MINUTES ITEM 1: CALL TO ORDER Chairman Goecke called the meeting to order at 7:00 p.m. 1-a. Roll Call Members Present: Carl Glick, Phil Bryson, Ron Goecke, Mike Morse Members Absent: Barb Nord, Donald Erwin, Amy Jackman Others Present: Councilman Duane Bannock, Administrative Assistant Marilyn Kebschull, Contract Secretary Barb Roper 1-b. Agenda Approval MOTION: Commissioner Bryson MOVED to approve the agenda to include the lay down items provided prior to the meeting and requested UNANIMOUS CONSENT. Commissioner Glick SECONDED the motion. There were no objections. 50 ORDERED. 1-c. Approval of Minutes: March 14, 2001 MOTION: Commissioner Glick MOVED to approve the Minutes of March l4, 2001 and requested UNANIMOUS CONSENT. Commissioner Bryson SECONDED the motion. There were no objections. SO ORDERED. 1-d. Consent Agenda MOTION: Commissioner Glick MOVED to approve PZO1-13 and requested UNANIMOUS CONSENT. Commissioner Morse SECONDED the motion. There were no objections. SO ORDERED. ITEM 2: SCHEDULED PUBLIC COMMENT -- None. ITEM 3: CONSIDERATION OF PLATS 3-a. PZ01-I2-Preliminary Plat-Inlet Woods Subdivision -Kenai Replat--Submitted by Integrity Surveys, 645 Swires Road, Kenai, Alaska. MOTION: Commissioner Bryson MOVED to approve PZO1-12 and Commissioner Morse SECONDED the motion. Kebschull indicated the lots were being combined in order to make them larger and confirmed the City of Kenai owned the lots, Councilman Bannock stated the idea to spur development was discussed during the; economic forum as well as the lack of large lots within the city. It was noted larger lots might sell better. Discussion also took place on the type of structures allowed on the larger lots. Box 987, Soldotna, Alaska. MOTION: Commissioner Glick MOVED to approve PZO1-14 and Commissioner Morse SECONDED the motion. Kebschull noted the Kenai Peninsula Borough needed to confirm the correct street name. Currently the parcel base map indicates the as 8161 Avenue SE and the E911 system lists it as North Strawberry Road. The Borough stated the road is State maintained therefore the State should be contacted. Kebschull added, the City is waiting to hear back from the Borough. Kebschull also noted, a right of way existed which currently is not being maintained. ITEM 4: PUBLIC HEARINGS 4-a. PZO1-11-An application for a Conditional Use Permit for Hotel (short-term recreational rentals( for the property known as Lot I, Block 2, Anglers Acres Subdivision, Part 2 (1230 Angler Drive), Kenai, Alaska. Application submitted by Brian Lowe, Hi-Lo Charters, I005 Angler Drive, Kenai, Alaska. MOTION: Commissioner Glick MOVED to approve PZO1-11 and Commissioner Bryson SECONDED the motion. There was no public comment. Kebschull noted the permit was for short-term recreational rentals in Anger's Acres and the applicant made no mention of food service but should that be introduced in the future, then staff recommended the appropriate DEC requirements be met. Kebschull also noted, the applicant provided a plot plan showing DEC approval for the onsite water and sewer system. Kebschull pointed out the plot plan indicated afour-plex, but the applicant advised the structure would be a tri-p1ex. Kebschull added, the structures must be inspected by the Fire Marshall and meet fire code requirements for the proposed use and inspected every two years after the initial Fire Marshall inspection. Kebschull drew attention to the letter provided prior to the meeting where a Mr. Lee expressed concern about trespassing. Kebschull reported the applicant owns the property on the other side and trespassing has never been an issue. Commissioner Bryson requested a point of order and requested the public hearing be formally opened. Chairman Goecke opened public hearing. There was no public comment and the public hearing was closed. Goecke stated he did not think the city should involve itself with DEC requirements for water and sewer, as that is a DEC problem and not the city's. Kebschull explained, with conditional uses in high-density areas, the city reserves the rigzt to require applicants meet DEC requirements as much focus had been placed on water contamination in those areas. Any documentation from DEC is kept in the file. City Council -- Councilman Bannock reported on the City Council agenda included in the meeting packet. He noted the city's new sign code was passed with ane minor addition. Bannock thanked the Commission for their excellent input. Bannock stated the Board of Adjustment had heard the appeal regarding the Michael Kent application and no decision had yet been made. However, as a result of that appeal, there is discussion about adding "lodge" and "guide service" to the land use table which would modify the definition for "hotel". After some discussion as to the conditional use permits for those types of uses, it was decided the item would be placed on the agenda for the next meeting so the full commission could discuss it in further detail. PLANNING & ZONING COMMISSION MEETING MARCH 28, 2001 PAGE 4 9-b. Borough Planning -Commissioner Bryson gave a report based on the Borough's agenda included in the packet. 9-e. Administration -Kebschull reported the following: • Comprehensive Plan proposals are due on April 9t~ and staff needs someone from the Commission to assist in the review process and the commissioner selected should be someone that will be available during the day. Kebschull requested a name be provided at the next meeting. • Letters would be sent to all day-care providers and B&B's within the city advising them of the requirement for a Fire Marshall inspection. • Referred to the memo included in the packet from the City Clerk addressing consent agenda items and noting that once a motiori approves a consent agenda item, then there shall be no discussion an the item. If discussion is required, the item needs to be removed from the consent agenda. • Referred to Item 9-c of the meeting packet addressing limitations on municipal regulation of radio antennas. Angler Acres Conditional Uses and Variance Permits Report ITEM 12: COMMISSION COMMENTS 8a QUESTIONS Commissioner Bryson reported briefly on the meeting held on March 27th regarding the Kenai River Bridge access road pathway. Commissioner Glick stated that because of the many conditional use permit applications for Angler's Acres, a new zone needed to be developed to fit that area as the recreation zone no longer works for that area. Goecke agreed. Chairman Goecke drew attention to the invitation in the packet for the Volunteer Appreciation Reception to be held on April 27th at the Kenai Senior Center. Day care is specifically listed as an allowed use under KMC 14.20.230. Applicant is applying for a day care permit to provide day care far 2-3 children under the age of 12. Applicant notes she has three children of her own under the age of 12. Prior to applying for the Home Occupation Permit, the applicant made arrangements for a fire inspection of the residence and has met the requirements of the fire code. As long as the day care is in operation, the residence must be inspected every two years from the initial date. WHEREAS, the current definition of "hotel" in 14.20.320 does not distinguish between large and small hotel-type uses; WHEREAS, adding a definition of "lodge" to describe a small (five or fewer rooms} hotel-type use, while redefining "hotel" to encompass more than five rooms, would clarify the Kenai zoning code; WHEREAS, the definition of "guide service" should be added to the Kenai zoning code duE to the increased number of guide services in the city; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF KENAI, Alaska, that KMC 14.20.320 is amended by changing the definition of "hotel" and adding the definitions of "guide service" and "lodge" as follows: "Guide Service" means any activity on any premises used for collecting or returning persons from recreational trips when remuneration is provided for the service. _ "Hotel" means a building or group of buildings containing more than five guest rooms used for the purpose of offering public lodging on a day-to- day basis with or without meals. "Lodge" means a building or group of buildings containing five or fewer guest rooms used for the purpose of offering public lodging on a day-to- day basis with or without meals. Communication Towers: THE SUBSTANTIAL EVIDENCE STANDARD OF THE TELECOMMUNICATIONS ACT OF 1996 by Alexander D. Ruskell, Esq. Congress enacted the Telecommunications Act of 1996 to promote competition and reduce regulation in order to secure lower prices and higher quality services for American telecommunications consumers and encour- age the rapid deployment of new telecommunications technologies. The Act preserves the authority of state and local governments to regulate the placement and construction of wireless service towers. How- ever, it also limits the manner in which state and local governments may exercise that authority, providing state and local governments may not deny construction of a wireless facility unless the denial is in writing and sup- ported by substantial evidence contained in the written record. Also, the denial cannot have the effect of prohibiting the provision of personal wire- less services. Finally, the Act prohibits discrimination among wireless ser- vice providers, requires local governments to act on permit applications within a reasonable time period, and disallows local governments from considering the environmental effects of radio frequency emissions. Much of the time, after a permit application is denied, the permit applicant will attack the local government's decision by claiming it is un- supported by substantial evidence. Substantial evidence does not mean a large or considerable amount of evidence, but rather such evidence as a reasonable mind might accept as adequate to support a conclusion. Sub- stantial evidence is more than a scintilla, but Iess than a preponderance. The reviewing court also grants a degree of deference to the decisions of local decision-making authorities. However, the substantial evidence stan- dard must be applied using common sense standards of reason. In Telespectrum Inc. v. Public Service Commission of Kentucky, the court ordered the local authority to approve a tower permit because it found the ot~iginai denial was not based on substantial evidence. The deci- sion to deny the application rested on the testimony and a letter from the Chambers, whose home was approximately 412 feet from the proposed site of the tower. The only recorded opposition to the site was the Cham- bers' concerns they would be exposed to harmful microwave emissions and that their property value would dinunish. The court believed, while the Chambers may have been credible, sympathetic witnesses, their testimony was no more than unsupported opin- ion that there were alternative sites available. Importantly, under the Act, concerns of health risks due to emissions could not constitute substantial evidence in support of a denial. The proposed tower would have risen from the ridgeline of a mountain and extended 40 to 50 feet above the tree canopy. Except for the property owner who intended to lease the property to build the tower, the county's citizens were unanimous in their apposition to the tower siting. Forty citizens signed a petition in opposition, while 23 spoke in opposition during hearings on the proposal. Most importantly, the proposed tower would be inconsistent with the county's comprehensive plan, open space plan, and zoning or- dinance, which discouraged activities that would alter the continuity of the ridgeline. In a Pennsylvania case, the tower applicant ap- plied for a variance necessary for construction of the tower. Under the local ordinance, variances could only be granted if the applicant established unique physical characteristics of the property inflicted undue hard- ship,the property could not be developed in strict con- formity with the ordinance, the applicant did not cre- ate the hardship, the essential character of the neigh- borhood would not be changed, and the variance re- questedwas the minimum necessary to afford relief. At the hearing, the tower applicant provided almost no evidence about the physical characteristics of the property in question. Instead of Focusing on the characteristics of the property, the applicant fixed on the quality of service it could provide customers. In particular, it argued it needed the variance to "provide seamless coverage as required under its FCC license." The applicant never provided a description of how the particular land in question was unique and how its al- legedhardship was directly related to the unique char- acteristics ofthe land. The applicant's tower design called for a tower height nearly five times the height restriction in the district. It presented no evidence explaining why a shorter tower would prevent it from closing its gap in service. It showed no evidence of efforts to acquire other properties, locate on other sites, or explore alter- native tower designs. Ultimately, far the above rea- sons, the local authority correctly denied the applicant's permit application. The U.S. District Court for the Southern Dis- trict of California ruled a_decision must be basemen more than just residents' concern about neighborhood aesthetics. However, the court ruled the Ciry of EI Cajon properly denied a permit application because the proposed tower would create safety and security problems, which was a question of police power, not simply another "Not in My Backyard" complaint. Both the city and the applicant agreed the proposal was more compatible with commercially zoned properties than the suggested residentially zoned district. The court was also presented with a petition signed by 2 i 2 resi- dents opposing the project. Finally, the residents' ex- periences with another wireless provider made their observations on visual blight, noise, etc., more cred- ible since they were based on personal experience. The ultimate lesson is that if you choose to deny a permit application for a wireless communica- tions tower, make sure you have ample reasonable, credible, and clear evidence supporting your decision.
