Freas, Cit Clerk City of Kenai DATE: May 3, 2001 RE: PLANNING 8a ZONING COMMISSION MEETING MAY 23, 200I At their regular meeting of May 2, 2001, the City Council set dates to hold interviews far two city manager applicants. These interviews will be held in the council chazxxbers at 6:00 p.m, on May 23 and May 25, 2001. Because May 23, 2001 is the regular Planning 8~ Zoning Commission date and the council chambers is the regular meeting site, some adjustment needs to be made for your meeting. Some alternatives are: 1. Change the meeting date to May 22, 2001 at 7:00 p.m. in the council chambers. 2. Change the meeting date to May 24, 2001 at 7:00 p.m. in the council chambers. 3. Keep the meeting date as May 23, 2001 at 7:00 p.m. and move the meeting to the Kenai Seniar Center. 4. Cancel the meeting if Administration determines there will be no significant items requiring action. AN ORDINANCE OF THE COUNCIL OF THE CITY OF KENAI, ALASKA, AMENDING KMC 14.20.321 (BED AND BREAKFAST ESTABLISHMENTS) TO PROVIDE: 1} THAT APPLICANTS MUST PROVIDE EVIDENCE OF BEING CURRENT ON ALL CITY OBLIGATIONS PRIOR TO ISSUANCE OF A PERMIT; 2) TO PROVIDE FOR AN ANNUAL REPORT SUMMARIZING ON-SITE ACTIVITY FOR THE YEAR; 3) SETTING FORTH STANDARDS FOR REVOCATION OF CONDITIONAL USE PERMITS FOR NON- COMPLIANCE WITH THE TERMS OF THE PERMIT, VIOLATIONS OF THE Kenai ZONING CODE, OR DELINQUENCY IN CITY OBLIGATIONS. Freas, City Clerk Introduced: Adopted: Effective 14.20.321 Bed and breakfast establishments. {a} Intent; It is the intent of this chapter to permit bed and breakfast establishments by conditional use which is compatible with other permitted uses, with the residential character of a neighborhood, and which is clearly secondary or incidental to the residential use of the main building. (b) Provided that these establishments shall be owner-operated, not more than one person outside the family shall be employed in the bed and breakfast; rent out no more than thirty percent (30%) of the total floor area; have adequate off-street parking for owner and all guests; and shall meet all other requirements as set forth by the Planning and Zoning Commission at the time of public hearing. (c} The bed and breakfast establishment must meet all area, height, and setback requirements of the zones in which they are allowed according to the Land Use Table. (d).Issuance of the permit. Freas, City Clerk Introduced: Adopted: Effective: DRAFT 14.20.150 Conditional use permits. (a) Intent. It is recognized that there are some uses that may be compatible with designated principal uses in specific zoning districts provided certain conditions are met. The conditional use permit procedure is intended to allow flexibility in the consideration of the impact of the proposed use on surrounding property and the application of controls and safeguards to assure that the proposed use will be compatible with the surroundings. The commission may permit this type of use if the conditions and requirements Iisted in this chapter are met. The allowed uses are listed in the Land Use Table. Before a conditional use permit maybe granted, the procedures specified in this chapter must be followed. (b) Applications. Applications for a conditional use permit shall be filed in writing with the Planning Department. The application shall include, but is not limited to, the following: (1) Name and address of the applicant; (2) Verification by the owner of the property concerned if other than the applicant; (3) A legal description of the property involved; (4) A description of the proposed use; (S}Dimensioned plot plans showing the location of all existing and proposed buildings or alteration, and such data as may be required; and {6} The appropriate fee. {c) Public Hearing. If the application is in order, a public hearing shall be scheduled in accordance with the requirements of KMC 14.20.280 of this title. (d) Review Criteria. Prior to granting a use permit, it shall be established that the use satisfies the following conditions: (1) The use is consistent with the purpose of this chapter and the purposes and intent of the zoning district; (2) The value of the adjoining property and neighborhood will not be significantly impaired; (3}The proposed use is in harmony with the Comprehensive Plan; {4} Public services and facilities are adequate to serve the proposed use; {S) The proposed use will not be harmful to the public safety, health or welfare; (6) Any and all specific conditions deemed necessary by the commission to fulfill the above- mentioned conditions should be met by the applicant. These may include, but are not limited to measures relative to access, screening, site development, building design, operation of the use and other similar aspects related to the proposed use. [e](h) Modification of final approval. (1) An approved conditional use permit may, upon application by the permittee, be modified by the Planning and Zoning Commission; (a) When changed conditions cause the conditional use to no longer conform to the standards for its approval; (b) To implement a different development plan conforming to the standards for its approval. (2) The modification application shall be subject to a public hearing and a filing fee. ([f]i) Expiration--Extensions--Transferability. (1} An approved conditional use permit lapses twelve (12) months after approval if no building permit is procured or if the allowed use is not initiated. {2) The Commission may grant time exkensions not to exceed six (b) months each upon a finding that circumstances have not changed sufficiently to warrant reconsideration of the approval of the conditional use permit. A request for an extension must be submitted prior to the expiration of the permit. A public hearing shall not be required prior to granting an extension of time. (3) A conditional use permit shall automatically expire if for any reason the conditioned use ceases for a period of one (1) year or longer. (4) A conditional use permit is not transferable from one (1) parcel of land to another. Conditional use permits maybe transferred from one (1}owner to another far the same use, but if there is a change in use on the property, a new permit must be obtained. Kent PO Box 3033 Kenai, Alaska 99611-3033 ~...__..,_~ ...~,,.w =..~ i k AIR 2 7 2001 ._ . _~ RE: KENAI PENINSULA BOROUGH HABITAT PERMIT KRC# 3557 Issued: April 24, 20x1 Expires: December 31, 2001 Permit for Installation of an Elevated Light Penetrating Walkway, Ramp, (Cabled Spruce Tree or Root Wads) and Floating Dock Dear Mr. Kent: Pursuant to KPB 21.18, the Kenai Peninsula Borough {KPB) has approved the proposed project to install 40-feet of rootwad bank stabilization, an 8-foot by 10-foot floating dock, a 4-foot by 20-foot ramp, and a 6-foot by 4-foot cantilevered elevated light penetrating (ELP) gratewalk. This work will occur along the right bank of the Kenai River at River Mile 10 adjacent to Tract 3, Anglers Acres Subdivision, Lowe Addition, Section 11, T. 5 N., R. 11 W., S.M., AK, KPB Parcel I.D.: {049-390-52). The ramp and gratewalk will be constructed of wooden or metal frames with open metal grate panels. The structures will allow at least 75%-light penetration. The gratewalk will be supported on 1.5-inch diameter pipe piling driven into the bank a minimum of 12- inches in from and above ordinary high water. Alf parts of the ELP walkway and landing, except for the vertical supports, will be a minimum of 8-inches above the ground. No portion of the gratewalk or landing will be constructed below ordinary high water. The 6- foot by 4-foot ELP gratewalk along the river will extend out to the river's edge or will cantilever no more thanl2-inches over the river. The 40-foot rootwad bank stabilization will consist of five tiers of rootwads topped with a single 12-inch willow brush layer. The toe of the project will be installed at approximately +11' mean lower low water and progress up the bank in five overlapping tiers to above the 19-foot mean high tide line. The trunks of the rootwads will be entrenched into the bank and anchored into place using rebar driven through the footer anchoring logs as well as helical earth anchors. Three to six-inch diameter rock will be placed to fill the voids between the rootwads and foa#er fogs to a depth of approximately 12-inches. 1~~. Those portions of the project that take place above OHW are allowable activities under KPB 21.18.070 B 3, provided they are built to the following minimum requirements: "Grafewalks and stairs with at leasf 75% light penetration, must be constructed so fha# no part, other than the supporting posts, are within 8 inches afiF the ground. Grafewalks and stairs wifh less than 75% but a minimum of 25% light penetration must be construe#ed so that no parts, other than the supporting posts, are less than T 8 inches off the ground." The Permittee is responsible for the actions of the contractors, agents, or other persons who perform work to accomplish the approved plan. For any activity that deviates from the approved plan, the permittee shall notify the Kenai River Center and obtain written approval before beginning the activity. All areas disturbed by project activities within the 50 foot Habitat Protection Area shall be vegetated with naturally occurring woody vegetation to provide additional bank protection. Revegetation shall be accomplished with rooted cuttings, transplanting, seeding, live staking andlor brush mattressing. Revegetation of any disturbed areas shall occur wi#hin mean high water (MHW) to 50 feet back from MHW. Trees or other woody vegetation for the project shall not be obtained within 50 feet of any specified anadromaus waterbody, including the Kenai River. Techniques steal[ be employed to avoid the introduction of sediments, contaminants, and other materials into the waters of the Kenai River both during and after construction. Certain habitat protection measures along the Kenai River may qualify for a Tax Credit. An application for this program is enclosed for your consideration. Discussion-Ordinance amending KMC 14.20.321 to provide: 1 }That applicants must provide evidence of being current on all city obligations prior to issuance of a permit; 2) To provide for an annual report summarizing on-site activity for the year; 3) Setting forth standards for revocation of condition use permits far non-compliance with the terms of the permit, violations of the Kenai Zoning Code, or delinquency in city obligations. c.
