PZ00-36-A resolution of the Planning and Zoning Commission of the City of Kenai, Alaska, recommending that KMC 14-ZO-321 be amended to require inspection of buildings for compliance with the fire code prior to issuance of a Bed 86 Breakfast Conditional Use Permit and requiring bi- annual inspections thereafter. MOTION: Commissioner Goecke MOVED to approve PZ00-37 and the motion was SECONDED by Commissioner Jackman. There were no public comments. Kebschull indicated staff had nothing additional, however, in response to Commissioner Jackman's question of the last meeting regarding what the Fire Marshal would look for during an inspection, Kebschull reported he would look for the basics to include smoke detectors, fire extinguishers, proper egress, etc. There was no Commission discussion. City Council -- Councilman Bannock gave a report on the City Council meeting that was held an October 4, 2000 and answered many questions from the Commission. 9-b. Borough Planning -Commissioner Bryson gave a brief report on the Borough Planning meeting which was held on October 9, 2000. A copy of the agenda was included in the packet. 9-c. Administration - • Kebschull stated the City Clerk wanted to bring to the attention of the Commission that the last meeting in November is the day before Thanksgiving. If there is no business to be conducted at that meeting the Commission needs to decide if they want to cancel which requires Council approval. • Kebschull reported she would not be at the next meeting on October 25. City Engineer La Shot may be present. • The sign code is in for final review and Kebschull noted it had been completely rewritten. The code may be available for review by the Commission at the next meeting and consideration should be given to whether a work session needs to be scheduled. Kebschull added, a consultant would be hired to lead the process. It was anticipated the RFP would be advertised by January, 2001. The code also specifies the review criteria that must be satisfied prior to issuing the permit. The criteria are: 1. The use is consistent with the purpose of this chapter and the purposes and intent of the zoning district; 2. The value of the adjoining property and neighborhood will not be significantly impaired; 3. The proposed use is in harmony with the Comprehensive Plan; 4. Public services and facilities are adequate to serve the proposed use; PZ00-34~ --Comments Page 2 5. The proposed use will not be harmful to the public safety, health or welfare; 6. Any and all specific conditions deemed necessary by the commission to fulfill the above-mentioned conditions should be met by the applicant. These may include, but are not limited to measures relative to access, screening, site development, building design, operation of the use and other similar aspects related to the proposed use. Section 14.20.321 of the Kenai Municipal Code outlines regulations that allow bed & breakfast establishments in the City of Kenai. Section 14.20.320 {39~ defines "Hotel" as, "means any building or group of buildings in which there are guest rooms used, designed or intended to be used for the purpose of offering to the general public, food or lodging, or both, on a day- to-day basis. The guiding service would be considered as a commercial use in the residential zone. All of these uses require Conditional Use Permits in residential zones. Applicant is seeking a Conditional Use Permit far a bed and breakfast, hotel {short-term rentals) and guide service for the above-noted property. The applicant has made an offer to purchase this property that is contingent upon receipt of the Conditional Use Permit. The present owner of the property has provided written permission for the application process. Based on the information provided by the applicant, it appears that the proposed bed and breakfast meets the requirements of the Kenai Municipal Code. The property would be owner occupied and use less than thirty percent {30%y of the total floor area. It appears that the use would be compatible with the residential character of the neighbor. The applicant proposes to remodel a portion of the residence into an efficiency apartment. It is planned to use the apartment as short-term rentals (hotels in the summer months and long-term rental in the winter months. The long-term rental [aver 30 daysl would not require a special use permit. The guiding business would involve using the home as an office, possibly meeting clients at the residence, or providing a place for clients to stay. The applicants stressed that they intend to run asmall-family business from their home. The property is accessed from the Kenai Spur Highway and has sufficient off-street parking for the occupants as well as any clients. It appears that because of the location of the residence that the proposed uses would not affect the neighboring properties. PZ00-34-Comments Page 3 The City Administration is currently working with the Fire Marshal to update the City's code to require bed and breakfast establishments be inspected prior to occupancy to ensure they meet fire codes for the prescribed use. It is recommended that prior to issuance of the bed & breakfast permit and the hotel permit, that the residence be inspected by the Fire Marshal. Buildin Official: A building permit was issued in October of 1994 to finish the area that applicant is intending to use for the Bed and Breakfast. No inspections were performed. Therefore, prior to issuing the permit, an inspection should be required for compliance with the building code. A certificate of occupancy will not be issued until any code violations are corrected. RECOMMENDATIONS It appears that the requested permits meet the requirements of the Kenai Municipal Code. Recommend approval if the residence meets the required fire code and require that the residence be inspected bi-annually to ensure continued compliance with the fire code. Plat Committee Meeting 10/9/2000 Location: City of Kenai, Spur Highway, opposite Kenai Middle School Proposed Use: Residential Zoning: Rural Residential (RR-1) SewerlWater: City Su ortin Information: This pla# was originally submitted as McCollum Subdivision. Staff informed the surveyor #hat this was not an acceptable name as it had already been used. The surveyor substituted the name RedFlo Subdivision. This plat will eliminate a lo# line between two government lots. ft will dedicate 30 feet to Magic Avenue, bringing that to a 63-foot dedication, and 33 feet to McCollum Drive, resulting in a full 66-foot dedication. The plat shows a 100-foot dedication of the Kenai Spur Highway. Staff recommends the surveyor verify #hat this agrees with the current DOT Right-of-Way plans for this area. Staff recommends that khe total width be shown far the Kenai Spur Highway and the data source be referenced. The Kenai Planning and Zoning Commission reviewed this plat on September 13, 2000. They had concerns about possible encroachments being created by this plat, due to the setbacks associated wi#h the three surrounding rights-af-way. The surveyor provided an as-built survey and requested a 30-foot dedication of Magic Avenue, instead of dedication of the full 33-foot access easement. This would allow the existing structures to comply with the City's regulations and no encroachment would result. The Commission was agreeable to this and recommended approval of the plat as submitted. No exceptions have been requested. Per KPB Resolution 2000-025, if the Certificate to Plat indicates any beneficial interests affect this property, they will be notified and given 30 days from the date of the mailing of the notification to respond. They are given the opportunity to notify staff if their beneficial interest prohibits or restricts subdivision or requires their signature on the final plat. If no response is received within 30 days, staff will assume they have no requiremen#s regarding the subdivision and it may be finalized. Staff recommends a Certificate to Plat be provided to s#aff as soon as possible to expedite this process. Chairman Hammerman recognized Cliff Baker, Surveyor. Mr. Baker noted the staff report said na exceptions had been requested; however, he requested an exception to survey and monumentation {Page 7fi). The subject plat eliminates a lot line between two government lots. The property has dedications on three sides. To do a full survey would require a breakdown of the 114 section. He did not believe this was necessary since lot lines are being eliminated. Three rights-of-way monument the property. Ms. Toll commented that the surveyor had requested an exception, but she had inadvertently omitted addressing it in the staff report. Commissioner Skogstad asked Mr. Best if staff objected to the exception. Mr. Best answered no. He added that the Committee needed to cite findings.
