5-a. PZO1-41-Resolution of the Planning and Zoning Commission recommending
that KMC 14.20.230 (Home Occupations be amended to allow home occupations in
residences in commercial zones.)
MOTION:
Commissioner Bryson MOVED to approve PZ01-41 and the recommended amendment
to KMC 14.20.230. Commissioner Erwin SECONDED the motion.
The Commission spoke briefly regarding details of the amendment of KMC 14.20.230
allowing home occupation in residences in commercial zones. No public comment.

5-b. PZO1-42-Conditional Use Permit for a governmental building, the Kenai
Youth Facility for the property known as T06N R11W S33 W1/2 Sec 33 lying north
of Kenai Spur Highway excluding Baron Park Sub No. 7 and Marathon Road. A
Preliminary Plat has been filed and parcel will be known as Baran Park
Subdivision, Kenai Youth Facility Addition. Parcel is located on Marathon Road,
bounded by HEA Access Road on one side and Marathon Road on the other.
Application Submitted by the City of Kenai and ECl HYER, 101 West Benson, Suite
306, Anchorage, AK 99503.
MOTION:
Commissioner Jackman MOVED to approve the conditional use permit.
Commissioner Glick SECONDED the motion.
Public Comment: Lt. Jeff Kohler- Kenai.
Kohler commented on the following items:
•The youth facility will serve as a juvenile detention facility with an approximate
ten-bed capacity. The facility would be designed to detain juveniles for less than
4S days.
•The City of Kenai maintains Marathon Road up to the Fire Training Center. Kohler
stated additional traffic would not be a concern as the site was partly chosen due
to location (Willow Street can be accessed from Marathon Road).
Architect Brian Meissner of ESI HYER spoke briefly to the commission and stated
the building would be located on a 10-acre parcel and any future building
expansion would be possible.
It was noted the Land Use Table allows government buildings in this area.

7-a. Discussion of Lease Application -Lot 4, Block 5, Cook Inlet Industrial Air Park
& Adjacent R.O.W.- Determine if lease meets zoning code and Comprehensive Plan.
MOTION:
Commissioner Bryson MOVED to approve the lease application. Commissioner Glick
SECONDED the motion.
Administrative Assistant Kebschull clarified several items concerning the application
and terms of the agreement:
•The lease is for anon-conforming use for a duration of 20-years.
•The Municipal Code requires an 8-foot fence to screen the use. If the fence became in
such disrepair that a building permit would be needed, a permit could not be issued
due to ROW regulations.

ANALYSIS
General Information:
KMC 14.20.185 details the definition, intent, and permit application process
for Encroachment Permits. Code also lists the review criteria that should be
considered by the Planning and Zoning Commission when determining i# a
permit should be granted. The Commission is to establish that the following
conditions exist before issuing an Encroachment Permit:
1. An encroachment as defined in KMC 14.20.185 {a1 exists.
2. The encroachment does not encroach upon a Federal, State or
City right-of-way or utility easement.
3. The issuance of the encroachment permit will not authorize a
use which is a not a principal permitted use in the zoning district
in which the property is located.
4. The encroachment is not located across a platted lot line.

This is a corner lot with three front setbacks (25 feety. In February 200, a
variance from the rear setback requirement was requested and received. The
variance is for 4 feet. An asbuiit provided shows that there is an
encroachment on the front of the building. The asbuilt shows 24.fi' instead
of the required 25 feet. This creates an encroachment of 4.8 inches.
Due to the size of the encroachment, KMC 14.20.185 Sit Administrative
1=xemptions was reviewed. The City Attorney advised that the permitted
variance is considered an encroachment so this encroachment would not
satisfy the requirements for an administrative exemption because it is over
the maximum of 12 inches.

SUB.lECT: Amendment to Land Use Table - Centra! Commercial Zone
Attached are suggested changes to the Land Use Table for the Central
Commercial Zone. There are six recommended changes. Changes as
suggested provide far residential use in the zone. Uses in the zone presently
contain bo#h residential and commercial uses similar to the Townsite Historic
District. Administration believes these changes provide for the best use of the
land in this zone. Please review the suggested changes. With the
Commission's support, a public hearing will be scheduled on the proposed
amendments.

(i) The property adjacent to the proposed dwelling group will not be
adversely affected.

(a) An uncleared buffer strip of at least thirty {30}feet shall be provided
between said use and any adjoining property in a residential zone.

This plat proposes to subdivide a 30-acre unsubdivided remainder of the adjacent Ruby's Dauiing Scenic View
Subdivision (Pla# KN 98-3). When subdividing large acreage remainder parcels such as this, which was not included
in the original preliminary design, and which is now in different ownership, staff has not required the subdivision of
the reminder parcel to carry the same plat name forward.
The plat will provide five smaller lots fronting on Beaver Loop Road, and a 23-acre Tract A which fronts by way of a
panhandle across the section line easement. An engineer's soils reportwill be provided for Lots 1-5 and an
engineer will sign the plat.
Staff is not requesting dedication of the section line easement since it accesses a large wetland complex and is not
required for dedicated access to any adjacent parcels. The easement wil! remain in place fvr public access.
Satellite imagery from June 2000 indicates ponding on this property. If these are not temporary tidal produced
ponds, staff recommends they be shown and labeled on the plat. Staff recommends the approximate limits of the
area subject to extreme tidal flooding be shown, if any.
Imagery also shows traveiways and clearing within the NE portion of this subdivision. Staff recomrtrends these be
shown and their use noted on the ptat.
The Kenai Planning And Zoning Commission reviewed this plat on July 25, 2001, They recommended approval,
with no concerns, noting that city water and sewer are not available to the parcel.
KPB Coastal Zone Management review indicates the subdivision is consistent with CMP. Development within this
subdivision may require permitting with the developer of any property responsible for obtaining all necessary local,
state, and federal permits.
Fioodplain and Kenai River Center review had not been received at the time of this report.
Per KPB Resolution 2000-025, if the Certificate to Plat indicates any beneficial interests affect this properly, they will
be notified and given 30 days from the date of the mailing of the notification #o respond. They are given the
opportunity to notify staff if their beneficial interest prohibits or restricts subdivision or requires their signature on the
final plat. If no response is received within 30 days, staff will assume they have no requirements regarding the
subdivision and it may be finalized.
No exceptions have been requested.
STAFF RECOMMENDATIONS: Grant approval of the preliminary plat subject to any above recommendations, and
the following conditions:

Staff has been contacted by Sharaiyn Wright, beneficiary to the Trust which awns or controls this property. She was
unaware of the submittal of this subdivision and has requested action be postponed. She has filed to remove the
Attorney who has acted as Trustee for this Trust.
KPB Records indicate that ownership is vested in the Waldo E. Coyle Revocable Trust with Sharalyn Sue Wright as
Trustee. No copy of the Certificate to Plat has been provided with the preliminary pla#. This would be a requirement
at final plat to indicate persons with any interest in the property, as well as the person(s) required to sign the plat.
Staff recommends the surveyor provide documentation to clarify the situation.
STAFF RECOMMENDATIONS: Postpone action on this plat to the September 10, 2001, pending submittal of a

This plat proposes to subdivide 10 acres out of two urge city-owned parcels. Marathon Road borders the
subdivision on the easterly side and Homer Electric Association's Kenai office and facilities lie adjacent to the
southwest. A wet area draining into Ryan's Creek lies along the west side with the airport complex appro~omately'/.
mile further west.
The site will be the location of an 8-10 bed youth detention facility. Baron Park #4 (Plat KN 86-19} provided a 50-
foot radius temporary turnaround at the end of the short northwesterly spur of HEA Access Road. It does not appear
that the terrain and the development pattern in this area will result in a need for extension of the spur to the
northwest. Staff recommends a cul~le-sac be provided to permanently end this road. kf the cui-de-sac is provded
to encompass a portion of the existing 60-foot dedication, and is not provided at the end of the dedication
overlapping the temporary turnaround, staff recommends the City consider a future vacation action far any
remaining portion of the temporary turnaround. if approved, this could be accomplished with a recorded Borough
resolution.
The easements on both sides of the section line running through this proposed subdivision appear to have been
vacated by a State Section Line Easement Vacation Plat {KN 85-13) north to the section corner common to
Sections 2$, 29, 32, and 33. Staff recommends this be shown or noted on the plat.
The Kenai Planning and Zoning Commission reviewed the plat on June 27, 2001. They recommended approval
subject to the name of the plat being changed to Baron Park Kenai Youth Facility Addition. Staff recommends the
fine! plat comply with the City's name preference.
KPB Coastal Zone Management retiew indicated no concerns with the plat but advised of the large wetland-type
area to the west. Staff recommends the wet area on or near the west boundary be shown and labeled on the plat.

This plat proposes to subdivide a 2.5 acre government or BLM lot into fsve lots. City water and sewer is available to
all lots.
The status shown on the plat is incorrect. Government lots typically were transferred with public access easements
reserved along all or some of the boundaries. The portion of 2"d Avenue that matches the dedication proposed by
this subdivision appears to be an easement and has not yet been formally dedicated. There is a road constructed
within the proposed dedication (this dedication also overlies a government lot public access easement) and the
adjacent easement to the south. Haller Street is shown correctly. The right-of-way in the middle of Wesbet
Subdivision, opposite the incorrect 3`d Avenue shown an this plat, should be labeled as Wesbet Court. Staff
recommends all status be corrected.
North of this proposed subdivision, BLM Lot 101 has been subdivided as White Country Estates Part 1 (Plat KN 93-
51). 3~d Avenue is located adjacent to the north boundary of that plat, 330 feet from the location shown. The
development pattern and the Evergreen Street frontage for BLM Lots 102 and 103 adjacent to the west boundary of
this subdivision do not appear to be conducive to extension of a right-of-way pattern for "3"d Avenue" as designed by
Porter's Acres.
KPB 20.20.160 requires that block lengths be greater than 400 feet. The City of Kenai has indicated to staff that
their code does not have a block length restriction. It has not been demonstrated that public access easements exist
on each side of the common lot line between former BLM Lot 101 and BLM Lot 104 being subdivided by this plat.
Staff does not feel that matching dedication will be likely upon further subdivision of White's Country Estates Part 1.
No exception to minimum block length has been requested, nor does staff feel that granting such an exception
could be justified, unless both parcels were involved with a short cul~e-sac design as provided by Wesbet
SUbd1111510R.
Staff recommends redesign to comply with Borough Code, with submittal to tha City of Kenai for Planning and
Zoning Commission review of the revised plat. Minutes of the meeting should be submitted to the Borough with the
revised preliminary plat, and it will be scheduled for KPB Plat Committee review.
The plat was reviewed by the Kenai Planning and Zoning Commission at their July 25, 2001 meeting. Their retiew
was based upon the incorrect status. They recommended approval, subject to demonstration that no
encroachments exist on Lot 1. As the City may have setbacks on ail lot lines, including side yard setbacks, staff
recommends that the revised plat show dimensional data to the house when it is submitted to the City for review.
Per KPB Resolution 2000-025, if the Certificate to Plat indicates any beneficial interests affect this property, they will
be notified and given 30 days from the date of the mailing of the notification to respond. They are given the
opportunity to notify staff if their beneficial interest prohibits or restricts subdivision or requires their signature on the

Scott McLane, 38240 Kenai Spur Highway
Mr. McLane said he was representing the subdivider. Earlier during the meeting he distributed a revised
preliminary plat, which he asked the Committee to consider. The major change was correction of the land
status and elimination of Third Avenue, which is not within the property being subdivided. He made the
made all this area Lot 5.
With the correction, no surrounding properties will be denied access. Mr. McLane said he would bring the
revised plat to the City of Kenai for their concurrence. He asked the Committee to act on the revised
preliminary during this meeting.
Chairman Pro Tem Troeger asked if staff wished to comment. Mr. Best commented that staff agreed with the
surveyor's request as long as the City of Kenai concurs with the revised plat.
Seeing and hearing no one else wishing to speak, Chairman Pro Tem Troeger closed the public hearing and
opened discussion among the Committee.
MOTION: Commissioner Boscacci moved, seconded by Commissioner Martin, to grant preliminary approval to the
