CHAIRMAN CARL GLICK PRESIDING MINUTES ITEM 1: CALL TO ORDER Chairman Glick called the meeting to order at 7:00 p.m. 1-a. Roll Call Members Present: Carl, Glick, Phil Bryson, Ron Goecke, Barb Nord, Donald Erwin, Arny Jackman Members Absent: Don Gough Others Present: Building Inspector Bob Springer, Administrative Assistant Marilyn Kebschull, Contract Secretary Barb Roper 1-b. Agenda Approval Chairman Glick announced Item 4-d would be removed from the agenda since the application was withdrawn by the property owner. A letter was provided explaining the reason. MOTION: Commissioner Bryson MOVED to approve the agenda adding the items provided prior to the meeting and with the deletion of Item 4.d. and requested UNANIMOUS CONSENT. The motion was SECONDED by Commissioner Goecke. There were no objections. SO ORDERED. 1-c. Approval of Minutes: May 24, 2000 MOTION: Commissioner Erwin MOVED to approve the minutes of May 24, 2000 and requested UNANIMOUS CONSENT. The motion was SECONDED by Commissioner Jackman. There were no objections. SO ORDERED. The minutes were approved as written. 1-d. PZ00-15-An application for a Conditional Use Permit for cabin remtals for the properties known as Lot 2 and Lot 3 of Clifford Subdivision (704 and 702 Highbush Lane), Kenai, Alaska. Application Submitted by Glenn Clifford dba PSsG Enterprise, P.O. Bow 245, Kenai, Alaska. MOTION: Commissioner Nord MOVED to approve PZ00-15 and the motion was SECONDED by Gornmissioner Jackman. There was no public comment. Kebschull indicated staff had nothing additional but pointed out the applicant was present should there be any questions. Glick announced the Commission received an objection letter regarding the project. Bryson expressed concern the cabins would create a substandard Iot size. Goecke asked if the City Engineer's comment in the application would address Bryson's concern. Bryson indicated it did not since it does not formally address the very small lot size. Bryson added, a 4,000 sq. ft. lot is not desirable. Glick turned the gavel over to Vice Chair Bryson in order to make comment. Glick reported that he lived in the area and many of the neighbors could not be present so he would speak on their behalf as well. Glick indicated he and the neighbors were concerned with a small motel-like business going into the neighborhood and the increased traffic it would bring. Glick announced he would be voting against the application. Vice Chair Bryson turned the gavel back over the Glick. Goecke stated he would abstain from voting on Items 4.a. and 4.b as the applicant was a close personal friend. Bryson asked the applicant where the existing structure was located. The applicant replied it was on Lot 1 and confirmed that the trailer was still there. Bryson asked if the pad was on Lot 3 and the applicant confirmed it was. Bryson asked if Lot 2 was cleared and the applicant confirmed it had been. The appeal has to be in writing to the City Clerk. 4-b. PZ00-1fi - An application for a Variance Permit for principal structures for the properties known as Lot 2 and Lot 3 of Clifford Subdivision (704 and 702 Highbush Lane, Kenai, Alaska. Application submitted by Glenn Clifford d.b.a. P8aG Enterprise, P.O. Box 245, Kenai, Alaska. MOTION: Commissioner Erwin MOVED to approve PZ00-16 and the motion was SECONDED by Commissioner Jackman. Dale Bondurant, Kenai, Alaska - Bondurant stated he lived in the area and didn't understand what the Commission was doing with this application. Glick explained the application. Bondurant stated the trailer in the area was on the right-of--way. Glick reminded Bondurant the trailer was not pertinent to the issue at hand. Public Hearing closed. Kebschull stated staff had nothing additional. Bryson again expressed concern with several structures being on very small lots. There were no public comments and the public hearing was closed. Kebschull stated staff had nothing additional and reported the applicant was present should there be any questions. Erwin announced he would abstain from voting since the applicant was a close personal friend. Bryson asked staff about the encroachment. The applicant explained the dimensions of the structure. Public Hearing Opened. PLANNING & ZONING COMMISSION MEETING MINUTES JUNE 14, 2000 PAGE 4 Michael Huhndorf, Kenai, Alaska -Huhndorf explained he is the Chairman of the Historic District Board and the issue was discussed with the two other HDB members present. Huhndorf indicated there was concern about the modern architecture of the proposed building and recommended the applicant consider a siding that would keep with the traditional appearance of Old Town. Don Petroze, 509 Overland Drive, Kenai, Alaska -Petroze announced he was the applicant and that he submitted the application packet prior to meeting with Huhndorf. Petroze indicated the profile of the structure was taken from a magazine just to have something to present to the Commission. Petroze indicated he was willing to work with the City to put a new structure in that would be allowed and in line with the Historic Zone. Bryson asked if the existing structure encroached on any right-of--ways and Petroze answered it did not. Public Hearing closed. Kebschull reported staff had met with the applicant in an effort to came up with a structure that would fit on the nonconforming lot size. Bryson stated Old Town was famous for the small lot sizes and it was noted the applicant was attempting to make the best out of a poor situation. Bryson indicated his support of the project but was not comfortable with determining the type of architecture of the structure. Glick handed the gavel over to Vice Chair Bryson in order to make comment. Glick stated this was a case where a variance was justified and he would like to see it approved. Glick stated the siding should be historic in nature. Bryson turned the gavel back over to Glick. Nard indicated she would be voting in favor of the motion as any building would be an improvement over the existing structure regardless of the type of siding. Goecke agreed with Nord and noted cedar siding would probably make the building look more modern. PLANNING 8v ZONING COMMISSION MEETING MINUTES JUNE 14, 2000 PAGE 5 ITEM 5: OLD BUSINESS -- None ITEM 6: NEW BUSINESS 6-a. Developanc~,ent in Townsite Historic Zone Review - 509 Overland Drive This issue was dealt with at Item 4.e. ITEM 7: ITEM 8: ITEM 9: -- None CODE ENFORCEMENT -- None REPORTS 9-a. City Council -Bannock noted a City Council meeting was held on June 7 and the City budget for the next year was passed. Bannock noted there would be no tax rate increases. Bannock also noted there would be two items of interest to the Planning 8v Zoning Commission before council at their June 21 meeting and indicated they were the proposed livestock ordinance and the Historic District Commission. Bannock announced the airport landing fees were increased but Kenai still has the lowest rate in the State. 9-b. Borough Planning -- Bryson reported the Borough Planning Commission met on Monday, June 12, 2000 and gave a brief outline of items discussed and/or voted upon. 9-c. Administration -- No report. ITEM 10: PERSONS PRESENT NOT SCHEDULED 10-a. Joseph Frank indicated he had been scheduled to speak on behalf of the item which was removed from the public hearing at the request of the applicant. Frank thought that individuals living in the surrounding areas needed more time to respond to any proposed construction. Frank noted, if he were on vacation he would have missed his opportunity to speak. Frank also stated he thought a better description of where properties are is needed, as a lot of people don't understand where Lot 13, Block 10 is and suggested topography be considered and the City should look at how the land lays. PLANNING & ZONING COMMISSION MEETING MINUTES JUNE 14, 2000 PAGE 6 Frank stated he pays top dollar for commercial property and others should do so as well rather than buy cheap residential property and then try to change it to commercial afterwards. Frank added, one word in the application stood out and that was "significantly." Frank said he looked it up in the New World Dictionary anal the third definition said "hidden meaning." He suggested astep-by-step procedure should be outlined which would let people know where to go to deal with situations such as this. Frank indicated he had to do all the footwork for the applicant before they withdrew their application. Frank added, the process was very rough on him and his family and they were very grateful the applicant withdrew his application. Phil Draheim, Kenai, Alaska -Expressed his concern with the application for cabins to go into the area where he lives. He indicated he wasn't sure what the outcome was but wanted to go on record stating the cabins in this residential area would change the character of the neighborhood. Draheim noted he did not receive notice and thought that residents within 300 yards should be notified. Glick informed Draheixn the application failed but the applicant had the right to appeal. Kebschull confirmed the notices are sent out to residences within 300 feet. ITEM 1 ],; INFORMATION ITEMS ITEM 12: COMMISSION COMMENTS ~s QUESTIONS Commissioner Bryson announced he would not be present at the next meeting. Commissioner Goecke stated it was possible he may not be at the next meeting as well. Goecke asked if staff would check with Alaska Roadbuilders and ask them why they ran the driveway at 410 Lawton to the street instead of to the curb. Building Official Springer stated he thought the Public Works Manager had already met with them regarding the problem. It was noted the action could cause drainage problems. Councilwoman Porter amended the ordinance to allow livestock on lots of 1 %Z acres or larger. Council approved this amendment. In Section 3.10.070 (b), Administration believes the intent was to delete the section regarding multiple family dwelling units, as it is contrary to the minimum lot size of 1 '/~ acres. There was discussion on whether a Conditional Use Permit was allowed. It was noted, as written, permits would not be allowed. Council asked that a provision for Conditional Use Permits be added to the Ordinance. Council also asked that the Ordinance provide a provision (if enacted) that the Ordinance be reviewed by Council in twenty-four {24) months. Council tabled Ordinance No. 1864-2000 and asked that it be sent back to you for further review and discussion. Attached is a draft ordinance that was madif ed to include these two suggested changes. In addition to these modif cations, it was questioned if there should be a specific number of livestock allowed dependent upon type ar~d land available for the livestock. The City Attorney, Animal Control Officer and I have discussed the difficulties in determining how much land is appropriate for each type of livestock listed. The Animal Control Officer commented he felt each case should be viewed individually for sanitary conditions, etc. based on the type of care received and the facilities available for the livestock. DOES THE COMMISSION WISH TO SCHEDULE A WORK SESSION TO DISCUSS COUNCIL'S CONCERNS? Suggested by: Planning & Zoning Commission CITY OF KENAI ORDINANCE NO. 1864-2000 AN ORDINANCE OF THE COUNCIL OF THE CITY OF KENAI, ALASKA, PROHIBITING THE KEEPING OF LIVESTOCK ON CERTAIN LOTS WITHIN THE CITY OF KENAI. WHEREAS, the keeping of livestock on small lots within the City of Kenai creates sanitary, hygiene and odor problems; and WHEREAS, the keeping of livestock on small lots within the City of Kenai in some instances reduces nearby property values; anal WHEREAS, restricting the keeping of livestock to lots of adequate size will reduce such problems; and WHEREAS, it is in the best interest of the City of Kenai to restrict the keeping of livestock within the City limits. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA, THAT KMC 3.10.070 is enacted as follows: 3.10.070 Livestock within the city,limits, (a) Except as otherwise provided in this section, no person shall keep or maintain livestock within the City of Kenai. (bJ Livestock may be kept on lots of 11/a acres or greater. On lots containing two-family or multiple family dwelling units, no livestock shall be allowed on lots containing Less than 18,000 square feet per dwelling unit. No livestock shall be allowed in the RU, RS 1, RS2 or TSH zones. Animals raised for afar-bearing purpose are not allowed in any zone. (c) In this section "livestock" is defined as the following animals: 1. Cow 9. Mule 2. Horse 10. Donkey 3. American bison 11. Ratite 4. Llama 12. Duck 5. Alpaca 13. Goose 6. Sheep 14. Chicken 7. Swine 15.Turkey 8. Goat (d] (1 ] Except for the RS 1, RS2, RU, TSH zone(s) , the Chief Animal Control Officer may issue temporary permits of not more than Ordinance No. 1$64 -2000 Page 2 of 2 fourteen (14) days for the keeping of livestock not otherwise allowed for public exhibitions or entertainment events. The Chief Animal Control Officer may impose conditions an the permits as reasonably necessary for sanitation, safety, or hygiene. The permit may be revoked for a violation of the conditions of the permit or pertinent section of the Kenai Municipal Code. The City Manager may set a permit fee as set out in KMC 7.15.100. (d)(2) Except in the RU zone, the Chief Animal Control Officer may, . after notifying adjoining property owners in writing and allowing reasonable time for comment, issue a permit for the keeping of livestock for educational or youth activities, such as 4-H, Future Farmers . of America, or Boy/ Girl Scouts on lots not otherwise eligible under this ordinance. The permit shall state the duration of the permit, which shall not exceed two (2) years, and the type and number of livestock to be kept. The Chief Animal Control Officer may impose conditions on the permits as reasonably necessary for sanitation, safety, or hygiene. The permit may be revoked for a violation of the conditions of the permit or Title 3 of the Kenai Municipal Code. Appeal of issuance or revocation of a permit may be made in writing to the Board of Adjustment. A permit may be renewed following written notice and reasonable time for comment to the adjoining property owners. The City Manager may set a permit fee as set out in KMC 7.15.100. (d~(3) If two or more lots of continuous frontage are awned or leased by the same person(s) and the combined square footage of such lots otherwise meets the requirements of this ordinance for the keeping of livestock, such lots shall be considered a single lot for purposes of this ordinance. (e) Lots on which livestock are kept on the effective date of this ordinance which are not eligible for the keeping of livestock under this ordinance shall be considered anon-conforming use of land under KMC 14.20.050. No new or replacement livestock may be kept or introduced on such lots after the effective date of this ordinance. (f) Corrals, pens, hutches, coops or other animal containment structures must have a minimum setback of twenty-fve (25) feet from the property's side yards, fifty (50) feet frarn the front yard, and ten (i0) feet from the back yard; and must be secure and in good repair. (g) A person seeking relief from the provisions of this section may apply for a conditional use permit under KMC 14.20.150. {h) This ordinance will come back to the City Council for review 24 months after the effective date. Commissioner Bannock asked if the drawing were for an existing structure. KENAI PLANNING & ZONING COMMISSION August 9, 1989 3 Mr. Thayer: No. There are existing structures as you can see from the pictures. There is a storage shed, covered patio for the patio and fire place, a fish smoker, and ali are easily moved. There are two Airstream trailers and one pickup type camper. The first Airstream has been there about 10 years. I could have them out of there in a day. I guided the river for five years and quit because of the demands of my job. I will be changing jobs in two to three years and at that time I intend to build . the structure. Chairman Nault: Isn't there a provision in the code regarding expiration of a permit if it isn't used. Answer yes. Mr. Thayer: "I'll be the first to admit that we have lots of guests at the lot. When it comes time to go back into business again, that comes to an end. Paying customers and guests do not mix. The conditions that the neighbors mention do exist. However, I don't think there's anything in there that says that they encroach on the other properties and I'm pretty careful to~tell them where the boundaries are. We run Thayer Recreation and its river charters in other areas. The Tesoro Oil Company started fishing with me in 1978. When I quit guiding, they wanted to continued to keep coming to the lot for two weekends each year and we serve them a family style meal, they drive their own rented campers down from Anchorage and we take care of their fish because we have a freezer there. They hire other guides that either pick them up at the lot or drive up to Poachers Cove for guides. I've done that every year since T've quit guiding, but I've not had those people in the boat. I'm not registered to guide but I have kept my Coast Guard registration. Commissioner Bannock: What immediate effects is this permit going to be used for. Are you wanting to go back into the charter service immediately? Obviously the bed & breakfast isn't going to happen for a couple years. Mr. Thayer: That's true. Commissioner Bannock: How about the charter service, when is that going to happen. Mr. Thayer: It could happen on a limited basis before I retire, but I would not foresee that happening for two years. Commissioner Bannock: Why are you asking for this permit now. Mr. Thayer: It will allow me to plan for what I'm going to do when I'm ready. Without the permit and knowing I can do it. Commissioner Bannock: You mentioned that there is a trailer there. With the Riddles the trailers were a major issue. Can you give us a brief history and your plan for the trailers, are they going to live there forever. Mr. Thayer: I would like to keep the trailers there until the permanent structure is built which gives me a place to live as I work on the structure. Commissioner Bannock: Do you take these trailers home in the fall? Answer no. Commissioner Bannock: How long have they been there. Answer: one far ZO years, the other two far six ar seven years. Commissioner Bannock: You want to keep one or two of them until you build the house? Answer yes. Commissioner Bannock: Is there going to be anything else built in regards to the charter service or are there plans for that in this floor plan? Mr. Thayer: I don't plan on any other structures. There is a storage shed and a covered patio I would like to keep. The trailers would go as the built became habitable. -~. t KENAI PLANNING & ZONING COMMISSION August 9, 1989 4 Councilman Smalley: Did I hear you say the trailer houses are not going to be used for the business at all. Answer no, and they have not been since I quit guiding. Commissioner Brown: So you would not operate a bed & breakfast until you build the structure. Answer yes. Mr. Thayer: One letter mentioned sewage, we have rented a Porto Potty every year since 1978. Commissioner Bryson: Do you have a well? Answer yes. Commissioner Bryson: How about gray water disposal? Answer: Only the Porto Potty. Councilman Smalley: Could something like this be conditioned upon something like the business would not be allowed to operate until the structure is completed. Mr. Thayer: I would agree to that. Councilman Smalley: He has a year and he could come back and request an extension. And that would seem to answer to the concerns of those that are there according to the letters. Chairman Nault: I agree. The opposition seems to be operating out of the trailers and temporary structures. Mr. Thayer: That's what I see in bath letters and there is some concern about running a business and having guests at the same time. And I agree, we did it before. Commissioner Glick: We've approved charter services and bed & breakfasts and in all those cases the structures were already in place and the businesses running. Discussion followed regarding the expiration of the permit. Commissioner Bannock: I still have a problem with the trailers. From all the heat that we've received on that street, there's a common denominator and that's trailers. I would want to encourage Mr. Thayer to, as quickly as possible remove them. I have no problem with his bed & breakfast and charter service. But I am concerned about the time period and the time we're going to have those sitting around. That's what his neighbors are complaining about. Chairman Nault: I think they're complaining about him operating a business out of those trailers. Commissioner Bannock: Because they're confused about that just as they were probably confused about the Riddles when they thought they were going to put in a fifty unit trailers park. Chairman Nault: Unless I'm wrong, the issue about the Riddles was that they were intending to operate the bed & breakfast out of those trailers and that was the Abjection and the problem with the code. Commissioner Bannock: I think the Simpsons made a valid paint in their letter regarding the trailers. I really don't know if issuing a permit at this time is appropriate. I like the idea of the amendment that no business be conducted until there is a structure but I don't know that that solves my problem. If we were to pretend the trailers weren't there and Mr. Thayer had just purchased his lot and was going to build his structure however he wanted to do it within a year and begin his business, than that would be easy. -~. Commissioner Bannock: Except we aren't issuing a bed & breakfast for this facility, we're issuing it for the lat. That means I can drive my Winnebego dawn there and if I have a permit I can run the business out of it. Councilman Smalley: By next fishing season I would imagine because that is where you take you most heat from your neighbors. You know trailer houses can be very nice but they're still trailer houses. Mr. Thayer: Those trailer houses are fairly well screened from the neighbors and you cannot see them from Angler Drive. Before you couldn't see them from the river, but the trees are thinning.
