City Council -- Councilman Bannock reported on the City Council agenda for June f, 2001 which was included in the meeting packet. 10-b. Borough Planning -Commissioner Bryson gave a report based on actions taken at the May 29 and June 1 I Borough Planning meetings. 10-c. Administration - Kebschull reported there would be a STIP meeting with DOT on June 18~ in the City Council Chambers. Kebschull encouraged the Commission to attend the July 18~ City Council meeting as Kevin Waring and Associates will be in attendance to discuss the Comprehensive Plan. All Boards and Commissions will be invited to attend. She also noted, this would be the first council meeting for the new City Manager. This parcel is owned by the City of Kenai and is the site of the future youth detention facility. The plat was reviewed by administration and the following changes are recommended: 1. Rename plat to Baron Park, Kenai Youth Facility Addition. 2. Parcel above the subdivided portion should be noted as "unsubdivided" instead of "unsubdivision." City Engineer: A small portion of Tract A appears to be within the conservation zone. In 1983, the Kenai Peninsula Borough Planning Commission passed Resolution 83-6 that allowed an exception to the 25-foot setback for this property {copy attachedy. This property is zoned Rural Residential which requires a 15 foot setback for the side setbacks. The drawing provided shows setbacks of 12.2', 10', 10' on the existing structure. Based on the date of construction, this structure would be grand fathered as anon-conforming use. However, the applicant wishes to build an addition on the structure that requires an Encroachment Permit to allow the Building Official to issue the building permit. The Code also outlines the review criteria that should be used by the Planning and Zoning Commission to determine if a variance should be granted. The Commission shall establish a finding that all of the following conditions exist as a prerequisite to issuance of a variance permit: 1. Special conditions or circumstances are present which are peculiar to the land or structures involved which are not applicable to other lands or structures in the same zoning district. 2. The special conditions or circumstances have not been caused by actions of the applicant and such conditions and circumstances do not merely constitute a pecuniary hardship or inconvenience. 3. The granting of the variance shall not authorize a use that is not a permitted principal use in the zoning district in which the property is located. 0128 Comment Page 2 4. The granting of a variance shall be the minimum variance that will provide for the reasonable use of the land andlor structure. 5. The granting of a variance shall not be based upon other non- conforming land uses or structures within the same land use or zoning district. The structure is currently considered anon-conforming structure because the structure did not meet the setback requirements when the City took over zoning in 1984. The applicant wishes to build an addition on the structure that wilt require a variance from the side yard setback. The structure is currently encroaching and the new addition would further encroach on the side setback. The addition would be within 6 feet of the property line requiring a variance of 9 feet. The applicant has provided a letter from the adjoining property owner that states they are aware of the present situation and are not against the addition to the structure. fCopy attached.] City Engineer: None.
