c. Sycamore Circle -- Status Update
Kebschull reported a second letter was sent to Triple T. Autobody. A
copy was included in the meeting packet.
Kebschull also reported Cowan responded to his notice and will request
an amendment to his current permit to include guiding. This will be
presented at the next Planning and Zoning meeting.
Kebschull stated the second 30-day photograph was taken of the
Sycamore Circle property and the case has been turned over to the City
Attorney for his action.
8. REPORTS
a. City Council
Couacilman Smalley reported a copy of the agenda from the August 19,
1998 meeting was included in the packet.
Item B-l, Kathryn Thomas spoke on behalf of the Western States
Coalition and reported seven Congressmen, including Speaker Gingrich
will visit the Kenai Peninsula. Several activities and tours are planned
and only Mayor Williams will participate. The City will co-sponsor the
luncheon for the visitors.
Items C-1 through C-4 were approved.
Item H-6, the Board of Adjustment hearing was scheduled for September
2, 1998. The City filed an appeal of the Planning and Zoning decision
regarding the Five Irons Heights Subdivision.
Smalley reported he visited with the City Manager regarding the Enstar
hookup near the golf course and it is not something that could be
utilized.
A joint meeting between the City Council, Planning and Zoning
Commission and the Historic District Board is scheduled for September
21, 1998 at 7:00 p.m.

b. Borough Planning
Bryson reported a Borough Planning meeting was held on Monday,
August 24, a copy of the agenda was included in the packet. During the
meeting, two plats, which had been postponed, were reviewed. One was
returned to the sub-divider for modification and the other was approved.
There were nine newly submitted plats; one was returned to the sub-
divider for modifications, one postponed and all others approved.
Under Section H, Item 3.a and b, were applications for waiver of platting
requirements. Item 3.a was postponed pending clarification of several of
the deed restrictions and Item 3.b was approved.
Item J-1, Conditional Use Permit along the Kenai River consisting of a
modification to an existing development and placement of a bridge
across a slough was approved.
c. Administration
Kebschull reported she provided Commissioners with a new Title 14 and
an updated street map which would help when issuing permits.
Kebschull requested the old Title 14 be discarded as the new one
contains Code changes made over the past few months.
Kebschull stated she and the City Attorney have discussed introducing a
new junk vehicle ordinance as the current section in the Code is difficult
to enforce and interpret. Kebschull continued, they are reviewing other
Codes from other communities. They found some communities require a
vehicle to be licensed or insured to prove that it is not a junked vehicle.
This will be brought before the Commission for review in the future.
9. PERSONS PRESENT NOT SCHEDULED:
Mark Schrag, 312 Princess, Kenai, Alaska stated he attended this meeting as
a result of recent decisions made by the Commission on issues he was involved
in, specifically the MAPS area and the Beaver Loop issue. Schrag asked the
Commission to take a more balanced approach in the future. Of their
decisions, with both neighborhoods, they were the majority in their opinions.
There wasn't even a 60/40 split, or even an 80/20 split, probably 90% or more
opposed the issues. Schrag also indicated there were some legal questions on
the issues and yet the Commission disregarded them. Schrag stated he didn't
understand the Commission's reasoning on the issues but he asked that
members give more consideration to the people in the neighborhoods.

Glick thanked Schrag for his input and informed him there was an opening on
the Commission and applications were available. Schrag reported he had
already submitted his application when the last seat became available, but
wasn't sure he made the deadline.

11. COMMISSION COMMENTS AND QUESTIONS:
Commissioner Mahurin apologized for being gone the last two meetings.
Mahurin announced she regretfully provided Mayor Williams and the City
Council with her resignation as she was elected to the national appointment
she mentioned previously. Her resignation will be effective the last meeting in
September. Mahurin continued, she will be able to attend the meetings in
September unless someone is waiting and can be appointed earlier.
Commissioner Goecke reported he will not be present at the work session on
September 21 nor the last meeting in September as he will be attending his
daughter's wedding in California.
Goecke wished Mahurin well with her national appointment.
Commissioner Nord also congratulated Mahurin on her new position.
Commissioner Graveley also congratulated Mahurin on her new position and
on behalf of the Commission, thanked her for sitting on Planning and Zoning.
Graveley expressed dissatisfaction with the low voter turnout on August 25.

Re: KMC 14.20.150 -CONDITIONAL USE PERMITS
Staff is recommending that the Kenai Municipal Code at 14.20.150 be amended as
suggested on the attached draft. As you are aware, the current code states, "Such
uses must be similar to principal uses in the zone." This statement, if interpreted
literally, could limit uses in residential zones to residential uses. This interpretation is
not consistent with the Conditional Uses noted in the Land Use Table.
Administration believes that the suggested amendment would alleviate the
inconsistency between the Land Use Table and KMC 14.20.150.

14.20.150 Conditional Uses: (a) Intent: There are some uses which may be
compatible with principal uses in some zones if certain conditions are met. The
Commission shall permit this type of use if the conditions and requirements listed in
this chapter are met. Before a conditional use permit may be granted, the procedures
specified in this chapter must be followed. (Ord. 1504-92)
(b) Conditional Uses in All Zones:
(1) Uses not specifically permitted in the zone concerned may be
permitted provided that the following conditions are met:
~i] Such uses must he similar to principal uses permitted in the
zone;
[ii] Such uses must be in harmony with the intent of the zone.
(2) Development and extraction of natural resources which can be mined
underground without substantially disturbing the surface of the land may be
permitted together with the necessary buildings and apparatus, provided that the
following conditions are met:
[i] The benefits to the City in terms of economic development
Must outweigh any adverse effects on adjoining properties;
[ii] Asight-obscuring fence or uncleared buffer strip of good
appearance acceptable to the Commission shall be provided between such
uses and all adjoining residential zones and all adjoining public rights-of-
way.
(3) Surface extraction of natural resources may be permitted provided
~ that the standards are met and the procedures set out in this chapter are
followed. The usual procedures for conditional use permits contained in this
chapter shall not be applicable to conditional use permits for the surface
extraction of natural resources.
(c) Procedure:
(1) An application for a conditional use permit shall be filed in writing
with the administrative official and verified by the owner of the property
concerned.
[i] Application shall contain the following data with respect to
the property and the applicant:
(A) Legal description of the property involved;
(B) Plans showing the location of all existing and
proposed buildings or alterations, elevations of such buildings or
alterations, and such data as may be required.
(C) Anon-refundable deposit/advertising fee of $100.00.
(2) The public hearing and notification procedure for a conditional use
permit application shall be accomplished in accordance with the requirements of
this chapter.
(3) An approved conditional use permit shall lapse twelve months from
the date of approval if the non-conforming use for which the conditional use
permit was approved has not been implemented. The Commission may grant a

time extension not to exceed six months upon a finding that circumstances has
not changed sufficiently since the date of initial permit approval. A request for

shall not be required as a condition to granting the extension. (Ords. 925, 987,

(d) Revocation:
(1) The Planning & Zoning Commission, after public notification and
hearing, may revoke a conditional use permit if it finds the permit holder has
violated a provision of the Kenai Municipal Code, including but not limited to
the provisions in Title 7. A decision by the Commission on revocation may be
appealed to the Board of Adjustment pursuant to KMC 14.20.290. (Ord. 1549-

(2) A person whose conditional use permit is revoked under this section
may reapply for a permit under KMC 14.20. The Planning & Zoning
Commission or Board of Adjustment may consider the prior revocation when
determining whether to grant the new conditional use permit. (Ord. 1549-93)

A RESOLUTION OF THE PLANNING AND ZONING COMMISSION OF THE CITY OF
KENAI, ALASKA, RECOMMENDING THE KENAI MUNICIPAL CODE AT 14.20.150 BE
AMENDED.
WHEREAS, KMC 14.20.150 needs clarification to make it compatible with the Land Use Table;
WHEREAS, KMC 14.20.150 does not conform with other sections of Title 14;
NOW, THEREFORE, BE IT RESOLVED THAT THE PLANNING AND ZONING
COMMISSION RECOMMENDS TO THE KENAI CITY COUNCIL THAT KMC 14.20.150 BE
AMENDED AS PER THE ATTACHED.

A. Intent. It is recognized that there are some uses that may be compatible
with designated principal uses in specific zoning districts provided certain conditions
are met. The conditional use permit procedure is intended to allow flexibility in the
consideration of the impact of the proposed use on surrounding property and the
application of controls and safeguards to assure that the proposed use will be
compatible with the surroundings. The commission may permit this type of use if the
conditions and requirements listed in this chapter are met. The allowed uses are listed
in the Land Use Table. Before a conditional use permit may be granted, the procedures
specified in this chapter must be followed.
B. Applications. Applications for a conditional use permit shall be filed in
writing with the Planning Department. The application shall include, but is not limited
to, the following:
1. name and address of the applicant;
2. verification by the owner of the property concerned if other than
the applicant;
3. a legal description of the property involved;
4. a description of the proposed use;
5. dimensioned plot plans showing the. location of all existing and
proposed buildings or alteration, and such data as may be
required; and
~ 6. the appropriate fee.
C. Public Hearing. If the application is in order, a public hearing shall be
scheduled in accordance with the requirements of KMC 14.20.280 of this title.
D. Review Criteria. Prior to granting a use permit, it shall be established
that the use satisfies the following conditions:
1. the use is consistent with the purpose of this chapter and the
purposes of the zoning district;
2. the value of the adjoining property will not be significantly
impaired;
3. the proposed use is in harmony with the Comprehensive Plan;
4. public services and facilities are adequate to serve the proposed
use;
5. the proposed use will not be harmful to the public safety, health
or welfare;
6. Any and all specific conditions deemed necessary by the
commission to fulfill the above-mentioned conditions should be
met by the applicant. These may include, but are not limited to
measures relative to access, screening, site development, building
design, operation of the use and other similar aspects related to
the proposed use.
E. Modification of fmal approval.
1. An approved conditional use permit may, upon application by the
permittee, be modified by the Planning & Zoning Commission;
a. when changed conditions cause the conditional use to no
longer conform to the standards for its approval;
b. to implement a different development plan conforming to
the standards for its approval.
2. The modification application shall be subject to a public hearing
and a filing fee.
F. Expiration -Extensions -Transferability.
1. An approved conditional use permit lapses twelve (12) months
after approval if no building permit is procured or if the allowed
use is not initiated.
2. The Commission may grant time extensions not to exceed six (6)
months each upon a finding that circumstances have not changed
sufficiently to warrant reconsideration of the approval of the
conditional use permit. A request for an extension must be
submitted prior to the expiration of the permit. A public hearing
shall not be required prior to granting an extension of time.
3. A conditional use permit shall automatically expire if for any
reason the conditioned use ceases for a period of one year or
longer.
4. A conditional use permit is not transferable from one parcel of
land to another. Conditional use permits may be transferred from
one owner to another for the same use, but if there is a change in
use on the property, a new permit must be obtained.

PUBLIC HEARING NOTICE
The following public hearing has been scheduled for the Planning and Zoning
Commission Meeting of September 9, 1998:
PZ98-41--An application for an Encroachment Permit for front yard setbacks
for the property described as Lot 7, Block 1, Evergreen Subdivision, 401
Evergreen, Kenai, Alaska. Application submitted by Jerry S. Stock, 1614
Fourth Avenue, Kenai, Alaska.
The Meeting will commence at 7:00 p.m. in the Kenai City Hall Council Chambers.
Anyone wishing to present testimony concerning this permit should do so at the
hearing or submit written comments to the City of Kenai, Planning Department,

22.6'. The entry and steps are not included since they are allowed under KMC
14.20.200, Accessory Structures. The distance from the street to the property line
is approximately 35.5', so the total is 58' from the street surface to the structure.
The intent of the Planning and Zoning code for setbacks was to provide an
adequate separation of the structure from the street. Fifty-eight feet appears to be
adequate separation; therefore, this encroachment should be approved.

Applicant wants to build a 20 by 30-foot garage. His initial proposal was to build
the structure to the side property line. After meeting with the applicant and
explaining staff's position that side setbacks be maintained, a second proposal was
submitted. This proposal would leave atwo-foot side setback. The minimum side
setback in this zone is 5 feet.
Based on the asbuilt survey that was submitted by Mr. Glonek, it appears that the
residence is "grandfathered" as anon-conforming structure since the asbuilt is
dated 1980, i.e. the residence does not meet the side setback requirements. The
proposed garage would not be affected by this non-conformity since it will not be
attached to the residence.
City Engineer:
The existing residence may be anon-conforming structure. It is not clear when it
was constructed.
Buildinq Official:
If this variance were approved, the building code would require applicant to
construct one-hour rated walls within three feet of the property line with no doors
or windows allowed in any wall less than three feet from the property line.
RECOMMENDATIONS
This request does not appear to fit the guidelines of KMC 14.20.180 11 ), (21, (4). I
would recommend that the applicant be required to maintain the minimum side
setback.

Applicant would like to rent his cabin on a short-term basis. The proposed use is
listed as a conditional use in the Land Use Table. Cabin rentals is defined as,
"...the renting out of one or more individual detached dwelling units or buildings to
provide overnight sleeping accommodations for a period of less than thirty (30)
consecutive days."
Due to recent concerns regarding septic systems in this area, the Commission
should consider recommending that commercial uses of property in this area show
proof of an approved septic system. This may be either DEC approval or an

KMC 14.20.150 details the intent and application process for conditional uses.
The code also specifies the criteria for conditional uses in all zones,
"Uses not specifically permitted in the zone concerned may be permitted
provided the following conditions are met:
[i] Such uses must be similar to principal uses permitted in the zone;
(ii] Such uses must be in harmony with the intent of the zone.
Applicant proposes to operate his drywall business from his residence. In addition
to parking his work vehicle at his residence, he will store materials on site, take
calls, and keep records at the residence.

Though not opposed to a garage being constructed on the Glonek
property, Lot 8, Block 6, Thompson Park Subdivision, we are
definitely opposed to any person(s) operating aconstruction-related
business in this residential subdivision.
The covenant of Thompson Park Subdivision was that commercial
lots were designated along the Kenai Spur Highway. Lots other
than along the highway were sold as residential. It is unfair to
property owners who bought lots for residential purposes to allow
variances to change this covenant.
The house on Lot 8, Block 6 was constructed during 1967 by Mr.
Ware.

Thank you for notifying me of the applications for variance and conditional use permits for property next
door to my property. I own the house commonly know as 4015 For Get Me Not. I have owned the house
since January 1986 and have made substantial improvements to it contributing to the general up-grade of the
neighborhood.
I must oppose a variance for a side vard setback which would allow the construction of a gazage or
storage building including the overhangs any closer than the authorized five feet for the following reasons:
1. The proposed set back area would not allow sufficient maneuvering room for the owner to properly
maintain the appearance of the backside of his building which he would not see but the rest of us
would.
2. T'he proposed set back may not be sufficient to allow snow to slide off the roof onto his property
but onto mine. The lesser distance between his building including any roof overhang would not allow
for the proper percolation of rain water but would run directly onto my lot. My gazage and house are
at or below grade.
Upon your issuance of a building permit for a gazage, please check the plans to assure for final grading
that will not allow snow melt or rain water to run onto my lot and flood my garage or crawl space. I have
no idea in what direction he plans to slope his roof.
The conditional use permit for a drywall business should not be allowed. But if it is it should not run
with the land forever but should be conditioned upon the following to protect the integrity of the intended
zoning use as residential:
1. The residence at all time continue to be the permanent and primary residence of the applicant or the
conditional use permit become null and void.
2. The words "tool and equipment storage" not be construed to mean a business apart from the drywall
business.
3. The to be built garage to look as a residential garage and not as a commercial building.
4. The commercial use of the property may not be conveyed or willed to a new owner of the property or
a new owner of the business including members of the family.
5. Normal business hours of 8 AM to SPM be adhered to. The use of noisy tools and equipment
including pressure washers and the prolonged running of trucks shall not be allowed.
6. All equipment pertaining to the business including equipment stored in the open carport shall be out of
sight from the street and adjoining residences including but not limited to trucks, vans, flat bed trailers,
ladders, scaffolding, hoists, fork lifts, buckets, lights, heaters, extension cords, propane bottles, sheet
rock, compressors, etc.
7. The applicant has removed our fence that separated our two driveways without our consent or prior
knowledge and he should be required to construct and maintain a new fence high enough that will

block our view of all his equipment and vehicles while parked in his driveway with the finished and
decorative side being on our side.
I commend the City of Kenai for encouraging its commercial growth and especially for offering great
incentives on land deals making it very attractive for businesses. There appears to be an abundance of
commercial and industrial property currently available. Some with existing vacant buildings and even
garages at reasonable prices.
The Thompson Park Subdivision is finally beginning to become attractive as a residential neighborhood
thanks in part to the extension of city water and sewer. It was necessary to leave our house unoccupied for
a couple of years due to unacceptable well water and septic system conditions. During those yeazs the
garage was not even used for storage. In my opinion it would be a shame to allow this type of business in a
neighborhood that is upgrading. I do not object to the home business concept, only to all the tools,
equipment and supplies that will be visible.

At the June 17~ City Council meeting, sites for a new Kenai Public Health Center
were considered. The Council agreed that the above referenced property would
be the most suitable of available City-owned land. The property is located on
Barnacle Street, between Country Foods Grocery and Kenai Dental Clinic.
In order to dedicate the property for the Health Center, the City Council needs to
pass an ordinance stating the property is needed for a public purpose. The deed
from the FAA states that revenues received from the lease or sale of the property
must be deposited in the Airport Land Sale Trust Fund. If the City wishes to use
the property for a General Fund purpose, the General Fund needs to compensate
the Airport Land System fair market value.
Please review the attached draft ordinance. Does the Planning and Zoning
Commission recommend City Council approve this ordinance?

WHEREAS, the Kenai Advisory Planning and Zoning Commission recommended the

SUBJECT: KMC 14.20.145 -RECREATION ZONE
There have been discussions at past Planning Commission meetings regarding the
Anglers Acres area and possibly rezoning this area to a recreation zone. Based on
this information, I have reviewed KMC 14.20.145.
This section of the code should have been reviewed when the Land Use Table was
changed. There is inconsistency under permitted uses in the zone and those
permitted in the Land Use Table. Specifically, the zone limits residential use to
single-family and duplex residences and the Land Use Table allows up to three
family dwellings. In addition, under Conditional Uses and Structures, Multi-family
units is listed. This appears unnecessary; a two orthree-family dwelling would be a
multi-family dwelling.
Is it the Commission's intent is to create a zone wherein Conditional Use Permits
would not be necessary for those uses currently seen in the Anglers Acres area?
Active permits include bed & breakfasts, cabin rentals, charters and guiding
services.
I am attaching a copy of KMC 14.20.145 for your review. Those areas that are
highlighted should be reviewed. Does the Commission may want to amend KMC
14.20.145 and the Land Use Table to make these uses permitted uses in the
Recreation Zone? If the Commission does not want to change permitted uses in the
zone; staff will proceed with an amendment to clear the inconsistencies between
KMC 14.20.145, the Land Use Table, and Development Requirements Table.
14.20.145 Recreation Zone (R): (a) Intent: The Recreation Zone (R) is intended to
contain both public and private lands to be utilized for recreation and residential purposes.
Lands designated for this district should be evaluated for long-term public benefits to accrue
from the protection offered by this designation.
(b) Permitted Principal Uses and Structures:
(1) Ball fields;
(2) Exercise trails and facilities;
(3) Parks and playgrounds;
(4) Picnic facilities;
(5) Recreation facilities, shelters, bathhouses;
(6) Recreation cabins:
Change to match Land Use Table.
(7) Single-family and duplex residences;
(8) Trails;
(9) Visual corridors and viewpoints;
(10) Watersheds.

As you directed on July 21, 1998, photos were taken at the above address on July
22" and August 24th. As you can see, the junk vehicle is still at the residence. I
continue to receive complaints about this vehicle. The latest complaint advised that
the resident is now storing garbage in the bed of the track. I am turning this

RESOLUTION 98-30
Vacating the thirty-three foot wide easements for public right-of-way and utility purposes within
the southerly 33 feet of Government Lot 24; within the northerly 33 feet of Government Lots 44
i and 45; except for the westerly 33 foot of the easement with the westerly 33 feet of said Lots 24
and 45; Section 34, Township 6 North, Range 11 West, Seward Meridian, Alaska; also within
the City of Kenai and the Kenai Recording District
WHEREAS, a request has been received to vacate the thirty-three foot wide easements for
public right-of-way and utility purposes within the southerly 33 feet of Government Lot 24; within
the northerly 33 feet of Government Lots 44 and 45; except for the westerly 33 foot of the
easement with the westerly 33 feet of said Lots 24 and 45; Section 34, Township 6 North, Range
11 1~Vest, Seward Meridian, Alaska; and
WHEREAS, on May 26, 1998, the Kenai Peninsula Borough Planning Commission
addressed all concerns about this proposed vacation; and
WHEREAS, on June 17, 1998, the Kenai City Council reviewed the vacation and had no
objections to the vacation; and
WHEREAS, the Planning Commission has found that vacating the above described public
easements will not be detrimental to the public interest; and
WHEREAS, 20.28.120 of the Kenai Peninsula Borough Code of Ordinances authorizes the
Planning Commission to accomplish vacations by Resolution.
NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF THE
KENAI PENINSULA BOROUGH:
Section 1. That the above described portions of the above described easements for public
right-of-way and utility purposes within Government Lot 24, 44, and 45, Section 34, Township 6
North, Range 11 West, Seward Meridian, Alaska are hereby vacated.
Section 2. That this resolution is eligible for recording after approval of the vacation; and
will be deemed void if not recorded within 90 days of adoption.
Section 3. That this resolution becomes effective upon being properly recorded; with
petitioner being responsible for payment of recording fees.
ADOPTED BY THE PLANNING COMMISSION OF THE KENAI PENINSULA BOROUGH
