Kebschull noted that she had provided the Commission with a copy of the zoning permit for Inlet View Subdivision because they would probably receive more applications for this in the future. MOTION Nord recommended approval of PZ00-11. Goecke SECONDED. It was noted that the applicant was present if there were any questions. Kebschull noted that she had received one letter which is included in the packet which is against this application; and telephone calls from Mr. Chin, Ron Rainey, and Dawn and Steve Riddle who recommended approval of this permit. Kebschull also noted she had done a report that showed other permits that had been issued in this area. It was asked by Bryson what the praxixnity of the lots were to the property under discussion of the persons making recommendations. Kebschull gave this information. PZ00-12-An application for a Variance Permit for principal structures for the property described as Lot 4, Block 2, Anglers Acres Addition No. I, 1350 Angler Drive, Kenai, Alaska. MOTION Goecke recommended approval of PZ00-12 with approval of a septic tank by DEC prior to issuing the Variance Permit. Jackman SECONDED. There was no one in the public wishing to speak to this item. Kebschull noted that it was the City's recommendation that prior to this permit being issued that they have an approved septic tank by DEC. She explained that their concern was that because they are issuing special use permits in this area, they may be looking at a use that is not typical and they want to be sure that DEC standards are met. Goecke asked if it was the Planning 8v Zoning Commission's responsibility to concern itself with well and septic issues and this was discussed. Bannock gave information on the last time this issue came up in this neighborhood which concerned a much larger sized property and multiple units; therefore the City and the Commission felt this was a compelling reason to have prior DEC approval. Bryson also gave his recollection of the property noted by Bannock. It was agreed to add approval of the septic tank by DEC before issuing the Variance Permit. PZ00-13 A resolution of the Planning and Zoning Commission of the City of Kenai, Alaska, recommending the Kenai Municipal Code at 1.61 be enacted to create the Kenai Historic Commission. MOTION PLANNING & ZONING COMMISSION MEETING MAY 24, 2000 PAGE 3 Bryson recommended approval of PZ00-13. Goecke SECONDED. There was no one in the public wishing to speak to this item. Kebschull clarified that PZ00-13 is to create a Historic Commission in Title l which was the decision of Council feeling that it might be more appropriate to place the citizens in that Commission under Title 1 and move same of their current responsibilities to the Planning Commission. Bryson commented on the number of members in the Historic Commission who were designated to be residents of the City and this was discussed. PZOO-I4-A resolution of the Planning and Zoning Commission of the City of Kenai, Alaska, recorin,mending that KMC 14.20.105 be amended to eliminate the Townsite Historic District Board (TSH) and transfer some of its duties to the Planning and Zoning Commission. MOTION Erwin recommended approval of PZ00-14. Nord SECONDED. There was no one in the public wishing to speak to this item. Kebschull noted that any input from the Historic Commission would be brought to the Planning and Zoning Commission far final approval and she would receive the requirements needed to maintain a certified local government from the Historic Board and bring them to the Commission. The code also specifies the review criteria that must be satisfied prior to issuing the permit. The criteria are: 1. The use is consistent with the purpose of this chapter and the purposes and intent of the zoning district; 2. The value of the adjoining property and neighborhood will not be significantly impaired; 3. The proposed use is in harmony with the Comprehensive Plan; 4. Public services and facilities are adequate to serve the proposed use; 5. The proposed use will not be harmful to the public safety, health or welfare; PZ00-15 Comments Page 2 6. Any and ali specific conditions deemed necessary by the commission to fulfill the above-mentioned conditions should be met by the applicant. These may include, but are not limited to measures relative to access, screening, site development, building design, operation of the use and other similar aspects related to the proposed use. Applicant proposes to build dwellings on these lots and intends to rent them far short-term and long-term use. Long-term use f30 days or more} is not regulated by the municipal code. The Land Use Table requires a Conditional Use Permit for cabin rentals. Cabin rentals are defined as, "the renting of one or more individual, detached dwellings units or buildings to provide overnight sleeping accommodations for a period of less than thirty S30} consecutive days. The plan is to build two structures, containing two dwelling units each, on both of these lots. Applicant is applying for a variance for principal structures. (See PZ00-16.} A sketch is attached showing the proposed layout of the structures. To accommodate the required parking, applicant plans to create parking on Lot 3 far the units on both lots. The parking area will be located on the south side of the lot along Clifford Avenue. The trees will be undisturbed along Highbush Lane with the exception that those trees necessary to allow access along the corner of Clifford Avenue and Highbush Lane will be removed. Applicant believes this will allow space for ten vehicles. KMC 14.20.250 (3} allows parking far a main use to be located on an adjoining lot. Structures will be served by city water and sewer. Applicant is applying for a Condi#ional Use Permit for both lots; however, will begin construction on Lot 2 and plans to begin the use on that fat this year. Applicant is aware that the permit will lapse twelve (12} months after approval if no building permit is procured or if the allowed use is not initiated. The Code also outlines the review criteria that should be used by the Planning and Zoning Commission to determine if a variance should be granted. The Commission shall establish a finding that all of the following conditions exist as a prerequisite to issuance of a variance permit: 1. Special conditions or circumstances are present which are peculiar to the land or structures involved which are not applicable to other lands or structures in the same zoning district. 2. The special conditions or circumstances have not been caused by actions of the applicant and such conditions and circumstances do not merely constitute a pecuniary hardship or inconvenience. 3. The granting of the variance shat! not authorize a use that is not a permitted principal use in the zoning district in which the PZ40-16 Comments Page 2 property is located. 4. The granting of a variance shall be the minimum variance that will provide for the reasonable use of the land andlor structure. 5. The granting of a variance shall not be based upon other non- conforming land uses or structures within the same land use or zoning district. This application is for a Variance Permit from the Development Requirements Table for Principal Structures. The Land Use Table requires 7200 square feet for a one, two, or three family dwelling in the suburban residential zone. tone structure containing up to three dwelling units.} Lot 2 is approximately 7946 square feet and Lot 3 is 10,596 square feet. The applicant proposes to build two structures on each lot. each structure will contain two dwelling units. Based on the Development Requirements Table, Lot 2 would accommodate a structure containing three dwelling units and Lot 3 would accommodate a structure containing four dwelling units. Based on the proposed plan, Lot 2 would require a variance for the fourth dwelling unit. Lot 3 could accommodate the four dwelling units if they were in one structure or the buildings were attached to meet the building code requirements. The applicant has been advised of these requirements and wishes to apply for a variance for both lots. The proposed structures will meet all other requirements of the Development Requirements Table tsetbacks, lot coverage, and height}. Applicant is applying for a variance at this time for both lots; however, may not begin development of Lot 3 until summer 2001. Applicant has been informed that the Variance Permit will lapse twelve (12} months from date of approval if the variance has not been implements. Even though construction in a residential zone does not require a iandscapelsite plan, the applicant has provided a site plan that satis#ies the code requirements for a site plan. The plan provides for sufficient parking, snow removal landscaping (grass), and setback requirements. The rear of the lot will be left with existing trees and natural vegetation. Because of the type of business, it is unlikely that increased traffic would be a concern. This lot is near the general commercial zone in the Thompson Park area. Please consider our comments and concerns as part of the official record. We have a number of questions related to a construction business at the named site. The "detailed description" on the Conditional Use Permit Application hardly gives even a brief description of the proposed business. Among our concerns are the following: 1. Is there going to be maintenance of construction vehicles with associated oil, diesel, and gasoline handling? 2. How is it that this business meets Rural Residential designation? We admit to our ignorance on this point, but a construction business certainly seems other than residential. 3. We cannot imagine property values not being affected by commercial structures of this type so dose to the homes in this area. 4. The noise level in our area has increased considerabl~r as traffic levels have increased. The proposed commercial enterprise will certainly add more than its share of noise as the large vehicles accelerate and use engine braking. 5. Diesel fumes cause one of us to become physically i!!. In light of new revelations on the hazards of diesel fumes, can we be assured there will be no significant increase? fi. A very major concern is the nearly direct drainage of this property into the Kenai River. Fuel tanks leak. Fluids spill. Every spring the drainage from the wetlands on or near this parcel runs directly through the culvert under the Spur Rd. and into the Kenai River. 7. We have recently seen the construction of a convenience store, a storage cache, and an electrical business in our supposedly residential neighborhood, This proposed commercial business is an escalation of the non- residential conversion of our area. At the risk of casting aspersions on our neighboring community, how many times have you heard people say they would not move to the "North Road" because of the clutter, noise, and general industrial feel of the area. This gets back to property values. We believe it is wise to curtail the semi-industrial use of the land in this area. We were advised of this situation by a concerned property owner (we were not notified by the city, probably because we are not within 300 feet of the property in question). The lots in the Townsite Historic zone vary in size and shape. This lot is 40` by 75'. The setbacks in this zone are ten feet front and rear and five feet side. Applicant seeks asix-foot variance from the front and rear setbacks. Lot coverage allowed is forty percent {40%1. The proposed structure would cover fifty percent {50%) of the lot. City Engineer: None. Building Official: The building code would not require any special construction if the building is at feast three feet {3'y from the property line. RECOMMENDATIONS It appears that the applicant's proposal would alleviate current encroachments. It has come to our attention that there is extreme public concern regarding this application. It should be noted that the intended use of this property is for warehouse and office space for a low traffic construction company. Our company is in the construction industry with respect to residential and light commercial construction. We do not now nor do we plan in the future to possess any type of heavy equipment which would result in extensive noise, smoke, fumes, or petroleum related leaks. Additionally this proposed building is intended only for storage of weather sensitive building material and office space. There is no intent either now or in the future to conduct any type of actual construction on site beyond the construction of the building itself. The proposed structure is designed to be appealing in appearance and situated on the property with the intent of complementing the surrounding environment. While it is true that a stream runs across the rear portion of the property, the proposed site plan would leave that area untouched and the existing vegetation left intact. The current public concern has in turn caused concern for ourselves. It is our intent to blend with and be accepted by our surrounding neighbors. With the current intensity of public concern, as exaggerated as it may be, we wish to withdraw our application for the Conditional Use Permit. In an effort to foster better public relations we will abandon our plans to initiate any type of commercial activity on this property.
