ITEM 6: OLD BUSINESS -- None ITEM 7: PENDING ITEMS 7-a. Proposed Livestock Ordinance -Glick reported a work session was held prior to the March 15~ council meeting and it was decided the City Attorney and staff will develop various scenarios for the Commission to review. Kebschull indicated this could be available as soon as the next scheduled Planning and Zoning meeting. ITEM 8: CODE ENFORCEMENT -- None ITEM 9: REPORTS 9-a. City Council -- Bannock reported a Council meeting was held on March 15~. Prior to the regular meeting a work session was held with the Planning Commission regarding the livestock ordinance. During the regular meeting, Mayor Williams gave a report on the status of the gas pipeline. Bannock noted the Phillips Petroleum announcement of buying out ARCO would potentially give Kenai the advantage for the gas pipeline over Valdez. He also noted, the Forest Drive construction could begin as early as this calendar year. 9-b. Borough Planning -- Bryson reported the Borough Planning Commission met on Monday, March 13, 2000 and, referring to the information in the packet, reviewed the actions taken by the Commission. 9-c. Administration -- Kebschull announced a DOT workshop would be held on April 5, 2000 regarding the Spur Highway. The Public Works Manager would be attending the workshop and would have information available to those who would not be attending. The applicant wishes to enter into a new 5-year lease. He intends to continue to use the property to store trailer vans. The property is Airport Land and is within the airport flight path. It is a requirement of the Federal Aviation Administration that the lease include a clause stating that the City reserves the right to cancel the lease on 90 days notice. Prior to leasing the site an appraisal must be reviewed and approved by the Federal Aviation Administration. The Planning and Zoning Commission needs to determine if the intended use complies with the zoning ordinance and comprehensive plan of the City. Justice Ginsburg delivered the opinion of the court, which Justices Rehnquist, Stevens, O'Connor, Kennedy, Souter, and Breyer joined. Justices Scalia and Thomas dissented. In 1986, Laidlaw Environmental Services Inc. bought ahazardous-waste incinerator facility in Roebuck, S.C. The facility included a wastewater treat- ment plant. The South Carolina Department of Health and Environmental Control (DREG) granted Laidlaw a permit authorizing the company to dis- charge treated water into the North Tyger River. The permit limited the discharge of mercury, an extremely toxic pollutant. It also regulated the flow, temperature, toxicity, and pH of the treated water. Finally, it imposed monitoring and reporting obligations. After receiving its permit, Laidlaw repeatedly exceeded the permit's limita- tions. Despite several attempts to fix the situation, Laidlaw exceeded the permit's mercury limitations 4$9 times between 1987 and 1995. In 1992, Friends of the Earth (FOE) and Citizens Local Environmental Action Network Inc. (CLEAN) sent a letter to Laidlaw notifying it of their intention to sue. Laidlaw's attorney then contacted DHEC and asked if DHEC would con- sider suing Laidlaw, because a DHEC lawsuit would bar the proposed citizen suit. DHEC agreed to sue. Laidlaw's attorney Bien drafted a complaint and paid the filing fee. Shortly thereafter, DHEC and Laidlaw reached asettle- mentrequiring Laidlaw to pay $ l OQ,000 and attempt to comply with the permit obligations. FOE sued Laidlaw, alleging noncompliance with the pernut. Laidlaw asked the court for judgment without a trial, arguing FOE could not show it had been injured and had na standing to sue. 57820507 Page 2 -Special Report Supreme Court Decision The court awarded judgment to FOE, fmding FOE had standing "by the very slimmest of margins." The court also ruled FOE's lawsuit was not blocked by the DHEC lawsuit, since the DHEC lawsuit was not diligently prosecuted. Fi- nally, the court assessed a civil penalty of $405,800. " ~A] threat has no deterrent value unless it is credible that it will be carried out.., land] it is reasonable for Congress to conclude that an actual award of civil penalties does in fact bring with it a significant quantum of deterrence over. and above what is achieved by the mere prospect of such penalties. Awould-be polluter may or may not be dissuaded by the existence o, f a remedy on the books; but a defendant once hit in its pocketbook will surely think twice be, fore polluting again." Laidlaw appealed. The court of appeals reversed and dismissed FOE's lawsuit because "the only remedy cur- rently available to [FOE] -~--civil penalties payable to the government -would not redress any injury [FOE had] suffered." The case was then heard by the Supreme Court. The Supreme Court found FOE's lawsuit was similar to other environmental cases where there was evidence of injury if the person suing used the affected area and the aesthetic and recreational values of the area would be lessened by the polluter's activity. For example, the desire to use or observe an animal species, even for purely aesthetic purposes, was undeniably an interest for the purposes of standing. However, Laidlaw argued even if FOE had standing to stop the permit violations, it could not seek civil mon- etary penalties because these penalties could only be paid to the federal government. Congress stated civil penalties in Clean Water Act cases do more than force immediate compliance by making it expensive to pollute, they deter future violations. When imposing civil penalties, courts should consider retribu- tion and deterrence, as well as restitution. To those injured or threatened by pollution, civil penal- ties abate and prevent its reoccurrence. To the extent civil penalties encourage polluters to discontinue viola- tions and avoid comtnitting new ones, they redress citi- zens who were injured as a consequence of the polluter's conduct. Additionally, several other FOE and CLEAN members testified pollution con- cerns kept them from using the area downstream of the facility. Finally, some members claimed property values were depressed by the facility's pollution. The civil penalties sought by FOE carried with them a deterrent effect that made it IikeIy, as opposed to merely possible, the penalties would redress FOE's injuries by stopping current violations and preventing future ones. WHEREAS, the keeping of livestock on small lots within the City of Kenai creates sanitary, hygiene and odor problems; and WHEREAS, the keeping of livestock on small lots within the City of Kenai in some instances reduces nearby property values; and WHEREAS, restricting the keeping of livestock to lots of adequate size will reduce such problems; and WHEREAS, it is in the best interest of the City of Kenai to restrict the keeping of livestock within the City limits. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA, THAT KMC 3.10.070 is enacted as follows: 3.10.070 Livestock within the city limits: (a] Except as otherwise provided in subsection (b] below, no person shall keep or maintain livestock with the City of Kenai. (b) Livestock may be kept on Option I lots of square feet or greater in the Option I.1 zoae~s). Option 1.2. On lots coataiaiag two-family or multiple-family dwelliag units, no livestock shall be allowed on lout containing less thaw Option 1.3 square feet per dwelliag unit. Option 2: lots of square feet or greater. On lots containing two-family or multiple family dwelling units, no livestock shall be allowed on lots containing less than Option 2.1 square feet per dwelling unit. Option 2.2 No livestock shall be allowed is the zone(s). (c) In this section "livestock" is defined as ... (See "Attachment A" for list of animals to select far iaclusioa.) (d~ (1) Option I: Earceyt for the zoae~~, the Chief Animal Control Officer may issue temporary permits of not more than fourteen (14) days for the keeping of livestock not otherwise allowed for public exhibitions or entertainment events. The Chief Animal Control Officer Ordinance No. -2000 Page 2 of 3 may impose conditions on the permits as reasonably necessary for sanitation, safety, or hygiene. The permit may be revoked for a violation of the conditions of the permit or pertinent section of the Kenai Municipal Code. The City Manager may set a permit fee as set out in KMC 7.15.100. (d)(2) Option 1: >~ccept in the zone(s), Option I.I the Chief Animal Control Officer may, after notifying adjoining property owners in writing and allowing reasonable time for comment, issue a permit for the keeping of livestock for educational or youth activities, such as 4-H, Future Farmers of America, or Boy/Girl Scouts oa lots not otherwise eligible under this ordinance. The permit shall state the duration of the permit, which shall not exceed Option Y .2 years, and the type and number of livestock to be kept. The Chief Animal Control Officer may impose conditions on the permits as reasonably necessary for sanitation, safety, or hygiene. The permit may be revoked for a violation of the conditions or the permit or Title 3 of the Kenai Municipal Code. Appeal of issuance or revocation of a permit may be made in writing to the Board of Ad;~ustment. A permit may be renewed foIIowing written notice and reasonable time for comment to the adjoining property owners. The City Manager may set a permit fee as set out in KMC 7.15.100. (d) (3) No variances other than set aut in (d) (I) and (d] (2) above shall be allowed. (e) Lots on which livestock are kept on the effective date of this ordinance which are not eligible for the keeping of livestock under this ordinance shall be considered anon-conforming use of land under KMC 14.20.050. (f~ Corrals, pens, hutches, coops or other animal containment structures must be a minimum of Option Y feet from the property's side yards and Option 2 feet from the front and back yards and must be secure and in good repair.
