Agenda Approval MOTION: Commissioner Glick MOVED to approve the agenda and requested UNANIMOUS CONSENT, Commissioner Morse SECONDED the motion. There were no objections. SO ORDERED. ITEM 2: APPROVAL OF MINUTES -- MAY 9, 2001 Minutes were approved by consent agenda. ITEM 3: SCHEDULED PUBLIC COMMENT -- None ITEM 4: CONSIDERATION OF PLATS: 4-a. PZO Z-20---KENAI TOWNSITE 200 ~ REPEAT-Submitted by Johnson Surveying, P.O. Box 27, Clam Gulch, Alaska 99568. MOTION: Commissioner Erwin MOVED to approve PZO1-20 and Commissioner Morse SECONDED the motion. Kebschull indicated that staff had nothing additional and also pointed out that it meets the setback for commercial zones. Chairman Goecke noted that the number on the resolution, Item 4-b in the packet, is incorrect. It reads PZ01-120 and it should be PZ01-20. Kebschull stated she would have that corrected. Resolution PZQ1-21 recommending to the Council an Ordinance amending KMC 14.20.321 to provide: 1~ That applicants must provide evidence of being current on all city obligations prior to issuance of a permit; 2) To provide for an annual report summarizing on-site activity for the year; 3) Setting forth standards for revocation of condition use permits for non-compliance with the terms of the permit, violations of the Kenai Zoning Code, or delinquency in city obligations. MOTION: Commissioner Glick MOVED to approve PZ01-21 and Commissioner Morse SECONDED the motion. When asked if staff had any additional Kebschull reported that a substitute resolution was brought in to the meeting which reflects a more realistic time period for the annual reporting by permit holders. The substitute resolution would allow the permit holder to submit an annual report between the period October 1 to December 31. Additionally, administration would not issue a permit until expiration of the 15-day appeal period. AMENDMENT: Commissioner Bryson MOVED to accept the substitute resolution for PZ01-21 and Commissioner Morse SECONDED the motion. Resolution No. 2001-32 - A resolution of the Council of the City of Kenai, Alaska, that the contract for planning services -City of Kenai Comprehensive Plan be awarded to Kevia Waring Associates for the total not-to-exceed amount of $79,745. Kebschull noted that this item should not have been included on the agenda and reported that the contract has been sent. ITEM 9 : CODE ENFORCEMENT -- None ITEM XO: REPORTS: a. City Council - No report b. Borough Planning - Comrnissioner Bryson gave a report based on the agenda included in the meeting packet. e. Administration -Kebschull reported that the City Council had a public interview scheduled for the two finalist for the City Manager position. Box 2295 Soldotna, AK 99669 Requested Action: Encroachment Permit -- Rear & Front Setback Legal Description: I_ot 16, Block 9, Inlet Woods Subdivision Street Address: 1301 Equinox Way KPB Parcel No.: 04101227 Existing Zoning: RS-Suburban Residential Current Land Use: Residential Land Use Plan: Medium Density Residential ANALYSIS General Information: KMC 14.20.185 details the intent and application process for Encroachment Permits. The Code also outlines the review criteria that should be used by the Planning and Zoning Commission to determine if an Encroachment should be granted. The Commission shall establish a finding that all of the following conditions exist as a prerequisite to issuance of an Encroachment permit: 14.20.185 Encroachment permits. {aJ Definitions. "Encroachment" means any object or structure above or below ground and constructed or located in a manner other than set forth in the Development Requirements Table. {b1 Intent. An encroachment permit is the relaxation of the development requirements of this chapter to remedy encroachments which do not fall under Section 14.20.050, nonconforming uses and which satisfy the requirements of financial institutions. {c1 Permit Application. An application for an encroachment permit shall be filed in writing with the City Planning Department and signed by the owner of the property concerned or representative of the owner. A fee of one hundred dollars {5100.00) shall be paid to the PZOI-23 Comments Page 2 City of Kenai at the time the permit application is filed. {1 }The application shall contain the following: (A} A legal description of the property involved; (B} Plans showing the location of all existing buildings, rights-of-way or easements, setbacks, elevations, and any data pertinent to the application. {d1 Review Criteria. The Planning Department shall submit the application to the Planning Commission for review and public hearing. The Planning Commission shall establish a finding that all of the conditions set forth in subsections (d) {1} through {d}{4} of this section have been found to exist before issuing an encroachment permit. {1} An encroachment as defined in KMC 14.20.185{a} exists. f2} The encroachment does not encroach upon a i=ederal, State ar City right-of-way or utility easement. L3} The issuance of the encroachment permit will not authorize a use which is not a principal permitted use in the zoning district in which the property is located. {4} The encroachment is not located across a platted lot line. {e} Public Hearing. The public hearing and notification procedure for an encroachment permit application shall be accomplished in accordance with the requirements of this chapter. {f} Unauthorized Encroachments. Unauthorized encroachments shall be immediately removed by the owner upon being given notice by the City. Notice shall consist of a written letter, sent by certified mail return receipt requested, or by personal service, explaining the violation and allowing twenty {20} days to remove the encroachment. {g} Expiration of Permit. Permits shall expire automatically upon termination or interruption of the use; damage to the building, structure, or object which makes it uneconomic to repair the building, structure, or object; or, the expiration of the useful life of the building, structure, or object, whichever comes first. [h) Right to Appeal. Any revocation, suspension, or denial of an encroachment permit by the Planning Commission may be appealed to the City Council by filing a written notice of appeal with the Clerk and stating the grounds for such appeal. The appeal notice shall be filed within thirty {30} days after the effective date of the revocation, suspension, or denial of the request for the encroachment permit. All notices of appeal must comply with Section 14.20.290. {i} Administrative Exemption. The Administrative Official may grant an encroachment permit without a public hearing if the total encroachment, inclusive of all front, rear and side setbacks, does not exceed twelve { 12} inches; and provided that: { 1 } The allowed encroachment on any one { 1 } front, rear or side setback may not exceed ten percent {10%? of the setback as contained in the Development Requirements Table, or twelve {12} inches, whichever is less; and {2} The Administrative Official finds that the review criteria in KMC PZO1-23 Comments 14.20.185fd] are met. (Ords. 1188, 1817-99} Page 3 The Development Requirements Table notes additional requirements for yards of corner lots, "The minimum side yard on the street side, or platted right-of- way, or government easement of corner lot shall be the same as the minimum front yard required for that zone. The front yard setback requirement is 25 feet." This is a corner lot with two sides fronting streets requiring two front setbacks. Applicant has asked for a variance from the March 14, 2001 ~PZ01-10} rear setback requirements. The variance was granted for 15 feet, Due to as-constructed conditions and 1.4 feet from the front yard setback the applicant is seeking an encroachment permit of an additional .1 foot or 1110 of a foot from the previously granted 15-foot rear setback. Applicant worked with the Building Official and Planning Administration on the original variance to determine how to situate the structure on the lot with the least adverse affects on adjoining property owners. Setbacks are determined from the front view of the structure. The garage faces Wedgewood Drive; however the front door to the house is off Equinox Way. It was decided that requesting afive-foot variance from the rear setback would be reasonable especially in light of the fact that if the front door faced Wedgewood Drive that setback would meet the side setback requirements. The house however, was constructed with the noted encroachments. City Ewngineer: None. Building Official: Minimum front setback to garage per KMC 14.20.200 is 10'. Therefore, the distance noted to garage from the front property line of 23.6' is in compliance. However, the living space aver the garage is required to have a 25' setback from the front property line. Therefore, an encroachment permit is necessary for the front. RECOMMENDATIONS Approval.
