Box 18 Kenai, AK 99611 Requested Action: Conditional Use Permit — Martial Arts/Yoga/Dance Studio Legal Description: 1311 Kiana Lane — Lot 1A, Rasmussen Vacation and Replat Parcel Number: 04512025 Existing Zoning: RS — Suburban Residential Current Land Use: Church Land Use Plan: Neighborhood Residential ANALYSIS General Information: Applicants are applying for a Conditional Use Permit to operate a Martial Arts/Yoga/Dance Studio from the above - referenced property. Records show the building was originally constructed in 1968, and has been used as a church, school and auditorium. Applicants have provided a floor plan of the conversion and hours of operation. The property is located at the intersection of Kiana Lane and Baker Street. The existing egress and ingress driveways are off Kiana Lane. Both streets are paved and maintained with existing City water and sewer utilities. Parking requirements for a fitness center is "One (1) per one hundred (100) square feet of gross floor area plus five (5) for patron parking. " Kenai Peninsula Borough records show the square footage of the building is 4,884 square feet (4,884'), which calculates out to approximately fifty- four (54) parking spaces, which the existing parking provided exceeds that requirement. The Borough estimates the paved area to be 17,700 square feet (17,700'), which provides sufficient parking to operate the business. PZ13 -33 Comments The property is located in the Suburban Residential zone. The Land Use Table (KMC 14.22.010) does not specifically identify "fitness centers." Uses not listed in the Land Use Table require Conditional Use Permits to operate. KMC 14.20.150 details the intent and application process for conditional uses. To issue the requested Conditional Use Permit, it must be established that the proposed use meets the following criteria: • The use is consistent with the purpose of this chapter and the purposes and intent of the zoning district — The Suburban Residential zone is described in Chapter 14.20.090. The intent of the zone is to provide for medium- density residential development in areas provided with common utility systems. The specific intent is to separate residential structures to an extent which will allow for adequate light, air, and privacy and to prohibit uses, which would violate the residential character of the environment and produce heavy traffic in predominantly residential areas. "There will be no perceived increase intensity in noise or traffic, as compared to the historical use of the property." • The value of the adjoining property and neighborhood will not be significantly impaired — "The business will operate during specific hours and days and should not adversely affect the existing homes in the neighborhood. " • The proposed use is in harmony with the Comprehensive Plan — The Comprehensive Plan describes Neighborhood Residential "consists of single-family and multi family residential areas that are urban or suburban in character.. Neighborhood institutional uses such as churches, schools, and daycare facilities may be intermixed if they comply with neighborhood design guidelines. " • Public services and facilities are adequate to serve the proposed use "The property is served with existing City water and sewer. " • The proposed use will not be harmful to the public safety, health or welfare — Police and fire service are available. "The business should cause no to harm to the existing homes in the neighborhood.
