CHAIR RON GOECKE, PRESIDING MINUTES ITEM 1: CALL TO ORDER Chairman Goecke called the meeting to order at 7:00 p.m. 1-a. Roll Call Members Present: Glick, Bryson, Goecke, Nord, Erwin, Osborne, Tunseth Others Present: City Planner Kebschull, Planning Assistant Carver, City Manager Snow, Contract Secretary Roper 1-b. Agenda Approval Chairman Goecke requested that Item 7.a. and 7.b. be reversed in order to accommodate guest speaker Eileen Bechtol's schedule. MOTION: Commissioner Osborne MOVED to approve the agenda as amended and requested UNANIMOUS CONSENT. Commissioner Bryson SECONDED the motion. There were no objections. SO ORDERED. 1-c. ITEM 2: APPROVAL OF MINUTE5 -- April 10, 2002 Approved by consent agenda. ITEM 3: SCHEDULED PUBLIC COMMENT -- None ITEM 4: CONSIDERATION OF PLATS -- None ITEM 5: PUBLIC HEARINGS 5-a. MOTION: Commissioner Bryson MOVED to approve PZ02-17 and Commissioner Erwin SECONDED the motion. Chairman Goecke opened the public hearing. There were no public comments and the public hearing was closed. Kebschull noted staff had nothing additional but drew attention to the letter that was provided prior to the meeting. Commissioner Bryson indicated he liked the proposal but had some concern with Item 6, which referred to fencing of the work area if excavation goes below the water table and the potential hazard to public safety if a fence was not provided. Kebschull explained, the code calls for fencing when required. Discussion took place on other pits that are below the water table and the lack of fencing. Councilman Bannock indicated the likeliness of an accident would be slim and that was the reason why the code didn`t make fencing a requirement. Kenai Comprehensive Play -Draft Chapter 2 -Accept Revised Chapter Eileen Bechtol provided the Commission with a draft of Chapter 2 of the Kenai Comprehensive Plan and indicated a motion accepting the draft would be desirable, Bechtol also provided a tentative review schedule to the Commission to take place at the regular meetings in May and June. Bechtol noted, work sessions would be held after the meetings if necessary. MOTION: Commissioner Nord MOVED to acknowledge receipt of the Kenai Comprehensive Plan - Draft Chapter 2 and Commissioner Glick SECONDED the motion. Discussion -- Kenai Comprehensive Plan -Draft Chapter 1 Discussed at Item 6.a. 7-b. Discussion -- Proposed Education Zone/Schedule Public Hearing Discussion took place on some items of the zoning table that were questioned by Commissioner Bryson. Bryson asked why dormitories anal boarding houses were combined and Kebschull indicated they always had been but a footnote could be added to include boarding houses, as long as they were an educational facility. Councilman Bannock asked if a map would be made available for the new educational zone in order to distinguish the exact locations. A lengthy discussion took place on the various locations of schools and how they would be affected. Kebschull noted the process would be done in two steps; first to create the zone and then rezone. Goecke expressed concern of rezoning schools that are on Kenai Peninsula Borough property and Bryson expressed concern about rezoning a school when there is no benefit to doing so. Nord reminded the Commission the reason for the zone was to make dealing with some issues easier for the Commission and used the sign proposal for the Challenger Center as an example. Kebschull stated the education zone was developed at the request of the Planning and Zoning Commission. Kebschull added, all schools should operate under a Conditional Use Permit. However, Sears Elementary never applied so if they ever want to da any exterior additions or renovations, a building permit could not be obtained. MOTION: Commissioner Nord MOVED to schedule the proposed education zone for public hearing and Commissioner Glick SECONDED the motion. City Council -- Councilman Bannock reported on actions taken at the April 17 City Council meeting and invited the Commission to the Volunteer Reception scheduled for Friday, April 26~~ to be held at the Kenai Senior Center. 10-b. Borough Planning -- Commissioner Bryson reported on actions taken at the April 17, 2002 Borough Planning meeting. 10-c. Admihistration -- Kebschull noted the following: • Drawing attention to the letters to gravel pit operators (included in the packet), she noted the operators had been given five years to come into compliance with the City Code. Kebschull will keep the Commission apprised of progress. • Stated she would provide the Commission with a copy of the comprehensive plan review schedule. Commissioner Nord asked when the City would begin cleaning the streets and it was noted the work had already begun. Commissioner Bryson noted a reference to KPB 21.13.070(b) on the Pelch site plan. Kebschull thought it was left in by error by the engineering firm. Commissioner Goecke provided some addresses on Stellar Drive needing to be investigated for code enforcement. Amendments to Kenai Municipal Code during 2001 that affected the Townsite Historic District included the following: • Ordinance No. 1893-2001--Repealed the current sign code, KMC 14.20.220, and replaced it with a new sign code, KMC 14.20.220. Adopted on March 21, 2001. Effective April 21, 2001. • Ordinance No. 1894-2001-Amended KMC 14.20.105(1) to reflect a change in the numbering of the new sign code, KMC 14.20.220. Adopted on March 21, 2001. Effective April 21, 2DD1. • Ordinance No. 1898-2001-Amended the Development Requirements Table by adding the requirement that front yard setbacks he measured from the right-of--way or access easement. Adopted March 7, 2001. Effective Apri17, 2001. • Ordinance No. 1910-2001-Amending the definition of hotel and adding definitions for "lodge" and "guide service" in the Kenai Zoning Cade {14.20.320). Adopted May 16, 2001. Effective June 16, 2001. • Ordinance No. 1911-2041-Amending the Land Use Table to add "lodge" and "guide service" to listed uses. Adopted May 16, 2001. Effective June 16, 2001. • Ordinance No. 1916-2001-Amending KMC 14.20.1 SO (Conditional Uses) to provide: 1) That applicants must provide evidence of being current on all city obligations prior to issuance of a permit; 2} To provide for an annual report summarizing on-site activity for the year; 3) Setting forth standards for revocation of conditional use permits for non-compliance with the terms of the permit, violations of the Kenai Zoning Code, or delinquency in city obligations. Adopted June 20, 2001. Effective July 20, 2001. 2. The City of Kenai awarded a contract to Kevin Waring Associates in June 2001 to complete a new Comprehensive Plan for the City. The draft plan is expected to be complete in the summer of 2002. B. LOCAL HISTORIC PRESERVATION COMMISSION OR BOARD: The City of Kenai's Planning and Zoning Commission assumed preservation responsibilities in January 2001. Two former Historic District Board members have agreed to provide professional consulting advice to the Planning Commission in matters of historic preservation. Bill Kluge will consult on architectural issues and Mike Huhndorf will address historical issues. 2. Planning and Zoning Commissioners have not been asked to provide statements of occupation and/or expertise. 3. The Planning and Zoning Commission has had a fully seated Commission for the entire year. Even though seats were vacated, they were immediately filled. The City Clerk is responsible for the City's Boards and Commissions. Vacancies are advertised by ward of mouth, public information advertisements, and by mailing information to citizens whom have served on various boards and committees in the past. 4. The Planning and Zoning Commission meets bi-monthly, the second and fourth Wednesday. The December 26th meeting was cancelled due to the Christmas holiday. All other meetings were held as scheduled. Copies of the minutes are attached. 5. The Commission did not formally participate in any CLG training or conferences during 2001. Staff member Marilyn Kebschull attended the Certified Local Government training in Anchorage in April 2001. C. SURVEY AND INVENTORY OF HISTORIC PROPERTIES: Note: This information did not change during 200(1. 1 . In ]uly 1996, Preservation North completed the survey of the Townsite Historic District, which was funded through a CLG grant. The area surveyed was approximately 70 acres and included 32 properties in the Townsite Historic District and 12 properties in the adjacent area. 2. Thirty-two historic properties were surveyed. AHRS cards were completed for these praperties. 2001 Annual CLG Report Page 2 3. This was the first survey of historic properties for the City of Kenai. The survey cataloged historic properties providing the City with information as to what praperties existed, their condition, owner, etc. This information will be used when revising or preparing development guidelines far the historic district. For the properties surveyed, there were 28 different property owners. D. PRESERVATION PLANNING ACTIVITIES: 1. The City of Kenai's Preservation Plan was completed in 1998 and approved by Kenai City Council Resolution No. 98-71. E. NATIONAL REGISTER PROGRAM PARTICIPATION: 1 . The CLG did not evaluate any properties far listing on the National Register of Historic Properties during 2001. F. PROTECTION OF HISTORIC PROPERTIES: 1. No development occurred in the District that required review. G. PUBLIC EDUCATION PROJECTS: 1. No educational projects were conducted during 2001. 2. The walking tour project that was completed as a joint effort with the Kenai Visitor and Cultural Center continues to be popular with tourists and local citizens. The City of Kenai assists the Visitors Center with funding to produce the brochures that are provided to the public at no cost. H. HISTORIC PRESERVATION GRANT ACTIVITIES: The City of Kenai did not apply for any CLG Historic Preservation Fund grants during 2001. 2. As has been noted in prior years' reports, the Shk'ituk't Village park proposal continues to be a goal. The Shk'ituk't Village sign {constructed in 199G as part of a CLG grant) is located at a parking area overlooking the mouth of the Kenai River. This site is a popular area for people to view the mouth of the river. In past year's reports, it was noted that the City was not taking any action on the park proposal awaiting the FAA's removal and cleanup of the FAA antenna farm. The FAA has removed the structures from the site and an environmental site assessment was completed. Further testing is being conducted. 2. As part of the City's Comprehensive Plan, an economic development study is being conducted for the properties located in this area. It is the City's intention to recommend that an area be set aside for the park. 3. The City of Kenai is conducting studies to build a Kenai Coastal Trail as a bluff stabilization project as well as a walking trail. The proposed trail would run along the bluff past the Historic District. The proposal includes a parking area, access paint near the Shk'ituk't Village Site.
