Review of the Land Use Table Individuals Present: Commission Members: Phil Bryson, Carl Glick, Ron Goecke, Barb Nord, Michael Christian, Teresa Werner-Quade (arrived at 6:50 p.m.) Others Present: Councilman Hal Smalley, Building Official Robert Springer, City Attorney Cary Graves, Administrative Assistant Marilyn Kebschull Glick noted they needed to start on RS Zone and reviewed the process that the Commission had used at the last meeting. RS-SUBURBAN RESIDENTIAL: Residential: Glick asked for changes to RS residential. Bryson voiced concern about commercial uses in RS zone. Bryson noted that the RS zone is much of the undeveloped area in the city. Bryson stated he felt the RS should be looked at as CUP and RS1 and RS2 be more restrictive. Nord noted she had an N for Auto sales and service stations in all RS zones, the rest conditional. Christian stated he was more restrictive and place N's on all commercial uses in that zone. Goecke stated he has a problem with N's if you do that most all of the available useable land in the city is in the RS zone so that means going through and rezoning if someone wants to put something in there. Christian stated he thinks that if property is rezoned it would be more appropriate so their neighbors would have time to react. Graves noted conditional uses require a public hearing and would be advertised. Nord commented that conditional use would keep from spot zoning in areas. Glick stated that rezoning is a problem if it is a small parcel. Christian agreed with Nord to first two as N's. Bryson commented that it is not uncommon to have more control with CUP than with more restrictive zoning. Glick asked if Bryson could agree to Nord's suggestion. Agreed to place N's in the commercial section for automotive sales and service stations. Nord asked if they needed to review the residential section for 4-7 dwellings. Bryson noted three family dwelling were split from four. Industrial: Glick noted the only N is suggested for gas manufacturing and storage. Nord stated she had N's on all of them adding she doesn't feel they belong in residential areas. Bryson asked if gas manufacture was production. Glick stated he didn't interpret it as production, instead like an LNG production. Goecke stated he has a bit of a problem with N under warehouse. Goecke asked for a definition of a warehouse from the Commissioners. Goecke noted it could be a storage place or 100,000 square foot building. Goecke stated he believes it should remain a C. Christian noted it is listed under industrial. Glick noted Goecke is out numbered unless someone changed their mind. Bryson commented he didn't have a strong opinion one way or another. Bryson added it may be justified as a conditional use but if heavy duty warehousing with a lot of traffic may not be appropriate. Goecke stated the could deny the CUP. Bryson stated he would consider swinging to the C in warehouse. Glick agreed. All N's except C under warehouse. Public/institutional: Bryson stated he feels suggested uses under public/institutional are appropriate. Agreement to no changes. Miscellaneous: Nord stated she has an N under crematories. Christian stated he would like to look at cabin rentals noting it sounds like a commercial operation. Smalley noted the CUP gives P&Z authority if to allow a CUP after considering surrounding property, size of lot, etc. Goecke noted they already said hotels and motels are a C under the RS zone. Christian noted it would be consistent to keep it a C. Nord commented regarding recreational vehicle parks her feeling is that they don't belong in the RS zone. Glick asked for others who agreed. Bryson agreed to leave it as a C. No changes. RS1-SUBURBAN RESIDENTIAL I: Glick asked if they needed to discuss square footage on the RS1 zone, residential section. Christian noted the line through four or more dwellings on the development table. Christian stated he would like to look at RS1 noting that as it is on the books no one is using it, it is more restrictive. Christian stated he assumes that since there is no minimum square footage in the development table that they didn't want them. Christian suggested N's for four family dwellings and above. Nord agreed. Glick asked about townhouses. Nord stated she had C as they are usually owned by individuals. Bryson stated he felt the intent of the RS1 zone was to not allow more than 3 family dwellings in the subdivision. Glick asked if they could agree that 4-7 all N's. Christian Planning and Zoning Commission Page 3 Minutes April 23, 1997 stated he would feel the same for townhouses. Bryson stated he would prefer a C noting that this way they would have to justify the permit. Goecke stated he agreed to the CUP for townhouses. Nord agreed. Christian stated he would like to argue that mobile home parks and planned residential developments do no fit the RS1 category. Glick stated he agreed with mobile home but disagreed with planned developments. Goecke also disagreed with planned development. Nord stated she thought they should have a C on both because it is private property. Nord noted that mobile homes are privately owned. Bryson stated that regarding mobile homes, they will be a hard sale. Bryson noted they have their own section in the code that they have to conform to adding that Council hasn't shown any great propensity to allow them anywhere. Bryson stated he didn't know of one that had been approved since the ordinance was adopted. Bryson noted that planned residential development are usually low density with clustered housing and has it's positive aspects. Bryson stated he feels it should be allowed as a C and given the opportunity to justify itself. Goecke agreed. No other changes. Commercial: Bryson stated he believes they should be all N's. Christian agreed. Nord stated she was inclined to agree. Smalley asked about an individual who wants to have a family style restaurant. Christian stated it is a restrictive zone like putting one in a subdivision. Smalley noted that is where they are found noting there is one that was approved in Thompson Park. Christian stated they are talking about parking and traffic that a business would bring with it. Smalley noted that under a CUP they have to establish parking. Christian stated he couldn't see it in the zone. Nord stated she feels it should be N's all the way. Bryson and Goecke agreed. Change to all N's. Industrial: Christian and Nord suggested all N's. Goecke noted he left it as suggested but added that after what they did with the RS zone he could see all N's put would have a little problem with a warehouse being an N. Bryson stated it should be at least as restrictive as the RS zone. All N's. Public and Institutional: Goecke, Bryson, and Nord suggested no change. Christian noted he has N's in the blanks; first three--government buildings, libraries and museums. No changes. Planning and Zoning Commission Page 4 Minutes April 23, 1997 j Miscellaneous: Christian stated he was hoping to make another pitch for animal boarding being restricted in RS1. Christian commented that it seems like in a subdivision like Inlet View you wouldn't want animal boarding. Nord stated she originally had an N and then changed to C to conform with boarding in the past. Nord stated she can be swayed. Goecke suggested leaving it as a C noting if someone wants to do this they would have to come before the commission. Bryson feels an N is appropriate. Glick noted they vote is 2 to 2 at this point. Springer commented that if an individual had four dogs they couldn't even ask to have them. Springer asked if the Commission thought that was appropriate. Christian stated he feels it is appropriate. Springer asked about cats. Kebschull asked clarification on how someone would apply and whether or not the animal control officer would issue permits and enforce the permit. Graves stated that historically Animal Control enforces. Graves noted that kennel boarding specifically addresses dogs however animal boarding does not specifically address dogs. Glick advised to leave as a C-No change. Christian stated he had N's for cabin rentals, cemeteries, and crematoriums adding they didn't seem to fit. Christian stated he felt they were left blank before as an indication they didn't want them. Christian noted an N for B&B also. Bryson stated he agrees with that keeping in mind this is the most restrictive zone. Nord agreed with crematoriums adding she has C's on the other three but would change cemeteries to N. Goecke stated he has no problem with the suggested changes. Goecke commented that he didn't think we would ever see a cemetery in RS zone as by design it takes up a lot of room. Change cabin rentals, cemeteries, and crematories to N. Christian stated he feels it should be N for dormitory and boarding houses. Goecke stated he disagrees because they allowed colleges under a conditional use and dormitories and colleges go hand in hand. Nord noted she has a C. Bryson stated he would go with a C. Glick agreed. Nord suggested RV Park should be an N. Christian stated an N for radio and t.v. transmitters. Nord stated she can speak from the heart as a neighbor has a ham radio that comes across her appliances, even an electric toothbrush. Nord commented that if you are looking at commercial versus independent, she is uncomfortable with restricting private, even her neighbor. Glick noted he has a neighbor with a c.b. that comes ~ through. Parks were not appropriate. Goecke agreed. Nord noted C for transmitter. Change RV Park to N. Smalley asked how group feels about surface extraction in this zone. Christian stated he had an N. Glick noted fairly strict requirements in the code on those already. Bryson stated he didn't feel it appropriate in RS1. Nord agreed. N under surface extraction. RS2-SUBURBAN RESIDENTIAL 2: Christian would like to see it the same as RS1 in land uses. Christian noted they had left them blank in the land development table. Christian noted this is a smaller lot residential area. Bryson and Nord agreed. Change 4-7 dwellings to N. Commercial: Bryson stated he felt the RS2 zone should reflect RS 1 restrictions, provide N's all the way through. Group agreement. Change to all N's. Industrial: Nord, Bryson and Goecke recommend all N's. Agreed to change to all N's like RS 1 zone. Public and Institutional: No changes. Miscellaneous: Nord stated she feels it should reflect RS1 all the way down. Bryson stated he agreed except for animal boarding. Goecke agreed. ~ RU-URBAN RESIDENTIAL: Residential: Planning and Zoning Commission Page 6 Minutes April 23, 1997 ~ Bryson recommended no change. Agreement. Commercial: Goecke suggested leaving it. Nord suggested N's in auto sales and service stations. Bryson suggested restaurants C and asked if that is specified in the code. Graves noted C8 now. Graves agreed to check the RU zone noting it is intended to provide for areas of apartments, etc... Christian stated he can go either way, seems in urban area likely to have service stations adding he wouldn't like to live next to one. Werner- Quade stated she suggests N with auto sales and service stations. Christian stated he would rather be restrictive. Nord stated she would back down on auto service stations to a C but leave auto sales an N. Glick clarified an N on auto sales and C on service stations. Glick checked vote noting still tied on auto sales, three to three. Christian noted it is a residential zone rather than commercial. Goecke suggests a C then the Commission has control if someone asked request a permit. Glick advised they will leave as is in draft until 7th member present to break the tie. No changes. Work session ended at RU, Industrial zone. Glick asked how they should continue. Goecke commented they have not made any significant changes adding that it appears that staff put some effort into the designations. Goecke noted the Commission made some changes but now they are getting into the commercial entities for the most part. Goecke suggesting accepting' staff draft unless someone has severe objections. Christian stated he doesn't think it will take very much time to finish but would prefer to go through as a group. Nord agreed adding she there are some things she is uneasy about in the zone. Discussion about when to come for work session. Agreement to meet at 6:00 on May 14th Springer asked if they will revisit any issues in the land use table noting he is concerned primarily about all the N's under the residential sections for five and six family dwellings. Spring noted they have relegated multi-family dwelling to only a couple zones. Glick advised they will not talk about it in work sessions but when the draft is finalized someone could propose an amendment. Nord stated she was curious of how it got approved before. Glick noted it may have been because of the old highway. Bryson noted that further down the hill the old right ~ of way cuts through there adding he is not sure why they created a frontage road situation. Bryson noted problems with utilities have not been addressed noting apparently HEA has utilities in the ROW. Bryson added that HEA will comment at the borough level if they have any. Glick noted this was not a public hearing but noted for the record no public were present to comment. b. Extension of Construction Schedule-Lot 1, Spur Subdivision, Senior Citizens Addition GOECKE RECOMMEND APPROVAL OF THE CONSTRUCTION EXTENSION FOR SPUR SUBDIVISION, SENIOR CITIZEN'S ADDITION. MOTION SECONDED BY CHRISTIAN. No additional staff comments. Glick commented he felt they are still trying to get financing. Smalley noted the idea of having city assist with bonding is not being pursued and they are looking elsewhere for financing. City Council Smalley referred to the copy of agenda in packet. Smalley stated several gentlemen ~ spoke representing corporations who would like to financially back the fire training center is built will build on to provide employee training. Smalley reiterated they would be using their money. Smalley added that Sakhalin's major oil companies are very Planning and Zoning Commission Minutes Page 9 April 23, 1997 l excited about the facility getting online here. Smalley stated they are talking about providing funds equal to the original 58 or 9 million that the facility will cost. Smalley reported that the Kenai Recreational Ice Rink group brought forth a proposal for a bare bones project. This would be a complete year round use facility, similar to the one in North Kenai but would not have walls. Smalley noted the project is estimated at $490,000. Smalley advised a new airline will start flying into Kenai around May 1. It is Yute Airline who will provide carrier service daily, every 1.5 hours from 5 a.m. to midnight. Smalley reported that Public Hearing-C1 passed unanimously. The city wrote a letter of protest for the reissuing of liquor license. Item H6 was a discussion of city's fuel supply. Smalley noted the city will split gas and diesel and bid them separately. Smalley noted the city will renovate the shop area fuel tanks which will cost about 510,000 and then contract out the gas. Smalley noted the concern was with the rack price. The city will be basing the RFP on the Tesoro rack prices because they can vary. Smalley advised the council had gone into executive session on the Inlet Woods litigation trying to bring it to closure. Smalley noted that offers had been made several times by the owners of the property prior to the city getting involved. They are dealing with another offer now and hope to bring it to a closure so the city comes out okay. Approximately $200,000 has been spent on litigation costs which has been going for 10 or 11 years. Smalley stated that council discussed the condition of the bike paths and the heaving and will be seeing if the state can do anything with the contractor. The state will not maintain the path so Parks and Recreation will run the sweeper a couple times a year. Christian asked about the difference in the rink proposal and covering the current rink at the high school. Smalley stated that rink is in disrepair and it is borough property. Smalley stated they have talked about working with the lots on the other side of the golf course. The city will see if they can sell the lots and put that money into other recreational purposes. Then, the city would dedicate a portion of those revenues for this type of facility. Smalley added that the city has a couple of other parcels the rink committee is reviewing. Kennel licenses are for people who care for and about their pets. They are people who are responsible, keep their pet under control, contained and have proper facilities to accommodate them. These people are usually well trained in the care and handling of their animals. They are willing to open their doors to inspections at anytime, that alone says they care about their pets and the City's Rules and Regulation that pertain to Animal Control. A lot of these people who receive this licenses are dog enthusiasts and go to Shows & Trials all over the State of Alaska and Outside and usually have 3 or more dogs. The City's dog problems do not lie in Kennel Licensing, but in the control of neglected, stray, abandoned and vicious dogs, who are not care for or trained and the people who own them let them run loose. This is not the case with people who apply and receive these licences. Uwe are very disappointed that this matter is before the Planning and Zoning Commission and is about to go to the City Council for approval. Uwe feel that this resolution is a waste of the Planning and Zoning Commissions time and urge that it be REJECTED. Building Official: Applicant is requesting a variance to allow the addition of two cabins (dwelling units) to his lot. There currently are three structures on this lot. The original structure was moved to this lot in 1987 and a building permit was issued. Two additional structures were issued building permits in 1989. At that time a variance should have been applied for to allow more than one structure on this lot. However, the city did not enforce KMC 14.20.190 and the permits were issued. By now, given the years of acquiescence, we might be regarded as arbitrary if we were to deny a variance or permit. Applicant is also applying for an encroachment permit for the storage building which encroaches five feet (5') on the side setback. This is an accessory structure and would not need an encroachment permit; however, the applicant has converted the structure to a laundry facility making it a permanent structure which will require an encroachment permit. Staff Report PZ97-17 ~ Page ~ PZ97-18 PZ97-19 Applicant is also wanting to clarify his original Conditional Use Permit. The original CUP was. applied for in 1989 for cabin rentals and guide services During the P&Z meeting, Planning Specialist Loper stated a CUP for cabin rentals was not needed which was not an accurate statement. Consequently, the Commission approved a CUP for drop off and pick up of clients for guide services. The applicant's intent was for a CUP for cabin rentals. (A copy of the original application and minutes from the 1989 meeting are attached.) Note: On February 14, 1996, he Commission denied a request for an encroachment permit and conditional use permit for Lot 17, Anglers Acres, Part 2 (Brian Lowe-PZ96- 7, PZ96-8). A copy of the minutes from that meeting are attached. In addition, permits issued in 1996 limited boat parking to three guide boats. RECOMMENDATIONS The variance and conditional use permit appear consistent with existing uses in this area. The encroachment appears to be a separate issue. The permit would actually be for the commercial activity going on at the location. Commissioner O'Reilly asked how long people would be staying in the cabins; Mr. Jahrig answered that most bookings thus far are for 5 days. Mr. Jahrig stated that he was planning on putting one more cabin on the property but this would not be for residents, it would be for laundry facilities. Chairman Nault asked if water & sewer were adequate; Mr. Jahrig answered that all DEC regulations are met. Commissioner Bannock asked Mr. Jahrig what type of restrictions he would place on himself regarding the activity on site. Mr. Jahrig ~ answered that since he has lived, in the area his entire life and enjoys and respects that area he would protect it from too much activity, has already placed signs on his property stating, "No Wake Area", has a strong policy regarding trash, and that no more ." NEW BUSINESS NOTE: Item b taken first as representatives were present. b. Lease Review: Addition to Building - Lot 1, Kenai Spit S/D - Inlet Salmon Administrative Assistant Howard informed the Commission that the lot number should read 2 instead of 1. Inlet Salmon is in the process of obtaining a lease for lot 1. Planning Specialist Loper informed the Commission that Mr. Ruckman has submitted a revised plot plan which is before the Commission with the lot number corrected. Chairman Nault asked what the existing buildings were used for. Mr. Buckman answered that the long building is cold storage, the grouped area is for mechanical use, and the original building is for processing. The other buildings are for service. The new building is to increase. the holding room for keeping the fish cool before processing and the upstairs is for offices. The present ' office location is to be moved and the new offices are to be used year round. MOTION: Commissioner Bannock moved to recommend that the Commission has reviewed the addition and approve, seconded by Commissioner O'Reilly 6. PUBLIC HEARINGS: a. PZ96-7, Encroachment Permit, Lot 17, Block 1, Anglers Acres, Part 2- Mr. Bryson asked for further staff report. Mr. La Shot stated that this first public hearing is the first of three that involve properties owned by the same individuals. The first one involves an encroachment on Lot 17. Mr. La Shot asked that any comments be related to the encroachment itself so that each permit request could be handled separately. Bryson stated the action on Lot 17, Block 1 that is open for comment is for the half foot encroachment into the 15 yard side setback. The building itself is 14.5 feet from the property line. The rural residential zone requires 15 feet. Mr. Bryson opened the public hearing. Nigel Guest, 3320 W 78th, Anchorage 99502-Mr. Guest stated he would try to keep his comments short and thanked the commission for the opportunity to speak. Mr. Guest stated that some of his comments do relate to the next item on the agenda. As far as the encroachment goes, Mr. Guest stated he was disappointed that things weren't planned and looked at before things were built next door. Mr. Guest stated Mr. Lowe has built it clearing everything out in the immediate area and basically where he sits is an eye sore. Mr. Guest stated he had requested that Mr. La Shot make available to the Commission a letter he had written. Mr. Guest stated he didn't know if the Commission had had an opportunity to read the letter but hopes that they will before voting. Guest stated that basically he has asked Mr. Lowe to build a fence that will shield his property from Lowe's property. Guest stated he would request it be built at an 8 foot level to block the things that are budding onto his property line and to help shield his property which he has tried to protect. Basically, to make his property to continue to be a residential area and something that he hopes to retire to soon. Guest stated he uses it for recreation in the summer from basically the middle of April when his tax season is over until approximately October 15 to the 31st. Guest stated this lot sits in a series of lots that are recreational and this will become a commercial use lot. Guest stated he would save that comment for the next hearing. Guest asked the Commission to read his letter and to help him keep some of the quality of life he is used to on a residential lot. Mr. Bryson closed the public hearing and brought the matter back to the Commission for action. MR. GOECKE RECOMMENDED APPROVAL OF PZ96-7 ENCROACHMENT PERMIT FOR LOT 17, BLOCK 1, ANGLERS ACRES. MOTION SECONDED BY MS. WERNER-QUADE. Goecke asked Mr. La Shot if Mr. Springer said anything about the building that is encroaching. Goecke explained that he when he looked at it it looked like the building was moved in okay but then added to after it was on location. Mr. La Shot stated there was an addition put on the building that was moved in; however, he is not sure if the PLANNING & ZONING COMMISSION MINUTES PAGE 3 FEBRUARY 14, 1996 addition is what is encroaching. La Shot stated he thought it was the addition. La Shot asked if there was anyone in the audience representing the Lowes. Brian Lowe, owner of the property on Lot 17 on Angler Drive identified himself. Mr. Lowe explained he had staked out and had an asbuilt on the property and then had more gravel put in. In doing so, stakes were removed and then put back. Lowe stated he moved the one part of the building to the extent he thought it was in the 15 foot and he said it looks like just the corner of it is in 6 inches over. Lowe stated it was an accident and it wasn't planned that way. Lowe stated if Nigel wants him to put a fence up there he has no problem with that. Mr. Bryson stated the question was whether the 16 foot dimension on the asbuilt as shown was the secondary addition. Mr. Lowe responded no, that was the building that was put in. Bryson clarified it was the original building and it was expanded with a 22 foot addition. Lowe stated it was set there and it turned a little bit. Lowe reiterated he had had someone come in and put more gravel, they removed the stakes and put them back. The building was tilted and the addition was put on the one right corner is extending beyond 6 inches. All the other corners are inside. Mr. Goecke stated looking at the asbuilt, assuming that everything on it is correct, he has a tough time looking at all the space to the left and wondering why the thing wasn't moved to the center a bit further, if you are close. Goecke stated there are so many of these coming in that are encroaching a foot and a half, six inches, a foot ,time after time, "Oh, I made a mistake." Goecke stated he is becoming a little disenchanted with the so-called mistakes. Ms. Werner-Quade stated that based on staff recommendations and the comments of Mr. Guest she will be objecting to the encroachment. VOTE: WERNER-QUADE-NO GOECKE-NO BOOTH-NO BRYSON-YES MOTION FAILED, THREE NAY VOTES, ONE YES VOTE. Mr. Bryson stated that for the record this action could be appealed to the City Council. Bryson asked what the time limit was for appeal and Kebschull stated the information would be sent to Mr. Lowe immediately. Bryson asked Mr. La Shot if he was aware of the appeal period and he responded he thought it was within seven days that he must give notice of appeal. La Shot stated the appeal board, council, has 30 days. Bryson stated that should be clarified tomorrow with the city secretary. b. PZ96-8, Conditional Use Permit, Lot 17, Block 1, Anglers Acres, Part 2- Mr. Bryson noted this was the same lot as the above lot. Mr. La Shot stated this Conditional Use Permit would allow the owner to rent nightly and weekly during the summer a two bedroom home with a loft. La Shot stated a contingency has been requested that the permit be issued upon resolution of the encroachment. La Shot stated he has an illustration for the Commissions' use to show some of the other conditional uses that are occurring in the Anglers Drive area. Mr. Bryson recessed meeting for five minutes. Mr. Bryson opened the public hearing for comment for Lot 17, Block 1, Anglers Acres, Part 2, request for a Conditional use Permit. Nigel Guest from Anchorage. Mr. Guest stated that he wanted to say that he realizes his area of Angler Drive is important to the City of Kenai because it is one of the few areas that the city can access the river from Kenai rather than from Soldotna. Guest stated he is an avid fisherman himself so he likes to see people fish. Guest stated he would like to mention that sometimes rules seem to get bent and there is little enforcement in this neck of the woods noting it has been seen in other lots and other areas not only on the Anglers Drive area but in Soldotna. Guest stated he would like protection as a residential area. He stated he has no objection to people staying in a house next to him but he would like to see the business use restricted to the overnight use, or week use, or monthly use. He stated he would hate to see a boat rental operation started or a guiding operation started out of that. Especially since Mr. Lowe has access to other lots which he already owns on Anglers Drive where he has a business use permit and where he has been running his Hi Lo Charters. Mr. Guest stated he would like the commission to think of his position of having a lot totally cleared next to you, campers in there, tents in there, basically the trees gone, and very little that the Kenai Peninsula offers to us as individuals. Guest stated that when he lived down here from 1977 to 1988 one of the things he really enjoyed was the fact that his house was out in the trees, he could look around and not see too many other people, and not hear too many other things. This is one of the things that keep bringing him back to the Kenai, the peace and quiet and enjoyment. Guest stated he would like to ask the Commission members to put themselves in his shoes and try to help a little bit., maybe not to deny the permit but to keep it to the actual specific use that has been asked for and to have some means of enforcement if the use expands beyond that permit. Bryan Lowe-stated he wanted to note that he would not be running a guide service out of the property but it would just be used for lodging alone. Lowe stated he does not plan on having an RV park and there are a lot of trees left. Lowe reiterated he does not plan on running a business out of there, lodging only and boat parking. Everybody along there has parking for boats and Lowe stated he doesn't see why he should be denied as far as just to have it for lodging. Will Jahrig stated he owns Lot 12 on Anglers Drive and noted he has been in conditional use since 1989. Jahrig stated he thought he was one of the front runners who started the conditional uses there. Jahrig was under the assumption that the Conditional Use Permit was allowed under city codes to run a small business following guidelines. And, if guidelines were not followed, the conditional use could be revoked. PLANNING & ZONING COMMISSION MINUTES PAGE 5 FEBRUARY 14, 1996 Jahrig asked if that was correct. Bryson stated it is. Jahrig stated with that assumption with their business they have tried to do their utmost to keep their neighbors happy and that he feels they have a good relationship with their neighbors down there. Jahrig stated that neighbors use the dock when they want to, they can come and go and use the phone. Jahrig stated they have tried to be very neighbor friendly. Jahrig stated Beaver Creek is a very nice, very positive area. It is a very safe area for clientele and for those who own their places down there. Jahrig stated he objects to things happening down there that can be negative. Stated he objects if they are not being perceived to the public or to the clients that are correct uses. Jahrig stated he has a hard time with some of the conditional uses. Jahrig stated that Mr. Lowe has Lot 8 coming up along with this lot. Jahrig stated Lowe has been running a business off another lot for several years now that has not had a conditional use. Jahrig stated Lowe knows a conditional use has to be in effect to run a business because he has had one previously. Jahrig states he realizes that the city doesn't have a way of policing or overseeing this. Jahrig stated you have to take it word wise from people who are down there. Jahrig stated he takes it as a slap to those who are down there to their intelligence if somebody has been doing things and stepping over their limits and their boundaries for years. A little bit here and a little bit here, and well, we got away with another one, well I can run this one. Jahrig stated he likes to see businesses down there and he thinks they are a good, positive business aspect for the city. Jahrig states he doesn't like it when they are taken advantage of because it doesn't just show lack of fore thought on their behalf. It makes it harder on somebody like myself. If I want to come before the board and ask for more conditional usage or a change, the negative aspect that comes back to us as property users. Jahrig stated they will have a hard time doing it. Jahrig stated he knows that is not the way it is supposed to happen. Jahrig stated you get grouped in as an area and he doesn't want to see it happen to that area down there. Jahrig stated that he thinks you have to grab it by a little bit more of a hand and make sure that things aren't just walking along and not being noticed, out of sight, out of mind. Jahrig stated he felt that if commercial businesses are coming in for conditional uses, he thinks the city should require DEC or some regulatory commission that would make sure that our septic systems down there are being 100 percent put in, designed, and installed for the usage. Jahrig stated he knows that for years Mr. Lowe had a septic system that on high tide was flooded. Jahrig stated he has another septic system now that he installed a drainage ditch for that is within less footage that is specified for having drainage ditches next to a leach field. Jahrig stated there is always water in the ditch. Jahrig stated it is things like this that he sees constantly that nobody does anything about and that it has come to a head now. Jahrig stated this is one of those issues and if there are going to be conditional uses and running people down there, he doesn't want his clients having to see somebody drainage ditch that is probably septic. Jahrig stated there is a fecal count that is a problem in the creek now and the state and borough are trying to address it. Jahrig stated he doesn't know that if it is in the city statutes but is an item he thinks should be addressed. Jahrig stated he knows he is coming in to get his conditional use on Lot 8, the next item, and he knows that it has been used for guiding and as commercial use for several years. Jahrig stated he has been there, fishing several times a week as a private individual off his dock. Jahrig stated he comes and goes and sees it all the time. WERNER-QUADE RECOMMENDED APPROVAL OF PZ96-8, CONDITIONAL USE PERMIT FOR LOT 17, BLOCK 1, ANGERLS ACRES, i PART 2. MOTION SECONDED BY MR. BOOTH. Goecke stated he doesn't have any problem issuing the Conditional Use Permit but not open ended the way it appears at this point. First, it must be contingent upon council overturning what was done on 96-7. Also, would definitely want to see a fence along the property line. Goecke stated that Mr. Jahrig brought up a point about making sure that the only thing that happens on this lot is rental of housing. Goecke stated he doesn't know how to state that he would like to see that happen and doesn't know where the enforcement would come from on that but would like to make sure that is the only thing that happens at this time if this Conditional Use Permit is granted. Mr. Bryson stated that at this time the motion was to approve the request for the conditional use and does not include the comments of the building official or the city engineer. Bryson noted that if you wish to have those attached, you better be specific or add them as an amendment. Booth directed a question to Mr. La Shot stating that he noticed there is a well on the plat within the flood line and asked if there is a possibility of well contamination. Booth noted the speaker commented on possible septic contamination in the area. Booth stated he was curious with annual flooding such as this last year whether it was a potential that that well could become contaminated. Booth added he is aware that if you run a business such as a bed and breakfast you are not required to comply with the same kind of health standards and codes that you would if you had a public restaurant. La Shot stated that the authority for onsite water and sewer rests with DEC. The city only gets involved marginally with that. La Shot stated it is not a problem for the city to communicate with them to let them know what uses are taking place on the lot but the city doesn't get involved that much in that. La Shot stated that as far as the well location, DEC has standards to abide by, separation distances from water bodies and other facilities and leach fields and wells. The flooding that took place last year was something greater than annual flooding. It was the 100 to 150 year flood. La Shot stated he is not sure what happened to this particular well but it could flood. Bryson added that whatever level the water gets in this area is 99 percent tidal situation so it could be predicted with the moon except in extreme worse situation which would be a combination of events. Bryson added that to conform with DEC requirements they would have to have a Class C well conformance. In the past, that has been a purview of DEC requirements. Booth asked Bryson to explain a Class C well. Bryson stated that effectively it is (Bryson noted this information was from memory) a well for less than 25 persons and it is not a business situation, not a domestic water source. Booth questioned if this would require a Class C well and Bryson stated yes. Bryson stated they are required to have a 150 foot separation between sources of contamination. Goecke stated he was having a quandary about thinking about doing anything with the Conditional Use Permit until the first matter is taken care of. Goecke stated that at this point in time there is not a place to operate the Conditional Use Permit. Bryson PLANNING & ZONING COMMISSION MINUTES PAGE 7 FEBRUARY 14, 1996 stated they are in violation of a side yard setback. Goecke stated that theoretically since the commission turned down the encroachment permit, he does not have at this point in time a place to use the Conditional Use Permit. Bryson stated he felt they were different subjects but the building inspector has tied them together in his recommendations which are not a part of the motion. Councilman Smalley stated that potentially the two resolutions that Mr. Bryson talked about and the comments could be to add an attachment suggesting that approval be conditioned upon resolution of the encroachment. That encroachment can be appealed within 30 days to the city council or Mr. Lowe can resolve that himself by moving his building. The city engineer is suggesting that once the encroachment has been dealt with, it could be approved. That is a recommendation that right now is not on the main motion. So, it could be resolved in one of two ways. Bryson stated, making reference to Mr. Fretz' letter, that he is somewhat dismayed that the house trailers and/or tents were being utilized for housing in the area. Though that is an administrative matter for conformance with the other conditions. Bryson added that he would hope in the future they are policed. Councilman Smalley stated that what probably should have occurred is that complaints should have been called into the city because the city is not actively out looking and seeking violations. That is the way the code is set up. When a complaint received, the city goes and investigates. And then, if there is a violation, it can be dealt with. But, probably no complaints came into the city so there was no awareness. But, whenever there are Conditional Use Permit violations, the city has to be notified before it has any knowledge. Bryson asked if there was a wish to modify by amendment any aspects of the main motion. Goecke asked if he could talk to maker of the motion. Bryson asked if he would like a break or to discuss it during the meeting. Goecke agreed to do it within the meeting. Goecke asked if the maker of the motion is the only one who can make an amendment to the motion. Bryson stated that he could make an amendment. Werner-Quade stated that as long as the City of Kenai continues to turn their head to this area and say it doesn't matter and grant these permits, we will see more and more abuse down there. There will be people coming after the fact to ask for permits, people writing letters saying they don't want to see tents and trailers and requesting fences. These are the kinds of things that are real restrictive and noted she is of the opinion that as a commissioner it is time to take responsibility for allowing these kinds of permits to continue in the area without overseeing the actual use of those areas. Gray added the other change will be the cedar roof. Kluge stated he has a concern on Detail B, S2. Kluge noted they are incorporating hold downs that come up on the logs with galvanized flashing. Kluge noted that will be visible from the outside of the building. Kluge added he would like to see them do something to hide them. Gray advised it will be shingled. Kluge clarified it will be shingled to cover the straps. Gray stated it is their intention to restore to as original as possible. Approved/Denied ~ - Z,~" Date U~ T T: Planning Secretary ~2~~~ ~~~ Kenai Russian Orthodox Rectory Holy Assumption National Historic Landmark Project Scope Attached is a copy of the 1997 Condition Assessment Report Update -Russian Orthodox Rectory Building in Kenai. The Condition Assessment Report provides an overview of condition and recommendations for rehabilitation of the structure. In FY 1996, Holy Assumption received a $200,000 grant from the Federal Government for the rehabilitation of the Rectory building. Rehabilitation work is scheduled to begin in the summer of 1997. The work will be accomplished through volunteer, donated services and subcontracts under the supervision of the Church Restoration Committee. The National Park Service shall provide incidental assistance and direction to the project as it progresses. The project will be accomplished in phases rather than a single contract for rehabilitation. Each phase will be accomplished by priority in order to accomplish the most serious tasks. The overall goals of the project is to restore the exterior of the building to its historic appearance. Because the interior continues to be used as a residence for the local priest and his family, some contemporary modifications are required. However, those interior features that are historic to the building, such as; sash, trim, exposed beams and ceilings and doors will be restored. The following project phases follow the recommendations of the Condition Assessment Report -Russian Orthodox Rectory in Kenai (as revised in 1997) and architectural plans and specifications as developed by the NPS and McLane Structural Engineers. Phase I -ARCHEOLOGICAL SURVEY: Construction of a basement and moving of the building to accommodate construction will cause site disturbance. As a result an archeological survey and mitigation shall be conducted within the area of impact. The area consists of the a 5' perimeter around the Rectory, an expanded area at the proposed reconstructed rear addition, and the area where the building will be temporary stored during basement construction. Phase II -LIFTING AND MOVING OF THE RECTORY: Construction of the basement and replacement of deteriorated sill logs requires that the Rectory be lifted and temporally moved off its present location. The Rectory will be moved north of its present location, approximately 40 feet. It is anticipated that a professional house mover will be contracted to and moved the Rectory. Phase III -CONSTRUCT BASEMENT AND UTILITY UPGRADE: A concrete basement will be constructed under the Rectory. In addition to providing a ` ii substantial foundation, the basement will serve as storage and for heating, water heating, ducting and electrical services to the building. Phase IV -ELECTRICAL AND MECHANICAL UPGRADE: The existing mechanical and electrical systems will be replaced with new systems that meet current mechanical and electrical codes. Phase V -EXTERIOR RESTORATION: Contemporary "improvements" that have been tacked onto the exterior of the Rectory over time will be removed. The deteriorated sill logs will be replaced with new logs that match the original and reestablishes the original Rectory height. The wood shingle exterior surfacing will be restored. Broken shingles will be replaced and new shingles will be installed to cover the sill log replacements. Original window and door trim and sash and door units will be restore to the original appearance. The Rectory will be repainted to match the original color. Phase VI -INTERIOR REHABILITATION: The interior of the Rectory will be rehabilitated to facilitate the present Priest and his family. However, the plan will not be altered, original architectural elements, such as; window trim, door trim, baseboard (where original) and exposed original wood plank ceilings and beams will be retained. Missing original sash and doors will be reconstructed and reinstalled to replace more contemporary units. Placement of the Rectory on a concrete foundation will required the removal of the existing concrete slab and replacement with a new wood floor. Phase VII -FIRE PROTECTION SYSTEM: A fire detection and protection system will be installed in the building. Current advancements in residential sprinkler systems and in "water mist" technology may allow for an economical fire protection system to be installed in the Rectory. Phase VIII -ROOF: The existing metal roof, installed in 1970, will be removed and replaced with a new wood shingle roof to match original.
