ITEM 1: CALL TO ORDER
Chairman Glick called the meeting to order at 7:00 p.m.

MOTION:
Commissioner Goecke MOVED for approval of the agenda adding the items provided
prior to the meeting and requested UNANIMOUS CONSENT. Motion SECONDED by
Commissioner Morse. There were no objections. SO ORDERED.

MOTION:
Commissioner Jackman MOVED for approval of the minutes of September 13, 2000

6-a. Amending KMC L4.25 Landscaping/Site Plan Regulations to provide far
administrative review and approval-Discussion
Kebschull reminded the Commission of the proposed amendment to KMC 14.25 to
allow for administrative approval, i.e. if the amendment is approved, landscape/site
plan applications will be reviewed and approved administratively and the Commission
will receive copies of landscape/site plans that have been reviewed as information
items in meeting packets. There was no discussion on the item. Kebschull
announced the issued would be scheduled for public hearing on October 11, 2000.
6-b. Proposed ordinances adding requirements for residences which are the
subject of home occupations permits to be inspected by the Fire Marshall
prior to issuance of a permit with continuing bi-annual inspections for
home occupation day-care £acilities and bed and breakfast establishments.
Kebschull introduced the two proposed ordinances and explained their purpose. After
some discussion it was noted that all Commissioners were generally in agreement that
users of such facilities should be assured of their safety. Discussion took place on
other businesses that may need the same requirements but it was decided the day
care and bed and breakfast businesses would be addressed first and others would be
added as administration or the Commission deems necessary.
Bryson asked if the term "shall" in {h)1 of the proposed day-care ordinance should be
"rnay." Kebschull agreed the term "rnay" would be more appropriate and would
discuss it with the City Attorney.

9-a. City Council -Councilman Frazer gave a report on the September 20, 2000
council meeting and noted Ordinance No. 1877-2000, which prohibits the operation of
motor vehicles on the vegetated areas of a portion of the south shore of the Kenai River
and Cook Inlet, was tabled in order to research other alternatives. Frazer noted that
might include roads, parking, etc.
9-b. Borough Planning -Commissioner Bryson gave a brief report on the
September 25, 2000 Borough Planning meeting and a copy of the agenda was included
in the packet.

9-c. Administration -Kebschull reported two summer interns continued to work on
adding streetlights to the existing GIS. Kebschull also announced that City Council
approved the water and sewer map work and it should be completed within two to
three months. Kebschull reported she attended a Foreign Trade Zone meeting and
work continues on the proposal.
Kebschull reported there had been some complaints regarding a potential home
occupation on Toyon Way. The application had not yet been submitted so staff is
unable to react to the complaints. The issue may come before the Commission in the
near future.

ITEM 12: COMMISSION COMMENTS. 8a_QUESTIONS
Commissioner Nord asked if the Fireweed Espresso sign placed on Forest and Spur
was a legal sign. Kebschull indicated it probably was not. Jackman reported the road
contractor placed the sign for the business while the road was closed. It was noted
the road was open and the temporary sign should come down. Kebschull stated she
would bring this to the attention of the building inspector.

A RESOLUTION OF THE PLANNING AND ZONING COMMISSION OF THE CITY OF
KENAI, ALASKA, RECOMMENDING THE KENAI MUNICIPAL CODE AT KMC 14.25 BE
AMENDED TO PROVIDE FOR ADMINISTRATIVE APPROVAL OF LANDSCAPING/SITE
PLANS.
WHEREAS, landscaping/site plans must now be approved by the Planning and Zoning
Commission; and
WHEREAS, that due to scheduling of the Commission meetings the issuance of
building permits may be delayed; and
WHEREAS, to alleviate unnecessary delays in issuing building permits it is in the best
interest of the public to provide for Administrative review;
NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING AND ZONING
COMMISSION OF THE CITY OF KENAI, ALASKA THAT KMC 14.25 BE AMENDED AS
APPEARS IN ATTACHMENT A.

Chapter 14.25 ~~
LANDSCAPINGISITE PLAN REGULATIONS
14.25.010 Intent.
(a) Site Plans: It is the intent of this section to provide for orderly and safe development of the
City commensurate with protecting the health, safety, and welfare of its citizens, and adequate
and convenient open spaces, light, and air, in order to avoid congestion of commercial and
industrial areas.
(b} Landscaping Plans: It is the intent of this section to provide for landscaping and/or the
retention of natural vegetation in conjunction with commercial and industrial development
within the City of Kenai. The general purpose of landscaping is to visually enhance the City's
appearance and reduce erosion and storm runoff.
14.25.020 Application.
This section shall apply to all commercial and industrial development and all development of
$20,000 or more in the Townsite Historic Zone (TSH) within the City of Kenai and shall apply to
both the landscaping and site plans. "Commercial and industrial development" and "a11
development" shall be defined as any improvements requiring a building permit for new
construction or any improvements of $20,000 or more, which adds square footage, located on
properties within the Central Commercial {CC), General Commercial {CG), Heavy Industrial
(IH), Townsite Historic {TSH), and Light Industrial (IL) zoning districts. It shall be unlawful for
any person to construct, erect or maintain any structure, building, fence, or improvement,
including landscaping, parking, and other facilities on property designated as a commercial tract
unless such improvements are constructed or reconstructed in a manner consistent with the
approved plan.
14.25.030 Landscaping/site plan--Submittal requirements.
Three {3) copies of the landscaping/site plan {1 ixl4 size) shall be submitted for approval to the
PLANNING SPECIALIST] Administrative Official prior to the issuance of a building permit.
One copy of the approved plans shall be returned to the applicant; one copy filed; and the third
copy showing action taken, filed with the Building Official. The landscaping/site plan shall be
prepared at a minimum scale of 1" = 20' and shall include the following information:
(a) Common and scientific name of the planting materials to be used in the project;
(b) Typical planting details;
(c) Location of all planting areas and relationship to buildings, parking areas, and driveways;
{d) Identification and location of existing vegetation to be retained;
(e) Identification and location of non-living landscaping materials to be used;
(f) Identification of on-site snow storage areas;
(g} Drainage patterns;
(h) Description of buildings, including building height, ground floor dimensions, kinds of
building materials, type of architecture anticipated;
(i} Physical features of the property including location of all buildings, ingress and egress, any
unusual features of the property which may restrict development or drainage.

14.25.035 Landscapinglsite plan.

Submittal of a preliminary landscapinglsite plan and approval by the [PLANNING AND
ZONING COMMISSION] Administrative Official is required prior to any land clearing andlor
tree cutting.
14.25.040 Landscaping plan--Performance criteria.
{a) Objectives far Landscaping Plan: An effective landscaping plan should utilize a variety of
techniques for achieving the intent of this ordinance. The appropriate placement or retention of
vegetation in sufficient amount will provide the hest results. Perimeter, interior, and parking lot
landscaping should be included as components of the overall landscaping plan.
(b) Perimeter Landscaping: Perimeter landscaping involves the land areas adjacent to lot lines
within the property boundary. This buffer landscaping serves to separate and minimize the
impact between adjacent land uses. Buffer landscaping may be desirable along the perimeter of
the property to shield vehicular or building lights from adjacent structures and to provide a visual
separation between pedestrians and vehicles.
{c} Interior Landscaping: Interior landscaping involves those areas of the property exclusive of
the perimeter and parking lot areas. Interior landscaping is desirable to separate uses or activities
within the overall development. Screening or visual enhancement landscaping is recommended
to accent or complement buildings, to identify and highlight entrances to the site, and to provide
for attractive driveways and streets within the site.
(d) Parking Lat Landscaping: Parking lot landscaping involves the land areas adjacent to or
within all parking lots and associated access drives. Parking lot landscaping serves to provide
visual relief between vehicle parking areas and the reminder of the development. It also is
desirable for the purpose of improving vehicular and pedestrian circulation patterns.
(e) Maximum Required Landscaping: The LANDSCAPING/SITE PLAN REVIEW BOARD]
Administrative Official shall not require more than five percent (5%) of any project area #o be
landscaped.
{f) Review: The PLANNING AND ZONING COMMISSION] Administrative Official may
reconsider plans for amendments after they have been approved if problems arise in carrying out
the landscaping/site plan as originally approved.
14.25.045 Site plan--Performance criteria.
(a) Objectives: An effective site plan should utilize a variety of techniques for achieving the
intent of this ordinance. The appropriate placement or retention and improvements of buildings,
parking lots, etc. should be considered on the site plan.
(b) Buildings: A commercial or industrial use housed in the building is to be compatible with the
surrounding properties, land use plan, and not be hazardous to the health, safety, and welfare of
citizens.
{c) Special Fermits: The site plan shall list any special permits or approvals which may be
required for completion of the project.
{d) Parking Lots: Parking lots referenced on the site plan shall comply with KMC 14.25.250.

{e) Snow Storage/Removal and Drainage: Snow storage/removal and drainage as refer o,~
the site plan shall be compatible with the surrounding area. ~~°
14.25.050 [PLANNING AND ZONING COMMISSION.] Approval.
[MEETINGS AND PROCEEDINGS:] The [COMMISSION] Administrative Official shall
[MEET TO] review and take action on a landscaping and site plan within fourteen { 14) days of
satisfactory submittal. The Building Official shall issue a building permit upon approval of the
associated landscaping/site plan [BY THE COMMISSION] or the expiration of fourteen (14)
days without official [COMMISSION] action, providing all of the other requirements far the
issuance of a building permit have been met. Any appeal of the action of the [COMMISSION]
Administrative Official shall be [SUBMITTED IN WRITING TO THE KENAI CITY
COUNCIL] in accordance with KMC 14.20.290.
14.25.Ob0 Completion--Landscaping plan.
All required landscaping as presented in the approved landscaping plan shall be installed prior to
the issuance of the Certificate of Occupancy. In the event that the landscaping has not been
completed upon request for the Certificate of Occupancy, the Building Official may grant a
temporary certificate not to exceed nine (9) months.
14.25.065 Completion--Site plan.
All requirements as outlined in Section 14.25.045 shall be installed according to the site plan as
approved by both developer and [PLANNING AND ZONING COMMISSION] the
Administrative Official. All restrictions cited in Section 14.25.060 shall apply to this section.

compliance prior to issuance of the permit; and
Whereas, such facilities should be inspected prior to issuance of a conditional use
permit; and
Whereas, such facilities should be subject to on-going bi-annual inspections to ensure
compliance with the fire code.
NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING AND ZONING
COMMISSION OF THE CITY OF KENAI, ALASKA, that KMC 14.20.321 BE AMENDED
BY ADDING THE FOLLOWING SECTION:
14.20.321 Bed and breakfast establishments.
(a) Intent: It is the intent of this chapter to permit bed and breakfast
establishments by conditional use which is compatible with other permitted uses,
with the residential character of a neighborhood, and which is clearly secondary
or incidental to the residential use of the main building.
(b) Provided that these establishments shall be owner-operated, not more than
one person outside the family shall be employed in the bed and breakfast; rent out
no more than thirty percent (30%) of the total floor area; have adequate off-street
parking for owner and all guests; and shall meet alI other requirements as set forth
by the Planning and Zoning Commission at the time of public hearing.
(c) The bed and breakfast establishment must meet all area, height, and setback
requirements of the zones in which they are allowed according to the Land Use
Table.
(d} Fire code inspections:
Buildings , which are the subject of a bed and __ breakfast permit

the fire code (KMC 8.05 prior to the approval of the_ conditional use
permit. Such facilities shall be inspected biannually by the Ci _ Fire

NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING AND ZONING
COMMISSION OF THE CITY OF KENAI, ALASKA, that KMC 14.20.320 is amended by
adding the following section:

Hatch-Kennedy take the
wrecking ball to local zoning
You would think that whenever
Senator Orrin Hatch, R-tTI'and Edward
Kennedy, D-MA, get together on a bill
one of the two has either undergone a
philosophical conversion or the issue
involves whether gumdrops will cause
cavities. In a case involving land use
zoning and religion Hatch, a Mormon,
and Kennedy, a Roman Catholic,
teamed up to blow a hole in the ability
of local governments to control the use
of land and buildings where religious
institutions are concerned.
On the last day of session before
adjourning for the August recess, Hatch
brought to the floor 52869, a bill inno-
cently titled Religious Land Use and
institutionalized Persons Act. The pro-
cedure he used is called "unanimous
consent." This either means the bill is
so good that no one in his/her right
mind would object to it or that it is so
bad, yet is favored by all the religious
groups, that no one in his/her right
mind would abject to it. The latter is
the case in this instance.
Christians, Jews, Muslims and
others in America feel that the First
Amendment to the Constitution should
protect them from local governments
that would deny them the ability to
build, expand and carry out their reli-
gious mission. The Founding Fathers
were pretty dear that they didn't want
the government either establishing or
controlling religions. So, on the face of
it, S2869 looks pretty benign.
However, suppose a church wants to
add to its existing structure, which hap-
pens to be in a quiet residential
neighborhood, a giant parking garage
and flood the area with cars, pollution,
noise and confusion every Sunday
morning, then rent stalls in the garage
not making this up) and allows the
phone company to erect a 124-foot cell
tower with a cross at the top next to the
church, that is very much a secular issue.
52869, according to Sob's lawyer
friends, some of whom are sober and
dependable, would tie the hands of
cities and counties in such a case.
By the time you read these pearls of
prose President Clinton may well have
signed this bill. If he does, it is a sure bet
that local governments will be forced
into court to defend their right to control
land use through zoning laws whether the
land-owner is a corporation, individual,
church or synagogue. It is a shame that it
comes to this. But clever Hatch and
Kennedy packaged a wish I ist for the reli-
gious groups in a First Amendment
wrapping and no one, House or Senate,
dared stand up against it.
You have to hand it to those
Founding Fathers. Apparently they pre-
dicted that Congress would be spineless
on some issues. That is why the justices
of the Supreme Court serve for life. They
may get old and foggy but at least they
do not have to stand for reelection.

and Kennedy have just sneaked through
a bill saying, "NOl" Nat one Senator
rose to object to this outrage, then the
bill was hustled across the rotunda to
the House where it was adopted
without so much as a whimper from the
Left ar Right.
No one, certainly not your dedi-
cated Washington correspondent,
wants to see religious rights trampled.
There have been cases of abuse and
those must be addressed. In one case a
community denied permits to build an
Islamic Center in an area where there
were Christian churches. People of
every religious persuasion have a right
to worship in America. After ail, why
did Mel Gibson shoot all those Brits
anyway? (if you haven't seen The
Patriot, Bob recommends it.)
S28G9 is a loophole a church could
sail Noah's Ark through. Bob, who
cannot be accused of being a lawyer, has
been told by people who can that bad
things will happen with this bill. For
example, there is a huge difference
between a religious organization`s
"exercise of religion" and its "religious
mission." Worship services and the
like are the "exercise." The "mission"
might be an elementary school, a hos-
pital or a halfway house for
sex-offenders. You locals have nothing
to say about the "exercise" stuff and
should not. But when a church thumbs
its nose at local zoning ordinances (I'm

The Planning Department requests that any plats you want filed prior to the end the year be
submitted no later than November 6, 2000.
This will ensure that staff will be able to complete a final review, secure the tax certificate,
request you update the Certificate to Plat, and have the plat ready for filing.
if the subdivider has not yet paid the taxes, it is importan# that you advise them of the need to
submit a copy of the receipt, showing date and method of payment. They will also need to
provide the name of the proposed subdivision when bringing or sending the receipt copy to the
Planning Department. Tax Certificates issued only on request from the Planning Department.
All plats granted preliminary approval an or after August 14, 2000 are subject to KPB
Resolution 2000-025, which requires notification to beneficial interest molders as determined by
the Certificate to Plat. The beneficial interest holders have 30 days in which to respond. In order
that this requirement not delay recording of your plats, staff recommends that a copy of the
Certificate to Plat be submitted for all affected pla#s with preliminary submittal or prior to final
plat submittal. This will allow me to notify the beneficial interest holders immediately.
This time frame does not allow time for numerous final reviews of the same plat. If a plat is
returned for corrections andlor additions, other than signs#ure, it will be placed at the end of the
line when returned for a second or third review.
We will, of course, try to accommodate plats received after that date. However, given the
current work load, we cannot make any assurances the review will be completed.
