Application submitted by Kenai New Life Assembly of God, 209 Princess Street, Kenai, Alaska. MOTION: GOECKE MOVED TO APPROVE PZ99-28. MOTION SECONDED BY ERWIN. Public Hearing Opens. Steve Brown, 251 Princess, Kenai, Alaska. Brown introduced himself as the Pastor of the Kenai New Life Assembly of God Church and requested the Commission approve his application for an oversized sign. Brown reported the new sign would very well constructed and costly. The sign would be one-sided and internally lit. Brown stated since the church was off the highway frontage approximately 200 or more feet, the new sign would make the church more visible. Brown pointed out the sign manufacturer is the same one used by the Grace Brethren Church last year when they had their new sign installed. Erwin asked what the wattage of the sign would be. Brown replied, he didn't know but could get that information from the manufacturer. Erwin clarified that what he was looking for was how brightly lit the sign would be. Brown answered that it would be a little understated, non-flashing and no brighter than the Grace Brethren Church. Public Hearing closed. Kebschull reminded the Commission that Brown had a letter to read into the record. Brown stated the letter was handed to him by Debbie Sonberg who lives at 410 Cinderella Street, Kenai, Alaska. The letter read: "As a concerned neighbor of the New Life Assembly of God Church, I request that the Commission approve their request for a sign variance. The New Life Assembly of God Church is active in our neighborhood. They are concerned about their image and have done a wonderful job of building and ground improvements. Planning & Zoning Commission July 28, 1999 Page 2 ~ I believe that this sign, like the one at the Kenai Grace Brethren Church, will enhance the beauty of the area. The internal lighting, style and color add to the aesthetic appearance of the neighborhood. It will be considerably more attractive than the existing sign." Bryson noted his firm had done some work on another project for the church but that had been some time ago. Kebschull brought attention to the applicant's comments indicating the existing sign would be removed once the new sign is in place. It was confirmed the sign was currently on city property but would be removed once the new sign is installed. PZ99-29--Landscape/Site Plan for the property described as Alyeska Sub Part 1, Replat Lot 5D (200 Willow Street), Kenai, Alaska. Application submitted by Wally Page of Kenai Steel Structures for Alyeska Sales & Service, 200 Willow Street, Kenai, Alaska. MOTION: NORD MOVED TO APPROVE PZ99-29. MOTION SECONDED BY GOECKE. Kebschull drew attention to the staff recommendations and requested the Commission to consider adding them as part of the motion. Kebschull continued, there was some general concern about the landscaping ordinance not being taken seriously by the applicant, as upon further review of the application, it was noted the site plan submitted was dated in 1969 and showed no landscaping or snow storage requirements. Kebschull added there could be landscaping at the site that would satisfy the requirement and the applicant was present to address the issue if necessary. Kebschull also pointed out the applicant was asked to have the dumpster covered for aesthetic purposes and debris control. Planning & Zoning Commission July 28, 1999 Page 3 ~ Wally Page, P.O. Box 2816, Kenai, Alaska 99611 -Page introduced himself as the general contractor on the project. His firm has been asked to put the addition on the back side of the building. Page reported the lot is 3 acres and covers about half of the lot next to the Merit Inn. Page stated that snow removal was never a problem as it went all the way in the back. Page also noted that most of the area is asphalt and there is a green strip out in the front of the lot. Page stated they will be happy to consider additional landscaping such as flower boxes etc. Page announced the covered dumpster would not be a problem. Discussion took place on the green strip in the area. Page pointed out on the site plan where the green strips would be and also indicated where trees would be left. It was noted, there would be one green strip in the front and one on the side. Goecke asked if the motion was approved would it include the staff recommendations. Nord, the maker of the motion, requested the staff recommendations be added to the motion. Goecke, who seconded the motion, concurred. The motion now read: NORD MOVED TO APPROVE PZ99-29 WITH THE RECOMMENDATIONS MADE BY STAFF. GOECKE SECONDED THE MOTION. City Council Councilman Bannock reported a copy of the agenda from the July 21, 1999 meeting was included in the packet. He noted, most of this meeting was devoted to the Multi-Purpose Facility and the City Council had approved it, Planning & Zoning Commission July 28, 1999 Page 4 ~ appropriating $426,750.00. Item C-5 of the agenda awarded the contract for Professional Consulting Services to Peratrovich, Nottingham & Drage, Inc. for the preparation of a project presentation package for the Kenai Coastal Trail. b. Borough Planning Bryson reported he was not present for the last two Borough Planning Commission meetings so was unable to report on them. However, he did have copies of the draft meeting minutes to share if anyone was interested. c. Administration Kebschull complimented Councilman Bannock on his explanation of the funding for the Multi-purpose Facility. Kebschull reported the police followed up on the complaint of the parking problems on Lawton and when they were in the area they didn't see anything. Should anyone observe illegal parking, etc., they are asked to contact the police as soon as possible. Kebschull stated they were diligently working on the city addressing and explained, the project was similar to what the Borough had done. Kebschull reported the City was responsible for addressing all parcels in the city and there were over 5,000 parcels. The old PTI maps were being utilized in this effort so some parcels may have three or four addresses and some large parcels may have ten or more addresses. At this time the project is 60% complete and approximately 100 people would be affected with address changes. All attempts were being made to keep assigning of new addresses at a minimum. The purpose for the addressing was the Enhanced 911 project; currently there is no access to a database with the City of Kenai's street addresses. Kebschull reported she would keep the Commission updated on the progress of this project. 9. PERSONS PRESENT NOT SCHEDULED: None. 10. INFORMATION ITEMS: a. The addition will be a garage for washing cars. Because the addition is valued at over 510,000 alandscape/site plan is required. The applicant is proposing no landscaping as result of this addition. In addition to the plot plan showing the new addition, the site plan that was submitted for the original landscaping in 1997 is attached. City Engineer: The adjacent Lot 9 was leased from the City to be used as parking. Minimal landscaping was required consistent with the existing landscaping. The accompanying ordinance provides for a hearing officer to heaz all appeals from planning commission decisions relating to subdivision plats and vacation petitions. Appeals from hearing officer decisions would be heazd by the boazd of adjustment. Currently subdivision plat appeals proceed directly to the boazd of adjustment, and appeals from denied vacation petitions are heazd either by the assembly or a city council if the azea is inside city limits. If this ordinance is enacted, hearings before the hearing officer would be conducted in accordance with the procedures governing board of adjustment hearings, except that the parties would be allowed to introduce new evidence and provide testimony. The hearing officer would be selected through a request for proposals and have relevant experience. It is anticipated that one or more hearing officers would be selected annually, and individuals then called upon to handle appeals as they arise. PC Meeting: 7-12-99 Inasmuch as these items are somewhat related the staff report addresses all three advertised items. Item 4, An Ordinance Amending KPB 20.28.110 and KPB 21.20.230 Clarifying the Circumstances under which the Assembly May Remand Appeals of Denied Vacation Petitions to the Planning Commission has been withdrawn by the sponsor and replaced with Ordinance 99-42. Ordinance 99-42 and Ordinance 99-43 address the issue of vacation petition denials by the Planning Commission; however, each ordinance takes a different approach. Ordinance 99-42 would have vacation denials heard by the Board of Adjustment while Ordinance 99-43 proposes to have appeals of vacation denials be appealed to Superior Court. Planning Department personnel have been working on revisions to Chapter 20 over the past year. One proposal _. ~ contained in the revisions is to include a new section establishing a Hearing Officer to hear appeals from decisions of the Planning Commission. As drafted, the hearing officer with a background in quasi judicial - proceedings and platting or planning experience would be selected through a request for proposal process. The Healing Officer would conduct the appeal in accordance with the procedures contained in Chapter 21.20. Ordinance 99-42 has the potential for starting a circular process: Planning Commission denial is appealed to Board of Adjustment who remands the issue to the Punning Commission which could still be appealed back to the Board of Adjustment. Ordinance 99-43 could be more costly for the individual who has been denied a vacation if it is imperative to the property owner to have some form of immediate relief to a vacation action. STAFF RECOMMENDATION: The Planning Commission recommend to the Borough Assembly adoption of a new section within Chapter 20 which would establish a Hearing Officer to handle appeals from decisions of the planning commission and recommend a substitute ordinance be submitted in lieu of either ordinance. END OF STAFF REPORT Chairman Hammelman opened the meeting for public comment. 1. Rogerlmhoff Mr. Imhoff, land surveyor, had been through the appeal process once. This process is quite lengthy. He thought the idea of a hearing officer had a lot of merit and should be explored. He did not support the idea of going directly to court from the Planning Commission (Ordinance 99-43). Mr. Imhoff believed this was too costly and even more time consuming than appealing to the Assembly. Seeing and hearing no one else wishing to speak, Chairman Hammelman closed the public hearing and opened ~ discussion among the Commissioners. Commissioner Gannaway wondered how the proposed ordinance would impact staffs workload. Ms. Parker replied the hearing officer would be an independent third party who would not be an employee of the Borough. Staff would issue a request for proposals for someone with quasi judicial experience as well as platting/planning experience. If the ordinance is enacted, decisions of the Plat Committee would be appealed to the Planning Commission, and decisions of the Planning Commission would be appealed to the hearing officer. Decisions made by the hearing officer could be appealed to the Board of Adjustment. Commissioner Gannaway inquired about the results of the hearing officer's decisions. Ms. Parker replied if the party wished to pursue the appeal, the next step would be to the Board of Adjustment. Often when hearing officers are utilized, the issues get resolved. Commissioner Gannaway inquired who would pay the hearing officer. Ms. Parker thought the Borough would pay the hearing officer. She doubted the appeal fee would cover the cost of the hearing officer. Staff would prepare the documents needed, which is the cunent practice. Commissioner Coleman asked if use of an arbitration boarci whose decision would be binding had been considered. Ms. Parker replied use of an independent board of adjustment with no Assembly representation had been discussed. The Assembly decided not to pursue this option.
