Chairman Glick called the meeting to order at 7:00 p.m.

MOTION:
Goecke MOVED to approve the agenda and asked for UNANIMOUS CONSENT.
Motion SECONDED by Bryson.
Agenda was approved as presented.
1-c. Approval of Minutes: August 25, 1999
MOTION:
Bryson MOVED to approve the Minutes of August 25, 1999 and asked that the
first sentence in Item 1-c be changed to read "Nord MOVED to approve the
Minutes... "rather than "Nord MOVED to approve the agenda. Bryson asked for
UNANIMOUS CONSENT. Erwin SECONDED the motion.
The Minutes of August 25, 1999 were approved as corrected.
1-d. Consent Agenda
MOTION:
~ Bryson MOVED to approve Consent Agenda Item PZ99-33, Home Occupation
Permit (Daycare) for the property described as Lot 8, Block J, Woodland
Subdivision (612 Laurel Drive), Kenai, Alaska. Application submitted by Janet
Stiers, P.O. Box 1435, Kenai, Alaska. Motion SECONDED by Nord.
Goecke asked if a letter of complaint was received to prompt the City to notify
Stiers that a permit was required. Kebschull replied the contact was more of an
inquiry than it was a complaint.
Chairman Glick asked Goecke if he would like to move the item from the
Consent Agenda for the purpose of discussion. Goecke declined.
VOTE:
There were no objections to the approval of PZ99-33. SO ORDERED.
ITEM 2: SCHEDULED PUBLIC COMMENT -None

4-a. PZ99-32 -Variance Permit (Rear Yard Setbacks) for the property described

MOTION:
Bryson MOVED to approve PZ99-32. Motion SECONDED by Goecke.
When asked if staff had anything additional, Kebschull informed the
Commission the owner was unable to be at the meeting because he had to
work. Kebschull also noted the owner requested a larger setback than may be
required because he didn't want to come back to the Commission for a
variance. Staff, however, did not believe a larger setback would be required.

ITEM 8 • REPORTS
8-a. City Council
Councilman Bannock reported the City Council met on September 1, 1999 and
a copy of the agenda was included in the meeting packet. Item C-1 was passed
unanimously and is a pass- through grant. Item C-2 approved $450,000 for
the design and engineering of the new airport facility. $250,000 of this project
was funded by the Legislature. Bannock noted there may be a problem with
storing non-airport equipment in the facility. Items C-3 and C-5 were related as
they dealt with the Jet Fuel Facility and the underground storage tank. Item C-
5awarded acontract to American Environmental for additional professional
services. The City Council congratulated the Peninsula Oilers for placing
second in the Nationals through their Resolution No. 99-53. Item G-1 approved
a $2,000.00 donation to the AML Conference. The City will host a reception for
the conference.
8-b. Borough Planning
Bryson reported no Borough Planning meeting was held since his last report.
8-c. Administration
Kebschull stated she wanted to provide a demonstration on the new Geographic
Information System (GIS) program at the end of the regular meeting.

Kebschull reported approximately 60 letters were sent out to individuals within
the Kenai City limits for address corrections. She noted, there seemed to be no
problems with the changes as only three phone calls were received. Kebschull
added, five street names had to be changed and the Commission could expect
to see resolutions in the near future.

Commissioner Goecke apologized for missing the last meeting. He was detained in
Anchorage.
Kebschull gave a brief demonstration of the GIS program and gave a summary of the
type of reports that will be available through use of the program.

General Information:
KMC 14.20.150 details the intent and application process for
conditional uses. The code also specifies the review criteria that must be
satisfied prior to issuing the permit. The criteria are:
1. The use is consistent with the purpose of this chapter and the
purposes and intent of the zoning district;
2. The value of the adjoining property and neighborhood will not be
significantly impaired;
3. The proposed use is in harmony with the Comprehensive Plan;
4. Public services and facilities are adequate to serve the proposed
use;
5. The proposed use will not be harmful to the public safety, health or
welfare;
6. Any and all specific conditions deemed necessary by the
commission to fulfill the above-mentioned conditions should be met

~~ by the applicant. These may include, but are not limited to
measures relative to access, screening, site development, building
design, operation of the use and other similar aspects related to the
proposed use.
Applicant proposes to operate a bookstore from her garage. The business,
Blue Barn Books, will sell children's books and supplemental learning
supplies. Applicant sees her market as children's educators. The application
describes the proposed business. The site plan shows the existing driveway.
Applicant plans to utilize the space to the right of the driveway for additional
parking.
The Commission must determine if the use is consistent with the intent of
the zoning district. KMC 14.20.090 states the intent of the zone is to
"provide for medium density residential development in areas which will be
provided with common utility systems." KMC 14.20.090 (2) prohibits uses
that would:
"i" violate the residential character of the environment;
"ii" generate heavy traffic in predominantly residential areas.
KMC 14.20.220 (d) (3) permits one sign not to exceed thirty-two (32)
square feet per use for conditional uses in residential zones.
This parcel is zoned RS--Suburban Residential. It is abutted by suburban
residential on one side and the rear and the other side is GC--General
Commercial. Properties across Birch Drive are RS--Suburban Residential.
If the proposed use requires remodeling in the garage, the applicant should
contact the Building Official to determine if a building permit is required.
The Building Official would also need to determine if there is sufficient
parking for the proposed use.

The minimum required parking spaces is two. It appears their parking plan is
adequate.

RECOMMENDATIONS
The proposed business, a small bookstore, would not appear to violate the
integrity of the zone. Based on the information provided from the applicant,
the business would not generate an excessive amount of traffic.
Recommend approval.

A RESOLUTION OF THE KENAI PLANNING & ZONING COMMISSION
RECOMMENDING TO THE COUNCIL OF THE CITY OF KENAI, CHANGING OF

WHEREAS, Section 14.15.140 of the Kenai Code authorizes the Council of the City
of Kenai to name and rename streets, and
WHEREAS, as part of reviewing street addresses for the City of Kenai in
conjunction with the "Enhanced 9-1-1 Mapping and Address Project" it was

Applicant is proposing to construct two 22 feet by 24 feet freestanding
canopies in the parking area behind RPM's Rebuild to be used for parking.
Because the construction is valued at over $10,000 alandscape/site plan is
required before a building permit can be issued.
Applicant has provided a plan showing the proposed location of these
buildings. This drawing also shows parking area, ingress and egress, snow
storage area, sidewalks, etc. The Building Official should verify that the
business will still have sufficient parking with the additional structures.
The applicant is not planning to provide any landscaping.

City Engineer:
As a point of clarification, the proposed structures do not address the issue
of outside storage. The structures will not be enclosed and the applicant
states they will be used for customer parking.
Building Official:
Parking will be adequate.
RECOMMENDATIONS
Recommend that the Commission clarify the intended use for the structures.
Applicant has advised the canopies will be used for customer parking. It is
unclear if the parking will be for customers who are visiting the business or
customers who are parking their vehicle while being worked on. RPM's is a
machine shop. Automobile repair is a permitted use in this zone.
The City has received numerous complaints over the years about storage of
materials outside this business. The code allows storage in this zone.
If the Commission determines the structures will be used for storage of
materials or vehicles while being worked on, would recommend the
Commission require they be enclosed.
Even though this is an addition to an existing business, the Commission may
require landscaping, as allowed, to a maximum of five percent. The
Commission should consider requiring landscaping to make the addition of
these structures appear ascetic in the setting, i.e., trees or shrubs placed on
the perimeter around the buildings. It does not appear there is currently any
landscaping on this site.
Recommend approval with landscaping required screening the structures..
And, if the Commission determines the structures will be used for storage of
equipment or vehicles, recommend that they be enclosed.

WHEREAS, it is in the best interest of the City of Kenai to restrict the keeping of such
animals to Rural Residential (RR) lots of sufficient size;
NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING & ZONING COMMISSION OF
THE CITY OF KENAI, ALASKA THAT KMC 3.10.070 is enacted as follows:
3.10.070 Livestock within the city limits:
(a) Except as otherwise provided in subsection (b) below, no person shall
keep or maintain livestock within the City of Kenai.
(b) Livestock may be kept in the Rural Residential (RR) zone on lots of
three acres or more.
(c) In this ordinance "livestock" is defined as any cattle, buffalo, llama,
alpaca, horses, sheep, swine or goats.
(d) The Chief Animal Control Officer may issue temporary permits of not
more than fourteen (14) days for the keeping of livestock not otherwise
allowed for public exhibitions or entertainment events.
(e) Lots not in the Rural Residential Zone (RR) or lots in the RR Zone less
than three acres on which livestock are maintained or kept on the
effective date of this ordinance shall be considered anon-conforming
use of the land under KMC 14.20.050.
