ITEM 1: CALL TO ORDER
Chairman Carl Glick called the meeting to order at 7:00 p.m.

1-b. Agenda Approval
MOTION:
Commissioner Bryson MOVED to approve the amended agenda to include the items
provided prior to the meeting and asked for UNANIMOUS CONSENT. Commissioner
Morse SECONDED the motion. There were no objections. SO ORDERED.
1-c. Approval of Minutes: August 9, 2000
MOTION:
Commissioner Nord MOVED to approve the minutes of August 9, 2000 and requested
UNANIMOUS CONSENT. Commissioner Morse SECONDED the motion. There were
no additions, corrections or objections. SO ORDERED.

6-a. Draft Ordinance amending KMC 12.25.030 Leaving of,~unked or illegally
parked vehicles--Discussion
Kebschull indicated the reason for adding the statement 'to obscure "junked vehicles"
from public view' was an effort to work with the public. Bryson thought the term
"public view" needed more clarification; for instance, is the adjacent neighbor
considered public view. Kebschull stated the ordinance would be scheduled for public
hearing at the next meeting and she would get a clarification from the attorney
regarding the "public view" term.
Nord asked if covering a vehicle with a blue tarp or storing it within a van is
considered obscuring from public view. Kebschull replied the legal opinion is if it is
covered the City cannot verify that it is indeed a junked vehicle so it is possible to have
it covered with a tarp or stored in a van. Kebschull continued, it is a difficult situation
as the City does not enter a property to determine whether a vehicle is junked or not.
If a complaint is made, the Building Official will go by the property and take
photographs from the street rather than enter the property.
When asked far his opinion on the issue, Councilman Bannock thought perhaps the
term "screening" would be a better term.
After further discussion Kebschull noted the Public Works Director would meet with
the Mat-Su Valley staff to determine how they handle junked vehicles. Kebschull will
take the Commission's comments back to the City Attorney for clarification and will
report on the outcome of the meeting in the Valley at the next meeting.

MOTION:
Commissioner Jackman MOVED to approve PZ00-30 and Commissioner Nord
SECONDED the motion.
Kebschull noted the application was straight forward, however staff recommended that
if a dumpster is required, that it be screened. Councilman Bannock noted that
currently, a dumpster was not in the plans but if it were added at a later date, they
would comply with City requirements.
Commissioner Jackman asked where the vehicles would be placed on the lot.
Councilman Bannock explained the drawing and indicated the vehicles would be
displayed and situated in various locations.
Commissioner Bryson abstained from voting on the issue as his firm was working on
the project.

9-a. City Council -Councilman Bannock gave a brief report based on the council
action agenda included in the meeting packet.
9-b. Borough Planning -Commissioner Bryson gave a report based on the Kenai
Peninsula Borough agenda included in the packet.
9-c. Administration -Kebschull reported the meeting packets would be mailed on
Friday mornings and anything needing to be included on the agenda should be
forwarded to her by Thursday afternoon.
Kebschull reported the sign code work is going well. A table was developed
which would make it much easier to read and understand. She added, the
ordinance would be presented to the Commission in the near future.

General Information:
This plat removes a lot line between Government Lot 25 & 26 lying North of

on these lots. There is currently a residence at 399 McCollum Drive.
Preliminary Plat is missing the subtitle and should be corrected.
Ciy Engineer:
Since an addition to the existing structure is underway, it is important that
structures are shown. An asbuilt survey would be required for the
construction.

WHEREAS, the attached plat McCallum Subdivision was referred to the City
of Kenai Planning and Zoning Commission on September 1, ,2000 and
received from Integrity Surveys.
WHEREAS, the City of Kenai Planning and Zoning Commission finds:
1. Plat area is zoned RR-1 -Rural Residential1 and therefore subject to said
zone conditions.
2. Water and sewer: Available.
3. Plat does not subdivide property within a public Improvement district
subject to special assessments. There is not a delinquency amount owed

WHEREAS, allowing such vehicles to be obscured from public view would alleviate the
aesthetic concerns with such vehicles; and
WHEREAS, it is in the best interest of the City of Kenai to allow such vehicles to be
obscured from public view;
NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING & ZONING COMMISSION
OF THE CITY OF KENAI, ALASKA, THAT THE COMMISSION RECOMMENDS TO THE
COUNCIL OF THE CITY OF KENAI THAT KMC 12.25.030{c) BE AMENDED AS
FOLLOWS:
12.25.030 Leaving of junked or illegally parked vehicles.
(c) No person in charge or control of any property within the City,
whether as owner, tenant, occupant, lessee, or otherwise, shall allow any
junked vehicle to remain on such property longer than seventy-two (72)
hours; and no person shall leave any such vehicle on any property within
the City for a longer time than seventy- two (72~ hours; except that this
ordinance shall not apply with regard to a vehicle in an enclosed building
or obscured from public view; a vehicle on the premises of a business
enterprise operated in a lawful place and manner, when necessary to the
operation of such business enterprise; or a vehicle in an appropriate
storage place or depository maintained in a lawful place and manner by
the City.

A RESOLUTION OF THE PLANNING AND ZONING COMMISSION OF THE CITY OF
KENAI, ALASKA, RECOMMENDING THE KENAI MUNICIPAL CODE AT KMC 13.30.080
BE AMENDED TO INCLUDE PROHIBITING THE OPERATION OF MOTOR VEHICLES

WHEREAS, that portions of the south shore of the Kenai River near the mouth of the
river and adjacent areas of Cook Inlet beach containing vegetated areas are sensitive
environmental areas; and
WHEREAS, the vegetation, including beach grass, in those areas is necessary to
maintain a stable and healthy beach environment; and
WHEREAS, the operation of motorized vehicles in those areas causes harm to the
plant life necessary to sustain a stable beach and healthy beach environment; and
WHEREAS, it is in the best interest of the City of Kenai to prohibit operation of motor
vehicles in such areas; and
WHEREAS, this ordinance is not intended to restrict motor vehicle operation on or
access to the non-vegetated beach areas of the south shore;
NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING AND ZONING
COMMISSION OF THE CITY OF KENAI, ALASKA THAT KMC 13.30.080 BE AMENDED
AS APPEARS iN ATTACHMENT A.

AN ORDINANCE OF THE COUNCIL OF THE CITY OF KENAI, ALASKA, AMENDING
KMC 13.30.080 TO INCLUDE PROHIBITING THE OPERATION OF MOTOR VEHICLES
ON THE VEGETATED AREAS OF A PORTION OF THE SOUTH SHORE OF THE KENAI

river and adjacent areas of Coak Inlet beach containing vegetated areas are sensitive
environmental areas; and
WHEREAS, the vegetation, including beach grass, in those areas is necessary to
maintain a stable and healthy beach environment; and
WHEREAS, the operation of motorized vehicles in those areas causes harm to the
plant Iife necessary to sustain a stable beach and healthy beach environment; and
WHEREAS, it is in the best interest of the City of Kenai to prohibit operation of motor
vehicles in such areas; and
WHEREAS, this ordinance is not intended to restrict motor vehicle operation on or
access to the non-vegetated beach areas of the south shore;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF KENAI,
Alaska, that KMC 13.30.080 is amended as appears in Attachment A.

(a) North Shore
u It is unlawful for any person to operate a motorized vehicle in the area indicated on
the man appended. to this chapter, designated as Appendix I, and made a part thereof
excepting the established roads within the area of beach road and a portion of Spruce
Street and further excepting transit of this prohibited area entering or leaving at the
designated area at the beach road and directly to the northwest to the westerly
boundary of the prohibited area which may be entered or exited only in the tidal area.
Public Safety_ _(police, fire, ambulance, rescue) vehicles ,may operate in the prohibited
area if necessary for public safetypurposes. [BOUNDED BY THE MOUTH OF THE
KENAI RIVER; THENCE NORTHWESTERLY ALONG THE WATERS' EDGE OF MEAN
LOW TIDE TO A POINT BEING THE INTERSECTION IN AN IMAGINARY LINE OF THE
STRAIGHT LINE EXTENSION OF FOREST DRIVE; THENCE NORTH ALONG THE
IMAGINARY EXTENSION WEST OF PROPERTY LINES OF FOREST DRIVE TO THE

f 21 Further, specifically prohibited is the operation of a motor vehicle on any portion of
the bluff slope in the area above so designated as prohibited, as is indicated on the
map appended to this chapter, des~ated_as Appendix I, and made a part thereof.
(B) ~ Operation of motorized vehicles in that portion of the prohibited area southerly
and easterly from the east end of Beach Road may be permitted for the purpose of
working on beached boats and barges provided that a permit is secured prior to such
operation. Applications for such permits shall be filed with the City Manager or his
designated appointee setting forth details as to the work to be performed and the dates
of such performance. The City Manager may issue such permit, if he finds it
reasonable under the circumstances, for a specified period of time, which may be
extended on application showing good cause for such extension.
(C) f 4~ Operation of motorized vehicles in that portion of the prohibited area described
in KMC 13.30.080(a) above and entry to such area at a point or paints other than at
the natural end of Spruce Street may be permitted for the purpose of working on the
Sewage Treatment Plant and on utility facilities provided that a permit is secured prior
to such operation. Applications for such permits shall be filed with the Gity Manager
or his designated appointee setting forth details as to the work to be performed and
the dates of such performance, the areas in which such operations are required, and
the point or points of entry required to expedite the work. The City Manager shall
condition such permit or permits on repair or reconditioning of the beach area or bluff
and may require a bond in such amount and with such terms, with or without cash
deposit or other surety, as he may deem advisable to secure such repair or
reconditioning or to reimburse the City for damages to the areas concerned.

Notification of Affected Property Owners in Platting Ac#ions
In compliance wi#h Resolution 2000-25, adopted by the Planning Commission on July 24, 2000,
the Planning pepartment has begun notifying affected property owners for each subdivision
submitted for review by the Plat Committee.
Notification will be sent by first Gass mail. Affected parties are defined in the Resolution.
The resolution also requires notification to beneficial interes# holders on a deed of trust. They will
be sent certified mail notification and will be glven a 30-day time frame from the mailing date
in which to notify the Borough that their beneficial interest requires their signature on the plat,
prohibits subdivision or has other limitations which affect the platting action. If no answer is
received within that time frame, it will be interpreted as anon-objection and the plat may proceed.
Common beneficial interest holders, such as banks and mortgage companies, may wish to supply
the Planning Department with contact names and specific mailing addresses, to facilitate this
process.
In order to expedite the platting process, staff suggests that a copy of the Certificate to Plat be
submitted with the preliminary plat to show the beneficial interests of record. If the Certificate to
Plat is not submitted until the final plat submittal, and it indicates beneficial interes# holders, this
notification requirement will delay final approval. A current updafed Certificate to Plat wil! still be
required in compliance with the Code prior to final approval.

and beneficial interests of record.

WHERE~I.S,~ subdivision activity and population has increased in the borough since Title 20
was adopted in 197$ resulting in more property owners affected by subdivision
activity; and
WHEREAS, it would promote fair and efficient platting process to provide a consistent
notification process;
NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF THE
KENAI PENINSULA BOROUGH:
Section 1. Affected property owners are defined as persons who own property within a
subdivision or proposed subdivision, and persons who own property within 600
feet of the boundaries of the subdivision or proposed subdivision.
Section 2. The borough surveyor or his designee shall determine whether an alteration ox
replat petition affects additional property owners to those set forth in Section 1
based on density of population, ownership data, topography, and facilities in the
area of the subdivision.
Section 3. Notice of public hearing shall appear at least once in a newspaper of general
circulation stating:
a) a general description of the alteration or replat sought;
b) who filed the petition;
c} when the petition was filed;
d) the purpose of the petition; and
e) the time and place of the hearing on the petition.
Section 4. The notice set forth in Section 3 shall also be sent by regular mail to the affected
property owners at least 14 days prior to public hearing.
A certif cate of mailing listing the names, addresses, and parcel identification for
each affected property owner shall be maintained in the subdivision file.

Section S. Parties whose sole interest in a subdivision, alteration, or replat is as a beneficiary
of a deed of trust shall be sent a notice by certified mail containing the
information set forth in Section 3 of this resolution prior to the public hearing.
The certificate of mailing required by Section 4 shall include any beneficial
interest holders. If a beneficial interest holder does not respond to the notice
within the time frame set forth in the notice, the platting authority may approve
the preliminary plat. If the certificate to plat submitted with the final plat reveals
a beneficial interest holder whose name and address have been previously
undisclosed by the subdivider to the borough, the borough may reject the plat
until notice of the plat proposal is given to the beneficial interest holder and a
time for objections has passed.
Section 6. This resolution shall tape effect immediately upon adoption.

This plat moves a lot line to alleviate an encroachment and a building code violation
The Kenai Planning and Zoning Commission recommended approval on July 26, 2000. They had no concerns that
have not been addressed by the plat.

MOTION: Commissioner Bayes moved, seconded by Commissioner Hohl, to grant approval to the preliminary
plat subject to staff recommendations.
Vice Chairman Bryson commented the plat corrected a side lot encroachment. The City of Kenai awns the
adjacent property, Mr. Johnson added that they wanted to keep the 80' street frontage.
VOTE: The motion passed by unanimous consent.

PUBLIC HEARING NOTICE
The following public hearings have been scheduled for the Planning and Zoning Commission Meeting
of September 13, 2000:
PZ00-31 A resolution of the Planning & Zoning Commission recommending the Kenai Municipal
Code at KMC 12.25.030(c} be amended to allow vehicles otherwise meeting the definition of "sunk
Vehicles" to be obscured from public view.
PZ00-32-A resolution of the Planning and Zoning Commission recommending the Kenai Municipal
Code at KMC 13.20.080 be amended to include prohibiting the operation of motor vehicles on the
vegetated areas of a portion of khe south shore of the Kenai River and Cook Inlet. (Maps depicting the
affected area are available at City Mall.}
The Meeting will commence at 7:00 p.m. in the Kenai City Council Chambers. Anyone wishing to
present testimony concerning these resolutions should do so at the hearing or submit written
comments to the City of Kenai, Planning Department, 210 Fidalgo, Suite 200, Kenai Alaska 99611-
