MOTION: Commissioner Nord MOVED that the property dedicated for the youth detention facility is not needed far City public use but is needed for a public purpose by the State of Alaska. PLANNING & ZONING COMMISSION MEETING AUGUST 8, 200 i PAGE 2 7-c. Proposed 1002 Foreclosure Sale -Determination if proposed parcels needed for public purpose. City Engineer La Shat reported the Parks and Recreation Commission made a recommendation that parcel #4710104 at 807 Peninsula Avenue be retained for public purpose. La Shot added, the parcel is next to an existing park that could be expanded if the lot was retained. Commissioner Nord asked about the right-of--way and La Shot replied there is no road going between the park and the parcel in question. MOTION: Commissioner Bryson MOVED to dispose of the lots with the exception of the parcel at 807 Peninsula Avenue which can be attached to the existing park in the event of a vacation of the right of way. Discussion of KPB Ordinance 2001-29, An Ordinance Amending KPB Chapter 2.40 Regarding Planning Commission Membership and Apportionment. Commissioner Bryson explained the purpose and the necessity of the proposed ordinance change to bring balance to the Borough Planning Commission. He noted, currently the Commission is required to have one member from each first-class and home-rule city to enable the Commission to comply with apportionment requirements without increasing the membership. Bryson indicated that increasing the membership would be unmanageable. ITEM 8: PENDING ITEMS -- None ITEM 9: CODE ENFORCEMENT -- None ITEM 10• REPORTS 10-a. City Council -Councilman Bannock provided a report from the City Council's August 1, 2001 agenda that was included in the packet. Discussion took place on the Five Irons Heights performance band. Councilman Bannock explained the successful and only bidder, Sean Anderson, questioned the requirement of the PLANNING & ZONING COMMISSION MEETING AUGUST 8, 2001 PAGE 3 performance bond which would assures the City the required work would be completed. Bannock added, the cost of the bond was $5,000 and could have affected the appraisal of the property. Commissioner Jackman asked if anyone purchasing property within the City would be required to provide a performance bond. Ban.rtock replied these bonds would be required for specific developments and also noted this was not required by ordinance but by the wishes of city council. 10-b. (a) Intent. Subject to the development requirements of this section, home occupations include, but are not limited to, the following uses: (1) Art studio. (2) Day care of no more than eight (8} children under the age twelve (12), including children related to the caregiver. (3) Dressmaking. {4}Millinery. {5} Beauty parlor. (6) Tutoring and musical instruction. {c} Uses Prohibited. (1) Commercial auto and boat repair. (2) Commercial kennels or similar uses. (3) Convalescent homes for the care of more than two patients. (4) Mortuaries. (5) Private schools with organized classes. (6) Real estate office. {7) Restaurants. (d} Development Requirements. {1 }Not more than one person outside the family shall be employed in the home occupation. (2} No more than thirty (30%} percent of the gross floor area of all buildings on the lot shall be used for the home occupation. (3) The home occupation shall be carried on wholly within the principal building, or other buildings which are accessory thereto. Any building used for a home occupation shall be wholly enclosed. (e) Permit Application. (1) An application for a home occupation permit shall be filed in writing with the Ciky Planning and Zoning Department and signed by the person requesting to operate the home occupation. (2) If the Planning and Zoning Department finds the application meets the criteria of KMC 14.20.230 it shall be placed on the consent agenda of the Planning and Zoning Commission. Applications fisted on the consenk agenda are considered routine and will be approved by one mokion. There wilt be no separate discussion of the application unless a member of the Commission so requests, in which case the item will be removed from the consent agenda and considered in its normal sequence on the agenda as part of the general orders. {3) A finding by the Planning and Zoning Department that an application does not meet the criteria of KMC 14.20.150 and denial of placement on the consent agenda may be appealed to the Planning and Zoning Commission by filing a written appeal with the Kenai City Clerk within khirty (30) days of the date of denial. (4) Notice of the consideration by the Commission of a home occupation permit application shall be published once at least two (2) days prior to the meeting in a paper of general circulation in the City of Kenai. (f) Permits non-transferable. A home occupation permit granted under this section shall not be transferable to another person or location. (g) Exemption. No home occupation permit shall be required for activities or business which are carried on solely by use of phones, computers and mail or delivery services and which involve no outside sign, little or no increase in traffic, and with only occasional visits by members of the public to the home. (h} Fire Code Inspections. (1 }Day care facilities shall be inspected by the Fire Marshal for compliance wiht the fire code (KMC 8.05) prior to approval of the permit. Thereafter, they shall be inspected every other year by the Fire Marshal. Failure to comply wi#h the fire code (KMC 8.05) shall be grounds far the suspension or revocation of the facilities' home occupation permit. (2) Residences which are the subject of a home occupation permit application (other than day care facilities) may be required to be inspected by the Fire Marshal for compliance with the fire code (KMC 8.05) prior to approval of the permit, if the Fire Marshal determines it is necessary for public safety. Attached is a memo from Kim Howard regarding the above-referenced lease application. Ms. Howard describes the lease request and administration's recommendations. The Planning Commission needs to determine if the intended use complies with the zoning ordinance and comprehensive plan of the City. This property is located in the Light Industrial zone. The use is considered non- conforming and is addressed in KMC 14.20.050 (h). The requested lease brings up several questions as to whether or not the use maybe continued. This section of the code states, Exception to this Section - Outside Storage of Junk. Notwithstanding the provisions of this section, no junked vehicle or junk shall be stored outside and no unenclosed junk or wrecking yard shall be maintained in a location which is visible from a city or state road in any zone. However, the Commission may grant a conditional use permit under the procedure specified in this chapter allowing said use to continue for a specified period of time if: { 1) An eight {8') foot high sight-obscuring fence of good appearance has been provided around said use. I requested the City Attorney review the lease application and this section of the code for legal guidance. Mr. Graves advised that in his opinion he believes that the goal behind Lease Application-Lot 4, Block 5, Cook Inlet Industrial Air Park & Adjacent R.O.W. Page 2 non-conforming uses is to gradually eliminate them. However, this section of the code provided for a means to allow the junk or wrecking yards to continue for a period of time with a conditional use permit. Mr. Graves notes that the city never required these businesses to apply for or receive the conditional use permit. The city has considered the uses "grand fathered." With the requested transfer, the question arises if the use may continue after it has been discontinued. (The current lessee has vacated the premises.) A review of case law and the conditional use section of the Kenai Municipal Code seem to provide for the use to continue up to 365 days before it would be terminated and that the use stays with the land. Thus, it appears that the use can continue as long as the property is screened as required. There is an issue that may arise regarding the required fencing. In this case, the lease includes aright-of--way that has historically been fenced. Should this fence be in disrepair so as to require a building permit to repair, a permit could not be issued to build in the right-of--way. Fences over six feet require building permits. With a 20-year lease and the condition of the current fence at this site, the fencing requirement may cause future problems to meet zoning requirements. This property is identified on the Airport Land Use map in the City's comprehensive plan. The property is identified for commercial/industrial use. APPLICANT: City of Kenai, 210 Fidalgo, Suite 2D0, Kenai, Alaska 99611. LOCATION: Within sections 5 and 6, T. 5 N., R. 11 W., Seward Meridian, Kenai. WORK: Construct I.2 miles of armor rock protected coastal trail, adjacent to the north bank of the Kenai River, and stabilize the currently eroding bluff by reducing the slope and vegetating the face. PURPOSE: To provide a recreational trail for the City of Kenai and stream bank protection to the north shore of the Kenai River. ADDITIONAL INFORMATION: The City of Kenai has designated Peratrovich, Nottingham & Dxage, Inc., 1506 West 36th Avenue, Anchorage, Alaska 99503 as their agent. The proposed project would require approximately 71,000 cy of fill material, 7,000 cy of filter rock, and 42,000 cy of armor rock be discharged below the HTL of the Kenai River. The majority of the fill material would be obtained from excavating trailhead ramps for coastal trail access. The remaining fill material would result from cutting back the top of the actively eroding bluff, up to 50' in some areas, to a stable slope. The proposed work would protect the structures adjacent to the top of the eroding bluff, including the historic Old Kenai Town site buildings. MITIGATION: The applicant has incorporated a 200' clear span bridge over a tidal estuary into the proposed project. The bridge will serve as a gateway for viewers to observe a healthy saltwater marsh environment. Educational signage will provide information on coastal ecology to visitors of the facility. WATER QUALITY CERTIFICATIpN: A permit for the described work will not be issued until a certification or waiver of certification as required under Section 901 of the Clean Water Act {Public Law 95-217), has bean received from the Alaska Department of Environmental Conservation. COASTAL ZONE MANAGEMENT ACT CERTIFICATION: Section 307 (c}(3} of the Coastal Zone, Management Act of 1972, as amended by 16 U.S.C. 1456{c}{3}, requires the applicant to certify that the described activity affecting land or water uses in the Coastal Zone complies with the Alaska Coastal Management Program. A permit will not be issued until the Office of Management and Budget, Division of Governmental Coordination has concurred with the applicant's certification. PUBLIC HEARING: Any person may request, in writing, within the comment period specified in this notice, that a public hearing be held to consider this application. Requests for public hearings shall state, with particularity, reasons for holding a public hearing. CULTURAL RESOURCES: The latest published version of the Alaska Heritage Resources Survey {AHRS} has been consulted for the presence or absence of historic properties, including those listed in or eligible for inclusion in the National Register of Historic Places. There is a grouping of buildings in the vicinity of the worksite collectively identified as Old Kenai. Because the buildings are directly adjacent to the proposed project area, a determination of eligibility and, if needed, a determination of effect will be made in consultation with the State Historic Preservation Officer (SHPO}. Consultation of the AHRS constitutes the extent of cultural resource investigations by the District Engineer at this time, and he is otherwise unaware of the presence of such resources. This application is being coordinated with SHPO. Any comments SHPO may have concerning presently unknown archeological or historic data that may be lost or destroyed by work under the requested permit will be considered in our final assessment of the described work. The project is designed to stabilize the bluff these structures are situated above. The applicant does not expect to have to relocate any of the buildings as a result of this proposal. ENDANGERED SPECIES: Preliminarily, the described activity will not affect threatened or endangered species, or their critical habitat designated as endangered or threatened, under the Endangered Species Act of 1973 (87 Stat. 899}. This application is being coordinated with the U.S. Fish and Wildlife Service and the National Marine Fisheries Service. Any comments they may have concerning endangered or threatened wildlife or plants or their critical habitat will be considered in our final assessment of the described work. ESSENTIAL FISH HABITAT: The proposed work is being evaluated for possible effects to Essential Fish Habitat (EFH} pursuant to the Magnuson Stevens Fishery Conservation and Management Act of 1996 (MSFCMA}, 16 U.S.C. et seq and associated federal regulations found at 50 CFR 600 Subpart K. The Alaska District includes areas of EFH as Fishery Management Plans. We have reviewed the January 20, 1999, North Pacific Fishery Management Council's Environmental Assessment to locate EFH. area as identified by the National Marine Fisheries Service (NMFS}. We have determined that the described activity may adversely affect 11 acres of EFH for adult Pacific salmon. This Public Notice initiates consultation requirements with the NFMS under the MSFCMA. We have insufficient information at this time to assess the cumulative effects of the proposed work on EFH, but cumulative effects will be considered in our final assessment of the described work. Any conservation recommendations regarding EFH for federally managed fish will also be considered in our final assessment of the described work. This proposed project might also adversely affect associated species such as major prey or predator species, which are not covered by Fishery Management Plans. SPECIAL AREA DESIGNATION: The project is located-within the Kenai River Comprehensive Management Plan boundaries. -2- E~JALUATION: The decision whether to issue a permit will be based on an evaluation of the probable impacts including cumulative impacts of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts, which the proposed activity may have on the public interest, requires a careful weighing of all those factors, which become relevant in each particular case. The benefits, which reasonably may be expected to accrue from the proposal, must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal., and if so, the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern fox both protection and utilization of important resources. All factors, which may be relevant to the proposal, must be considered including the cumulative effects thereof. Among those are consexvation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards, floodplain values, land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving 404 discharges, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agency's 904(b){1} guidelines'. Subject to the preceding sentence and any other applicable guidelines or criteria (see Sections 320.2 and 320.3}, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. The Corps of Engineers is soliciting comments from the public; Federal, State, and local agencies and officials; Indian Tribes; and other interested parties in order to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to determine whether to issue, modify, condition or deny a permit for this proposal. Background The Kenai Peninsula Borough selected its remaining entitlement selections as a result of the completion of the Kenai Area Plan that was adopted January 2000. The Kenai Area Plan identified all state lands in management units and identified the resources and primary land use designations for each unit. The land-use designations determine Iand classifications, and classifications determine which lands are conveyable to the borough as defined in AS 29.65 to be Vacant, Unappropriated, and Unreserved (VUU). Parcels that are classified as VUU are available for selection and conveyable to the Borough unless the plan's management intent directs otherwise or more detailed research determines the parcel is not conveyable. The Kenai Peninsula Borough prioritized its selections in priority order for the borough to receive conveyance of certain lands over a lower priority of conveyance of other selections. This preliminary decision is considering the borough's priority 1 selected Kenai Peninsula Borough Preliminary Finding and Decision Page 4 of 14 Iands totaling approximately 12,524 acres. The Borough's remaining entitlement is approximately 44,000 acres. The Borough's original entitlement under AS 29.65.010 was 155,780 acres. Flannin and Classif cation: Land Use Plan: The decision of what state lands are conveyable to the borough depends in large part on the designations and classifications contained in the Kenai Area PIan. The following designations that appear in the Kenai Area Plan are conveyable to municipalities: agriculture, grazing, general use, public facilities -transfer, dispersed recreation and settlement. Land designated as Resource Management -high value and materials maybe conveyable depending on the individual unit's intent. The Kenai Area Plan was developed through amulti-year process with extensive public, agency and borough input. The plan was adopted January 7, 2000. Land use classifications determine what land is considered vacant, unappropriated and unreserved (VUU) under AS 29.65.130{10). Land must be classified VW in order to be transferred to the Borough. The classification for land within the Kenai Area Plan is based upon Table 4.1 Upland Designations Conversion to Classifications contained in Chapter 4 of the plan. Each of the management units that are the subject of this preliminary finding and decision are conveyable to the Borough unless this best interest finding under AS 3$.05.035{e) determines otherwise. Alaska Coastal Management Program: Conveyance of state land to a municipality that will be counted against the municipality's remaining entitlement under AS 29.65 does not require an ACMP consistency review. This action is listed in the Categorically Consistent Approvals section of the Classification of State Agency Approvals (generally referred to as "the ABC List"} (OMB/DGC March 30, 1999). Environmental Risk: No hazardous material or contamination areas are known to exist on the selections made by the borough. The Kustatan Ridge selection, however, ADL 227937 is affected by PLO 2162, entire area is formerly within Cook Inlet Bombing and Gunnery Range; United States cannot and does not give assurance that contamination does not exist within any part of the area. Access: The selected areas are located on or near local roads providing access to the parcels with the exception of the Kustatan Ridge selection. This selection fronts on the western shoreline of Cook Inlet from where an all weather road extends from the shoreline westward through the southern portion of the selection area to the Kustatan River. This road also provides access to the parcel within Section 36, T 9N, R15W, SM., a parcel conveyed to the Borough in 1990. No physical access exists northward along the length of the selection. Kenai Peninsula Borough Preliminary Finding and Decision Page5of14 Easements, 50 feet wide on each side of section Iines, are dedicated far public highways under AS 19.10.010 and 11 AAC 51.025. AS 38.05.127 provide for public access easements to and along public and navigable waters. Water Bodies: Navigable and public waters are determined in accordance with AS 38.05.127 and i 1 AAC 51.035. There are no identified navigable waters in these selections. For the purposes of this decision, public waters are described as (a} water bodies at least 10 acres but less than SO acres in size, or (b) waterways at least 10 feet in width but less than 50 feet in width from ordinary high water mark to ordinary high water mark, unless previously determined to be navigable. Water bodies smaller than 10 acres in size or waterways less than 10 feet in width maybe determined to be public waters. Public waters will be subject to a public access easemen#, 50 feet wide, upland of the mean high water mark and further subject to a public access easement, 50 feet wide, to such waters from the nearest existing public easement at intervals of approximately ane mile. An existing easement may include roads, trails, section Iine easements dedicated under AS 19.10.010, or other surveyed public access easements. Kenai Peninsula Borough Preliminary Finding and Decision Page 6 of 14 A enc Review: Notice of the proposed actions was distributed far agency review on May 9, 2001. The following agencies responded: Division of Agriculture indicated it had no objections to any of the proposed conveyances to the KPB. Department of Administration commented only on ADL 227963, Kenai Court House parcel. DOA submitted copy of the letter from Commissioner Jim Duncan to KPB Assembly President Tim Navarre, dated April 23, 2001, indicating it had no intention to surplus the facility to allow transfer to the KPB. The facility is fully occupied by state agencies that would have to relocate to other locations at increased lease costs. DOA did not see itself as able to surplus the facility in the foreseeable future. Response: DNR is unable to transfer a facility without the facility being surplused by DOA. The Kenai Area Plan identified the possibility of the land and facility to be transferred only after more detailed research was done on the parcel. DOA has indicated that the facility is fully occupied with state agencies that would otherwise need to be relocated. Department of ash and Game indicated it had no objections to the conveyance of ADL 227962 Kalifornsky Road, ADL 227963 Kenai Court and Office, ADL 32145 Gray Cliffs, or ADL 227964 OhIson Mountain Road. ADL 227937 Kustatan Ridge ADFG commented that the specific management intent for Unit 169 of the KAP requires that the wetlands and forested edges along the base of the ridge remain forested, to provide bear travel corridors and escape cover for bear from the Trading Bay State Game Refuge. The plan provides that this vegetated buffer be retained by the state and to consider adding the buffers to the State Game Refuge. Habitat Biologists identified several buffer areas and recommended that these areas be retained in state ownership for future inclusion into the adjoining Trading Bay State Game Refuge. These areas are described by aliquot part descriptions and depicted on a map submitted with their comments. Additionally, ADFG recommended a vegetative buffer be provided for protection of east- westbear movement because of the long narrow configuration of the parcel. Their concern was that potential development of the parcel {e.g. logging) could become a barrier to bears traversing the area. Vegetated buffers were recommended at two locations identified on the map. Response: The KAP does provide for specific management intent for Unit 1 b9 by retaining a forested buffer (dead or alive} along the base of the ridge for bear travel corridors and escape cover. These areas are to be retained in state ownership and added to the State Game Refuge. These areas were described by aliquot part description. Further review of the legal descriptions with staff of DNR and ADFG determined that Kenai Peninsula Borough Preliminary Finding and Decision Page7ofl4 additional areas could be conveyed to the borough from the original legal descriptions submitted and still maintain protection of the buf~ j`er areas. This review reduced the amount of acreage of the buffer areas to be retained by the state from 1960 acres, originally identified by ADFG, to1620 acres. The area plan also stated that a conservation easement could be used to protect these areas, however, this kind of easement would be difficult to manage in this area. The vegetated buffers for east-west bear movement were ident fled to be 200 feet upland from the ordinary high water along both sides of the streams and certain uplands as shown on the ADFG map. The kind of development for the area is not known at this time, however the buffers will insure minimal conflicts for hear movement. These buffers will not be retained in state ownership and the acreage within the area will not be counted toward the borough's entitlement. Additionally, road access through these buffers should not be prohibited. (See Attachment Map No. 7) ADL 227964 Ohlson Mountain Raad ADFG is not apposed to this conveyance. ADL 227965 Juneau Creek it was recommended that this parcel not he considered for conveyance to the borough until the Sterling Highway Bypass route has been selected. It was pointed out that DOTPF has recently begun the process to develop a supplemental environmental impact statement for this project and the final route has not yet been selected. Alternate routes are proposed and depending an the route that is selected that parcel will be conveyed to the borough and the other parcel will be retained by the state. Response: DNR agrees that approval of this selection is premature at this time until the environmental impact process is complete and the location of the road bypass is determined by DOTPF. Department of Transportation and Public Facilities Regional PIanning responded concerning the ADL 227965 Juneau Creek selection having no abjection or comment. In a teiephane conversation with planning staff DOTPF had hoped the bypass route could have first been located before processing a selection to the Borough. Na comments were made concerning any of the other selections. Response: Postponing action on the selection of ADL 2279b5 will allow the ROW selection to be made without influence of a selection. If the highway bypass is located on the south side of the Kenai River this parcel will be retained in state ownership and re- designate this unit as Habitat and Dispersed Recreation. The management intent for the unit suggests that the location of the road first be determined before conveyance of the parcel, ADL 321 ~5 No comment was received from DOTPF. Gray Cliffs selection is conveyable to the Borough as stated in the management intent far Unit 188 Kenai Area Plan "...subject to a successful land exchange between the borough (for this unit) and the Seldovia Native Association (for land upon which the Seldovia landfill is located). The Kenai Peninsula Borough Preliminary Finding and Decision Page 8 of 14 mineral estate and all materials has defined by AS 38.05.965(IO)J will be reserved to the state if the unit as conveyed to another party including the borough and the Seldovia Native Association... "Therefore, conveyance of this parcel will be subject to this successful exchange between the baraugh and the Native Associatian and the state will continue to manage the parcel until such time that a QCD is fssued. Management to the borough will be transferred at the time of the issuance of the title document. The mineral estate and ald materials will be reserved to the state. Survey: A survey determination will be issued following the final decision. The borough will be required to survey land found to be unsurveyed prior to conveyance. Alternatives: 1) No action or rejection of the proposed conveyance has been considered. This option would deny the borough ownership of sites suitable for community development and Iocal economic growth. This option would also fail to provide land to the Borough as required under its municipal entitlement grant AS 29.65. 2) Approve the municipal selection for conveyance under AS 29.65 subject to existing third-party interests. This action would result in land being transferred to the Kenai Peninsula Borough and credited toward its municipal entitlement. Approval would benefit community development and economic growth. 3} Combination of the two above alternatives would protect the state's interest. In the case of the Kustatan Ridge selection, rejecting portions of the selection that are important buffer areas and included within the State Game Refuge would help protect the wildlife resources in the area. Concerning the runeau Creek selection postponement until the selection of the highway bypass is known will allow management of the unit as provided in the area plan. Recommendation It is recommended that alternative 3 be followed. Land approved for conveyance to the Kenai Peninsula Borough is subject to: 1) Any restriction, reservations or exceptions in the conveyance documents by which the State of Alaska acquired title and all platted and valid existing easements and reservations. 2) An easement, 50 feet on each side of section lines, dedicated to the state of Alaska for public highways under AS 19.10.010 and 11 AAC 51.025. 3) A public access easement, 50 feet wide, upland of the mean high water mark of water bodies and waterways identified as public waters pursuant to AS 38.05.127 and 11 AAC S1. Final determination as to public waters will be made with assistance from the DNR's Tech Data Management & Support Kenai Peninsula Borough Preliminary Finding and Decision Page9of14 Survey Section at the time of survey.
