CHAIR CAR GLICK, PRESIDING MINUTES ITEM 1: CALL TO ORDER Chairman Carl Glick called the meeting to order at 7:00 p.m. 1-a. Agenda Approval MOTION: Commissioner Bryson MOVED to approve the agenda adding the lay down items provided prior to the meeting and requested UNANIMOUS CONSENT. Commissioner Morse SECONDED the motion. There were no objections. SO ORDERED. 1-c, Approvval of Minutes: December 27, 2000 MOTION: Commissioner Jackman MOVED to approve the minutes of December 27, 2000 and requested UNANIMOUS CONSENT. ITEM 2: SCHEDULED PUBLIC COMMENT -- None ITEM 3: CONSIDERATION OF PLATS -- None ITEM 4: PUBLIC HEARINGS 4-a. PZO1-O1--A resolution of the Planning and Zoning Commission recommending to the Council of the City of Kenai, Alaska, that the current sign code, KMC 14.20.220 be repealed and replaced with a new KMC 14.20.220. MOTION• Commissioner Jackman MOVED to approve PZ-O1-01 and Commissioner Morse SECONDED the motion. There were public comments. Kebschull drew attention to the item provided prior to the meeting which consisted of recommended changes to the sign code that would address the concerns expressed by Councilman Bannock at the last meeting. Bannock indicated the memo was a result of a conversation he had with Attorney Graves. Bannock added, the recommendation is to remove the last sentence in paragraph three of the proposed sign code and add a new paragraph 11 to state "The City of Kenai may erect on premises public informational signs as otherwise allowed in this section. City of Kenai off-premises public infor7natianal signs or public informational signs not otherwise in compliance urith this section may be allowed by variance under KMC 14.20.180. For purposes of this section, legal notices, or signs directing or regulating pedestrian or Vehicular traffic or public safety signs are not considered public informational signs." MOTION TO AMEND THE MAIN MOTION: Commissioner Nard MOVED to amend the main motion by removing the last sentence in paragraph three and replacing it with a new paragraph 11. Commissioner Erwin SECONDED the motion. After some general discussion it was noted other governmental agencies were not addressed in the new paragraph. It was noted this was an oversight and the first sentence would read, "The City of Kenai may erect or may allow another governmental agency to erect informational signs..." Discussion took place on how signs in disrepair were addressed in the sign code. After discussion it was determined the issue was appropriately addressed in Item 6 of the General Requirements. Administration ,-- Kebschull reported the following: • The yearly report was included in the packet. • Announced aone-day planning workshop is scheduled for February 16 in Anchorage and asked if there were any commissioners interested in attending. Commissioners Nord, Morse, and Jackman expressed interest in attending. Kebschull also noted the cost of the workshop is $50.00 and included lunch, Because no funds were included in the Planning budget for these costs, she would request funding from Council. The code also specifies the review criteria that must be satisfied prior to issuing the permit. The criteria are: 1. The use is consistent with the purpose of this chapter and the purposes and intent of the zoning district; 2. The value of the adjoining property and neighborhood will not be significantly impaired; 3. The proposed use is in harmony with the Comprehensive Plan; 4. Any and all specific conditions deemed necessary by the commission to fulfill the above-mentioned conditions should be met by the applicant. These may include, but are not limited to measures relative to access, screening, site development, building design, operation of the use and other similar aspects related to the proposed use. In May of 2000, a Conditional Use Permit was issued for cabin rentals for this property. The applicant would now like to modify this permit to provide guide service from this property. Mr. Kent would like to offer his clients food service at this location. To do so, wilt require a modification of the permit to Hotel which is defined in Title 14 as, "means any building or group of buildings in which there are guest rooms used, designed, or intended to be used for the purpose of offering to the general public, food or lodging, or both, on a day-to-day basis." Mr. Kent has been advised that he wilt be required to meet with the State of Alaska, Department of Environmental Conservation to determine what modifications may be required to meet DEC standards for food service. Modifying the current permit from cabin rentals to hotel does not change the daily rental aspect of the cabins; it will now allow food service to be provided to clients. The Anglers Acres area has become amixed-use zone through the issuance of Conditional Use Permits and it appears the proposed use is consistent with other permits issued in the area. Mr. Kent purchased this property believing that it was zoned for commercial use. The property has previously been used in a commercial nature; however, the zoning is rural residential and any new commercial venture requires a Conditional Use Permit. The applicant proposes to use this site in conjunction with his sites on Angler Drive. The building will be remodeled to house an office for the guide service and possible retail space. In addition, the applicant plans to build cabins on this site and rent them on short-term basis. The applicant plans to provide food service to his clients which will require a permit for a hotel defined in Title 14 as, "means any building or group of buildings in which there are guest roams used, designed, or intended to be used for the purpose of offering to the general public, food or lodging, or both, on a day-to-day basis." These plans are in the early stages and drawings have not been provided showing a site plan for the property. Because of the commercial nature of this project, a landscapelsite plan review should be required before a building permit is issued. This review will assure that all setbacks, lot coverage, snow storage, parking, etc. are provided far the development. Mr. Kent has been advised that he will be required to meet with the State of Alaska, Department of Environmental Conservation to determine what modifications, if any, may be required to meet DEC standards for food service. Day care is specifically fisted as a permitted home occupation. The code allows for no more than eight ~8} children under the age of twelve {12}, including children related to the caregiver, to be cared for in the home. Ms. Pugh advised that she currently cares for four children in addition to her own three children, which places her within the code guidelines. A sketch provided by the applicant shows that children are cared for using the dining room, kitchen, family room, and a bathroom. This area is within the code guidelines that no more that thirty percent (30%} of the home may be used in the home occupation. The applicant advises that she is a home state registered day care and was unaware that the City required a permit until she was contacted as PZ41-06 Comments Page 2 result of the ordinance that now requires fire inspections of day cares. Due to state licensing requirements, the Fire Marshall has already inspected Ms. Pugh's home. The last inspection was on August 4, 2000. The Fire Marshall suggests that the City place Ms. Pugh on the schedule for the required inspections based on this last inspection. The next inspection would be in August 2002. The purpose of the annual report is to provide information on the local government's historic preservation activities. This information helps the Office of History and Archaeology to . evaluate local CLG programs and to be aware of the activities of the historic preservation commissions around the state. Information about CLG program activities can be provided in outline or narrative form. The annual report should provide, as applicable, the following: A. LOCAL PRESERVATION ORDINANCES: l . Mayor John Williams and Councilman Jim Bookey confrmed the City of Kenai sugges#ion for routing of the pathway as outlined in my a-mail of January 3, 2001. This pathway goes north from K-Beach to the Kenai Spur along the Bridge Access Road on the following suggested sides. 1. On the east side from K-Beach to bridge. 2. Have the pathway go under the bridge to the west side on an elevated walkway. `This walkway is part of a DNR project called "Kenai River Flats Scenic Overlook and Interpretive Trail." It connects the Birch Island Historical Site to the State Parks existing parking at the bridge. The DNR Parks project is on the STIP list and scheduled for about the same time as the pathway. 3. Attach the pathway to the west side of the Warren Ames Bridge. 4. Continue the pathway along the west side from the bridge to the existing Kenai Bird Watching Station. 5. The Mayor also suggested DOT consider locating the pathway away from the highway firom the Bird Watching Station towards the river and Boat Launch Road. It January 18, 2001 Mr. Mark Bianning Page 2 January 18, 2001 would then go north back to the Bridge Access Road. This new pathway location would bypass Beaver Loop Road and a major trucking company and possible conflicts. It would also provide a scenic view and a welcome relief from the heavy road traffic. 6. The pathway would continue north on the west side of Bridge Access Road to the sidewalk on the Spur Highway. During the January 16, 2001, open house, Mayor Williams pointed out that the existing State Parks parking lot at the Bridge and the future parking area for the Kenai Coastal Trail would make excellent staging areas for the people using the pathway. Discussions at the City Council meeting of January 17 indicated that the City supports the pathway location as outlined in 1-6 above. The City also has no objections to DOT considering routing the pathway across City-owned land near Boat launch Road. The new routing, ROW requirements, any deed restrictions, zoning requirements, and future maintenance are items of City concern but may easily be worked out. This project is very important to the City of Kenai. We encourage additional "open house" meetings and offer the Kenai Council Chambers for the meeting location, which offers easy access to local citizen input.
