ANALYSIS
General Information;
KMC 14.20.150 details the intent and application process for
conditional uses. The code also specifies the review criteria that must be
satisfied prior to issuing the permit. The criteria are:
1. The use is consistent with the purpose of this chapter and the
purposes and intent of the zoning district;
2. The value of the adjoining property and neighborhood will not be
significantly impaired;
3. The proposed use is in harmony with the Comprehensive Plan;
4. Public services and facilities are adequate to serve the proposed
use;

5. The proposed use will not be harmful to the public safety, health or
welfare;
6. Any and all specific conditions deemed necessary by the
commission to fulfill the above-mentioned conditions should be met
by the applicant. These may include, but are not limited to
measures relative to access, screening, site development, building
design, operation of the use and other similar aspects related to the
proposed use.
On January 27, 1999, a Conditional Use Permit was issued far a Charitable
Institution, the Challenger Learning Center {PZ99-011 at this location. The
original plans included a phase two for this facility. The current application
submitted by Mr. Horn for the Center is for phase two. Because this is a
modification of the current use, Kenai Municipal Cade requires a new
application and public hearing.
Phase two will expand the educational facility and provide two dormitories to
house a maximum of 18 students and 2 adults in each dorm. There will also
be restroom, shower facilities, and a kitchen in this addition.

RECOMMENDATIONS
The proposed addition is an expansion of the current facility that was
planned since the original design of the Center. The intended use will meld
with existing facilities in the area, i.e., the Multipurpose Center, Kenai Central
High School and the Kenai Middle School.
It is recommended that the new construction require a review of the
landscaping and parking requirements for the facility.
Recommend approval with the following requirements:
• Landscapinglsite plan review is required prior to issuance of any
building permit.
• Submit to fire inspections as required by the Fire Marshal for the
intended use.

ANALYSIS
General Information:
KMC 14.20.180 details the intent and application process for Variance
Permits. The Code also outlines the review criteria that should be used by
the Planning and Zoning Commission to determine if a variance should be
granted. The Commission shall establish a finding that all of the following
conditions exist as a prerequisite to issuance of a variance permit:
1. Special conditions or circumstances are present which are
peculiar to the land or structures involved which are not
applicable to other lands or structures in the same zoning
district.
2. The special conditions or circumstances have not been caused
by actions of the applicant and such conditions and
circumstances do not merely constitute a pecuniary hardship or
inconvenience.
3. The granting of the variance shall not authorize a use that is not

not a permitted principal use in the zoning district in which the
property is located.
4. The granting of a variance shall be the minimum variance that
will provide for the reasonable use of the land andlor structure.
5. The granting of a variance shall not be based upon other non-
conforming land uses or structures within the same land use or
zoning district.
The Alaska Challenger Center #or Space Technology, Inc. operates at this
location under a Conditional Use Permit. KMC 14.20.220 {b1 {2f {C1
provides for one sign per use not to exceed 32 square feet. The Challenger
Board of Directors worked diligently with Architect Peter Klauder to design a
sign that would meet the Center's needs and attempted to meet the City's
sign code. When they couldn't meet the code requirements, they opted to
apply for a variance. The applicant is asking for a variance for an oversize
sign.
Attached is a drawing of the proposed sign. The drawing shows a large
pillar with a sphere on top. The pillar contains the emblems of three
organizations. The only text on the sign will be placed on the pillar. The
pillar is 75 square feet. The sphere measures 63.fi2 square feet.
In KMC 14.20.320 sign is defined as:
"Any words, letters, parts of letters, figures, numerals,
phrases, sentences, emblems, devices, trade names, or trade
marks by which anything is made known, such as are used to
designate an individual, firm, association, corporation,
profession, business, or a commodity or product, which are
visible from any public street or highway and used to attract
attention."
The Commission must determine whether or not the sphere is a sign. If the
sphere were considered a sign, the total square footage would be
approximately 139 square feet and a variance of 107 square feet would be
required. If the Commission determines that the sphere is not a sign, the
total square footage would be 75 square feet requiring a 43 square #oot
variance.
The Center is located along the Kenai Spur Highway. The highway has a
large right-of-way requiring the sign to be placed approximately 155 to 160
feet from the shoulder of the road. Because the sign will be placed at this
distance from the road, the size is necessary to for the sign to be visible.
The Commission has reviewed and approved two other sign variances in this

general area over the past few years. A variance for the New Life Church
was approved for 57.5 square feet (25.5 square feet variancel and the
Grace Brethren Church for 40 square #eet f8 square feet variance.
City Engineer:
Nothing additional.
Building Official:
By definition, the sphere could be interpreted as a figure, emblem or
trademark. Since the sphere is not needed to support the sign, it could be
argued that the size of the sphere should be included in the total square
footage of the sign. If the Commission approves this variance for a sign
without the sphere square #ootage included, then a precedent will be set
where future sign structures could be unlimited in size. However, if the
Commission approves this variance to include the sphere as part of the sign,
it will limit the size of a structure far a sign, which may be what the
Commission would prefer far the sign code.
RECOMMENDATIONS
Based on the definition of sign in Title 14 of the Kenai Municipal Cade, it
appears the sphere does not meet the definition of a sign. Because of the
distance the sign must be placed from the shoulder of the road, it appears
- ghat the variance is reasonable. Recommend approval.

CITY OF KENAI
RESOLUTION NO. 2002-2
A RESOLUTION OF THE COUNCIL OF THE CITY OF KENAI, ALASKA, DESIGNATING
APPROXIMATELY 21 ACRES OF PROPERTIES INFORMALLY KNOWN AS THE FAA
FOOTBALL FIELD, THE OLD FAA ANTENNA FARM, AND DAUBENSPECK PROPERTY
AS "MILLENNIUM SQUARE."
WHEREAS, the City of Kenai owns the property known as the "Daubenspeck Property"
(Daubenspeck Property Tract C, consisting of 15.144 Acres) and the "FAA football field"
(Spur Subdivision Senior Citizen Addition Un-subdivided Remainder, consisting of
3.086 Acres), and will acquire, upon completion of environmental remediation and
approval by the State Department of Environmental Conservation, the property known
as and the "old FAA antenna farm" (FAA Tract consisting of 3.216 Acres); and,
WHEREAS, the City of Kenai has received a Rural Business Opportunity grant in the
amount of $20,000 from the U.S. Department of Agriculture for the sole purpose of
determining the highest and best use of the three properties noted above and will use
that information in the comprehensive planning and development of the city; and,
WHEREAS, it is the intent of the Kenai City Council to refer to the three properties as
one, calling it "Millennium Square" for consistency in referencing the properties in
future correspondence, reports, comprehensive planning, etc.
WHEREAS, because the "Daubenspeck property" was acquired by the city through a
generous donation from Harold A. and Rita Daubenspeck, their name will be dedicated
and included in some element of the development of the property, through the naming
of a street, a building, etc.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF KENAI,
