the meeting and thanked all speakers at the meeting.
Council Member Bookey thanked the Mayor for the acknowledgement of the fire fighters.

ORDINANCE NO. 2712 -2013
AN ORDINANCE OF THE COUNCIL OF THE CITY OF KENAI, ALASKA, AMENDING
THE OFFICIAL KENAI ZONING MAP BY REZONING TRACT A, KILLEN ESTATES,
RICHMOND ADDITION FROM A SPLIT ZONE RURAL RESIDENTIAL (RR) AND
SUBURBAN RESIDENTIAL (RS) TO RURAL RESIDENTIAL (RR) ONLY.
WHEREAS, this parcel of more than four (4) acres was replatted in 2011, and as result
of that platting action a split -zone was created; and,
WHEREAS, the property is currently zoned Rural Residential and Suburban
Residential; and,
WHEREAS, the property owner supports this action to rezone the property initiated by
the Planning & Zoning Commission; and,
WHEREAS, the rezone to Rural Residential is consistent with the 2003 City of Kenai
Comprehensive Plan; and,
WHEREAS, on June 26, 2013, the City of Kenai's Planning and Zoning Commission
held a public hearing and voted unanimously to the City Council that the property be
rezoned to Rural Residential; and,
WHEREAS, that City Administration supports this rezone; and,
WHEREAS, it is in the best interest of the City of Kenai to rezone the area shown on
Attachment A to Rural Residential (RR) to allow for full and reasonable property use.
Section 1. Form: That this is a Code ordinance.
Section 2. That the official Kenai Zoning Map is amended by rezoning a portion of
Tract A, Killen Estates, Richmond Addition from a split zone Rural Residential (RR)
and Suburban Residential (RS) to Rural Residential (RR) only, as shown on
Attachment A.
Section 3. That this Ordinance shall be forwarded to the Kenai Peninsula Borough
to Amend the Official City's Zoning Map.
Section 4. Severability: That if any part or provision of this ordinance or application
thereof to any person or circumstances is adjudged invalid by any court of competent
jurisdiction, such judgment shall be confined in its operation to the part, provision, or
application directly involved in all controversy in which this judgment shall have been

rendered, and shall not affect or impair the validity of the remainder of this title or
application thereof to other persons or circumstances. The City Council hereby

take effect August 17, 2013.

SUBJECT: Ordinance No. 2712 -2013 — Rezone
Ordinance No. 2712 -2013 is an ordinance amending the official City of Kenai zoning
map to rezone the parcel legally described as Tract 2A, Killen Estates, Richmond
Addition (733 McKinley Street) from Rural Residential and Suburban Residential (split
zone) to Rural Residential. KMC 14.20.270 provides procedures and criteria for an
amendment.
An application to rezone the property was submitted by Bill Richmond. The property is
located at the end of McKinley Street. In 2011, the property owner removed the lot line
creating one (1) large parcel. One parcel was zoned Rural Residential and the other
was zoned Suburban Residential. Removing the lot line created a split zone. This was
missed during the review of the plat. The City tries to eliminate split zones when they
are created due to subdivision replats. The development standards are different in each
zone, which can cause problems with certain types of development and uses. Based
on the size of the lot and on -site utilities, the property mirrors the Rural Residential
zone.
I reviewed the application and found it met the requirements of KMC 14.20.270. Details
of the review are outlined in the body of the ordinance. On June 26`h, the Planning &
Zoning Commission held a public hearing on the application and voted unanimously to
recommend the rezone. As prescribed in KMC 14.20.270, that recommendation is
being forwarded to Kenai City Council for their consideration.

ANALYSIS
General Information:
This is an application to rezone the property described above as Tract 2A, Killen Estates,
Richmond Addition, as shown on Attachment A, from a split zone Rural Residential and
Suburban Residential to Rural Residential. There is a single - family structure on the lot.
The property is served by onsite water & sewer.
Kenai Municipal Code 14.20.270 describes amendment procedures. Section 2 states,
"Amendments to the Official Zoning Map shall be considered only if the area to be
rezoned contains a minimum of one (1) acre (excluding street or alley rights -of -way)
unless the amendment enlarges an adjacent district boundary." This property is adjacent
to property zoned Rural Residential and Suburban Residential. The lot contains
approximately 4.78 acres. The requested rezone meets the criteria for an amendment.
The property is located at the end of McKinley Street. This portion of McKinley Street is
not maintained. In 2010, to obtain a building permit, the applicant was required to build a
single- family driveway. Single family driveways are built to provide developed access to
properties and consist of construction of a half street. It was the owners intent to build
on one lot, but during the inspection process it was determined the house encroached into
the setbacks. Removing the lot line between the two (2) parcels would eliminate the
encroachment violation.

The intent of the Rural Residential zone is, "The RR Zone is intended to provide for low
density residential development in outlying and rural areas in a form which creates a
stable and attractive residential environment." "The intent of the RS Zone is intended to
provide for medium density residential development in areas which will be provided with
common utility systems."
The Comprehensive Plan classifies the area as Neighborhood Residential. "The
Neighborhood Residential district consists of single - family and multi - family residential
areas that are urban or suburban in character. Typically, public water and sewer services
are in place or planned for installation. This land use district may include both single -
family and multi - family dwellings subject to reasonable density transitions and/or design
compatibility. Formal public outdoor spaces (parks) are a critical feature in this district.
Small home -based businesses may be accommodated within certain design guidelines.
Neighborhood institutional uses such as churches, schools, and day care facilities may be
intermixed if they comply with neighborhood design guidelines."

RECOMMENDATIONS
The proposed rezone meets the requirements of the Kenai Municipal Code. The parcel is
accessed off of McKinley Street from Redoubt Avenue. The rezone will enlarge an
adjacent boundary, and eliminate a split zone, which can cause problems with certain
types of development and uses. Based on the size of the lot and on -site utilities, the
property appears to mirror the Rural Residential zone.
Recommend approval.

1. All driveway or road approaches constructed under this permit within any rights -of -way shall
be the property of the City of Kenai. All costs and liability for maintenance shall be at the
sole expense of the owners of those lands served.
2. Such facilities shall be constructed and maintained in such a manner that the street and all
its appurtenances or facilities, including, but not limited to, all drainage, culverts, utilities and
their safety shall not be Impaired or endangered in any way by the construction or
maintenance of this facility,

3. The permittee shall adjust, relocate or remove this improvement without cost or liability to
the City of Kenai if, at any time, or from time to time, the use or safety of the street requires
this to be done, The permittee shall assume all liability or costs in connection with the
improvement and shall hold the City of Kenai or its officers, agents, employees, contractors
harmless in any way pertalning to the improvement.
4. The City of Kenai reserves the right to inspect and /or reject materials or workmanship not to
City of Kenai standards, to stop work until corrections are made, or to require removal of the
improvement and to charge time and equipment to the permittee to correct the
Improvement if It fails to comply to the attached City of Kenai Typical Section for a Single
Family Dwelling Access Right -of -Way Permit,
5, A copy of this permit must be available for review on -site at all times during construction.
6. The permittee certifies that the minimum clearance between the proposed finished driveway
grade and the lowest aerial utility conductor is in accordance with the requirements of the
National Electric Safety Code (Section 23), but In no case is less than eighteen (18) feet,
7. This agreement transfers to any /all future property owners until the road is acceptable by
the City of Kenai for maintenance.
8. The permittee is responsible for obtaining and compliance with all permits required by other
local, state and federal agencies.
9. The permittee is responsible for the recording of this City of Kenai Typical Section for a
Single Family Dwelling Access Right -of -Way Permit, and all fees associated with this
recording. A copy of the recorded easement must be returned to the City of Kenai. Permit
is not valid until a recorded copy Is returned to the City of Kenai.
10. The engineer must submit signed documentation to the City of Kenai verifying the driveway
was constructed to the standards of the City of Kenai Typical Section for a Single Family
Dwelling Access Right -of -Way permit drawing (attached).

RE: Bill Richmond 733 McKinley Street Driveway in right of way.
Dear Mr. Ogle,
At the request of Bill Richmond, I inspected the construction of a driveway in the McKinley Street right of
way to access Mr. Richmond's property at 733 McKinley Street. The purpose of my inspection was to
confirm that the driveway within the right of way is constructed in conformance with the City of Kenai's
'Typical Sections for Single Family Dwelling Access Right of Way Permit.'
I visited the site prior to construction to review existing drainage patterns. The driveway extends
approximately 280 feet south from Redoubt Avenue to Mr. Richmond's property which lies on the west
side of McKinley Street. The driveway is built in the west side of the right of way centerline and is 12'
wide. There is an existing paved approach at Redoubt Avenue. The area is very flat and runoff will
dissipate by percolation, so the final driveway grade was established approximately 1' above adjoining
ground. Ditches were excavated to approximately 2' deep to provide adequate snow storage and room
for snowmelt to accumulate off of the road surface. The area had been previously cleared and had a thin
layer of gravel. The new driveway was constructed by excavating out the existing gravel surface and
approximately 2 feet of unsuitable soils to expose underlying NFS sand. After excavation was complete,
NFS gravel was brought in to fill to within 4" of final grade. A final lift of 2" minus non frost susceptible
gravel was then placed a finish driving surface. All material was compacted as it was placed. Mr.
Richmond's property is accessed via a driveway at the end of the McKinley Street extension. A culvert
was placed parallel to McKinley street at the driveway. The final surface was graded and compacted and
conforms to the Typical Sections for Single Family Dwelling Access Right of Way Permit.'

Enterprise Fund to fund the siding project for the Vintage Pointe facility; and,

The engineers estimate to perform this work was based on the architect's assumption
that there was a weather barrier installed under the existing siding. As soon as I was
made aware of this assumption I investigated and confirmed in several locations at
Vintage Pointe and the Senior Center that there is not an existing weather barrier. The
weather barrier is required to meet the siding manufacturer's installation requirements to
be eligible for a warranty. The addition of the weather barrier to the plans and
specifications resulted in bids that exceeded the engineer's estimate and subsequently
require the additional appropriation of funds above and beyond what was requested in
the original Ordinance 2713 -2013.

and Kenai Senior Center Exterior Renovation to Polar North Construction LLC for the
estimated amount of $440,900.
Base Bids 1 & 2 consist of furnishing and installing metal siding and trim for the exterior
walls of Vintage Pointe and the Senior Center. Additive Alternates 1 & 2 provide for
siding the outbuildings. Additive Alternates 3 & 4 include siding the soffit, fascia, and
rakes. The base bid and alternates are split into two numbers to account for the different
funding sources for each facility. They are combined on the Resolution for clarity.

On June 24, 2013 the City Council held a special meeting and conducted executive
session to discuss evaluations and compensation of the City Clerk and Attorney.
Similarly, the Council held a special meeting on June 26, 2013 to discuss the evaluation
and compensation of the City Manager. Action cannot be taken during an executive
session. In order to implement the compensation increases discussed during the
executive sessions action is now required by the Council on the above referenced
action agenda items. It is intended that the new compensation for each position will be
applied retroactively to July 1, 2013.

amended the original grant agreement by increase the level of funding by $8,366 for
additional testing performed during and after the 2012 Personal Use Fishery; and,
WHEREAS, this appropriation shall be to the FY2013 Operating Budget of the City
and shall be applied retroactively to June 30, 2013; and,
WHEREAS, it is in the best interest of the City to monitor the bacteria level on its
beaches to protect its visitors and residents from potential dangers caused by the
waste generated by the Personal Use Fishery.

The past month has been particularly busy for the Parks & Recreation Department.
Temporary staff are getting settled in with their roles and I have been very pleased so
far their efforts.
The department assisted with 4th July activities and performed field preparations for the
Kenai Softball Association's annual Firecracker Tournament. There were a total of 30
teams involved with most being from out -of -town.
There were a total of 12 shelter reservations made for the month of June, including one
wedding at Leif Hansen Memorial Park.
The trail crew finished up most of the trail work at Daubenspeck Family Park and
completed the gravel approaches to Airport Way, Main St. Loop, Granite Point St. and
Kenai Spur Hwy. Contractor completed repair work to Meeks Trail.
Crews spent considerable amount of time organizing and making preparations for the
July 10th opening of the Personal Use Fishery.
Staff members Chris Pearson and Evan Atchley have been working diligently on
installing landscape brick around the All- American City sign along the Kenai Spur
Highway.
American Legion Baseball (Post -20) is hosting their Annual Bill Miller Tournament July
9th and 11�h and will be utilizing both the Peninsula Oilers field and field #3 at the Little
League complex.
The department had a total of 84 hours provided through the Community Work Service
program since the first of June.

Master Plan — The Phase II report containing Facilities Requirements, Alternatives,
and Environmental Conditions is still under review by the Technical Advisory
Committee.
Tree Obstruction Clearing Proiect: The bid was awarded to Gage Tree Service, LLC at
the July 3, 2013 Council meeting. Work is scheduled to start after July 15th
Airfield Marking — Plans and specs are complete and the City's front -end bid documents
are being prepared. The project will be advertised and bid with painting to start this
summer.
Wildlife Hazard Assessment - The final review is complete. The USDA presented the
Wildlife Hazard Assessment with the opinion that wildlife hazards can be reduced to an
acceptable level if the recommendations are fully implemented and followed.
Recommendations included but are not limited to the removal of all woodlands within
the perimeter fence, perimeter fence repair, elimination of areas that retain water, keep
the grass at a height of 6 -10 inches while hydro -axing shrubs and small trees as
appropriate within the fence.

Great weather all around the peninsula contributed to another successful
Kenai Peninsula Air Fair and Poker Run. Thirty -seven pilots, family, and friends
participated in the poker run enjoying a delicious breakfast cooked by the
Experimental Aircraft Association Chapter 975 in the MARC hangar at the
Soldotna Airport. Thank you to Barnstormer Aviation, Era Alaska, Grant Aviation,
Lake and Peninsula Airlines, Metal Magic, Alaska Sea Kayakers, Chugach Outdoor
Center, Nenana Roft Adventures, Kenai Aviation, Kenai Golf Course, Dan's TV &
Appliance, Frames and Things, Ken's Alaskan Tackle, Swiftwater Bill, and Major
Marine Tours and the Cities of Kenai and Soldotno for the outstanding poker
prizes. The participants all expressed sincere appreciation!
The afternoon activities included the Military Appreciation Event and
members of the Alaska Aviation Centennial Celebration; in addition to the barbeque
and poker run prize presentation with music provided by Troubadour North.
Special thanks to Mayor Porter and Senator Mark Begich for conducting the
appreciation event and introducing members of the Wounded Warrior Project.
Thank you to master chefs Rick Koch and Brian Gabriel, Ed Sleater and Ted
Lindsey, Kenai Senior Center, Kenai Chamber of Commerce and the Kenai Visitors
Center for working the barbeque which served over 300 people; Councilman Bob
Molloy, Kyle Waters, Jack Lashot, Kelly Holt, Chip Versaw, Charlie Rediske, Jim
Beeson and the members of the Kenai Central High School football team, Kenai
Tower, and Kenai Flight Service Station. A great job was done by all!
The free flights provided to children by the Young Eagles program were very
popular. Jumpin Junction and the Challenger Center were hits with the kids.
Thank you to Sun Dog Seriographics who produced the 2013 poster design. We
were proud to have these highlight our event,

SUBJECT: Police & Communications Department Activity - Month of June 2013
Police handled 801 calls for service. Officers made 50 arrests and wrote 283 reports.
Traffic enforcement resulted in 143 warnings, 13 speeding tickets, 13 citations for
seatbelt violations, 13 citations for equipment violations, and 19 citations for other traffic
violations. Police investigated 8 crashes, one of which was alcohol - related. One of the
crashes involved a moose.
Most officers on the department completed periodic firearms training, and two of our
newer officers completed basic rifle training.
Officer Miller completed two weeks of SERT training with the State Troopers.
Officers have been busy handling calls for service and investigations this month.

The department has been extremely busy since the beginning of the new fiscal
year on July Vt. The transition of the employees' health care insurer has been in
full swing and seems to be progressing well. As expected, there have been
issues and obstacles but they are being worked through and I am confident in the
end the transition will be a success.
Dan, the IT Manger has been working extremely hard in preparation for the 2013
Personal Use Fishery. Each of the City's fee shacks had permanent power
installed. The installation of permanent power has provided the infrastructure
needed for a computerized cashiering system. The new system makes it
possible to accept credit cards at the shacks as well as the installation of
telephones and other security enhancements in the shacks.
On July 12th the department issued its first biweekly paychecks. What sounds
like a small task took weeks of preparation by Robin Adams and Susan Joy.
Meetings were held with employees along with multiple communications and
forms that had to be distributed and collected. This was a large project that was
handled efficiently and professionally by these ladies.
With the completion of the budget the department's focus has switched to closing
of FY13 and completion of the City's Comprehensive Annual Financial Report.
This process includes closing of the FY12 financial records, fiscal year end grant
reporting and finally financial statement preparation. The annual audit is
scheduled for the week of September 30t�

FIRE DEPARTMENT MID -MONTH REPORT

As I write this mid month report, it has only been a few days since the tragic airplane accident in Soldotna. Events
like this that happen in a small town are far reaching. One of our employees had a relative on that plane and our
thoughts and prayers go out to him and his entire family. Our thoughts also go out to our neighboring department
members that had to respond to this accident. All firefighters prepare for such events as part of their job, but we
pray they never happen.
Also as I write this, we are on the cusp of the dip net season 2013. As a department, we have stayed involved with
the preparation plans for this season. Boats and all terrain vehicles are prepped and ready and training has
commenced for river events. We again hope that we have a safe season for all participants that come to our
beaches and to the river.
Because of the recent rains, burn suspensions have been lifted and people have been able to proceed with yard
clearing projects. Residents have been very understanding and very compliant to the occasional suspension so we
appreciate the cooperation during the dry spells we had.
This month, two members of the department will be attending a week long data base user's conference for our
records management system. This conference will help our department to further utilize the system we have to
manage statistical information, track trends and manage EMS and Fire records more efficiently.
There have been many changes with time slips and payroll for the City and we have worked closely with the
finance department in hopes of making a smooth transition. The first round seemed to go well and we will work
hard to make further payroll periods efficient.
Run volume for the department is up 7% from this time last year and we anticipate a busy summer. We are
continuing to stay involved with Safe Kids and doing car seat checks at the Fire Station. Kenai Peninsula College
is still sending students to our station for their Paramedic ride along program.

In June we had 3 volunteers who worked putting in a total of almost 21 hours. There were 18 Children's programs with 320 total in
attendance and I 1 adult programs with 41 participants. There have been 6 Summer Reading activities with a total attendance of 412.
Inter Library Loan logged 38 orders with 35 items received, 33 returned and 41 items lent by our library to other institutions.

KENAI SENIOR CENTER
JULY REPORT
During the month of July the senior center was rented 4 times this month.
The volunteers provided 622 service hours.
The administrative assistant had 20 various senior appointments during the month of June.
The meal program has grown 2% this past year. We have lost many home clients but others have
been added to our client list. Last year we served 24,601 home meals and 13,504 congregate
meals.
158 seniors from the various senior centers on the Peninsula were present on the green strip for the
annual senior picnic. Forget -Me -Not Band entertained and the senior center directors served the
food. The cloudy cool weather chased some of the seniors away.
We had a great turn out for our Father's Day luncheon. 97 seniors participated in a BBQ and
games for Father's Day.
Tai Chi class continues to grow. This class has grown from 2 seniors to 10 seniors. Other wellness
and exercise classes continue to maintain with an average of 15 for the various health classes and
14 in the "Strong Body" class, 4 seniors in the Gold Zumba, and 5 in the Richard Simmons Class.
ExxonMobil's summer grant was approved. We have hired a high school student to do "flower
care," visit with the seniors in the morning, and assist in the kitchen. The seniors are enjoying
having the high school student to visit with.
Seniors are gearing up for their 4i° of July booth. They are making their wonderful homemade
apple pies and strawberry - rhubarb pies.
