Vice-Chair Bryson called the meeting to order at approximately 7:00 p.m.

MOTION:
Commissioner Glick MOVED for approval of the agenda as presented, including the
lay down (updated list of commissioners) and requested UNANIMOUS CONSENT.

City Planner Kebschull noted the utility easement will be vacated and the City
Engineer had no objections. There were no public or Commission comments.

4-b. PZ02-58 -- Preliminary Plat -- Inlet Woods Subdivision-Jones Replat.
A replat of Lots 2 and 3. Submitted by Integrity Surveys, 505 Swires

MOTION:
Commissioner Osborne MOVED for approval of PZ02-58 Preliminary Plat -- Inlet
Woods Subdivision-Jones Replat and Commissioner Glick SECONDED the motion.
Kebschull noted comments made by Commissioner Amen prior to the beginning of the
meeting regarding a structure he is aware of on one of the lots which is not indicated
on the plat. She explained, the resolution requires the plat verify there are no
encroachments and the surveyor will need to do that at borough level. She added,
technically the structure should have been shown on the plat.
There were no public comments or further comments from the Commission.
VOTE:
There were no objections. SO ORDERED.

10-a. City Council -- Councilman Bannock reviewed actions taken by council
at their September 18 council meeting:
• Passage of a slash ordinance based on zone and size of lots.
• There are two additional L1D paving projects to take place in the spring.
• A joint work session will be held on October 15 with the Council, Airport
Commission and representatives of ERA Aviation to discuss the proposed airport
marketing study.
• Council discussed the borough ordinance to exempt sales tax on senior,
disabled veterans and disabled resident rents and an ordinance will be brought
forward for council's consideration at the October 2, 2002 council meeting for the city
to exempt itself from the ordinance.
• Council unanimously vetoed the petition to vacate the 33-foot access
easement along the east boundary of Government Lots 51 and 61.
Commissioner Tunseth asked the progress of the Unity Trail and Bryson noted it was
his understanding the State would begin paving Redoubt Boulevard in Soldotna in the
next few days and the remainder in the spring after right-of--way problems are
resolved.
10-b. Borough Planning -- Bryson reviewed the September 23, 2002 Borough
Planning meeting agenda included in the packet and noted the following:
• Fifteen plats were reviewed and all were approved.
• Three public hearings were held and those items were all approved.
• The vacation of a utility easement in the Daisy Subdivision No. 3 was
approved.
• Aright-of--way acquisition plat on Mann Road was approved.
10-c. Administration -- Kebschull noted the following:
• Commissioner Goecke will be out-of-state and will miss the October
Commission meetings.
• Asked if the Commission will want to request council to cancel their
November 27 meeting (Thanksgiving eve) .
MOTION:
Commissioner Osborne MOVED to request council to cancel the regular Planning 8v
Zoning Commission meeting scheduled for November 27 and Commissioner Glick
SECONDED the motion. There were no objections. SO ORDERED.

Councilman Bannock noted, depending upon the outcome of the election, this may be
his last meeting with the Commission and thanked them far their efforts and added,
he has always enjoyed his involvement with the Commission.

Waring stated the only items left for review are the last two parts of the
Comprehensive Plan. Upon completion, the Commission will review in full,
The Airport Commission reviewed relevant parts of the draft concerning the
airport; some word changes were suggested. Any further review and input from
the Airport Commission and the Airport Manager will be suggested to Kebschull
within the next month.
Waring noted the following information and dates:
• Work session -- October 9 to review the Implementation section.
• Request a Special Meeting for November 19 at 7:00 p.m. to present
the entire plan to the Commission and public.

scheduled at a future date and then the Plan will be forwarded to the Council
for their review and consideration.
The following items and ideas were discussed:
• Warning noted nothing in the Comprehensive Plan could obligate
the City of Kenai; any and all implementations would be made after the final
review and Council decisions.
• Kebschull inquired if defining the city centerJMillennium Square
area as a focal "area of opportunity" with the additional development of senior-
oriented facilities would take away from mixed-use commercial options. Waring
stated the area would not be exclusively for senior housing or health facilities,
as the mixed-use notion is an important aspect in a successful city center.
• Identify `conservation land' around airport as `airport reserve' to
avoid confusion and set aside wetland areas as conservation. A map detailing
Iands to be set-aside for the future exists in the Airport Master Plan.
Provide adequate public access to beach areas.
• Establish a rnap of trails for walking/hiking/biking and distribute
brochure to tourists and visitor's.
• Encourage private groups to help maintain local parks or look into
waiving user fees at parks if apre-determined amount of volunteer hours are
spent an improving and maintaining the area.
• Separate verbiage concerning the dock from the boat launch to
avoid confusion.

General Information:
KMC 14.20.150 details the intent and application process for conditional
uses. The code also specifes the review criteria that must be satisfied prior to
issuing the permit. The criteria are:
1. The use is consistent with the purpose of this chapter and the
purposes and intent of the zoning district;
2. The value of the adjoining property and neighborhood will not be
significantly impaired;
3. The proposed use is in harmony with the Comprehensive Plan;
4. Public services and facilities are adequate #o serve the proposed use;
5. The proposed use will not be harmful to the public safety, health or
welfare;
6. Any and all specific conditions deemed necessary by the commission
to fulfill the above-mentioned conditions should be met by the
applicant. These may include, but are not limited to measures relative
to access, screening, si#e development, building design, operation of
the use and other similar aspects related to the proposed use.
Applicant is proposing to construct an addition on the property that will house a
children's activi#y room for the children living at the property. I# will also house a
small office, for use by current day staff. Staff will meet one-on-one with children
in the office and will occasionaNy meet with adult residents in the office.
The intent of the suburban residential zone is to provide for medium density
residential developmen#. KMC 14.20.090 defines the intent of the zone and
states, "To prohibit uses which would (i) violate the residential character of the
environment; (ii} generate heavy traffic in predominantly residential areas."
Based on the information provided, it does not appear that the adjoining
properties would be adversely affected.
It does not appear tha# the reques#ed uses are incompatible with the
comprehensive plan. The use will not be harmful to public safety, health or
welfare.
Ms. Arnett, Executive Director has stated that James Baisden, Fire Marshal, has
conducted inspections at the residence. Mr. Baisden will #orward his inspection
reports to us to insure that there are no fire code issues.
City Engineer:
Not available for comment.
Building Official:
No Building Code issues.
RECOMMENDATIONS
It does not appear that the requested permit will have an adverse effect on the
neighboring properties. There is sufficient parking available at the location and
at property across the street owned by the applicant. The Fire Marshal has
inspected the facility and there are no fire code issues. Recommend approval
subject to the following conditions:
1. Submit to fire inspections for use as required by the Fire Marshal.

ANALYSIS
General Information:
KMC 14.20.150 details the intent and application process for
conditional uses. The code also specifies the review criteria that must be
satisfied prior to issuing the permit. The criteria are:
1. The use is consistent with the purpose of this chapter and the
purposes and intent of the zoning district;
2. The value of the adjoining property and neighborhood will not be
significantly impaired;
3. The proposed use is in harmony with the Comprehensive Plan;
4. Public services and facilities are adequate to serve the proposed
use;
5. The proposed use will not be harmful to the public safety, health or
welfare;
6. Any and all specific conditions deemed necessary by the
commission to fulfill the above-mentioned conditions should be met
by the applicant. These may include, but are not limited to
measures relative to access, screening, site development, building
design, operation of the use and other similar aspects related to the
proposed use.
Applicant proposes to build an eight building condominium complex on
Lawton Drive. The current plan is to construct triplexes. In the future, the
plan may be modified to duplexes in the development. The property is zoned
recreation. The recreation zone permits up to three family dwellings.
However, because the applicant proposes to develop a condominium
complex, a conditional use permit is required. The Kenai Municipal Code
does not specifically address condominiums. The Legal Department has
determined that the development must meet the requirements of KMC
14.20.160 -- Townhouses.
The project will be developed in phases. To meet the requirements for the
State of Alaska, Horizontal Regimes Act, Mr. Anderson has subdivided the
property to begin phase one. A copy of the preliminary plat for the current
lot configuration is attached {Attachment #1 f. It should be noted that Lot 1
will be excluded from this development. Attachment #2 depicts the final
development layout. Phase one will be a three-unit townhouse constructed
on Lot 3, Five Irons Heights Subdivision, Caribou Heights Addition.
Attachment #3 shows the sitelpfot plan for this structure. The plan includes
the structure, landscaping, and driveways (ingresslegressy. Drainage is not
shown; however, applicant explained that the lot will be sloped and there will
be ditches with culverts along Lawton Drive. It is believed there will be no
drainage issues.
Attachment #4 shows square footages of the units. Based on the
information provided, the development meets lot coverage and setback
requirements. Also attached are drawings showing a rendition of the
development and floor plans for the units.
The units will be served with public water and sewer. As part of the
development, Lawton Drive will be paved to the intersection of Swires Road.

RECOMMENDATIONS
It appears that the proposed development meets the requirements of KMC
14.20.164 for townhouse development. Recommend approval with the
following conditions:
1. Landscaping must be completed for each phase of the development
within a timely manner after completion of building construction.
Staff wil! determine the timing based on weather constraints. If
future phases require modification of the landscaping (as currently
submittedy, the plan must be reviewed and approved prior to
construction.
2. Because the proposed development will be constructed in phases,
staff will review each building plan as submitted to insure that
construction meets development standards.
3. Prior to the sale of any unit, proof that the development meets the
Horizontal Property Regimes Act must be filed with the City of
Kenai Planning Department.

The Kenai-Soldotna Women's Resource & Crisis Center has a 99-year lease, at
the cost of $1.00 per year, with the City of Kenai for the land on which the
agency's emergency shelter sits. The landlfacility is located at 325 S. Spruce St.,
Kenai. The lease will expire in 2082.
Per the lease agreement, WRCC is required to receive approval in writing from
the Planning and Zoning Commission prior to the construction of buildings on the
site.
When the emergency shelterladministrative building was first constructed in
1985, two small conference roams were included in the facility. Each conference
room seats 10 persons, at the most. The rooms are located in separate parts of
the building. One of the conference rooms is now used as a co~rlmur~iry
"Clothes Closet," where community residents bring used clothing and WRCC
clients, and any individual in need can come and select clothes, at no charge.
Since the (ease was initiated in 1983, the agency's provision of services and
staffing have grown significantly. The agency's staff has increased from 8
employees in 1985 to 35 in 2002. In FY02, the agency provided emergency
residential services to 119 women and 96 children and walk-in services to 348
individuals. In addition, staff responded to 1,271 calls on WRCC's crisis
telephone line.

There is not sufficient conference space at the current building far all staff to
meet together and there is not sufficient space for WRCC educational classes.
WRCC is proposing to add a 22' x 24' conference room to the existing facility.
The new room would provide adequate meeting space for the agency.

A RESOLUTION OF THE COUNCIL OF THE CITY OF KENAI, ALASKA, ADOPTING THE
CITY OF KENAI, ALASKA 2003-2004 CAPITAL IMPROVEMENT PROJECT (CIPj PRIORITY
LIST FOR REQUEST OF STATE GRANTS.
WHEREAS, input for the 2003-2004 CIP list from: the Kenai City Council, City
Administration, and citizens of the City of Kenai has resulted in the attached prioritized
CIP projects being requested of the State of Alaska; and,
WHEREAS, it is the intent of the Council that any paving projects in residential areas will
be partially funded by forming assessment districts in order to make any available State
funding go farther toward completion of the priority list; and,
WHEREAS, public meetings were held concerning Capital Improvement Projects; and,
WHEREAS, the Council of the City of Kenai, after receiving and analyzing the input from
all sources and after discussion and deliberation, has decided to adopt the attached 2003 -
2004 CIP list; and,
WHEREAS, the Mayor and the Council of the City of Kenai pledge their affirmative vote for
the maintenance and operational costs of all the City projects listed.
NOW, THEREFORE, BE IT RESOLVED THAT THE COUNCIL OF THE CITY OF KENAI,
ALASKA adopt the attached list entitled "CITY OF KENAI, REQUEST FOR STATE GRANTS,

PROJECT DESCRIPTION & JUSTIFICATION:
The Kenai Coastal Trail is a proposed multi-purpose trail that will run for approximately
one mile along the base of the Kenai bluffs. The trail will begin at the Kenai Dunes
Park, at the mouth of the Kenai River, and progress up the riverbank to a new trailhead
and parking area located just off Bridge Access Road.
The trail will provide a scenic walkway within the City of Kenai with easy, safe beach
access down the bluff at several locations. A scenic estuary area will be crossed with a
bridge, and periodic ramps and rest areas along the trail will provide handicapped
accessibility and opportunities for wildlife viewing. In addition to its recreational
benefits, the trail will provide needed relief to the City from ongoing erosion of the bluff
and associated property losses.
Through the years, the City of Kenai has commissioned many studies and reports for
the area of the lower Kenai River. These studies include Kenai River sedimentation,
dredging, bluff erosion, boat harbor, and others.
In 199$, the City hired Peratrovich, Nottingham, & Drage, Inc. (PN&D) to perform a
Reconnaissance Level Study for a Kenai Coastal Trail. In 1999, PN&D completed the
next phase for the City and produced the °Kenai Coastal Trail and Erosion Control
Project Design Concept Report." This report included a schematic design, right-of-way
property impacts, preliminary environmental considerations, and a rough project cost
estimate. PN&D just completed their third contract with the City, which consisted of
working on the environmental and permitting requirements of this project.
Approximately $120,000 of City funds has been spent on PN&D recent work.
The US Corps of Engineers was albcated $500,000 to complete the planning,
engineering, and environmental studies needed plus obtain the necessary permits to
start cons#ruction of this project.
It should be enough money to include surveying, soils, and design of the trail. The final
product should include abid-ready set of documents and drawings to build the Kenai
Coastal Trail.
This State Grant Capital Improvement Request is for the next phase, which is the actuak
construction.

Kenai Spur Highway.
This project would also include recanstruc#inc~ and repaving existing badly damaged

Salmon Drive, King Salmon Drive, and others.
It would also include chip and seal reconditioning of roads such as in Woodland

This part of the project is to rebuild the Boat Launch Road and a portion of the
Boating Facility parking lot, which is presently gravel. The project includes
asphalt paving, parking striping, and signage.
b. New Launch Ramps

This part of the project is to add two new launch ramps with a floating dock
between the ramps. It would be similar to the existing launch ramps.
c. New or Upgrade of Dock Access Road $300,000
This part of the project is to add a new road as an exit access to the boating
facility or to widen and upgrade the existing road.
PROJECT JUSTIFICATION:
Personal dip net fishermen from all over the state use the Boat Launch Road,
Parking Lot, and Launch Ramps. Over 15,000 dip net permits for households are
issued each year, and over 100,000 fish are caught in this Kenai River fishery. The
City Boat Facility handles most of this fishery. This project will improve the Boating
Facility operation and make it a lot cleaner.
This project will greatly enhance the health and quality of life of its users. At the
present time, users of the Boating Facility use staging areas that are gravel surfaced
and often dirty and unsanitary. Dust in the area is a problem since dust retardants
cannot be used due to the closeness to the water. Users spend time in staging
areas getting their boats ready to load and unload onto their trailers and in parking.
This project would definitely enhance recreational opportunities for dip net
fishermen. Informational signs would also enhance the understanding of the area.

The biggest bottleneck that restricts the number of dip net users is having only two
launch ramps. This project would provide users an additional two ramps allowing
more users and faster access to the river. Under the present conditions, sometimes
there is a two-hour wait to get a boat into the water plus another two-hour wait to get
the boat out of the water.
At times, the line of vehicles with boats or trailers extends down Boat Launch Road
almost to Bridge Access Road. This presents many problems of access on this
narrow road. Users often have to exit the facility and drive down Bridge Access
Road to find a place to turn around and then back to Boat Launch Road to get in line
to retrieve their boats. Anew one-way exit from the facility would allow users with
their boats to exit directly or allow vehicles with a trailer to make a loop to the line on
Boat Launch Road to retrieve their boats. Another alternative would be to widen the
existing road and reroute a return.
The three parts of this project are very badly needed, and they are a direct result of
the heavy use of dip net fishermen. Since the dip net fishery is governed or
regulated in this area by the State of Alaska, the City of Kenai is requesting funds to
help relieve some of the costs caused by the impact of this fishery. That is also why
this project is entitled "State of Alaska Dip Net Fishery Projects."
