City Council -- No report. 10-b. Borough Planning--- Commissioner Bryson gave a report based on the agenda for the Borough Planning meeting held on Monday, September 24, 2001. 10-c. Administration -- Kebschull noted the following: • Referring to the facilitator's draft agenda for the planning session scheduled for October 27, 2001, Kebschull noted there were two scheduled times that would be of interest to the Planning Commission. The City would like to have the Commission available to serve as a recorder/facilitator at a table at 8:55 a.m. At 9:20 a.m. Chairman Goecke v~ill be asked to speak to the strategic planning effort. Kebschull stated additional information would be forwarded and public service announcements would be made on the radio and in the newspaper. PLANNING & ZONING COMMISSION MEETING SEPTEMBER 26, 2001 PAGE 3 • A Conditional Use Permit application would be on the agenda at the next meeting for the reopening of a gravel pit off Beaver Loop Road. She added, the application would probably bring opposition from the residents in the area. • Her assistant was checking the State's website which lists all the people on the Peninsula with daycare businesses. Those who have not applied for the proper permit with the City have been notified. Kebschull noted there were several operators caring for family members but noted that if they are getting paid for the service they would still require a permit from the City. • Certification letters continue to be sent to those individuals with Conditional Use Permits in an effort to confirm they are in compliance. • Requested a review of the code regarding public hearing notification as the application fee often did not cover the cost of notification to properties within 300 feet. Kebschull stated she contacted other cities such as Soldotna, Homer, Seward, etc., and their fee is $250, which easily covers notification expenses and they do not send the notices via certified mail. After a brief discussion it was recommended the fee be changed to $200 and that the notifications be sent via regular mail rather than certified. The Code also outlines the review criteria that should be used by the Planning and Zoning Commission to determine if a variance should be granted. The Commission shall establish a finding that all of the following conditions exist as a prerequisite to issuance of a variance permit: 1. Special conditions or circumstances are present which are peculiar to the land or structures involved which are not applicable to other lands or structures in the same zoning district. 2. The special conditions or circumstances have not been caused by actions of the applicant and such conditions and circumstances do not merely constitute a pecuniary hardship or inconvenience. 3. Applicants began constructing a shed (16X20`y in their back yard. They were unaware that a building permit was required. When they realized it, they stopped construction and contacted the Building Official. At that time, they were notified that because the shed was over 120 square feet it requires a building permit and would also have to meet setback requirements. In this case, 5 feet from the side lot line and 20 feet from the rear lot line. The shed was being constructed in the side and rear setbacks. Applicant met with the Building Official and the Planning Administration, it was decided that the shed would be moved from the side fot line to meet that setback and a request for a variance would be made for 10 feet from the rear setback. Applicants have provided letters from the neighbors most affected by the variance. All neighbors state they have not opposed to the variance. City Engineer: Not available to comment. Kenai Municipal Code: 14.20.151: Application for conditional use permit for surface extraction of natural resources. An application for a conditional use permit to engage in the surface extraction of natural resources shall be in writing on a farm supplied by the City of Kenai and shall be filed with the administrative official, along with the requisite fees. All applications shall be accompanied by the following documents and information: {a1 A site plan, drawn to scale, containing the following: {1 } Graphic {and legal} description of the proposed area, including dimensions in feet and number of acres or square feet; {21 Existing topographical contours with not less than ten-foot (10'1 contour intervals; {31 Proposed finished topographical contours {when extraction is completed? with not less than ten foot {10'] contour intervals; {4] Existing and proposed buildings and structures on the site; {5) Principal access points which will be used by trucks and equipment, including ingress and egress points and internal circulation, especially the haul road from the public road to the proposed site of the pit; {fit Indication of the existing landscape features, including cleared areas, wooded areas, streams, lakes, marsh areas, and so forth; {7] Location and nature of other operations, if any, which are proposed to take place on the site. {b) A narrative statement containing the following information: 0152 Comment Page 3 {1 } Soil surveys with reference to the average year-round water table throughout the entire acreage. Piezometers may be used to determine an average water depth; {2} 1=stimated amount of material to be removed from the site over the entire period of operation; {3} estimated length of time to complete the operation, or, if the pit is to be operated on a continuing basis, a statement to that effect; {4} Proposed hours of operation; {5} Method of fencing or barricading the petition area to prevent casual access; {6} Amount and location of natural screening provided by trees and vegetation, if any, between the property lines and the proposed site of the pit; {7} Plans, if any, to construct artificial screening; {$} Description of operations or processing which will take place on the site during and after the time the material is extracted; {9} Plan or program for regarding and shaping the land for future use; {10}Method of backfilling and/or replacing topsoil; {1 1 }Proposed future use of the land after resources are extracted, including a proposed development plan showing location of houses, parks, lakes, etc.; {12}Other information which may pertain to the particular site. {c} Proof that the applicant has obtained or is eligible to obtain the necessary licenses required by state or federal agencies. {d} Proof that the applicant is the owner of the subject property. {Ord. 925} 14.20.152: Review of application. The administrative official shall place the application for the conditional use permit on the agenda of the Commission for the first meeting of the Commission for which it is eligible, based on the date of filing with the secretary and the applicable rules of the Commission at that time. At that meeting, the Commission shall review the application and accompanying information and shall determine if it meets the requirements of this chapter. If the requirements have not been met, the Commission shall specify the deficiencies therein and shall request that a supplement to the application be filed. The Commission may, in its discretion, request additional information pertinent to the particular site to be supplied by the applicant. Such additional information shall not be requested unless it can be obtained by the applicant at a reasonable cast. The issue of reasonable cost may be appealed by the applicant directly to the Board of Adjustment before further proceedings by the Commission. {Ord. 925} O1S2 Comment Page 4 74.20.153: Public hearing. The Commission shall hold a public hearing on the application at the first regular meeting following the meeting at which their initial review was made, if no additional information is requested, or if additional information is requested, at the first meeting following a determination by the Commission that the supplement to the application contains the requested information. The public hearing and notification procedure for this conditional use permit shall be accomplished in accordance with the requirements of this chapter. In addition, a map showing the approximate location of the proposed surface extraction, and a statement as to the nature of the proposed extraction operation shall be included. {Ord. 925) 14.20.154: Issuance of permit. {a} On the basis of the application with accompanying information, any supplemental information filed, and such information as may be presented at the public hearing provided for in this chapter, the Commission shall make a determination as to whether each of the following requirements has been met: {11The application is in substantial compliance with the requirements of this chapter; {2}The boundaries of the proposed excavation at its greatest dimensions, including back slopes, are at least 200 feet from any road or public right-of-way and at least 150 feet from other surrounding property lines; {3}The buffer strips between the excavation site and roadways and property lines contain sufficient natural screening to obscure the entire excavation from sight of roadways and inhabited areas. If there is not sufficient natural screening, the site plan must provide for artificial screening; {4}The site plan provides that back slopes be a minimum of a 2:1 slope, except for the contiguous working face; {5}The site plan does not provide for excavation below the water table except where a reasonable method of drainage is available at the particular site or where the proposed future development plan provides for a lake on the site of the excavation; {6}If the excavation is to be below the water table and the site is likely to endanger the public safety, the site plan shall provide for fencing of the work area; {7}The proposed use of land after extraction is completed is feasible and realistic and is a use permitted in the zone in which the property is located; {8}The extraction does not destroy the land for the purposes for 0152 Comment Fage 5 which it is zoned; {9}The need for the particular natural resource within the City of Kenai outweighs any detrimental effects the operation may have on surrounding property owners; {10}The applicant is the owner of the subject property. {b} If the Commission determines that all requirements have been met, the Commission shall direct the administrative official to issue a conditional use permit to the applicant. The permit shall be issued for an indefinite period and shall be subject to the provisions of this chapter, and shall so state. {c} The permit may be expressly conditioned by the Commission upon the erection of artificial screening. If the permit is so conditioned, the Commission shall specify the type of screening to be erected. Such screening shall obscure the entire extraction operation from view from any public roadway or inhabited area and shall be compatible with the general character of the neighborhood. No extraction of resources can take place until the artificial screening provided for has been erected and approved by the Commission. {d} Appeals from decisions of the Commission under this section shall be made in accordance with the provisions of this chapter. {Ord. 925) City Engineer: City Administration will provide an aerial view of the existing condition of the site to supplement the applicant's site plan. The gravel was requested by the state as a close resource to the new bridge access across the Kenai River. In 1992 my father was granted a conditional use permit; KPB Parcel #0494449021, 3713 Beaver Loop Rd to reclaim the 8 acres of an old ugly gravel pit swamp. In 1998 Michael J. Pelch Sr,'s health at, 78 yrs, was not favorable; strokes and memory loss. This is the reason for no annual reports and the closing of the permit. It is my intenet to fulfill my fathers plan and restore the beauty of the land. The goal is to have a 10 ft deep lake that is visibly attractive for wildlife and "humans. It has been evident for sometime that the $100 fee does not cover the cost to process the permits. While researching information for this resolution, it was determined that the $100 fee was set in 1984. Since that time, postage and advertising expenses have risen drastically. The following are actual costs paid for the public hearings in August and September: August 22"d Meeting $161.2fi (2 hearings advertised) September 12th Meeting $118.26 {1 hearing advertised) September 26th Meeting $118.26 {1 hearing advertised) As you see, the cost goes down somewhat when multiple hearings are advertised; however, it still averages approximately $80 for each hearing. Certified mail costs have risen dramatically. Complaints are received from individuals receiving the notices who are required to stand in line at the post office to pick up the mailing. As an alternate to certified mail, staff may certify the mailing. NOW, THEREFORE, THE PLANNING AND ZONING COMMISSION RECOMMENDS THAT THE COUNCIL CF THE CITY OF KENAI, ALASKA AMEND KMC 14.05.020 as follows: SECTION I 14.05.020 Fees. In order to defray the expenses connected with the consideration of applications for variances, [AND] encroachment permits, conditional use permits, and amendments to the Kenai Zoning. Code or Official Map, the person presenting the application shall pay [TO THE CITY CLERK] a fee in the amount of [ONE HUNDRED DOLLARS ($100.00)] two hundred dollars _($200). [A FEE IN THE AMOUNT OF ONE HUNDRED DOLLARS ($100.00) SHALL ACCOMPANY AN APPLICATION FOR AMENDMENT TO THE KENAI ZONING CODE OR OFFICIAL MAP.] Whether an application is granted or denied by the Commission, the petitioner or applicant shall not be entitled to the return of the fee paid. SECTION II 14.20.150(b~(6~ Conditional Use Permits. Resolution PZO 1-55 Page 2 of 4 (b) Applications. Applications for a conditional use permit shall be filed in writing with the Planning Department. The application shall include, but is not limited to, the following: (1 } Name and address of the applicant; {2) Verification by the owner of the property concerned if other than the applicant; {3) A legal description of the property involved; {4} A description of the proposed use; {5} Dimensioned plot plans showing the location of all existing and proposed buildings or alteration, and such data as may be required; and (b) The appropriate fee as set out in 14.05.020. SECTION III 14.20.151 Application for conditional use permit for surface extraction of natural resources. An application for a conditional use permit to engage in the surface extraction of natural resources shall be in writing on a form supplied by the City of Kenai and shall be filed with the administrative official, along with the requisite fees as set out in 14.05.020. All applications shall be accompanied by the following documents and information: SECTION N 14.20.180 Variance permits. (a) Intent: A variance means the relaxation of the development requirements of this chapter to provide relief when the literal enforcement would deprive a property owner of the reasonable use of his real property. (b) Permit Application: An application for a variance permit shall be filed in writing with the administrative official and signed by the owner of the property concerned. {1) The application shall contain the following: (A) A legal description of the property involved; {B) Plans showing the location of all existing and proposed buildings or alterations, elevations of such buildings or alterations, and such data as may be required. {C} [A NON-REFUNDABLE DEPOSIT/ADVERTISING] The appropriate fee [OF ONE HUNDRED DOLLARS (~ 100.00)] as set out in 14.05.020. {c) Review Criteria: The Commission shall establish a finding that all of the conditions have been found to exist as a prerequisite to issuance of a variance permit. { 1) Special conditions or circumstances are present which are peculiar to the land yr structures involved which are not applicable to other lands or structures in the same land use or zoning district. (2) The special conditions or circumstances have not been caused by actions of the applicant and such conditions and circumstances do not Resolution PZ01-55 Page 3 of 4 merely constitute pecuniary hardship or inconvenience. (3} The granting of the variance shall not authorize a use that is not a permitted principal use in the zoning district in which the property is located. (4) The granting of a variance shall be the minimum variance that will provide for the reasonable use of the land and/or structure. (5) The granting of a variance shall not be based upon other non- conforming land uses or structures within the same land use or zoning district. {d} Public Hearing: The public hearing and notification procedure for a variance application shall be accomplished in accordance with the requirements of this chapter. [THE APPLICANT SHALL BE REQUIRED TO PAY A ONE HUNDRED DOLLAR ($100.00) NONREFUNDABLE FEE TO COVER THE COSTS OF THE PUBLIC HEARING NOTICE.] SECTION V 14.20.185 Encroachment permits. {a) Definitions. "Encroachment" means any object or structure above or below ground and constructed or located in a manner other than set forth in the Development Requirements Table. (b) Intent. An encroachment permit is the relaxation of the development requirements of this chapter to remedy encroachments which do not fall under Section 14.20.050, nonconforming uses and which satisfy the requirements of financial institutions. (c) Permit Application. An application far an encroachment permit shall be filed in writing with the City Planning Department and signed by the owner. of the property concerned or representative of the owner. The appropriate [A] fee [OF ONE HUNDRED DOLLARS ($100.00)] as set out in 14.05.020 shall be paid [TO THE CITY OF KENAI] at the time the permit application is filed. SECTION VI 14.20.270 Amendment procedures. (a) Intent: This section shall govern any amendment to the Kenai Zoning Code and Official Map. (b} Initiation of Zoning Code and Official Map Amendments. (1) Amendments to the Kenai Zoning Code and Official Map may be initiated by: (A) Kenai City Council; (B) Kenai Planning and Zoning Commission; (C) Submission of a petition by a majority of the property owners in the area to be rezoned; (D} Submission of a petition bearing the signatures of fifty {50) registered voters within the City of Kenai to amend the ordinance text; (E) Submission of a petition as provided by the Horne Rule Charter of the City of Kenai. Resolution PZ01-55 Page 4 of 4 (2) Amendments to the Official Zoning Map shall be considered only if the area to be rezoned contains a minimum of one (1) acre (excluding street or alley rights-of--way) unless the amendment enlarges an adjacent district boundary. (3) A proposed amendment to the zoning ordinance which is substantially the same as any other proposed amendment submitted within the previous nine (9) months and which was not approved shall not be considered. (4) The zoning amendment request shall include the names and addresses of the applicant, a map showing the area involved, the present and proposed zoning, the a ro riate [A NON-REFUNDABLE DEPOSIT/ADVERTISING] fee as set out in 14.05.020 [ONE HUNDRED DOLLARS ($100.00)]= and any other pertinent information requested by the City. No structures appear to exist in the replotted area. No reason for the replat has been provided. The Kenai Planning and Zoning Commission reviewed the plat on August 22, 2001. They recommended approval subject to the plat verifying that no encroachments exist. Staff recommends the plat comply with the City's request, and verify that no encroachments exist. Per KPB Resolution 2000-025, if the Certificate to Plat indicates any beneficial in#erests affect this property, #hey will be notified and given 30 days from the date of the mailing of the notification #o respond. Cliff Baker, Integrity Surveys Mr. Baker said he was representing the developer. He noticed the staff report noted that no reason for the replat had been provided. He asked if he needed to start providing reasons. Referring to the Kenai Planning & Zoning Commission's recommendation to verify that no encroachments exist, he pointed out that the preliminary plat showed the structures. The plat does not have encroachments. Mr. Baker did not want to show improvements on the final plat. He reiterated that there were no encroachments. Mr. Best said this satisfied staffs concerns. Mr. Best commented that occasionally the Plat Committee asked for the reason for repiatting. Seeing and hearing no one else wishing to comment, Chairman Hammelman closed the public hearing and opened discussion among the Committee. MOTION: Commissioner Hohl moved, seconded by Commissioner Boscacci, to grant approval to the preliminary plat subject to staff recommendations. VOTE: The motion passed by unanimous consent.
