PLANNING & ZONING COMMISSION MEETING MINUTES AUGUST 11, 1999 PAGE 2 VOTE: There were no objections to UNANIMOUS CONSENT. SO ORDERED. ITEM 6: OLD BUSINESS -None ITEM 7: CODE ENFORCEMENT -None ITEM 8: REPORTS 8-a. City Council Councilman Bannock noted a copy of the agenda from the last City Council meeting was included in the packet. Rick Baldwin of the LLC Group gave an update on the Multi-purpose Facility and noted the boards for around the ice were to be donated by the Nikiski High School. Item C-1 was passed unanimously and this was a maintenance facility for the airport and it will house snow removal equipment and a fire truck. Bannock reported the City's Sewage Treatment Plant employees received a safety award. This was the first of its kind and the City is very proud of the excellent job by the three employees. 8-b. Borough Planning Bryson noted two meetings were held and all items on the Agenda for August 9+~ were approved. All items on the August 23, 1999 Agenda were also approved with the exception of Item F-1, which was denied as it was a request to fill in wetlands for the purpose of road access. A request for a three week extension was requested in order to get more public comment. 8-c. Administration Kebschull reported the City was in the final stages of updating street addresses and there would be fewer changes than what was previously anticipated. This task should be accomplished within the next few weeks. The GIS program has been installed and Kebschull will provide a demonstration once more comfortable with its operation. The program will provide more immediate access to City streets, water/sewer data, and information on permits. The Code also outlines the review criteria that should be used by the Planning and Zoning Commission to determine if a variance should be granted. The Commission shall establish a finding that all of the following conditions exist as a prerequisite to issuance of a variance permit: 1. Special conditions or circumstances are present which are peculiar to the land or structures involved which are not applicable to other lands or structures in the same zoning district. 2. The special conditions or circumstances have not been caused by actions of the applicant and such conditions and circumstances do not merely constitute a pecuniary hardship or inconvenience. 3. The granting of the variance shall not authorize a use that is not a permitted principal use in the zoning district in which the property is located. PZ99-32 -Comments Page 2 4. The granting of a variance shall be the minimum variance that will provide for the reasonable use of the land and/or structure. 5. The granting of a variance shall not be based upon other non- conforming land uses or structures within the same land use or zoning district. Applicant is requesting a variance of five feet from the rear setback requirements. This is more of a variance than is actually necessary; however, applicant wants to request enough space to alleviate the possibility of an encroachment. As is shown on the attached drawing, the house sits on a corner lot and is accessed from an unnamed right-of-way. The drawing shows the location of the proposed garage. City Engineer: The drawing provided shows this lot has right-of-ways on two sides, an alley to the rear, and Lot 27 on one side. The Development Requirements Table states minimum yards for corner lots as, "The minimum side yard on the street side, or platted right-of-way, or government easement, of a corner lot shall be the same as the minimum front yard required for the zone." Based on this requirement, we are not considering the alley as a platted right-of- way, side street, or government easement and are considering it a back yard for setback requirements. Building Official: The non-permanent, movable storage shed is not considered encroachment on setbacks and is not required to maintain a three (3) foot setback from property lines unless it is over 120 square feet. Ms. Stiers was issued a home occupation permit in October 1998 (PZ98-48) for 518 Pine Avenue in Woodland Subdivision. Applicant has moved from 518 Pine Avenue in Woodland to 612 Laurel Drive, also in Woodland Subdivision. KMC 14.20.230 (f1 specifically notes that "A home occupation permit granted under this section shall not be transferable to another person or location." The Kenai Peninsula Borough assessing information shows the legal owners of this property as Donald & Virginia Maesner, 205 Pleasant Valley Drive, PZ99-33 -Comments Page 2 Marion, MT 59925. The property owners have been sent a copy of this information. Ms. Stiers continues to operate under astate-licensed daycare. Other than the change of location, it appears that the daycare operates as was approved in October 1998. The attached report is a sample of a report we will be using. This report incorporates the Borough's assessing data and mapping. We have also incorporated databases we keep on building permits and planning permits. The utility information shows whether or not a parcel currently has city water and sewer. If this area shows "N" - no, it does not mean that water and sewer is not available just that they are not currently connected to the service. The next goal will be to have the water and sewer asbuilts updated and digitized so that we can add a layer to the Borough maps. This layer would show locations of water and sewer lines, manholes, etc. I plan to provide a short demonstration at your meeting on September 8~`. Please understand this will be a basic demonstration. This is a very extensive program that I will be learning as time permits.
