The Commissioners briefly discussed the new plat and no objections were stated. Bryson noted the new plat addressed previous trespassing concerns, VOTE: There were no objections. SO ORDERED. ITEM 5: PUBLIC HEARINGS 5-a. PZ02-6~A resolution of the Planning and Zoning Commission of the City of Kenai recommending to the Council that KMC 14.20.220(c)(M) be amended to limit the use of sandwich board signs froze May 1 to September 15. Kebschull stated she received no complaints regarding sandwich board signs and Nord stated she viewed limiting the use of the signs as unnecessary. Tunseth stated he could see some logic in amending the code as it was possible abandoned signs could become a nuisance in the winter. The following suggestions and comments were made: Residential Nei borhoods: • Bryson suggested further review in the statement `retain natural vegetation' as many of the existing trees axe unstable. • As no landscaping requirements are currently in the KMC, perhaps rewording this particular section could be beneficial; i.e. require re-planting of new growth. Commercial Land Use: • The Commission agreed the idea of providing tax incentives should be addressed by Council and the Finance Department rather than from the Planning and Zoning Commission. • Several Commissioners questioned the effectiveness of providing a tax break; perhaps additional taxation would be more effective in improving existing buildings. Street Improvements: • Add landscaping and buffering guidelines. City Center/Millennium, Square: • Bluff stabilization. Provide public amenities (benches, etc.) Townsite Standards Historical Zane • Encourage more private investments. • Review code section dealing with Section ZO5 and design standards of the code. • Bryson stated he felt uncomfortable with this particular section as he is unsure how to implement or define a design standards code. Natural Setting and.Onen Space: • Promote bluff stabilization. Develop map of public trails. Community Facilities • Look into promoting more non-profit entities like the Boys and Girls Club and Community Schools Program for youth activities. • Research more mixed-use options and joint uses of the facilities. The Commission decided to recommend that the code be amended to no longer require notices be mailed via certified mail and at a later time review public hearing fees. City Manager Linda Snow asked that legal clarification as to whether or not certified mail is required for legal public notice be researched by the Legal Department. Cary Graves was asked for an interpretation and the following is his response: You requested a memorandum regarding whether property owner notification of a public hearing must be by certified mail as now required under KMC 14,20.280{c) or whether notice by regular mail is sufficient. The general rule as to such notice is stated in IOTA C.J.S. Zoning and Land Planning #208: As a general rule, notice must be given of applications for zoning or building permits or certificates in some public manner, or to persons who maybe interested in contesting the application or whose property rights may be adversely affected. There must be sufficient compliance with a statutory requirement as to the person who must give the native, and the time of giving the notice; and the latter requirement has been held to be jurisdivtional. The notice is not re uired to be ig•yen personally but may be. t~?'ven b~posting notice on thP~roperty or_by publication, The native must afford an opportunity to a person by the exercise of reasonable diligence to determine if his property would be affected by a Fees determination far which application has been made, and to what extent. (Emphasis added and footnotes omitted). Page 2 McQuildin Mun Corp #25.2b1 (3rd Ed) notes that, "Due process with respect to the landowners and other interested ar affected by the proceeding requires either personal or constructive notice that is reasonably adequate to inform them of the pendancy of the proceeding" (Footnotes omitted}. While the above authorities do not require both mailing and publication, it is common to do so. For example, AS 29.40.130 sets out the requirements for a platting alteration or replat. It requires publication and mailing, but does not require the mailing to be certified. In Inniswold-Jefferson Terrace v. L.A. Health, 396 So.2d 348, 351 (La Ct App 1981), the court held notice of a proposed action by the planning board by regular mail in conjunction with publication was legally suffcient. Based on the authority cited above, it is my opinion that amending KMC 14.20.280 to require notice by publication, posting the property and regular mail to property owners within three hundred feet of the affected parcel would provide legally sufficient notice. Basically, it is the City Attorney's opinion that regular mail is legal notification of a public hearing. Attached is a draft resolution recommending that Council amend the code to eliminate the certified mailing requirement. Unless directed otherwise, a public hearing will be scheduled on the draft resolution. A 20-fast sewer and water easement was granted by the parent plat. The City has indicated that they have no objection to vacating the easement. No formal vacation petition has been submitted to the Borough. If not formally vacated prior to the final plat, staff recommends the easement be shown on the final plat. The lots being replotted appear to be vacant. Year 2000 satellite imagery does show improvements on an adjacent lot #o be over ar near the lot line. Staff recommends the surveyor verify that no encroachments exist, The Kenai Planning and Zoning Commission reviewed the plat and recommended approval. They requested verification that no encroachments exist. An installation agreement will not be required. Per KPB Resolution 2000-025, if the Certificate to Plat indicates any beneficial interes#s affect this property, they wilt be notified and given 30 days from the date of the mailing of the notification to respond. They are given the opportunity to notify staff if their beneficial interest prohibits or restricts subdivision or requires their signature an the final plat. if na response is received within 30 days, staff will assume they have no requirements regarding the subdivision and it may be finalized. He pointed out the small square-shaped utility easements on the former lot lines. Instead of conduc#ing a vacation process, he suggested giving staff the authori#y to vacate private utility easements if all the utility companies have submitted written nonobjection. Commissioner Johnson asked Mr. Baker to give the Committee suggested language regarding his proposed changes. Ms. Toll commented that she submitted this request to the Legal Department more #han a year ago. She noted that the Mat-Su Borough platting staff handles utility easement vacations administratively. Mr. Best added that staff would provide the Commission with the proposed changes for review.
