MINUTES
ITEM 1: CALL TO ORDER
Chairman Goecke called the meeting to order at 7:00 p.m.

Roll was taken and confirmed as follows:

MOTION:
Commissioner Osborne MOVED to approve the agenda as presented and requested
UNANIMOUS CONSENT. Commissioner Glick SECONDED the motion. There were no
objections. SO ORDERED.

MOTION:
Commissioner Bryson MOVED to approve the consent agenda and requested
UNANIMOUS CONSENT. Commissioner Glick SECONDED the motion. There were no

5-a. PZ02-fi7-A Resolution of the Planning and Zoning Commission of the City of
Kenai, Alaska, recommending to the Council of the City of Kenai, Alaska, that
KMC 1~.20.280(c) be amended to remove the requirement that notification of
Public Hearings be sent via certified mail.
MOTION:
Commissioner Nord MOVED to approve PZ02-67 and Commissioner Osborne
SECONDED the motion.
There were no public comments.
City Planner Kebschull stated for clarification that administration was directed to
either increase fees or reduce costs as the financial situation at the City of Kenai was
being more closely monitored. Postage costs for sending a single certified notice
averages over $4.00; a significant cost to the City. Kebschull stated the Commission
has approved the removal of this requirement in the recent past and wanted to
reiterate there is no legal requirement stating notices must be sent certified.
Furthermore, Kebschull told the Commission, an even larger reason for removing the
requirement of sending notices via certified mail is the amount of complaints received
by the recipients of the letters. Kebschull has been made aware of a general
resistance to certified mail recipients standing in line at the Post Office, as they feel it
a great inconvenience.

5-b. PZ02-fib An application for a Variance Permit from KMC 14.20.250 - Off-

Block 3, Kenai, Alaska. Applicant is seeking a variance of 5 parking spaces
from the required 10 spaces. Application submitted by Glenn E. Lockwood,
D.D.S., P.O. Box 2403, Kenai, Alaska.
Commissioner Bryson stated he would be abstaining from participation in this item as
a Commission member.
MOTION:
Commissioner Osborne MOVED to approve PZ02-68 and Commissioner Glick
SECONDED the motion.
Glenn Lockwood, CO5 Marine Street, Kenai, addressed the Commission and
requested approval for a variance due to a building addition at the Kenai Redoubt

Dental Clinic. Currently, he is six feet away from code. Lockwood stated he could
avoid the necessity of a variance by clear-cutting the trees on the side of the building
to provide parking; but would much rather prefer to keep the trees where they are.
Additionally, clearing the site would be a tremendous burden on the business.
Lockwood also stated the parking area in question is for patient use only; staff utilizes
off-street parking areas and walks the short distance to the building.
Phil Bryson, 609 Marine Street, Kenai, stated his business is adjacent to Dr.
Lockwood's and has no objections to his request for a variance and recommends the
Commission approve his request with the addition of staff recommendations.
There were no more public comments.
Commissioner Tunseth inquired if the Alternative School parks on that same street
and if these businesses and the school would produce a significant increase in
vehicular traffic. Lockwood, Bryson nor administration stated they did not anticipate
a considerable increase.
Kebschull stated there have been no complaints received by the street crew and
recommends approval with the condition that if a significant amount of complaints are
received, the applicant either find additional parking by way of tree removal or obtain
parking permission from an adjacent lot owner. Kebschull also stated that proving
any such complaints are the direct fault of the Kenai Redoubt Dental Clinic would
require close monitoring and would be time consuming.
Councilman Bannock urged the Commission to be cautious of placing additional
requirements on variances.

Chairman Goecke stated anyone wishing to appeal could do so at the City Clerk's
Office within 15 days.

10-a. City Council -- Councilman Bannock provided a recap of council action
items. Additionally, Bannock stated he supports the Commission's recommendation
to remove the certified mail requirement and will assist this issue on a council level.
as he did the last time this item was an issue. Bannock stated administration would
be preparing documents (including the current documents) to show council this is not
a customer-friendly program. Bannock stated, measuring this resolution on both
customer satisfaction and monetary scales, this resolution passes unanimously.
Bannock stated he feels requiring the public to stand and wait in line at the Post
Office is neither `customer friendly' nor cost effective. Bannock urged Commission
members to attend the upcoming council meeting to support this issue.
Commissioner Bryson stated he felt the only difference between certified and regular
mail is that you get a return receipt.
Bannock stated there is one potential alternative; a gentleman in the audience
informed Council about a verification program the Post Office offers and stated the
whole idea with certified mailing was to assure that everyone got the notice. Bannock
stated he was unaware of the alternative program. Bannock stated even if an
alternative exists, it doesn't change the necessity of passing this resolution.
Chairman Goecke stated the only alternative he could think of was a return receipt
requested, which still requires standing in line.
Commissioner Osborne stated it could be useful to see haw many, if any, of those who
received the notices have actually come to any of the Commission meetings as a show
of interest. He stated, to the best of his memory, maybe two or three have come
unless in direct opposition.
Commissioner Tunseth stated he realizes sending certified mail isn't a huge money
issue, but year after year it adds up to a great deal of money. If every city department
can shave the cost of sending certified mailings, the savings would be noticeable.
10-b. Borough Planning -- Bryson reported on the last two Borough Planning
and Zoning meetings.
10-c. Administration -- City Planner Kebschull reported the following:
• The owner of the state-regulated daycare facility at the end of Fidalgo has
requested administration reconsider the Conditional Use Permit requirement on the
facility. Kebschull stated administration would be proposing an amendment as
facilities of this sort are fully regulated by the state.
+ The businesses along Frontage Road are addressed using Kenai Spur

Highway addressing and Administration will be working with those businesses at the
beginning of the new year to change the addresses to the Frontage Road address
system (from five-digit addresses to three-digit addresses).

A RESOLUTION OF THE PLANNING AND ZONING COMMISSION OF THE
CITY OF KENAI RECOMMENDING THAT THE ATTACHED SUBDIVISION
PLAT BE APPROVED SUBJECT TO THE FOLLOWING CONDITIONS:
WHEREAS, the attached plat Tide View Heights - Padge# Replat was referred to
the City of Kenai Planning and Zoning Commission on December 6, 2002 and
received from Integrity Surveys.
WHEREAS, the City of Kenai Planning and Zaning Commission finds:
1. Plat area is zoned RR - Rura! Residential and therefore subject to said zone
conditions.
2. Water and sewer: Not available
3. Plat does not subdivide properly within a public improvement district subject
#o special assessments. There is not a delinquency amount owed to the City
of Kenai for the referenced property.
4. Installation agreement or construction of improvements is not required.
5. Status of surrounding land is shown.
6. Utility easements, if required, shall be shown.
7. Plat shall verify that no encroachments exist.
8. Street names designated on the plat are correct.

3. There appears a potential for more than 10 lots to be served from Ames
Road and a right-of-way that meets Kenai Peninsula Borough standards
should be dedicated.
4. A note should be placed an the plat noting that development is limited in the
area that does not meet the lot width for the zone, i.e. 90 feet. {No
structure should be placed in the area of the lot that is less than the 90-foot
wide.}
5. There is a question whether or not the section line was vacated. This
should be clarified and if not, vacation issue should be resolved.

A RESOLUTION OF THE PLANNING AND ZONING COMMISSION OF THE CITY OF
KENAI, ALASKA, RECOMMENDING TO THE COUNCIL OF THE CITY OF KENAI,
ALASKA, THAT THE LAND USE TABLE IN KMC i~.22.010 BE AMENDED TO
CHANGE DAY CARE CENTERS FROM "C" (CONDITIONAL USE) TO "P" (PRINCIPAL
PERMITTED USE) IN THE CG (GENERAL COMMERCIAL), CC (CENTRAL
COMMERCIAL) AND IL (LIGHT INDUSTRIAL) ZONES.
WHEREAS, currently day care centers are listed in the land use table for the CG, CC
and IL zones as a conditional use; and
WHEREAS, day care centers are already regulated by the State of Alaska, the Fire
Code (KMC $.05.101) and the Uniform Building Code (KMC 4.05); and
WHEREAS, a day care center is a compatible use for the CG, CC and IL zones; and
WHEREAS, it is in the best interest of the City of Kenai to allow day care centers as
principal permitted uses in the CG, CC and IL zones.
NOW, THEREFORE, THE PLANNING AND ZONING COMMISSION RECOMMENDS
THAT THE COUNCIL OF THE CITY OF KENAI, ALASKA AMEND KMC 14.22.010 AS
SHOWN ON ATTACHMENT A.

AN ORDINANCE OF THE COUNCIL OF THE CITY OF KENAI, ALASKA, AMENDING
THE LAND USE TABLE IN KMC 14.22.010 TO CHANGE DAY CARE CENTERS FROM

INVESTIGATION
Received complaint from City Hall on 05/14/02 and subsequently traveled to the subject
property to inspect and photo two abandoned vehicles. There were no structures on the property.
On 07/22/02, prepared a notice letter with photos and the Kenai Municipal Code and copied,
packaged and mailed them to the property owners.
Made phone contact with the property owner, Mary Jeanne Yragui, on 08/31102. She advised
that her husband was out hunting and would return on 09102/02. She will advise him that the
vehicles need to be removed ASAP.
ACTION TAKEN
Follow-up on 09/01/02 found that the vehicles had been removed. Photos of area taken.

SUBJECT: Annual Reports -Extraction of Natural Resources
There are currently seven active gravel pits operating in the City under Conditional Use
Permits. The operators have submitted yearly reports as required by code. The following
is a brief report of the operations:
1. Chester Cone operates under grandfather status. He has several parcels
included in his extraction operation. {See attached map.) Mr. Cone reported
approximately G00 cubic yards of material was extracted from this site this
past year. Under the grandfather status, Mr. Cone must extract resources in
compliance with current code requirements. However, because these pits date
back many years and excavation took place prior to the City assuming zoning
powers, there are some problems with buffers.
2. Foster Construction holds permits to excavate from two areas. The oldest
gravel pit is located off Beaver Loop Road in the Angler Acres area. This pit
was purchased from Mr. Cone. Only a small quantity of material
(approximately 120 cubic yards} was excavated from the site in 2002. This pit
has buffer problems from excavation that took place many years ago. Mr.
Foster advised there has been no clearing in the buffer areas far at least 15
years. Also, the Angler Acres side of the pit borders wetlands and limits any
activity in that area.
The second pit permit that Foster Construction operates is located off Beaver
Loop Road between the Krogseng and Doyle pits. The report for this pit notes

approximately 4,$00 cubic yards of material excavated this year. Also noted
was that there was no clearing on this parcel this year. This operation has
buffer problems on the rear property line.
3. Pat Doyle, Beaver Loop Sand & Gravel, operates off Beaver Loop Road next
to Foster Construction. The report for this year notes approximately 5,500
cubic yards of material excavated frarn this site. During the past year, Mr.
Doyle worked to reclaim the excavated area at the rear property line.
Photographs document the area was sloped and na further excavation will be
taking place along that property line. There has been miscellaneous
equipment stored at this site that is not a part of the excavation operation. Mr.
Doyle has been advised that the storage operation must be removed no later
than May 30, 2003 ar that he must apply for a permit to operate a storage
yard.
4. Daniel Krogseng, AA Dan's Construction operates off Beaver Loop Road
next to Foster Construction. Mr. Krogseng reported approximately 30,000
yards of material was extracted this last year.
Zubeck, Inc. operates from two parcels located in Hollier Subdivision. The
pits are behind Cone's property. Brad Zubeck, Vice-President, reported there
was approximately 3,900 cubic yards of gravel and topsoil removed from the
site this season. In addition, approximately 1,600 cubic yards of clean fill
materials were placed at the site. No reclamation activities took place this
year. This site has buffer problems from excavation prior to the transfer to
Zubeck, Inc.
6. This year Michael Pelch was approved to reopen the pit previously operated
by his father. This pit is located off Beaver Loop Road across from the
Foster's Angler Acres pit. There was no activity at this site this year.
In July 2002, Ordinance 1957-2002 became effective. This ordinance removed the
requirement for buffers between pit operations. By enacting this ordinance, several code
issues with the pit operations were resolved However, as noted above, several of the pits
still have buffer issues. The code currently requires buffer areas of 200 feet from any
public right-of--way and at least 150 feet from other surrounding properties.
Administration will be reviewing these requirements to determine if further amendments
to the code are justified. As in Mr. Cone's situation, some of the excavation occurred
many years ago and to require reclamation may not be appropriate.
Permit holders will be asked far input and suggestions as to how the code maybe
modified to meet the operator's needs and to protect the surrounding properties. The
Commission and permit holders will be kept abreast of administration's
recommendations for any amendments to the code.

The fallowing public hearing has been scheduled for the Planning
and Zoning Commission meeting of January 8, 2003:
a. PZ03-02-A resolution of the Planning and Zoning Commission of
the City of Kenai, Alaska, that the Land Use Table in KMC
14.22.010 be amended to change day care centers tram "C"
{Cvnditiona! Use} to "P" {Principal Permitted Use} in the CG
(General Commercial), CC (Central Commercial) and IL (Light
Industrial) zones.
The meeting will commence at 7:00 p.m. in the Kenai City Council
Chambers at 290 Fidalgo Avenue, Kenai. Anyone wishing to present
testimony concerning this application should do so at the hearing or
submit written comments to the City of Kenai, Planning Department, 210
