Chairman Glick called the meeting to order at 7:00 p.m.

CONSENT. MOTION SECONDED BY GOECKE. AGENDA WAS APPROVED

MAHURIN MOVED TO APPROVE THE MINUTES OF OCTOBER 8, 199? AND
ASKED FOR UNANIMOUS CONSENT. MOTION SECONDED BY CHRISTIAN.

a. Application for Review of Development in the Townsite Historic

Mahurin asked what exactly was being approved. Kebschull answered,
Code requires that the Historic District Board review any development or

modification requiring a building permit in the Townsite District. The
'i Board reviewed the request and recommended that Planning and Zoning
approve the building permit.
MAHURIN MOVED THAT A BUILDING PERMIT BE ISSUED AND THAT
THE APPLICATION BE CORRECTED TO SHOW THAT A BUILDING
PERMIT IS REQUIRED. SECONDED BY CHRISTIAN.
Kebschull commented that it was unlikely the work would be completed
this year.
Discussion took place on the exact location. It was noted the building is
behind the day care center.

b. PZ97-50 -Landscape/Site Plan Review - 140 Willow Street South
(Lot 3, Etolin Subdivision) -Country Foods (John Steinbeck)
GOECKE MOVED TO APPROVE PZ97-50. SECONDED BY NORD.
Kebschull pointed out the recommendation made by the City Engineer
that it may be appropriate for the Commission to require landscaping.
She further stated that at this time there is no landscaping other than a
small grass strip along the building. A group discussion took place on
landscaping in the area. Concern was expressed that any shrubbery or
bushes planted may take away from the already limited parking. It was
recommended that perhaps planters and/or hanging baskets be
included in the area of the sign since the proposed work would be done
in that area anyway.
MAHURIN AMENDED THE ORIGINAL MOTION TO REQUIRE THE
APPLICANT TO INCLUDE FLOWER BOXES OR HANGING PLANTERS.

b. Borough Planning: Bryson reported that a meeting was held on October
13, 1997.
The Plat Review Committee met before the regular meeting and 13 plats
were considered. Twelve were recommended for approval and were then
ratified by Planning.
At the regular meeting a presentation was made by individuals
concerned about a proposed road wetlands permit project. The project
was previously advertised and withdrawn at the last minute. The
applicant, who was in attendance, indicated the project would be
reactivated at a later date. This will go through another advertising and
hearing process.
All action items were approved except for item 4 which was postponed
until spring. Item 8 was denied at the Assembly level.

d. Administration:
Kebschull reported that Kathy Woodford resigned to go to work for the
City of Soldotna. Her last day is October 31, 1997. A potluck lunch will
be held that day from noon to 2:00 p.m. A temporary will be hired until
a permanent replacement is hired.

13. COMMISSION COMMENTS AND QUESTIONS:
Commissioner Werner-Quade commented on the apparatus located in the K-
Mart parking lot and expressed concern that it may become a safety hazard for
those driving by. The Werner-Quade family hosted one of the Japanese
delegates and it was very wonderful cultural experience.
Commissioner Christian expressed concern about the Blockbuster Video
dumpster being placed in the middle of their parking lot instead of behind the
building. The fence the owner said would be installed is not there. Christian
stated he is still waiting for Mr. Norville to take care of the work he promised to
do.
Commissioner Nord reported that she will be gone for the entire month of
November as she is taking an extended vacation and attending the National
Convention.
Commissioner Mahurin stated that although she does not apologize for her
comments at the work session with City Council she will apologize to any
member of the Planning and Zoning Commission if her actions cause any them
embarrassment.
Kebschull reported the land use development table needs to be reviewed by the
Historic District Board. This review will take place at their next meeting and
will be back to Planning and Zoning for public hearing at the last meeting in
November.

The following public hearing has been scheduled for the Planning and Zoning
Commission Meeting of November 12, 1997:
PZ97-48-An application for a Conditional Use Permit for a Head Start
School for the property described as 120 & 130 Willow Street North
(Lots 4 & 5A Block 1, Cook Inlet Industrial Air Park), Kenai, Alaska.
Application submitted by Salamatof Native Association, Inc.
The Meeting will commence at 7:00 p.m. in the Kenai City Hall Council Chambers.

The lot would be raised to grade with gravel. The first 30 for facing on Willow Street
could be paved for parking with two exits on Willow. The Northerly half of the remaining
lot would be planted in grass and fenced with an 8` tall fence.with a gate from ad:~oining
lot 5-A. Within the fenced area play ground equipment such as swings, slides and
merry go round would be constructed. Trees and picnic tables would favor the alley
side of the lot. The remaining south half of the lot would be undeveloped at this time.
Most of the lot is cleared, disposal is not required. Snow would be piled on the
undeveloped protion of the lot.

advised this permit would be for an existing two bedroom and one bedroom duplex on
the lot that the applicant wishes to rent nightly and weekly during the summer and
monthly during the winter. Very similar to the last situation.
Public hearing opened.
Will Jahrig stated he feels it is good that we have set a direction for what we want to
see happen down there. Development can be done, it can be done right, and it can be
done to coincide with what we have down there. Jahrig stated he thinks that the
stipulations with water and sewage being permitted properly is very important. Jahrig
stated this area holds into his stomach, stating he likes the area and not just because
he has a business there. Jahrig stated he was raised there, he plays down there, his
kids still play down there and they are going to play down there. Jahrig stated he will
be there for a long time to come. Jahrig stated that if we can try to adhere to some of
these it will be good.
Bryan Lowe stated he has been down there eleven years and noted that he respects the
land there. He stated he runs a very professional operation. Everybody who knows him
knows that he keeps the place clean. Lowe stated that as far as Lot 8, he just
purchased the place. Jahrig mentioned that somebody was running guide businesses
out of the property and Lowe stated that is bull because it was never done. Lowe stated
he purchased the property in April. Lowe stated that he thought there was a
Conditional Land Use Permit and found out there wasn't so he went ahead and
proceeded to get one. Lowe stated his sewer systems have all been done legally. As far
as the flooding, the last 100 year flood we just had, the water never came over the bank
and affected his properties at all. Lowe stated he thinks there is a pissing contest going
on because both of these gentlemen wanted to buy that one piece of property, Lot 17.
Lowe stated he is not in violation; there are a lot of people who are in violation there.
One of them is Conditional Land Use Permits restricting to three boats per dock. Lowe
stated on his permits he has stood by them. He does not run more than three boats on
his dock. There are other problems with people's wells, artesian wells flowing onto his
land, Mr. Nigel's land right next to him has been flowing onto his property for two years
and he has not said a thing. Lowe stated he doesn't think this is fair. That he built a
building there and one corner of it is six inches over. Lowe stated that both these guys
wanted to buy the property from him and he didn't sell it and now they want to fight
him for it. Lowe stated it is not fair.
Ms. Werner-Quade asked Mr. Lowe if he had the proper DEC permits for Lot 8. Lowe
said he does not that he just bought the property in April. Lowe stated that Lot 17 is
DEC coded for three bedroom and the same goes for Lot 8, it is just a house. It is
- -~ residential; although, he will be lodging people. Lowe stated there are other people on
the street and stated at least he is trying to be up front and be legal. There are other

people on the street lodging that the city knows nothing about. Lowe stated that if the
city is going to put conditions on him that they need to put them on the whole street,

her a paper with everybody on Angler Acres who does have the proper permits and that
is why she asked.

d. PZ96-10, Conditional Use Permit, Tract 4, Horseshoe End at River Bend
S/D-Mr. La Shot stated that this Conditional Use Permit would be to convert an
existing single family residential home into a six Alex. The property is over two acres.
There is another residence to the east, to the west is a city park, Cunningham Park. La
Shot stated he has attached part of the code, the Land Use Table. This shows that
more than four family dwellings are allowed in this zone by conditional use. There is a
footnote that is also attached to the staff report.
Mr. Bryson questioned for point of clarification that Footnote C has a subscript 3 and
asked if the intent that the footnote on page 14-68 of the code, #3 A through I,
requested to be applied to the permit. La Shot responded yes.
Public hearing opened.
Chris Garcia, owner of the property-stated that last fall he became extremely ill and
was hospitalized and the end result of it is that he is no longer physically able to work.
Stated he is looking for a way to make a living. Garcia stated he owns an extremely
large house and decided that he might as well try to put the house to work for him and
change it into a six plex. Garcia stated he found out that he has to obtain a Conditional
Use Permit to do it so that is what he has applied for.
Bryson stated that the rural residential zone allows up to a four plex and Bryson
clarified that Garcia would like to put a six Alex in. Garcia stated it is his
understanding that he could put up to a four plex without any type of permit but to put
a six Alex in requires a permit.
Werner-Quade stated she would like to know about the sites septic and water and what
provisions he has for a six plex. Garcia stated he would have to find out from DEC and
added that there is no sense in spending money until he knows he is allowed to put in
-~ the six plex. Garcia stated he has called engineers to find out and has been told it is a
matter of testing. Garcia stated he has an existing water and sewer and has never had

On June 25, 1997, the Commission approved Resolution 97-28 recommending a change
to the above-referenced code. City Council failed to approve this recommended change.
At the work session on October 8, 1997, Mayor Williams asked that I review this
recommended change.
For your information, the staff's original recommendation for lot size coverage was taken
from the Development Requirements Table. However, a further review shows that the
CC-Central Commercial, CG-General Commercial, and IL-Light Industrial zones
were included in the 30 percent coverage recommendation. These zones are not listed
in the Development Requirements Table with a "Maximum Lot Coverage" listed .
Additionally, we failed to recommend a lot coverage for the IH-Heavy Industrial Zone.
At this time, the building code determines lot coverage in the IL-Light Industrial, IH-
Heavy Industrial, CC-Central Commercial, and CG-General Commercial zones. By
using 30% coverage, small lot sizes would prohibit townhouses in some commercial
zones, primarily the CC-Central Commercial zones. After further consideration, I
would recommend referring to the Development Requirements Table for lot coverage
requirements in the RR-Rural Residential, RR1-Rural Residential 1, RS-Suburban
Residential, RS1-Suburban Residential 1, RS2-Suburban Residential 2, RU/TSH-
Urban ResidentiaUTownsite Historic, and R--Recreation zones, and the building code for
lot coverage in the CC-Central Commercial, CG-General Commercial, IL-Light
Industrial, and IH-Heavy Industrial zones.
Attached is a copy of the Development Requirements Table. Using the table, the RR,
RR1, RS, RS1, RS2, and R zones would allow a maximum lot coverage of 30%. The
RU and TSH zones would allow a maximum lot coverage of 40%. The IL, IH, CC, and
CG zones would not be restricted to a maximum lot coverage. Building size allowed
would be limited by the Uniform Building Code and set back requirements.

WHEREAS, the 1997 Uniform Building Code determines lot coverage for commercial
and industrial zones in the city; and
WHEREAS, the Planning and Zoning Commission determined that the code should be
amended to include all zones in the city; and
WHEREAS, the City of Kenai Planning and Zoning Commission held a public hearing
on November 26, 1997;
NOW, THEREFORE, BE IT RESOLVED THAT THE PLANNING AND ZONING
COMMISSION OF THE CITY OF KENAI, ALASKA, RECOMMENDS THAT THE KENAI
CITY COUNCIL AMEND KMC 14.20.160 (bl(6)[A] to read:
(A) [THE TOTAL BUILDING COVERAGE SHALL NOT EXCEED THIRTY
PERCENT (30%) OF THE LOT AREA IN THE RR AND RS ZONES AND FORTY
PERCENT (40%) OF THE LOT AREA IN THE RU ZONE;] The total building
coverage in the R, RR, RR 1, RS, RS 1, RS2, RU, and TSH zones shall be
determined by the Development Requirements Table of the KMC Title 14 The
total building covera a in the IL, IH, CC, and CG zones shall be determined by
the Uniform Building Code as adopted by KMC 4.05.010.

STAFF REPORT PC MEETING 10/13/97
Original conditional approval was granted by the KPB Planning Commission on January 24, 1994 and by the City
Planning Commission on January 26, 1994. (Kenai PZ Resolution 94-4).
The City of Kenai has been advised that the plat is scheduled for a time extension.
Through prior actions and time extension, approval remained active through January 8, 1997.
There have been no known changes in the area that would affect the design of the proposed subdivision.
ADEC has signed the plat. There have been no changes to the Borough Code of Ordinances that would affect
this subdivision.
STAFF RECOMMENDATION: Staff recommends extending the approval through October 13, 1998.

The Planning Department requests that any plats you want filed prior to the end the year, be
submitted no later than November O5, 1997.
This will ensure that staffwill be able to complete a final review, secure the tax certificate, request
you update the Certificate to Plat, and have the plat ready for filing.
If the subdivider has not yet paid the taxes; it is important that you advise them of the need to
submit a copy of the receipt, showing date an method of payment. They will also need to provide
the name of the proposed subdivision when bringing or sending the receipt copy to the Planning
Department.
This time frame does not allow time for numerous final reviews of the same plat. If a plat is
returned for corrections and/or additions, other than signature, it will be placed at the end of the
line when returned for a second or third review.
We will, of course, try to accommodate plats received after that date. However, given the current
work load, we cannot make any assurances the review will be completed.
Your anticipated cooperation is appreciated.

Legislation is currently moving through Congress that will directly atfect how you run
your municipality. For thy: first time, Congress is considering so-called "takings"
le_is(atiun that targets state and local planning and zoning decisions.
Two bills - H.R. 1534 and S.1?56 -have enough momentum right now to pass the House
and Senate this year before lawmakers are able to consider the impacts on towns like
your. In order to Icarn more about the impact of this legislation. [ am writing to mayors
and other local officials to determine how H.R. 1334 and S.l?~6 will change the wav you
run your municipality.
The National League oFCitics opposes both bills, stating that each will "greatly enhance
the ability of developers and other claimants to sue cities in federal court fur allc~ed
`takings'. Such a fedora! action would expose (Dual Qovrrnmunts to increased financial
liability and interfere with the ability of local sovernments to make reasonable land use
decisions."

Summary of Key Provisions of S.1256

• S. l 256 states that "Federal and local authorities, through complex, costly, repetitive
and unconstitutional permitting, variance and licensing procedures have denied property
owners their fifth and fourteenth amendment rights under the U.S. Constitution."
Definitions
• S.125b defines an "agency action" to be an action, inaction or decision by any
government agency that adversely affects private property rights.
• S. 1256 defines "private property" as all interests constituting property, as defined by
Federal or State law.
• S. 1256 defines a "taking" as any action that restricts ownership, possession or use of
private property including physical invasion, regulation, exaction. condition or other
means.
Jurisdiction of U S Court of Federal Claims and U S District Courts
• Section 8 of 5.1256 would allow claimants to proceed to federal court after receiving a
"definitive decision regarding the extent of permissible uses on the property" and a single
denial of a~i appeal or waiver request. This significantly chat:ges current law by allows
claimants to sidestep other available stages of state or local review and proceed directly to
federal court.
• Section 8 eases the "futility" standard by excusing a local appeal or waiver
requirements where the claimant's "prospects of success or reasonably unlikely." This
allows a claimant to proceed to federal court by asserting in court that the local
community is unlikely to change its position.
• Section 8 also would prohibit federal courts from abstaining on state law Issues in cases
involving real property brought under 28 U.S.C. ~ 1343 where there is no parallel state
court proceeding and where the claimant .asserts no state law claim in federal court.
Existing abstention doctrines allow a federal court to decline jurisdiction in cases that
