oil and gas rights on this property and some adjoining parcels. A
well has been located on this site since the early 80's with no complaints on
file. If the drilling operation is successful it will filfzll the public need for
natural gas.
4. Public services and facilities are adequate to serve the proposed use.
There is a private thirty-foot (30 ) wide gravel road from Beaver Loop Road
to the gravel pad. Well site development will not require use of City water or
sewer. Existing development activities do not require electrical service,
although final well production equipment may require single phase electric
service of up to 400 amps. Public services and facilities are adequate to serve
the proposed development.
5. The proposed use will not be harmful to the public safety, health or welfare.
State and Federal agencies regulate this type of development. Through the
permitting process, mitigation requirements and restrictions on the
development will be required to obtain permits from the various agencies.
The well will be conducted in accordance with industry specific safety
standards. The well is surrounded by a fence and locked gate. The proposed
use will not be harmful to the public safety, health or welfare.
6. Any and all specific conditions deemed necessary by the commission to fulfill
the above- mentioned conditions should be met by the applicant. These may
include, but are not limited to measures relative to access, screening, site
development, building design, operation of the use and other similar aspects
related to the proposed use.

The City will issue a drilling permit as required in Kenai Municipal Code
Chapter 5. Through the drilling permit processes, the City will ensure that
the required State and Federal permits are in order. The application for a
permit has not been received by the City. No additional conditions are
recommended.

RECOMMENDATIONS
Alaskan Crude Corporation has owned this property for several years. The well is located
on 5 acres within a 26 acre parcel. The closest residence is located southeast
approximately 990 feet from the well. There has been a Natural Gas well at this location
since the early 80's with no complaints on file. A drilling permit is required under Kenai
Municipal Code Title 5.
This type of development requires multiple permits from the City, Borough, State, and
Federal governments. The City does not have the expertise to regulate the oil and gas
industry and relies on the State and Federal regulatory agencies to review and address
pennitting for the development and operation standards. The applicant states well
workover and production operations will comply with all local, state and federal laws,
and will be conducted in accordance with industry standards.
The applicant states that a workover rig or drilling rig will be used intermittently, and
primarily during daylight hours for well workover or abandonment operations. Well
operations may include temporary tanks; coil tubing units; engine driven pumps; heaters
and electric generators. Workover operations may include temporary flaring of natural
gas for well testing or pressure relieve of production equipment. Production equipment
would include wellhead structure; separators; dehydrators; metering station; and produced
water storage tanks. Based on this, it is administration's recommendation that the
application for the Conditional Use Permit should be granted and recommends approval
with the following requirement:
1. All permits required from City, State, and Federal agencies must be approved
prior to operation of the well.

as leases.
West: Adjoining 40 acre parcel to the East is undeveloped and is owned by the Bureau of Indian Affairs.

SUBJECT: PZ13 -25 — Kee's Tern Subdivision Plat Improvement Exceptions
At the May 8, 2013, Commission meeting the Commission directed Administration to
bring a resolution to the May 22, 2013 Commission meeting requesting exceptions to
PZ13 -01 Kee's Tern Subdivision.
• January 9, 2013, the City of Kenai Planning & Zoning Commission recommended
approval of PZ13 -01 with staff's recommendations.
• February 11, 2013, Kenai Peninsula Borough Planning Commission approved
the plat with the City's recommendations.
The property owner is requesting the Planning Commission grant exceptions to three
(3) of the recommendations that were approved under PZ13 -01 (see attached PZ13 -01
Resolution):
1. "Grant an exception to KMC 14.10.080(e) (Public Water System) and (0
(Sanitary Sewer Service)." The Planning Commission cannot grant this
exception, but they can make a recommendation to the Kenai City Council
to waive the requirement.
2. "a. Streets and drainage plans must be designed and constructed to Municipality
of Anchorage Standard Specifications (2009 MASS)." The City of Kenai has
not formally adopted this section of code into our municipal code,
therefore it cannot require it.
V. Streets will require a minimum 24 -foot paved surface, with 2 -foot shoulders
and approved excavation and backfill." This requirement is not in our code.
Roads must be built in compliance with Kenai Municipal Code 14.10.080(c).
It is recommended the Commission make findings to the waiver of the utility exceptions.
The Commission can amend the requirement that the streets must be built to the
requirements of KMC 14.10.080(c). Unless the Commission makes additional
exceptions, the remaining requirements must still be met.

WHEREAS, further review requires the City of Kenai Planning and Zoning Commission to amend
the minimum road standards imposed; and,
WHEREAS, the City of Kenai Planning and Zoning Commission must recommend to the City
Council the waiver of water and sewer requirements for Council approval.
