Chairman Goecke passed the gavel to Commissioner Bryson in order to propose a
motion to reconsider PZ02-43.
MOTION•
Commissioner Goecke MOVED to reconsider PZ02-43--an application for a
Conditional Use Permit for a retail business to operate a pet grooming business from
the property known as 1802 4th Avenue. Commissioner Osborne SECONDED the
motion.
Commissioner Goecke explained he moved to reconsider to enable the entire
Commission to consider this application.

Chairman Goecke stated the applicant had one day to file an appeal with the City
Clerk's Office. The applicant turned in a written appeal at that time (8-28--02 at
approximately 7:20 p.m.).
6-b. Amend sign code -Sandwich Board Signs -Limit permitted display
tune. Brought forward from the 8/ 14/02 meeting. Discussion.
Pat Parter--310 Ro ers Road: Porter reported to the Commission of her concerns
regarding road-side sandwich board signs and addressed the following:
• The signs are often in the State Right-of--way.
• As some businesses do not pick up the signs at the end of a workday,
some signs become permanent structures and are often left in disrepair.
Parter stated she feels the sign code should be reconsidered and would like to see
sandwich boards allowed only in the summer months, perhaps May 15-September 1S.
Building Official Springer informed the Commission the city has the right to remove
abandoned sandwich boards in any state right-of-way.
MOTION•
Commissioner Glick MOVED to request staff provide more information on allowing
sandwich boards for the summer months only and then set for a public hearing.
Commissioner Osborne SECONDED the motion.
Bryson stated he would personally like to see what would be proposed before the item
goes out to public hearing. Additionally, he stated, he would like for staff to have a
week or two to prepare the information before bringing it back for discussion.
Commissioner Glick stated he agreed.

7-c. Public Hearing Fees -- Discussion
Kebschull provided a brief background of a past effort to change public hearing fees
from $100.00 to $200.00; this request was rejected by City Council. Kebschull
informed the Commission that public hearing newspaper notifications average
approximately $130.00 to provide certified mailings and the general fund subsidizes
these costs. This cost does not include staff time. Kebschull proposed the
Commission consider either eliminating certified mail for notices (as very few
communities provide this), or to charge more for applications. Kebschull also
commented the cost for appeals is the same as for a public hearing and noted the
Commission may want to recommend a fee for filing an appeal.
Councilman Bannock stated he would be opposed to charging more as he feels the
right to appeal should be as affordable as is prudent,
The Commission approved by a general consensus to request Kebschull inform the
City Manager of the Commission's desire to eliminate certified mailing. The
Commission would look into the issue of fee changes in the future, if warranted.
7-d. Amendment to KMC 14.20.200 Accessory Structures -Discussion
Kebschull reported Title 14 changes made several years ago were designed to include
setbacks, but this was not specifically stated in the Code. Therefore, administration
would like to make changes in the verbiage to ensure clarity for the public.
Kebschull stated the main concerns were regarding carports. Building Official
Springer stated changes in the carport section of the Cade would make the section
more restrictive, but will hopefully eliminate any confusion regarding carports that are
really considered to be garages by way of adding an additional wall to a carport.
Kebschull stated she would like to schedule this for public hearing.

10-a. City Council -- Councilman Bannock reported on the following:
• The Board of Adjustment appeal against the Conditional Use Permit far
Gary Foster failed.
• Currently there are two Board of Adjustment hearings being considered
by Council; DeWayne Craig and Ona Wilbert.
• The ordinance regarding slash storage has been tabled.
10-b. Borough Planning-- Commissioner Bryson provided a recap of Borough
Planning Commission events including:
• Current Borough procedure has eliminated the process of informing City
of Kenai administration of plat reviews and changes within city limits.
10-c. Administration -- City Planner Kebschull reported on the following:
• Kebschull stated she noticed Anchorage has a city wood storage lot for
public use and perhaps Kenai could officially dedicate a parcel of land for this
purpose.
• Kebschull stated she would be out of the office September 4-24, 2002.

ANALYSIS
A replat of Five Irons Heights Block Three. The four lots will meet minimum lot size
requirements for the recreation zone. This zone requires a minimum of 20,000 square
feet.
The City has an installation agreement with the property owner that requires a water main
extension down Lawton Drive. When the extension is complete, these lots will have
access to city water and sewer from Lawton Drive.
The plat s#~ould be corrected to show the correct street name for Swires Road.
City Engineer:
No installation agreement needed if current improvements are completed.
Building Official:
No I~uilding code issues.

A RESOLUTION OF THE PLANNING AND ZONING COMMISSION OF THE
CITY OF KENAI RECOMMENDING THAT THE ATTACHED SUBDIVISION

A RESOLUTION OF THE PLANNING AND ZONING COMMISSION OF THE CITY OF
KENAI, ALASKA, RECOMMENDING TO THE COUNCIL OF THE CITY OF KENAI,

storage sheds or passenger landings to be built within the yard setbacks provided they
are not closer than three (3) feet to any lot line; and
WHEREAS, such accessory structures should be smaller than i20 square feet in order
to be allowed in the setback areas; and
WHEREAS, as written, KMC 14.20.200 is unclear whether such items as stairways,
fire escapes or eaves may be constructed into the setback areas and, if so, how close
to a lot line they may be constructed.
NOW, THEREFORE, THE PLANNING AND ZONING COMMISSION RECOMMENDS
THE COUNCIL OF THE CITY OF KENAI, ALASKA AMEND KMC 14.20.200
(ACCESSORY STRUCTURES) TO CLARIFY WHICH ACCESSORY STRUCTURES MAY
BE BUILT WITHIN THE SETBACK AND HOW CLOSE SUCH STRUCTURES MAY BE
BUILT TO LOT LINES.
14.20.200 Accessory structures.
(a) Yard Requirements far Accessory Structures. Where yards are
required, accessory structures shall be subject to the same
requirements as principal structures except as follows:
(1) In an RR and RS zone, the minimum front yard setback for an
unoccupied attached or detached garage ar carport shall be ten (10)
feet;
(2) Covered but unenclosed passenger landings, carports or storage
sheds of not more thaxi 120 square feet and not more than one (1) story
in height may extend into either side yard or rear yard, but such
structure shall not be closer than three (3) feet to an adjoining lat;
(3) Unenclosed outside stairways, fire escapes, porches, or landing
places as well as cornices, canopies, eaves, and other similar
architectural features not providing additional floor space may extend
into a required side or rear yard except within three (3) feet of any lot
line;
(4) Unenclased outside stairways, fire escapes, porches, or landing
peaces as well as cornices, canopies, eaves, and other similar
architectural features not providing additional floor space may extend
into a required front vard except within ten { 10) feet of anv lot line;

yard; provided that, not more than one-third { 1 / 3) of the total area of
such rear yard shall be so occupied. Except as provided in KMC
I4.20.200(a)(2], setbacks, pursuant to development tables, must be

General Information:
KMC 14.20.150 details the intent and application process for
conditional uses. The code also specifies the review criteria that must be
satisfied prior to issuing the permit. The criteria are:
1. The use is consistent with the purpose of this chapter and the
purposes and intent of the zoning district;
2. The value of the adjoining property and neighborhood will not be
significantly impaired;
3. The proposed use is in harmony with the Comprehensive Plan;
4. Public services and facilities are adequate to serve the proposed
use;
5. The proposed use will not be harmful to the public safety, health or
welfare;

6. Any and all specific conditions deemed necessary by the
commission to fulfill the above-mentioned conditions should be met
by the applicant. These may include, but are not limited to
measures relative to access, screening, site development, building
design, operation of the use and other similar aspects related to the
proposed use.
Applicant is proposing to convert a residence into an executive retreat for
business professionals. The facility would provide a fully equipped meeting
facility for up to 24 people and overnight lodging for a maximum of 6 people.
The applicant describes the facility as "fully catered, very private and
discreet. It is available on a daily, weekly, or monthly basis. Its purpose is
to accommodate Kenai's growing business community."
The Land Use Table lists lodge as a conditional use in the suburban
residential zone. Lodge is defined as "building or group of buildings
containing five or fewer guest roams used for the purpose of offering public
lodging on a day-to-day basis with or without meals." The code does not list
or define meeting facility. In cases such as this, a similar use is considered
when determining whether or not the use requires a conditional use permit.
In this case, the meeting facility would be similar to either
businesslconsumer services or professional offices. Both of these uses
require a conditional use permit in the suburban residential zone.
The intent of the suburban residential zone is to provide for medium density
residential development. KMC 14.20.090 defines the intent of the zone and
states, "To prohibit uses which would li} violate the residential character of
the environment; (ii} generate heavy traffic in predominantly residential
areas." As noted above, lodge, businesslconsumer services, and
professional offices are all allowed in the zone by conditional use.
Based on the information provided, it does not appear that the adjoining
properties would be adversely affected. The one Issue that may affect
neighboring properties would be traffic generated by the meeting facility.
There are five parcels that would have vehicles travel past to access the
facility. Three of the five parcels that would be affected are owned by the
applicant.
The application states there is space available at this location for twelve full-
sized vehicles and additional parking available on a parcel owned by the
applicant across the street. KMC 14.20.245 specifies off-street parking
requirements. Because the application is specifically asking for a commercial
use in a residential zone, it should be insured that parking is sufficient for the
use. Single-family residences require two parking spaces. Hotels, rooming
and houses and other structures containing sleeping rooms other than, or in

addition to, dwelling units require one per dwelling unit and one per three
guest rooms. This would compute to two spaces. The meeting facility area
is approximately 607 square feet. The section in the parking code that most
closely meets this use is for libraries, exhibition halls, and other places of
public assembly without fixed seats. The required parking spaces for these
uses are %z per employee and one per ~ 00 square feet of usable floor area.
There will be no employees. The square footage of the facility would require
six parking spaces. As noted by the applicant, additional parking if
necessary is available across the street. The code provides for the use of
parking "on any lot if it is determined that it is impractical to provide parking
on the same or adjoining lot."
It does not appear that the requested uses are incompatible with the
comprehensive plan. The use will not be harmful to public safety, health or
welfare. There will not be an additional demand for public utilities; although,
it will be necessary to determine if the water and sewer utilities will require
billing for commercial use.
Mr. McLennan requested James Baisden, Fire Marshal, conduct an inspection
of the residence to insure that there were no fire code issues. The Fire
Marshal conducted the inspection and advises there are no fire safety
hazards and he did not see a problem with the garage being used for
meetings with an occupant load of 24.
The facility may provide catered meals if requested. A separate conditional
use permit for a catering facility was issued to the applicant for the property
located across the street. The lodging conditional use permit will allow food
service.

RECOMMENDATIONS
It does not appear that the requested permit will have an adverse effect on
the neighboring properties. There is sufficient parking available at the
location and at property across the street owned by the applicant. The Fire
Marshal has inspected the facility and there are no fire code issues.
Recommend approval subject to the following conditions:

This right-of-way was reserved in the patent as an access easement. Building setback restric#ians are applied by
the Borough (by plat note) and the cities (by zoning) to the right-of-way line. This is based upon the dedicated
right-of-way, because the property line extends to include the easement until it is dedicated. The subdivision plat
associated with this vacation will dedicate Candlelight Drive as a 30-foot dedication in compliance with the KPB
minimum streek width requirements. This will allow a future match of the adjacent easement to provide the full 60-
foot width. This also complies with the Ciky minimum street wid#h requirement to staff's knowledge.
No information has been provided regarding the date of construction of the building.
The Kenai Planning and Zoning Commission reviewed the subdivision plat and recommended approval. The KPB
Plat Committee granted preliminary plat approval on August 12, 2002. If the vacation is approved by the KPB
Planning Commission, the Kenai City Council will have thirty days to veto that approval.
Findings:
1. Sufficient rights-of-way exist to serve the surrounding properties.
2. No surrounding properties will be denied access.
3. Per the submittal, the right-of-way proposed for vacation is not in use for access.

Vice Chairman Bryson read the rules by which public hearings are conducted and opened the meeting for public
comment.

Mr. McLane said he was representing Mr. Yragui. A previous owner constructed numerous buildings on
Lot 1. The lots are being configured to alleviate encroachments. The Department of Transportation
(DOT) has already granted aright-of-way vacation along the Kenai Spur Highway, which eliminated one
encroachment. The subject pe#ition to vacate three feef along Candlelight Drive will eliminate another
encroachment. Candlelight Drive is a paved street. Mr. McLane believed City water and sewer were
already installed along Candlelight Drive.
Commissioner Johnson recalled that previous vacation petitions to resolve encroachments requested
vacation of the building foofprint only. He asked why the subject petition requested vacation of three feet
along the entire length of the lots. Mr. McLane replied the intent was to have continuity for survey
purposes so the lines would not be jagged.
Seeing and hearing no one else wishing to comment, Vice Chairman Bryson closed the public hearing and opened
discussion among the Commission.
MOTION: Commissioner Tauriainen moved, seconded by Commissioner Boscacci, to approve the vacation.
Vice Chairman Bryson recalled that an oil storage facility was on the property in the past. At some time in the pas#
a concrete containment dike and a building were construc#ed on the property. The surveyor noted the fuel storage
facility had been moved.
Findings:
1. Sufficient rights-of-way exist to serve the surrounding properties.
2. No surrounding properties will be denied access.
3. Per the submi#tal, the right-of-way proposed for vacation is not in use for access.
4. Per the submittal, the right-of-way proposed for vacation has not been construc#ed.

Public notice is hereby given that a petition has been received to vacate a 3-foot portion of a 33-

SUBJECT: 406 South Forest -Craig
While processing Mr. Craig's Encroachment Permit (PZ02-32) and Variance Permit
(PZ02-39) several issues were discovered that I feel important to document for future
building and zoning permit applications.
1. In 1984 a building permit (B 1824} was issued on July 7, 1982 fora 4-plea
with 24XS0' garage. The building official documented inspections on the
structure. A temporary certif Cate of occupancy was issued on 1/28183 far two
weeks. It appears from the inspector's notes that several items needed to be
corrected prior to the final certificate of occupancy being issued. That was
issued on 211/S3.
2. On July 18, 1992, building permit B2$23 was issued fora 8X22' glass
solarium. No inspections are documented for this structure and it is unclear if
it was ever constructed.
3. On August 2S, 1997, building permit B3440 was issued fora 600 square foot
garage. Sometime either during the framing or insulation phase, the building
official discovered a second story had been constructed. When questioned,
Mr. Craig advised they were going to put a bedroom up there. The building
offcial informed Mr. Craig of the required modifications to construction to
meet the building code but did not require a new set of plans or a building
permit be issued for the modified structure. The original building permit
clearly notes the construction for a garage and the setbacks on the permit are
listed for an unoccupied garage. NOTE: By adding the second story living
area, the setback was encroached into resulting in the encroachment
permit PZ02-32.)
4. On June 15, 1999, a preliminary plat was received from Integrity Surveys to
convert the multi-family dwelling to common-interest ownership
(condominiums). The Planning Commission approved the preliminary plat on
June 23, 1999. The plat was approved with the stipulation that the plat
verifies that no encroachments exist. In addition, the building official
stipulated that proof ofone-hour separations between units should be required
from the land surveyor or owners. Reviewing this plat has brought forth
several issues that should be clarified:
• The plat shows three stories, five units. There is no evidence that a
building permit was ever issued for the fifth unit. A sixth unit was
discovered during inspections for building permit B-3440.
• Kenai zoning code does not specifically address condominium
developments; however, the city attorney has determined in other cases
that such developments must meet KMC 14.20.160, Townhouses. To
meet the criteria for townhouse development, a Conditional Use Permit
must be received from the Planning and Zoning Commission. No such
permit has been applied for.
• Based an the asbuilt provided by Mr. Craig far encroachment permit
PZ02-32, the original structure has encroachments. Bob Springer noted
this to Mr. Craig in a letter on July 12, 2002. The original building permit
listed the setbacks as 15-foot side yard and 20-foot rear yard setback. The
ashuilt shows 5.1 feet side yard and the rear yard as 17.8 feet. The
surveyor should have noted these encroachments and the plat should
not have been finalized without seeking remedy.
S. On July 19, 2002, building permit B-3902 was issued to convert a garage to
living space. The permit notes the setback allowed by the encroachment
permit PZ02-32.
6. Mr. Craig has submitted three different plans for an addition. Plans were
received and reviewed on May 23, July 15, and July 24, 2002. These plans
have not been approved due to a variety of building code and zoning issues.
In Mr. Craig's appeal letter, he brings up several issues:
1. The "seventh residence" that he mentions was a question raised by staff
during the review of the variance request PZ02-39. That question was
raised because of the past history regarding the building permit for the
garage that ended up being an apartment. The information was
documented so that Mr. Craig would be fully aware that if the intent was
now or to in the future modify the structure to include a seventh residence
that it would require a conditional use permit as required in the Land Use
Table, footnote 3. (Page 3 of Comments dated 6/20/02)
2. Regarding parking spaces, Mr. Craig is attempting to use space in the
right-of way as a portion of the required "off-street" parking spaces. The
building official determines parking spaces based on KMC 14.20.250.

The required parking space for dwellings is two spaces per dwelling unit,
i2 required spaces. There are five garages {spaces} and five vehicles can
park {on Craig's property) in front of the garages however there is not
enough room to park two vehicles {one behind the other) in front of
garages. At this time, the lot is short two spaces. These spaces may be
constructed in the newly excavated area. (NOTE: Mr. Craig did not
apply for an excavation permit even after being told by Mr. Kornelis
that it was required. A citation was issued by the Code Enforcement
Officer for this action. An excavation permit still needs to be applied
for and the excavation, curb cut, etc. needs to be approved by Mr.
Kornelis.)
3. Based on the asbuilt drawings we have from Mr. Craig, it does not appear
that there is sufficient snow storage area available for the development.
4. The dumpster is located in the City's right-of--way and Mr. Craig should
not misconstrue that because it is Iandscaped he has the right to use that
area for his needs. Mr. Craig has misinterpreted the City's code. Title 9
clearly stated, "9.10.030 No garbage containers or other containers for
refuse shall be placed, stared, or located within the traversed right-of--way
of a street or alley; provided, however, that such containers ma be laced
on the edge of the public right-of-way, but •off the traveled portion, at
s eeifed laces and times when such location is necessar for
ex editious collection." Mr. Craig should provide a location an his
property for the collection of his trash.
5. Item 6 of Mr. Craig's letter states, "My fnal inspection showed "no
noncompliance observed" and I also furnished an as-built at that time."
We have no record of receiving such asbuilt. The first time we saw the
asbuilt was when Mr. Craig came in this spring to determine what he had
to do to meet the city's requirements to obtain financing for his
condominiums.
Finally, it should be noted that bath Bob Springer and myself worked diligently with Mr.
Craig to try to accommodate his needs. When reviewing the encroachment permit PZ02-
32, we felt it was a reasonable request due to the minimum encroachment and that it was
a corner lot requiring two front-setbacks. When reviewing the variance for lot coverage
and the additional variance for encroaching into the front setback we had concerns about
the safety of access off Toyon Way. In addition, we were lenient when determining lot
coverage. Mr. Springer did not count all of the decks as lot coverage. The square
footage was determined by structures only. Clearly, there were additional areas that
should have been counted including the decks on the front of the structure, and any stairs
or decks that were over three feet off the ground that would have required a building
permit.

Dear Mr. Craig:
We talked previously on the phone about issuing a building permit to convert one
garage to living space. I indicated we could issue a permit for this on the same
permit for your proposed addition. Since the variance for lot coverage was
denied, no permit may be issued for your proposed addition. This letter is to
inform you that you will need to come in and get a permit for a garage
conversion.
I also wanted to inform you that upon further review of your as-built survey, it was
noted that an encroachment exists for the side and rear setbacks of your main
building. The side yard indicated on the as-built is 5.1 feet. The minimum side
yard setback for atwo-story structure is 15 feet. The rear yard indicated on the
as-built is 17.8 feet. The minimum rear yard setback is 20 feet. The original
Building Permit No. 1824 issued in 1982 indicates a 15-foot side yard and 20-foot
rear yard setback. Some lending institutions will require these encroachments be
alleviated prior to lending money on the building.

The following public hearings have been scheduled for the
Planning and Zoning Commission meeting of September ~ 1, 2002:
a. PZ02-54-- A resolution of the Planning and Zoning
Commission of the City of Kenai, Alaska, recommending to
the Council of the City of Kenai, Alaska that KMC 14.20.200
{Accessory Structures) be amended to clarify which
accessory structures may be built within the setback and
how close such structures may be built to lot lines.
b. PZ02-55-An application for a Conditional Use Permit far a
LodgelMeeling Facility far the property known as 602
Davidson Street {Lot 5, Luebke Subdivision), Kenai, Alaska.
Application submitted by D. Cheney McLennan dba

The meeting will commence at 7:00 p.m. in the Kenai Cily Counci!
Chambers at 21D Fidalgo Avenue, Kenai. Anyone wishing to
