Chairman Goecke called the meeting to order at 7:00 p.m.

4-a. PZ03-O1 -Preliminary Plat -Tide View Heights Padget Replat - A

MOTION:
Commissioner Nord MOVED to approve PZ03-O1 and Commissioner Glick SECONDED
the motion.
Kebschull stated, in addition to the staff recommendations included in the packet, the
following needed to be included:
The plat complies with Borough standards regarding right-of--way dedications.
It appears some dedication may be necessary along Ames Road.
The City has a minimum lot width of 90' for this zone and the twa lots in
question are 66' and 70' so development needs to be limited in the area. A note
should be placed on the plat stating development shauld be restricted to the
area to meet the minimum lot area for the zone, i.e. 90' wide.
The City was unable to determine whether or not the section line was vacated
and that needs to be verified.

Kebschull also noted the surveyor was present to answer Commissioner questions if
necessary. Commissioner Bryson noted the 90' lot width restriction leaves very little
for housing.
AMENDED MOTION:
Commissioner Glick MOVED to amend the main motion to add staff recommendations
and Commissioner Nord SECONDED the motion.
Cliff Baker, Iategrity Surveys, 605 Swires, Kenai, Alaska. Baker indicated the
Borough restricted the area to permanent structures and they had no problem with
the requirement.
After review of the City's additional recommendations, Baker noted the right-of--way off
Ames Road was 50' and he was sure the Borough would give an additional setback.
Baker confirmed the section line was vacated.
Discussion ensued regarding the developable area and Baker stated DEC required a
20,000 sq, ft. setback and that had been accomplished. Baker added, this had been
accomplished and there was developable area. This limits where a structure may sit
but a well and septic could be placed in that area.
Commissioner Amen asked if there was a shared driveway for lots 12A-1 and 12A-2
and if there was an existing structure. Baker confuzned there is a small cabin and a
shared driveway. Bryson asked if it would be a problem if the Borough required the
driveway to be removed. Baker indicated it would not and if there is no easement, his
clients would be instructed that if they were to sell, they would have to put in the deed
an encumbrance for both lots.
Bryson asked about the rationale for the lot shape and Baker stated it was based on
the driveway. Bryson asked if a note would be put on the plat to require structures
meet minimum lot width. Baker stated it would.

10-a. City Council -- Councilman Bannock, referred to the City Council's
action agenda of January 2, 2003, Item D-3, and explained the resolution and noted
the assessing fee for paving was changed from 25% of the total cost to 50%.

Since he wasn't at the January 2nd meeting Councilman Bannock asked Kebschull to
provide a report on Item D-2 (amending KMC to remove requirement of certified
mailings). Kebschull reported the item was tabled for more research on the cost of
delivery confirmation. Discussion took place on the current procedure and what
additional research would be made. Kebschull stated one item that was not
considered during Council discussion was the customer service aspect at the post
office; a lot of people don't want to stand in line for a certified or delivery confirmation
letter,
10-b. Borough Planning -- No report, Cammissioner Bryson noted there had
been no meeting.
10-c. Administration -- Kebschull reported the following:
• The meeting packet includes year-end reports.
• She attended a meeting in Anchorage on December 20~ to review the
final draft of the Comprehensive Plan. This draft will be presented to the
public for comment on February 12~. The fuzal Comprehensive Plan
should be available by early May.
Bryson drew attention to the 2002 Resolution report and thought 2002-~3 was
appealed and approved. Kebschull agreed and stated the action column should have
read Denied/Appealed/Approved; she will make that correction.

ITEM 13 : COMMISSION CO11dMENT3 & QUESTIONS
Commissioner Nord announced her term would end on January 31st and she will
resign. She will provide Council with a formal letter within the week. Nord noted her
reason far resigning as she would not be able to comply with APOC requirements as
she is starting a new business and most of the records APOC requires are in storage.
Commissioner Glick stated he will miss Nord and also thanked Kebschull for the
code violation report as it has been most helpful.
Commissioner Amea stated his term is also up on January 31st and he is willing to
stay on.

Chairmaa Goecke thanked the Commission for their vote of confidence in his re-
election as Chair of the Commission.
City Planner Kebschull stated the Code Enforcement Officer prepared the code
violation report and does a fine job. She thanked Council for allowing this position.

ANALYSIS
General Information:
KMC 14.20.150 details the intent and application process for
conditional uses. The code also specifies the review criteria that must be
satisfied prior to issuing the permit. The criteria are:
1. The use is consistent with the purpose of this chapter and the
purposes and intent of the zoning district;
2. The value of the adjoining property and neighborhood will not be
significantly impaired;
3. The proposed use is in harmony with the Comprehensive Plan;
4. Public services and facilities are adequate to serve the proposed
use;
5. The proposed use will not be harmful to the public safety, health or
welfare;
6. Any and all specific conditions deemed necessary by the
commission to fulfill the above-mentioned conditions should be met
by the applicant. These may include, but are not limited to
measures relative to access, screening, site development, building

design, operation of the use and other similar aspects related to the
proposed use.
Theresa Eddens, applicant, proposes to operate a dog grooming business
with boarding from her home. Ms. Eddens has been operating from her
home for over a year. She was unaware, until contacted by the City, that a
Conditional Use Permit was required to operate this type of business from
her residence. When contacted, Ms. Eddens immediately filed an application
far a Conditional Use Permit.
The City is unaware of any complaints regarding this business. Applicant
states that appointments are scheduled to insure there is only one client at
the residence at any one time. Applicant advises there is sufficient space in
her driveway to accommodate additional vehicles from the business.
Attached is a detailed description of the business provided by Ms. Eddens.
She also attached information provided to prospective clients. This
information further explains the services she provides.
The business is primarily carried on entirely within the residence; however,
there is a fenced area for the pets when they need to go to the bathroom.
Ms. Eddens noted the pets are supervised when they go outside.
It appears, the business as operated, is not in conflict with the
comprehensive plan. Because the business is contained within the residence,
much like a home occupation, it does not appear to have adversely affected
adjoining properties. Public utilities are available to meet the needs of the
business. The use does not pose a health or safety issue.

Kenai K-9 Spa
The Kenai K-9 Spa offers three
categories of extended pet care:
Specialty dog grooming, boarding and
PetMassage Therapy. I am a sole
proprietor and operate the business
totally by myself. I cater to "Special
Needs" dogs, i.e, geriatrics, first time
puppies, dogs that have suffered
previous bad grooming experiences, and
otherwise traumatized dogs.
My grooming and massage appointments
are scheduled in such a manner that I
do not have more than one client
arriving.or departing at any given time,
mal~ing it extremely low traffic.
My boarding technique includes
excercising the dogs in a secure fence,
and always supervised. My boarders do
not go out without me. I do it that way
for several reasons; I am watchful for
any signs of stomach upset, I can
interact and play with them, and they
are quiet.
I have enclosed the handouts that I give
to each client. They explain , in detail,
my procedures.

Our Day begins with a potty excercise time (supervised,
so I can mare sure everything is "working" right).
Then, we have a 'personal' time to include petting,
r is Bing, hissing, or whatever other one on one activity
indicated by the boarder: A morning massage to
relax, build a bond and relieve stress is next on our
schedule. 'T'hen they will have crate time while I
remain in the room and interact and tally to them.
There is always music and, while I am present, candles
and aroma therapy will also be activated. Mid
afternoon, there's another potty excercise session,
personal time and a good brushing. Early evening, after
a short trip outside, I invite them into my living room

are "put up ; so as to not cause any jealousy behavior on
any one's part3. By this time, it is dinnertime. After
they eat and potty once again, we have a short personal
time and an evening massage. Throughout the day, they

Massage Therapy is a procedure that
accomplishes several things. First of all, it
aids in forming a bond between handler and
dog, and instills confidence and comfort.
Secondly, it will stimulate blood flow and
energy to all tissues. There is an increase in
mobility and wellness to muscles and joints.
I begin with a hands only technique and
thoroughly go over every inch of the body, The
joints are worked slowly and carefully, so as to
not over extend or over rotate. Then,
depending on the severity of the
rehabilitation, I do a hydromassage in the tub
using either a whirlpool, or water massage
unit. This stimulates and rejuvenates to an
even further extent. In the event that

a drying process that also aids in promoting
healthy shin and coat,

1 live very close to Terri Eddens of the K_9 Spa. Her front yard borders my back yard. I am disabled and,
for the most part, bed ridden. 1 can see her driveway from my bedroom window. There is very little traffic
going to and from her home. I observe one car at a time at sparatic intervals. I never hear any excessive
barking. It always seems very quiet at her house.
Incidently, Terri does groom my poodles. She picks them vp and delivers them, right to my bed, in a very
timely manner, They always look very nice, but, more importantly, they come home happy. I feel very
comfortable with her taking them, as they seem to enjoy going with her!

SUBJECT: Education Zone Rezone Study
At the Commission's recommendation, an education zone was created within the City of
Kenai. The zone became effective July 5, 2Q02. The purpose of the zone was to create a
district that contained land uses that were consistent with educational facilities.
At the time the Commission recommended the code amendment, several institutions were
listed as possible sites for inclusion in the zone. Initially, administration recommended
only including properties that were in zones that did not permit educational facilities.
Administration now believes all institutions should be reviewed and considered for
inclusion in the zone. Because there was a question by City Council whether or not
rezoning these sites could be considered spot zoning, I asked the City Attorney for a legal
opinion on spot zoning. A copy of his response is attached.
It was agreed that administration would request recommendations from the Kenai
Peninsula Borough for Borough lands they believed would be appropriate for rezoning.
That information has been received.
In addition to the Borough's information and recommendation, City administration
reviewed properties within the City and compiled a list of properties for the Commission
to review. Attached to this memo is a list of properties that includes those recommended
by the Borough and by City administration. Each property should be reviewed using the
criteria described in the education zone and the permitted uses in the use table.
It appears appropriate to schedule a work session to review and discuss the properties
prior to scheduling a public hearing for rezoning.

You requested a summary of the doctrine of "spot zoning" under Alaska law. In Balough v.
FairBanks North Star Borough, 995 P.2d 245, 264 (Alaska 2000), the Alaska Supreme Court
noted, "We have stated that `the classic definition of spot zoning is the process of singling out a
small parcel of land for a use classification totally different from that of the surrounding area, far
the benefit of the owner of such property and to the detriment of others'." (Citations and
footnote omitted).
One scholar has described it as a zoning change which "reclassifies a small parcel in a manner
inconsistent with existing zoning patterns, far the benefit of the owner and to the detriment of the
community." 1 Robert M. Anderson American Law of Zoning 3d §5.12 at 368 (1986}. The
common spot zoning situation is one where the owner of the property seeks a zoning change to
establish a use prohibited under current zoning regulations. Anderson, supra, §5.12 at 358
{1986}. Alaska courts have held spat zoning is an unconstitutional exercise of legislative zoning
authority. Balough, 995 at 264.
In Alaska, courts will examine whether a zoning action constitutes spat zoning on a case-by-case
basis. Balough, 995 P.2d at 264. In Griswold v. City of Hamer, 925 P.2d 1015 (Alaska 1996},
the court set out the basis on which it would examine zoning actions to determine whether they
constituted spot zoning. In general, there is a three-part test for spot zoning: 1) the consistency
of the change with the comprehensive plan; 2) the benefits and detriments of the change to the
owners, adjacent landowners and public; and 3) the size of the area rezoned. No one of the
factors is determinative of the case; courts will balance all the factors when determining spot
zoning.
The first item courts will examine is whether the change is consistent with the municipality's
comprehensive plan. Consistency of the zoning change with the comprehensive plan is a good

indication that the change is for the public benefit and not an arbitrary exercise of power solely
for the benefit of the property owner.
The second paint is whether the change is designed to benefit the public as a whole rather than
primarily benefit a private landowner. As a general rule, if the change is designed with the
primary purpose of benefiting the property owner rather than the public as a whole, Alaska
courts will consider the change spot zoning. Griswold, 925 P.2d at 1024. That doesn't mean the
change can't benefit the property owner, It's just that the intent of the city must be primarily
intended to benefit the public as a whole rather than the individual landowner.
In the Griswold case from Homer, the zoning change was to allow auto-related uses in part of the
Central Business District (CBD). While it was clear the change would benefit the property
owners (one in particular), the court upheld the change because i# found the city's primary goal
to benefit the community rather than just the property owners.
The third criterion is the relative size of the parcel(s) rezoned. In Griswold, the Alaska Supreme
Court noted as a general guide that rezones of a parcel(s) under three acres were nearly always
found invalid and rezones of over thirteen acres are nearly always valid. Whether the area to be
rezoned is one parcel or several is not determinative. The court noted that in some situations the
rezone of a single parcel may not be spot zoning, whereas rezoning of several parcels in another
situation may constitute spot zoning. The rule is not ironclad and size is only one of the three
factors to be considered.
In summary, the courts will use the three criteria set out in Griswold to use as a guide in
evaluating each situation on a case-by-case basis. Please let me know if you have any other

FOOTNOTES
(i) Allowed as a secondary use except on the ground floor of the part of the building fronting on collector
streets and major highways.
(2) One (i) single-family residence per parcel, which is part of the main building.
(3} Allowed as a conditional use, subject to satisfying the following conditions:
(a) The usable area per dwelling unit shall be the same as that required for dwelling units in the RS
zone;
(b) The site square footage in area must be approved by the Commission;
(c) Yards around the site, off-street parking, and other development requirements shalt be the same as
far principal uses in the RR zone;
(d) Water and sewer facilities shall meet the requirements of all applicable health regulations;
(e) The proposed dwelling group will constitute a residential area of sustained desirability and stability;

14.25.020 Application.
This chapter shall apply to all commercia[ and industrial development and ail development of twenty
thousand dollars ($20,000) or more in the Townsite Historic Zone (TSH) within the City of Kenai and shalt
apply to bath the landscaping and site plans. "Commercial and industrial development" and "ail
development" shall be defined as any improvements requiring a building permit for new construction or
any improvements of twenty thousand dollars ($20,000) or more, which adds square footage, located on
properties within the Central Commercial (CC), General Commercial (CG), Heavy Industrial (IH),
Townsite Historic (TSH), [AND) Light Industrial (IL) and Education l=D zoning districts. It is unlawful for
any person to construct, erect or maintain any structure, building, fence or improvement, including

DESCRIl'TION OF OCCUPATION:
The business will provide quilting and quilting design services to quilters.
The bulk of the business will be providing custom machine quilting for quilters
("quilting" refers to the sewing together of a quilt top, batting and the back side of
a quilt). A lesser amount of the business will be designing quilt patterns for
wholesale markets.
The custom machine quilting services will generate some traffic in and out
of my residence. With business at peak capacity, there will be approximately one
to two customers visiting per day between the hours of 8:00 a.m. and 8:00 p.m.
There is ample off street parking in my driveway to accommodate these
customers.
There will be no employees {other than myself) employed in the business.

ALASKA, THAT THE LAND USE TABLE IN KMC 14.22.010 BE AMENDED TO
CHANGE PARKS AND RECREATION IN THE RR, RR1, RS, RS1, RS2, RU, IL, AND IH
ZONES FROM A SECONDARY USE TO A PRINCIPAL PERMITTED USE.
WHEREAS, parks and recreation is currently listed as a secondary use in the RR,
RR1, RS, RS1, RS2, RU, IL and IH zones; and
WHEREAS, parks and recreation is compatible with the intent of those zones as a
principal permitted use; and
WHEREAS, inclusion of parks and recreation as a principal permitted use is
consistent with the 1992 Kenai Comprehensive Plan (Revised 1996); and
WHEREAS, it is in the best interest of the City of Kenai to allow parks and recreation
to be a principal permitted use in the above_referenced zones.
NOW, THEREFORE, THE PLANNING AND ZONING COMMISSION RECOMMENDS

The second year of compiling data for the yearly reports for active Conditional Use
Permits has been completed. This year the process was streamlined. Administration
verified the permit holder was in compliance with the Borough, State, and the City as
required in the code. The permit holder was responsible for verifying that the business
had operated. There are 42 permits required to complete the yearly report. All permits
have been determined to be in compliance as required in K11rIC 14.20.150 {g).

The Code Enforcement Program has now been in operation for the past nine months. By in large
the program has been well received. Investigation, enforcement and report processing have been
refined to where they are being efficiently handled. During the frst quarter of 2003 the Code
Enforcement Officer will have a draft Policies & Procedures Manual prepared for review and
approval of the City Attorney.
The Code Enforcement Program has also proved to be a benefit to the Kenai Police Department.
Some of the minor non-criminal offenses such as abandoned vehicles have been handled by the
Code Enforcement Officer thereby allowing line officers to pursue more important duties.

1 five very close to Terri Eddens of the K-9 Spa. Her front yard borders my back yard. I am disabled and,
for the most part, bed ridden. I can see her driveway from my bedroom window. There is very little traffic
going to and from her home. I observe one car at a time at spastic intervals. I never hear any excessive
barking. It always seems very quiet at her house.
Incident[y, Terri does groom my poodles. She picks them up and delivers them, right to my bed, in a very
