CALL TO ORDER AND ROLL CALL: Chairman Glick called the meeting to order at approximately 7:05 p.m. Members Present: Carl Glick, Teresa Werner-Quade, Barb Nord, Phil Bryson, Members Absent: Karen Mahurin, Michael Christian, Ron Goecke Others Present: Administrative Assistant Marilyn Kebschull, City Engineer Jack La Shot, Councilman Duane Bannock, Contract Secretary Barbara Roper Quorum was established. 2. APPROVAL OF AGENDA: Chairman Glick stated that Mr. Zubeck brought in an application for transfer of a Conditional Use Permit and it didn't get put on the agenda as it came in too late to include it. Chairman Glick asked the members if there were any objections to bringing it up tonight. Copies of the application were given to members and staff present. With no objection noted, Resolution PZ-88-16 was added to the agenda under New Business. Commissioner Bryson then stated for the record that he didn't know what the subject is but he will be abstaining from voting as he is presently doing work for Mr. Zubeck in private subdivisions, probably separate from this. Chairman Glick stated that it was no use putting it on the agenda then as there would be no quorum vote. Mr. Zubeck stated from the audience that it has nothing to do with subdivisions, it is a transfer of a gravel permit. Commissioner Bryson stated that he'd leave it to the Commission, he further stated that he recently fmished the design of water, sewer and streets on Mr. Zubeck's project. Chairman Glick asked if the application for transfer had anything to do with the project Commissioner Bryson worked on. Commission Bryson stated he assumed not. Chairman Glick stated the application for transfer will go on the agenda and after Mr. Bryson read the application and felt he had to abstain then we won't vote on it. BRYSON MOVED TO APPROVE THE AGENDA. MOTION WAS SECONDED BY WERNER-QUADE WHO ALSO ASKED OF UNANIMOUS CONSENT. BRYSON SECONDED THE MOTION. THE MINUTES FOR JULY 9, 1997 WERE APPROVED BY UNANIMOUS CONSENT. 4. PERSONS PRESENT SCHEDULED TO BE HEARD: None 5. CONSIDERATION OF PLATS: a. PZ-97-36 -Preliminary Plat -Highlands Subdivision No. 2 - A resubdivision of Block 4 and Killdeer Court R.O.W. Vacation. MOTION: NORD RECOMMENDED APPROVAL OF PZ-97-36. SECONDED BY WERNER- QUADE. Commissioner Bryson stated that John Segesser, the surveyor on this plat is presently working by the hour for his engineering firm in Unalaska doing construction layout surveying. Unless the will of the board is otherwise Commissioner Bryson stated he will be voting on this as he feels personally there is no conflict. Chairman Glick ruled there is no conflict. PZ-97-37 - Prelimiaary Plat - Origiaal Townsite of Kenai -Rainbow Addition. MOTION: WERNER-QUADE MOVED TO APPROVE PZ-97-37. MOTION SECONDED BY NORD. Chairman Glick asked if staff had any comments on this. City Engineer La Shot stated that he would like to draw the Commission's attention to the as-built they have '~ Planning & Zoning Commission Minutes July 23, 1997 Page 3 put in the packet, it does show a 6.6' encroachment, the new plat may or may not cover that encroachment and he suggests that the Commission sees that the new plat eliminates the encroachment. La Shot further stated that the resolution does say that plats shall verify that no encroachments exist. Commissioner Bryson stated that he would like to revise his comments made last time, John Segesser is the surveyor of this plat and the prior one is Integrity's, therefore Bryson stated that he stands corrected. After review it was noted that Bryson was correct the first time, Integrity is the surveyor. Chairman Glick asked La Shot if an amendment is needed to the motion to include that no encroachment exists. La Shot stated that No. 7 on the resolution probably covers it as it states that the plat shall verify that no encroachments exist. No further discussion was made by the Commissioners. Mr. Cliff Baker with Integrity Surveys stated that it was their intention to clear up the encroachment. The plat that is shown is what has already been purchased and it also states in the deed that it refers to resolving any encroachments. He further stated that a complete as-built was done the same time the survey was done and any lot lines will be adjusted to fit. PZ-97-34 -Conditional Use Permit -Bed 8a Breakfast - 406 S Forest Drive (Lot 1, Block 6, Redoubt Terrace Subdivision, Kenai Alaska. Applicant DeWayne and Diane Craig. Chairman Glick stated that public hearing will take place this evening but the applicants are not available as they thought this was going to be at our next meeting. Since it was advertised we will have the public hearing and he requested a motion to continue public hearing at our next meeting so that the applicants can be here when action is taken or answer any questions. `~ Planning & Zoning Commission Minutes July 23, 1997 Page 4 MOTION: BRYSON MOVED TO HAVE THE PUBLIC HEARING TONIGHT BUT TO ALSO CONTINUE THE PUBLIC HEARING AT THE NEXT MEETING IN ORDER TO RECEIVE PUBLIC COMMENT. MOTION WAS SECONDED BY NORD. PUBLIC HEARING OPENED: JIM WHITE, 1509 TOYON WAY--Mr. White stated that his place is one house and two vacant lots away from DeWayne Craig's place. Mr. White stated that he would like to tell the Commission a story, a number of years ago he had a friend who had a place out on K-Beach. He had about 3 acres and hand built his home on it. Soon after a cannery came in next door to him and built a chain link fence right up to his place and they had their workers camping in his backyard. Mr. White stated that his friend could not sell the place, he couldn't stand to live there so lost the place. Mr. White stated that this situation made an impression on him about the value of zoning. He stated when he was looking for property he wanted to buy inside the city and thought a residential neighborhood around Toyon and Forest shouldn't have a problem, but you buy into that and you are agreeing to those rules, now folks want to change the rules. Mr. White noted that the street has a lot of traffic on it, there is a lot of people using the new beach access there, the City's upgraded the park there, there's a lot of kids running back and forth. Mr. White asked, "will there be more traffic with the bed and breakfast there instead of an apartment," he stated probably not but the trafhc that is there now at least knows there's little kids in the area. Mr. White said "my take on this is that if the Commission allows the bed and breakfast the conditional use permit for this guy then how can you stop the next guy coming in; if he wants to sell that place to a guide operation, how can you tell that guy no; how can you tell the guy who has the vacant lot next to me that he can't build something and run it as a bed and breakfast; the guy on the other side of me has got an apartment in his place, he can turn that into a bed and breakfast in 20 minutes." Mr. White stated that his concern is that precedent is being set here and will you (Planning & Zoning) be able to control the next guy coming in, we've got vacant lots all up and down that street. Mr. White noted that he didn't want to turn that into a bed and breakfast row, so he asked the Commission to vote it down. Chairman Glick asked if there were any questions for Mr. White. No questions were asked. No other speaker was present. Chairman Glick stated that the public hearing will not be closed at this time but a vote on the motion to continue public hearing to the next meeting. Councilman Bannock asked why the public hearing was being extended. Commissioner Bryson stated that Mr. Craig had requested the extension. Chairman Glick reiterated that Mr. Craig thought that this would be on the agenda for the next meeting which will be August 13 and he wanted to be here when we took action at least. Commissioner Werner-Quade requested that staff provide information on how the Commission voted in the minutes of last year when Mr. Craig applied. Chairman Glick also requested that staff research for our next meeting whether or not there are any other bed and breakfasts in Redoubt Subdivision. ~. NEw BvsnvESS• a. PZ-88-16 -Application for Transfer of the Conditional Use Permit for Surface Extraction of Natural Resources, City of Kenai Advisory Planning Ss Zoning Commission, Tracts Al-A and B of Hollier S/D No. 2. Chairman Glick called an At Ease to allow the Commissioners to look the item over before continuing. MOTION: BRYSON MOVED FOR APPROVING THE TRANSFER OF OWNERSHIP OF CONDITIONAL USE TO THE NEW OWNER. MOTION WAS SECONDED BY WERNER-QUADE. Commissioner Bryson stated that it appears that all conditions on the original application will transfer with the obligations attached thereto and he feels it's an appropriate action to take. Chairman Glick asked if staff had any comments. La Shot stated that had there been any amendments to the permit we wouldn't have been able to do this and we would have to re-advertise but since this is a simple transfer of ownership of an existing permit that has all the same stipulations it would be fine to proceed. Chairman Glick asked Mr. Zubeck if he understood that all of the conditions are still valid or enforced. Mr. Zubeck indicated that he did. CODE ENFORCEMENT ITEMS: None 10. REPORTS• a. City Council: Councilman Duane Bannock stated that a copy of the July 16 agenda was included in the Planning and Zoning packets and he wanted to briefly go through some of the public hearings. Item C-1, the ordinance that came from this Commission was postponed again for Mr. Smalley's input, this will be dealt with at the next Council meeting. Item 4 had some interesting conversation which had to do with where the City of Kenai does it's banking. The City very recently sent out an RFP for banking proposals and they scored the proposals on a zero through 100 point scale and it was sent to four different banking institutions, two of which scored a perfect 100 and when it came to the dollars there was exactly $1.00 difference per year between the two banks that scored 100. The City decided to stay with the National Bank of Alaska where the funds are at currently. On the second page under New Business, the request for special use permit for Mr. Bierdeman who has a logging operation and will continue logging some old trees from Section 36, and a lease application approval, item #4, Lot A-2, Baron Park Subdivision, No. 6, Hertzl Benyamini, this is an area pretty much between Marathon Road and Airport Way, east of Donagain's Restaurant and west of Homer Electric, the wooded area. The application read of a 120,000 sq. ft. retail complex. The comments from this Commission were noted at the meeting and the Council was also concerned that in the lease that was actually written which will be presented to Mr. Benyamini, there would be a clause where after a certain amount of time with zero development they would be done. What Council was trying to get out of was a situation where we would tie up a very large tract of land and then it not be developed. Certainly the recommendations made by this Board were passed on as well. Administration has been directed to draw that lease up and now well wait and see if they are willing to sign it, their good faith deposit had been paid. Councilman Bannock stated that after the meeting there was a brief work session which had to do with the developments of the proposed fire training center and the Pacific Rim Institute of Safety and Management (PRISM). Discussion was held on who was going ~) Planning & Zoning Commission Minutes July 23, 1997 Page 7 to own them and who was going to be responsible for what. As we begin our negotiations with the company ESI we ask who is going to be responsible for this and what the City is going to be doing with it. We had a sample list of things that the Council went through which included things we felt that we should be willing to take care of and things we felt they should be willing to care of, Administration will be presenting that to them. There were no questions for Councilman Bannock. b. Borough Planning: Commissioner Bryson pointed out that the July 14, 1997 agenda was in the packets. He noted that the agenda was approved which approved items through C. Item E, Unfmished Business is a Notice of Reconsideration of a prior decision to vacate a portion of aright-of--way was moved for reconsideration, that was approved and the item which is on Kenai Lake will come before the Borough P1atLning at their next regularly scheduled meeting. Item F, Public Hearings, an item that had been continued by the Planning Commission at a prior meeting concerned Mr. Zubeck and his request to eliminate an easement across his property. The recommendation of the staff was to deny the action and Commissioner Bryson noted he abstained due to conflict having worked on the project. Mr. Zubeck has subsequently appealed that decision and his appeal will go to the City of Kenai Council and they will presumably have the authority to reverse the decision of the Borough Planning Commission, Commissioner Bryson is positive of that. Item F-2, proposed negotiated sale of up to 40 acres of Borough land to Ed and Kathleen Martin in Cooper Landing area, that item was recommended to be denied, it was voted and that was the recommendation that came out of the Planning Commission, that will go to the Assembly for their action. Item 3 was postponed. Item 4 was recommended to be approved and was so voted. Item 5, Adopting Procedures for Variances from the Provisions of Title 21 was postponed. Item G-1 was approved which is a vacation of a utility easement. All the special considerations items with the exception of was approved for the Borough staff comments. That concluded Commissioner Bryson's report and there were no questions. c. Administration Report: None 11. PERSONS PRESENT NOT SCHEDULED: LEO OBERTS: Mr. Oberts stated that he wanted to mentioned a few things. The area around where he lives (Mr. Oberts pointed out the area on the wall map). He noted that the area was a large parcel of land that he and his wife had accumulated and much of it now is changing rapidly as he expects to see rapid growth into the area because the new Pillar's park is opening up on Friday at 7:00 a.m. and that will allow parking for 72 boats and trailers, a good sized area for the handicapped, and an area for people to stop and move around. It's going to be a real surprising thing to the City as he had several people come over as of late and the funny part of it is there aren't Planning & Zoning Commission Minutes July 23, 1997 Page 8 very many people who really know what's going on over there. Mr. Oberts suggested that the Commission take a long, hard look at it because he sees a lot of opportunity for himself and his family. He pointed out properties along the river which he feels is better than almost 2000 feet of river frontage and there isn't too many parcels of land available anymore and this would be the ability for somebody to come in and find a spot along the river. Mr. Oberts noted that he won't necessarily be involved in it but the opportunities are there as these people start to come in there. Mr. Oberts stated that he discussed with the people in the City because there were various items that came up that he was concerned with, most of which have been satisfied but there are still some that have problems. The one right now that seems to be showing up more often is the fact that when you come up out of Silver Salmon Drive that the trees are so large in there that when you start looking at the traffic which will be so great in there it will be difficult for them to see where they're going. Mr. Oberts mentioned it today to the Police Department and they are concerned as well. Mr. Oberts noted that he was not saying that this Commission will say this is something we have to do, it's just there are some items that should be taken care of. Mr. Oberts again reiterated that there is a lot of opportunity in the area because this is the first time that the City of Kenai is going to have probably one of the finest parks in the State of Alaska right in an area where all the fishing takes place and where everything is happening, and where Les Anderson caught his world record King Salmon right off where the landing is. There is so many things there Mr. Oberts feels are going to be so great for everybody that lives in Kenai and he is excited about it and is trying to get the Commission to be excited about it too, he noted that perhaps they can take a look at it on Friday. Mr. Oberts noted that as with everything, there are some things he doesn't agree with and some that are far better than what he thought. Mr. Oberts stated that the Commission has listened to him before about this sector and what would be happening in the future and it is where our immediate future is going to be happening. Chairman Glick asked Mr. Oberts if he intended to subdivide anymore of this land. Mr. Oberts stated that he would do a lot of it, he said there was some for sale right now and there's a lot more coming. Mr. Oberts stated that the reason he is saying that there is a lot of things going to happen because when his wife passed away, his son, in case something happened to him, would have to change the properties so that IRS won't end up with it. Mr. Oberts indicated that it looks great right now as far as looking at what the City receives in just the taxes he pays. If anything happened to him his son would really get socked if the property were to be turned over. IRS would say, hey you better pay up right now, he would have to look to the City to buy something. It should be noted that the current application differs from the original application which was for daily rental of apartments with breakfast service and/or dinner. The current application is for a bed and breakfast which appears to satisfy the code requirements as long as this is the Craigs' principle place of residence and use no more than 30 percent of the unit for the bed and breakfast. Forest Drive. Such an application was made last year and was resoundingly disallowed by the commission. I am hopeful you will take such action again. A bed and breakdast is not compatible with the peace and harmony of our neighborhood. Allowing auy bed and breakfast operations into the area serves only the intemsts of the operator, without regard to the investments of the other property owners. This is a residential area, a resideritiai area still with a sizable number of vacant lots...all potential commercial bed and breakfast operations. Our family has rented for over ten years in Kenai. We identified the neighborhood we wanted to eventually live in, did our research, and saved our money. One year ago, we bought the house we now live in on Toyon Way. Had I wanted to live by a bed and breakfast, I'm sure such property was available. Instead, we chose a nice comfortable area and I am hoping the planning commission will help keep it that way. I don't want bed and breakfasts in this neighborhood I don't want grades clanging around throwing coolers in the back of their boats, and loading up their bed and breakfast customers in their diesel Suburbans at 4:00 in the morning. Or a bunch of guys standing around the yard drinking and carrying on every evening. We didn't sign up for that. We shouldn't have to tolerate it. We have a substantial urvestmem in our home. Everyone does. Zoning should protect our investment. I see no gain for the other property owners in the area, only a long list of potential problems, a list that will only get longer as more bed and breakfasts invade the area. This is a residential area. It was when these houses were bought. It should stay a residential area. There is no change in the application from last year. The neighbors were opposed last year and are opposed this year. The application was denied last year and should be denied this year. Glick advised yes. Goecke asked Mr. Zimmerman if in his estimation with what they were talking about earlier with requiring the corners to be staked, would that additional cost be a detriment to you as a builder. Goecke added that we all know that would be passed on. In your case, if the city had required you to have your surveyor stake the corners of the house to make sure you are within the setbacks, would that $100 more. Zimmerman stated he has never heard of a surveyor staking corners of a house. Smalley commented he thought it was property corners. Bryson stated they are talking about putting about references for corners of the house. Zimmerman stated when they know it is going to be this tight adding they had to do the preliminary and that was why he had the surveyor locate the lot corners. Zimmerman commented that in some cases it might not be a bad idea adding that in some cases you cannot always find those corners. Zimmerman commented that if he hadn't surveyed it he might have been two feet off. Goecke stated his question was if had the city required the surveyor to stake the corners of the house prior to digging, and this costs from $100 to $200, would that cost extra to pay surveyor be a detriment to the sale of that house? Zimmerman responded it wouldn't but you have to dig afterwards and it is hard to keep the stakes there for the house. Zimmerman added that if you string the corners from the lot, you can measure off the strings. Zimmerman explained how the excavation makes it difficult to maintain the stakes. Zimmerman explained that he had gone back and checked and the left corner of the bedroom and it was okay but it was the right corner that was over. Zimmerman added you cannot keep stakes on the corners during construction. Zimmerman commented that he thinks when doing a certified plot plan, in some cases it wouldn't be a bad idea to say you need to survey this. White questioned if a guide could come in and rent this and have fish fries every night, people drinking beers, and rattling coolers and throwing them in the boat at 5 a.m. Could that happen? White noted this is not a bed and breakfast if the owner doesn't live there. Instead more like a Comfort Inn where you rent a room and get a continental breakfast. La Shot noted the applicant indicated daily rental with breakfast service and/or dinner and didn't indicate if the owners would live there or not. White commented that next to his property there are two empty lots and asked what would keep someone from building another motel there? White asked if that could happen or would they have to go through someone. La Shot asked Glick if he wanted him to answer these questions. La Shot stated this Conditional Use Permit is specific to this property. If any other lots around it wanted to do something similar, they would have to go through the same process. White asked if it would it be easier since the precedent was set. La Shot agreed it may set some precedent. White stated that based on that this, he would be opposed to this separation of commercial versus residential properties. White stated that this is a nice property, expensive property on the bluff and wouldn't want to see my property damaged as by what I see as a motel. DeWayne Craig-Listed residence as Vancouver, Washington at present. Craig stated that when talking about how to fill out the application when talking to people upstairs they indicated that a bed and breakfast specifically designed for residential house. Craig stated that what he wants to do is operate a bed and breakfast adding he would live there and take all the pride that someone would take in their own home. Craig stated he feels he has demonstrated that over the years. Craig noted he has won a beautification award, put steps in to the beach, put bench there, planted the beach grass along the walkway, and planted the trees. Craig stated he feels he has shown pride and ownership. The concern about the lots next door that are vacant next to Dr. Bailie is specifically zoned in the covenants for single family. Craig stated his lot was specifically zoned for apartments adding the whole street all zoned for apartments and that there aren't any residents there on Forest Drive. Craig stated that right now the way it is being rented someone could have a beer party and it could last all night. Adding there is nothing keeping it from happening. Craig commented that he felt with a bed and breakfast situation there would be a lot more control as you would be living there and could evict them on the spot. Craig commented that the apartment, the next one up street the gray one, was used by Louie for a couple summers as a nightly rental noting this was the overflow from Louies. Craig noted there has been some precedence set. Craig noted he wouldn't want to use it as an overflow but wanted to use it as a bed and breakfast. Christian asked Craig if his intention is to live in it. Craig stated absolutely. Craig noted he has been living outside, has grand kids here, and has been trying to figure out a way to come back four or five months in the summer. Christian asked what Craig's plan was for the other months? Craig stated it will be either vacant or as it always has been, rented as an apartment. PUBLIC H EAR,ING CLOSED. Glick asked if there was an additional staff report. La Shot noted if the commission would like the owner to occupy the building when they rent it by the night, they should make a specific motion. La Shot noted this was not noted in either the application or the staff report. Chairman Glick drew attention to the items handed out tonight relating to this item. La Shot asked if there were any questions on handout. Werner-Quade asked if this handout 6b is in regard to this particular rental application? La Shot stated yes. Werner-Quade asked what the intent was and if it was to point out the regulations? La Shot noted the one memo is from the Kornelis'. Werner-Quade asked if that is the Public Works Director. La Shot stated yes and that he is attempting to show that this is a use not shown in the land use table. The other item is to show things that were done to allow uses that were not listed in the land use table. La Shot stated he thinks memo from Kornelis was submitted as a citizen. Werner- Quade asked if it is in opposition. L a Shot stated it appears to be. Werner-Quade concurred with that. Werner-Quade stated she would like to note this is an apartment and is not four separate cabins. Goecke noted he got as much as ever of calls from people in that neighborhood from people complaining although noted there is not one here tonight. Goecke noted it may be because he knows some of the people who live over there. Goecke stated they were not real happy when they got this letter and called. Goecke noted he has a problem with it adding he doesn't think that that neighborhood was ever thought to be designed for a nightly thing. This is not a commercial zone. Goecke stated he thinks that is the way it should be and think it should be left that way. Goecke stated that nightly rentals, to me, are a little more on the commercial side. Goecke noted that because of this he will be voting against this. CHRISTIAN MOVED THAT THIS B&B BE OWNER OCCUPIED AT THE TIME THAT IT IS USED AS A DAILY RENTAL. AND, AT ANY SITUATION THAT HE IS NO LONGER IN RESIDENCE THAT THE CUP BE WITHDRAWN. MOTION DIES FOR LACK OF A SECOND. Bryson stated the conditional use permit applicaton does not state that it is requested to be used as a bed and breakfast. Bryson stated he didn't see where he uses that word. So, presumably we cannot approve it on that basis. La Shot stated the reason the CUP was used because of them being apartments and the square footage being used would exceed that allowed for bed and breakfast. If you put a stipulation that the owner did occupy it during times of nightly rental it may amount to the same thing without it really having the definition of a bed and breakfast. Smalley stated that he thinks a number of years ago when serving on P&Z there was a situation in VIP where a four plex that came to the same procedures. Smalley stated he thought this was right about the time that approved of B&B ordinance. This was an apartment complex that the owner lived in one of the units and the other units were then allowed to be used as B&B's, like La Shot was saying. Smalley noted so there is precedence on record. Smalley stated with Christian's motion that failed a concern that when it is not owner occupied that the CUP be completely gone which means he would have to apply again. There is a precedence in the city where conditional use for B&B's of such are on record in residential areas. Werner-Quade stated she did not have trouble with the amendment until if Mr. Craig isn't there then CUP would be revoked. Werner-Quade asked what if he had to go out of town suddenly for an emergency, what if he has a daughter or someone else who could oversee the B&B. Werner-Quade stated that is why she couldn't support the amendment even though supporting the basics and think someone should be there. Werner-Quade stated she would want that to be Craig but if someone should check and you are out of town the permit revoked. Bryson stated concerning the staff reference to difference general conditions how this proposed use affects the neighborhood and the area. Bryson stated he doesn't feel that the access problem where it might increase traffic is valid. Presumably the units are already created so the traffic count wouldn't modify that much. Bryson noted Forest Drive is the same width development on the north end of Redoubt Terrace as on the south. Virtually half the subdivision uses the north end and only Toyon Way uses the ~ south end. Bryson stated he feels the infrastructure is adequate. As far as the affect on neighbors, I would think it would have an affect. Christian stated he agrees that there is so much traffic on Forest that he doesn't see much increase in traffic there. There seems to be adequate parking for numerous units. Craig noted that for the first year he just planned on renting one or two units. Christian stated it doesn't seem it will be that large a burden because Forest Drive is a very active street. Christian stated he would think impact would be minimal. Christian stated he would like to see something in there that would identify this as a bed and breakfast which says the owner would occupy building when it is used as a bed and breakfast. Christian noted he would like to make a proposal that would keep this from being rescinded as soon as he leaves. BRYSON SECOND THE MOTION. Smalley noted he caught one thing when talking about the stipulations in the code in reference to bed and breakfast, it gives a specific square footage in a home. The precedence that has been set in apartment is larger than that 30 percent figure. Do you want to leave it at that 30 percent or make it a similar situation where it is more than the 30 percent. Smalley noted he believed the one in VIP is three of the four apartment units were rentals. Christian stated he has a problem if we go with the 30 percent either this owner or a subsequent owner could subdivide into numerous rooms that could make it into 8 or 12 units and noted he wouldn't like to see that either. Smalley stated the amendment could speak to the number of apartments that would be allowed for B&B in the facility. Werner-Quade asked for clarification of how many units there were and that the owner intends to occupy one. That would leave three units available for the nightly rental. Werner-Quade stated if amendment was changed to state that the owner would occupy one of the existing four units leaving three available for nightly rentals that would be an amendment she could support. At that time you stated your intention was to use the connection for a recreational vehicle during the summer months. The Finance Department noted that when you purchased your permits you paid for two months' service. The Kenai Municipal Code 14.20.245(d)(3)pmhibits long-term use of a recreational vehicle within the City of Kenai. Connecting your vehicle in excess of 30 consecutive days would be in violation of this code. For your information, I have attached a copy of this section of the code. The City cannot prohibit you from connecting to the city's water and sewer system. However, should you use the systems in a prohibited manner, the city could disconnect your service. (3) The home occupation shall be carried on wholly within the principal building, or other buildings which are accessory thereto. Any building used for a home occupation shall be wholly enclosed. (Orris. 925, 145 14.20.240 Mobile Homes: (a) No mobile homes may be installed for use in the City of Kenai .for public, commercial, or assembly purposes after the effective date of this ordinance. (b) No mobile home may be stored outside in the City of Kenai in a residential-zoned area after the effective date of this ordinance. _ (c) Mobile homes for residential use may be established only in mobile home parks as permitted in the Land Use Table. (d) Mobile homes which were installed prior to the effective date of this ordinance in conformance with applicable building code regulations in areas where now prohibited and used for residential purposes or stored outside may have such use continued indefinitely, except that such trailers shall not be replaced if destroyed or removed. (e) Mobile homes utilized on bona fide construction sites for offices, storage, or other such purposes may be so used anywhere within the City Limits on the construction job they serve, but shall be removed immediately upon completion of said construction. (Orris. 925, 1017, 1155, 1419) 14.20.245 Recreational Vehicles: (a) Recreational vehicle parks may be allowed by conditional use permit as provided by the Land Use Table. Prior to issuance of a recreational vehicle park conditional use permit, the pazks shall meet the following conditions: (1) Adequate utilities for projected or actual use shall be available. (2) The projected or actual use shall not threaten the health and safety of adjoining landowners or recreational vehicle users in the park. (3) Any and all specific conditions required to comply with Subsections (a)(1) and (2) as determined by the Planning and Zoning Commission shall be met by the applicant. (b) Maintenance of Pazks: Recreational vehicle pazks aze not to become a nuisance to surrodnding properties. Recreational vehicle pazks shall control dust, shield lighting from other properties, prohibit loud noises and maintain a clean and orderly appearance free from refuse. (c) Revocation of Permit: The conditional use permit may be revoked by the S57-10/18/91 14-47 CITY OF KENAI Commission if the conditions set forth in Subsections (a) and (b) above are not maintained. (e) Exceptions to prohibited uses: (1) Section (d) above shall in no way be construed as to prevent the historical use of recreational vehicles by workers employed in the cannery business if the recreational vehicles aze on cannery property, are used only during the cannery season, and adequate utilities are available and their use will not threaten the health and safety of adjoining land owners or others. (2) Recreational vehicles may be set up as living or sleeping quarters in mobile home pazks under the provisions of KMC 14.20.240. (3) For purposes of promoting tourism or industry, the City Manager may from time to time temporarily designate Portions of City property for the parking of recreational vehicles. Vehicles parked upon City property so designated are exempt from the general requirements of this Code section. (1306-89) 14.20.250 Off Street Parkins and Loadins Requirements: (a) In all zones, there shall be provided at the time of construction of any main building or at the time of the alteration, enlargement, or change in use of any main building, permanently maintained off-street parking facilities for the use of occupants, employees, or patrons of such building. After lengthy discussion, council chose to fail both ordinances. The Land Use Table was failed, largely because council felt the ordinance was more restrictive, to development within specific zones, than what is already in place. They also felt the public may not understand the ratification of the ordinance with those restrictions. The Townhouse ordinance was failed because of its relationship to the Land Use Table ordinance. Council is aware of the detailed work the Commission invested in amending the Land Use Table and plans to schedule a joint work session with the Planning 8~ Zoning Commission toward the middle of October to review both ordinances.
