CHAIRMAN RON GOECKE, PRESIDING MINUTES ITEM 1: CALL TO ORDER Chairman Goecke called the meeting to order at 7:00 p.m. 1-a. Roll Call Members Present: Carl Glick, Phil Bryson, Ron Goecke, Barb Nord, Donald Erwin, Mike Morse, Amy Jackman Others Present: Councilman Bill Frazer, Public Works Manager Jack La Shot, Contract secretary Barb Roper 1-b. Agenda Approval MOTION: Commissioner Glick MOVED to approve the agenda and requested UNANIMOUS CONSENT. Commissioner Morse SECONDED the motion. There were no objections. SO ORDERED. 1-c. Approval of Minutes: February 28, 2001 MOTION: Commissioner Bryson MOVED to approve the minutes of February 28, 2001 and requested UNANIMOUS CONSENT. Commissioner Glick SECONDED the motion. There were no objections. SO ORDERED. 1-d. Consent Agenda -None ITEM 2: SCHEDULED PUBLIC COMMENT -- None ITEM 3: CONSIDERATION OF PLATS -- None ITEM 4: PUBLIC HEARINGS 4-a. Application submitted by Jason and Angie Daniels, P.4. Box 2295, Soldotna, Alaska. MOTION: Commissioner Glick MOVED to approve PZO1-10 and Commissioner Morse SECONDED the motion. There was no public comment. Commissioner Bryson indicated it appeared to be the situation when there is double lot frontage on modest-sized lots. VOTE: B son Yes Erwin Yes Glick Yes Nord Yes Morse Yes Jackman Yes Goecke Yes MOTION PASSED UNANIMOUSLY. ITEM 5: OLD BUSINESS -- None ITEM 6: NEW BUSINESS 6-a. Request that Inlet Woods Subdivision lots be made available for sale. Determine if needed for public purpose. Chairman Goecke drew attention to the Parks & Recreation Commission recommendation regarding the Iots in Inlet Woods Subdivision. The recommendation was contained in the unapproved minutes included in the meeting packet. Public Works Manager La Shot explained it would be the recommendation of Administration that Lots 21 through 25 be retained for drainage purposes. This would still leave seven lots that would not be affected by the pond. Commissioner Nord reported the Beautification Committee had also discussed this particular area in great detail in regard to retaining it for a future park. Nord thought that perhaps not all lots should be retained for park use, however those located on the east side may be suitable. Commissioner Jackman asked if the area was suitable for a park and if that was the reason it was being held. La Shot replied, if the five lots were withheld, the City Manager would entertain giving the person the other lots and a use permit to go in and put fill and material around the edge of the pond so that it can be seeded. If that happens, then perhaps it would be suitable for park use. Nord clarified, she was in favor of having lots 21 through 27 retained far a park so there could be some area for playground toys. Jackman asked if Administration thought there was ample space for such equipment. La Shot answered, he couldn't speak for Parks and Recreation, but PLANNING & ZONING COMMISSION MEETING MARCH 14, 2001 PAGE 2 thought they did envision a larger area than just the five lots. La Shot continued, there had been no views from the City Administration on the issue other than all lots not affected by water should be made available for sale. Commissioner Bryson concurred with Parks and Recreation in that a buffer area is needed on bath sides. MOTION: Commissioner Bryson MOVED to concur with the Parks and Recreation Commission that Lots 18 through 27 be retained for public purpose. Chairman Goecke stated that he wasn't totally convinced that he liked the idea of a pond being accessible for kids. Goecke considered the pond a safety hazard. Jackman again asked for clarifcation on whether the Commission should first determine whether the lots should be sold first then decide which ones should be held far public purpose. Goecke replied that if part of what the Commission did was against what Council decides, it wouldn't make any difference. Goecke added, the Commission should determine whether or not the lots should be made available for sale but the viewpoints should also be made known. Commissioner Bryson called for point of order, as there was a motion on the floor without a second. Commissioner Nord SECONDED the motion. Bryson stated, the safety concerns were well founded, as there had been a problem with ignoring ponds. Bryson pointed out that there is no park development plan included, but thought that when there is one, consideration would be given to the pond and the safety issues. Councilman Frazer stated he talked with the proposed purchaser and it was noted the dirt from the pond area was hauled out and mounded on Lots 1-5 of Block i 1. The proposed purchaser intends to move the dirt back to the pond area. Frazer added, the drainage in that area didn't make the pond; it was just where the rainwater drains. Frazer continued, another consideration would be if all of the lots on the backside were taken out, the remaining utilities would have to come down Backwood Avenue to serve Lots 14 and 1 in Block 10, and 1 through 5 in Block 11. Frazer added, the cost of those utilities would be borne by those lots instead of both sides of the street, so there would be some side effects on how these particular lots are treated. Goecke stated the cost of running power would be pretty minimal considering what's already there. Bryson stated the water and sewer was already in, the road was paved and street lights were in so it was likely they would run the shallow utilities along the side that they're serving rather than cut across so there wouldn't be much of a cost difference. Discussion took place on the lots requiring utilities and it was determined PLANNING & ZONING COMMISSION MEETING MARCH 14, 2001 PAGE 3 there wouldn't be many that are affected. Further discussion took place on the depth of the pond and what those levels were at certain times of the year. City Council -Councilman Frazer reported that the agenda from the last council meeting was in the packet and he was available to answer any questions. 9-b. Borough Planning _ Commissioner Bryson gave a report on the KPB Planning meeting held on Monday, March 12. 9-c. Administration -Public Works Manager La Shot announced the RFP for the request for proposals for the update to the comprehensive plan had been sent out. ITEM 10: PERSONS PRESENT NOT SCHEDULED -- None ITEM 11: INFORMATION ITEMS 11-a. Wince-Corthell-Bryson correspondence regarding ADOT/PF Kenai River Bridge Access Road Pathway. ITEM 12: COMMISSION COMMENTS 8s QUESTIONS Commissioner Jackman stated she thought the Commission's decision to not put lots up for sale in Inlet Woods properly addressed the safety issue concerns addressed during the Commission's discussion of the matter. She recommended that if those lots should be made available for sale, those issues be addressed. Jackman stated it was the duty of the Commission to come up with solutions to the problem and to have more positive guidance. Jackman reported she would not be present at the March 28~ meeting. PLANNING & ZONING COMMISSION MEETING MARCH 14, 2001 PAGE 4 Commissioner Nord reported she would not be present at the March 28~ meeting. Commissioner Morse agreed with Jackman regarding Inlet Woods and thought the Commission should recommend the property be made available for sale and then deal with the safety issue. Morse noted, there was a lot more property back there that might be more suitable for a park. Commissioner Nord addressed the safety issue in Inlet Woods and pointed out there were safety issues all over the country as well as many parks with water and ponds. Nord stated she envisioned the area being seeded and the pond is nice looking when there is water. Nord thought the area was a nice location for a park. Chairman Goecke agreed and thought that Council would read the minutes and their concerns would be brought to their attention. ITEM 13: ADJOURNMENT Commissioner Glick MOVED for adjournment. The resulting lot sizes meet development requirements for the zone. Plat dedicates a 33-foot right- of-way along Strawberry Road. The Kenai Peninsula Borough should verify the correct name for 81St Avenue S.E. as shown on the preliminary plat. This is the street name that is currently shown on parcel base maps; however, the E911 System is addressing using North Strawberry Road. (The plot plan shows afour-plex; however, applicant has advised the structure will be a tri-pfex.? The Land Use Table permits up to afour-family dwelling in the rural residential zone. The development requirements table for this zone requires 20,000 square feet for each singleltwolthree family dwelling. The four family dwelling also requires 20,000 square feet. The lot is 1.62 acres, approximately 70,000 square feet. The proposed development would require 80,000 square feet so a variance for principal structures would be required to construct the third cabin. The applicant has provided a plat plan from McLane Consulting Group showing the site plan. This shows the Alaska Department of Environmental Conservation has approved the onsite water and sewer system. The requested Conditional Use Permit is consistent with other permits that have been issued in the Anglers Acres area. City Engineer- Parking and drainage appear to be adequate. Building Official, A building permit was issued on December 7, 2000 for construction of a tri- plex. The application indicates afour-plex and three cabins. The four-plex will not be allowed due to the restrictions of the building permit. RECOMMENDATIONS The proposed plan meets the development requirements for the City of Kenai in the rural residential zone for the tri-plex and two cabins. This tract often held a cow moose over the summer months and frequent visits by the local caribou herd. Many songbirds were seen over the summer there such as woodpeckers, white crown sparrows, robins, nuthatches, chickadees, and owls. + Naise will increase with the rise in the number of people (including vehicular traffic and pet animais)_ • The loss of tree and underbrush cover to buffer the sound will also keep the noise level higher than the previous years. • Traffic will increase with additional rentals on this stretch of road creating a walking ltazard. • Air quality will diminish with the increased amount dust thrown up by the increase in vehicular traffic on this dirt road. • Trespassing on my property will increase. Each year more people come to my cabin asking directions. Additionally many believe that ray lot is also a rental property and use it as a corridor to Beaver Creek. • The esthetics of a rural site and quality of life feeling diminishes considerably. • Property takes increase hurting single-family dwelling property owners. • Litter in this area will be mare with the increase in number of people that do not have a long term vested interest in this area. • With an increase in the numbers of these transient people I fear that vandalism will rise. This pathway will begin at the Kalifornsky Beach Road and end at the Kenai Spur Highway, a distance of approximately 5.3 kilometers (3.3 miles). The pathway, as proposed, is to be 10 feet wide and will roughly parallel the existing roadway. This project includes crossing the Kenai River. Our contract consists of preparing the appropriate environmental document, surveying, geotechnical analysis, and preliminary pathway and bridge design. This pathway segment will link existing and proposed pathways on each side of the Kenai River to complete the Unity Trail System loop between Soldotna and Kenai, Alaska. Typical targets of intentional discrim- ination claims under the FtlA include spacing requirements that say group homes must be a rerlain distance from each other. The FHA also rovers disparate impact claims, such as where a rule that limits how many non-relatives can live to- gether would affect group home mem- bers more than others. 'The municipality has to be given an opportunity ro craft an aocammodation. U you don't put it in the record and the municipality didn't have chance ro re- spond, you disadvantage yourself;' he says. The explanation for consent agenda items, which is on each of the Commission agendas, states: All items listed with an asterisk (*) are considered to be routine and non- controversial by the Commission and will be approved by one motion. There will be no separate discussion of these items unless a Commission Member so requests, in which case the item will be removed from the Consent Ageada and considered in its normal sequence on the agenda as part of the General Orders. (Emphasis added.} Action / No changes to the consent agenda: If consent agenda items (introductions of resolutions, approval of minutes, etc.) are to be approved without making any changes, action would be: Motion: "I move to approve the consent agenda as presented." Second: "I second the motion." Vote: Unanimous consent may be requested by a member or the chair may ask if there are any objections. If there are no objections to unanimous consent, the chair declares the motion passed by unanimous consent. If unanimous consent is not requested or there are objections to the request for unanimous consent, a roll call vote is required (the motion requires a majority to pass]. When an item with an asterisk (resolution for introduction, approval of minutes, etaJ comes up in the normal sequence and the consent agenda has been approved, there is no discussion on the item. Action/Removing? an item(sy from the consent agenda: If, for some reason, a commission member wants to discuss an item which appears on the consent agenda, the member would request the introduction of a resolution to be removed from the consent agenda and the item would then be "considered in its normal sequence on the agenda..." Action would be: Motion: "I move to remove Item 6-a, Resolution No. PZ_ from the consent agenda. Second: "I second the motion. Vote: Unanimous consent may be requested by a member or the chair may ask if there are any objections. If there are no objections to unanimous consent, the chair declares the motion passed by unanimous consent. If unanimous consent is not requested or there are objections to the request for unanimous consent, a roll call vote is required (the motion requires a majority to passJ. Action/Approval of the consent agenda as amended: If an item is successfully removed from the consent agenda, a second motion is then required to approve the consent agenda as amended: Motion: "I move to approve the consent agenda as amended." Second: "I second the motion." Vote: Unanimous consent may be requested by a member or the chair may ask if there are any objections. If there are no objections to unanimous consent, the chair declares the motion passed by unanimous consent. If unanimous consent is not requested or there are objections to the request for unanimous consent, a roll call vote is required (the motion requires a majority to pass). *Remember, if a resolution is removed from the consent agenda it would then require a motion to introduce it when it comes up in the normal sequence of the agenda, seconded, discussed and then voted on separately at that point. Action would then be: Motion: "I move to introduce Resolution No. PZ " Second: "I second the motion." Discussion Vote: Unanimous consent may be requested by a member or the chair may ask if there are any objections. If there are no objections to unanimous consent, the chair declares the motion passed by unanimous consent. If unanimous consent is not requested or there are objections to the request for unanimous consent, a roll call vote is required (the motion requires a majority to pass). Add Approval of Minutes to Consent Agenda Items: If there are no objections from the Commission, the approval of minutes will be included on the consent agenda in the future, If they are included on the consent agenda and there is an error found in a set of minutes, action would be taken at the approval of the consent agenda to remove them from the consent agenda so that the correction can be accomplished in the normal sequence of the agenda.
