Fandel 283-4501 702 Lawton Drive Kenai, AK 9961 1 Requested Action: Conditional Use Permit - Guide Service Legal Description: Lot 18, Block 1, Angler Acres Subdivision, Part 2 Street Address: 1325 Angler Drive KPB Parcel No.: 04939021 Existing Zoning: RR-Rural Residential Current Land Use: Residential Land Use Plan: Low Density Residential ANALYSIS General Information: KMC 14.20.150 details the intent and application process for conditional uses. The code also specifies the review criteria that must be satisfied prior to issuing the permit. The criteria are: 1. The use is consistent with the purpose of this chapter and the purposes and intent ofi the zoning district; 2. The value of the adjoining property and neighborhood will not be significantly impaired; 3. The proposed use is in harmony with the Comprehensive Plan; 4. Public services and facilities are adequate to serve the proposed use; 5. The proposed use will not be harmful to the public safety, health or welfare; 6. Any and all specific conditions deemed necessary by the commission to fulfill the above-mentioned conditions should be met by the applicant. These may include, but are not limited to measures relative to access, screening, site development, building design, operation of the use and other similar aspects related to the proposed use. 0130 Comment Page 2 Applicant is purchasing the property at i 325 Angler Drive to use in his sport fishing guide business that has previously been operated outside of city limits. The current property owner, Nigel Guest, has provided written permission for the application. Mr. Fandel states on this application that the business is to include the use of boatSs}, boat dock, walkway, ramp, parking and all facilities generally associated with a sport fishing guide business. In discussing the application with Mrs. Fandel, she advised that there would be a picnic area at the site for guests to use. The Fandels may provide basic picnic supplies such as paper plates, disposable cups, eating utensils, etc. Mrs. Fandel clarified that they will not be providing food other than an occasional snack such as cookies, donuts, etc. Mrs. Fandel was also questioned as to whether the intent was to expand the business to provide cabin rentals or lodging. She advised that they did not intend to provide those services now. Mrs. Fandel was informed that to modify the permit in the future would require an additional public hearing. There are a number of Conditional Use Permits operating in the Anglers Drive area. It appears that the requested application is consistent with other uses currently active in the area. In the past, the Commission has limited guide boats to three per site. City Engineer: Nothing additional Building Official: No building code issues. We are scheduled to brief you and City Council members on the project at the City Council's July f 8~ meeting, This letter is to introduce you and council members to some key #acts about the project in advance of the July 18~' meeting. • Project purpose. The purpose of the project is to develop a new strategic Comprehensive Plan for land use and community improvements for adoption and impiementa#ion by the City of Kenai. • Special issues, Special attention will be give to planning issues related to th® Daubenspeck Tract, the Kenai Spur Highway comdor, and the municipal airport. Strategic planning workshop. In September, the planning team will conduct a local strategic planning workshop with P & Z commissioners and a broad cross-section of the community to develop strategic goals for th® Comprehensive Plan. • Public participation and review. The work plan provides for substantial work time in Kenai for data collection and interviews, and workshops and reviews with the Planning Commission and advisory groups. The Strategic Planning Workshop is planned for September, with additional local meetings to review interim reports and plan alternatives as the project progresses. Our goal is to complete a Final Draft Plan, approved by the Planning and Zoning Commission, by next May. • Consultant team. The consultant team consists of Kevin Waring of Kevin Waring Associates (Anchorage), Eileen Bechtol of Bechtoi Planning and Development (Homer}, and Elizabeth Benson of Benson Planning Associates (Anchorage}. Together, the planning team has over six decades of planning experience with Alaska communities.
