City Councrl _ Councilman Bookey reported the following: • Interviews for the a new City Council member will be held on March 27, 2003 at 7:00 p.m. in Council Chambers. • The smoking issue will be on the April 2, 2003 agenda. • A tour of the Emergency Operations Center at the Alaska Regional Aircraft Fire Training Center is scheduled for Tuesday, April 1 at 10 a.m. • A work session with City Council, Parks and Recreation Commission and the Boys and Girls Club will be held on April 7, 2003. • A joint meeting between the City Council and Airport Commission will be held on April 9, 2003. • The LID public hearing was again postponed. IOb. Borough Planning -Commissioner Bryson provided a report based on activities at the March 24, 2003 Borough Planning meeting. i0c. Administration Kebschull reported the following: • A final review of the draft comprehensive plan is underway and if anyone has any comments they can be forwarded to Kebschull. • The work session for the new education zone will be scheduled for April 9, 2003. • A variance request will possibly be presented to the Commission for the Thompson/Bible addition as there is a 4.5-foot side setback encroachment. Applicant is proposing to operate a nail salon business from her home. Beauty Parlor is listed as a permi#ted home occupation. Nail salon is considered similar to beauty parlor and licensed by same State Agency. Ms. Arbelovsky, applicant, advises there will be no employees and believes at peak capacity there would be approximately one to two customers visiting the residence. There is sufficient off-street parking; applicant notes that there is a wide drive way as well as extra parking available on the property. (See attached drawing provided by the applicant.) The applicant has asked to enter into a new 10-year lease. The property is Airport Land and is within the airport flight path. It is a requirement of the Federal Aviation Administration that the lease include a clause stating that the City reserves the right to cancel the lease on 90-days notice. Prior to leasing the site an appraisal must be performed and approved by the Federal Aviation Administration. The Planning and Zoning Commission needs to determine if the intended use complies with the zoning ordinance and comprehensive plan of the City. Your recommendation will be forwarded to the Kenai City Council for their April 16`h meeting. The same owner subdivided a similar tract adjacent #o the north boundary in 7996. Due to the similar size, adjacent proximity, and close subdivision names {Tract A Strawberry Fields Forever and Tract A Strawberry Fields Forever Addition # 1), staff requests the owner consider changing the Tract designation to Tract B to avoid passible confusion. The subdivision proposes to extend and match Devray Street, bringing it to a foil width adjacent to the west boundary. A clearing and travel way are apparent on the satellite imagery. The surveyor has shown and labeled this as an old fire break on the plat. KPB 20.20.030 requires the subdivision to provide for the logical extension of surrounding streets. KPB 20.20.160 allows a maximum block length of 1400 feet. Staff recommends Wolfe Avenue be extended across the north boundary of the current Tract A to satisfy bo#h of these Code requirements. Extension across the south boundary, as a full or half dedication, could not feasibly be continued in the future due to the development pa#tern to the east and west. The Kenai Planning and Zoning Commission recommended approval of the plat on February 26, 2003. They commented that while this current subdivision does not require an installation agreement, any further subdivision of Trac# A will require such an agreement. This has been noted on the plat. Per KPB Resolution 2000-025, if the Certificate to Plat indicates any beneficial interests affect this property, they will be notified and given 30 days from the date of the mailing of the notification to respond. They are given the opportunity #o notify staff if their beneficial interest prohibits or restricts subdivision or requires their signature an the final plat. If no response is received within 30 days, staff will assume they have no requirements regarding the subdivision and it may be finalized. No exceptions have been reques#ed. It appears that the center !o# is vacant and is being split and replotted into the two outer lots. The two outer lots are developed with residential structures. Constructed road access is available to the lots. The Kenai Planning and Zoning Commission reviewed the plat on February 26, 2003. They recommended approval, subject to the surveyor verifying that no encroachments exist. Staff recommends the surveyor submit documentation #o comply with this request. No installation agreement is required by the City. . Staff recommends the surveyor clarify whether water and sewer service are on-site or City provided. Per KPB Resolution 2000-025, if the Certificate to Ptat indicates any beneficial interests affect this property, they will be no#ified and given 30 days from the date of the mailing of the notification to respond. They are given the opportunity to notify staff if their beneficial interest prohibits or restricts subdivision or requires their signature on the final plat. If no response is received within 30 days, staff will assume they have no requirements regarding the subdivision and i# may be finalized. Na exceptions have been requested. This amendment requires Title 14 be amended to include this adoption. This is considered an editorial change and a public hearing will not be held at the Planning Commission. Attached is a copy of the proposed amendment to Title 14. Attachment 14.20.220 Signs. (a) General Requirements. (1) A permit shall be obtained from the administrative official prior to the installation of any sign, nameplate, advertising sign or advertising structure except as provided in subsection (c) of this section. Construction and erection of signs shall be in accordance with this chapter, with [THE UNIFORM SIGN CODE] A endix H of the International Buildin Code, and with the National Electrical Code, except that temporary signs need not be constructed according to [THE UNIFORM SIGN CODE] Appendix H of the International Building Code. (2} When a building permit is obtained for the construction of a building, signs for that building that conform to this Code shall be considered as part of the valuation of that building. The fee for signs not covered by a building permit shall be set as provided by KMC 7.15.100. (3} A permit for a commercial advertising sign shall be issued only if the sign will be located an the premises advertised, or on the common property available for such purposes to all commercial occupants of a multiple commercial development such as malls. (4) Penalties for violations of this section shall be as set forth in KMC 14.20.2b0 (e}. (5) If any of the provisions of this Code hereby adopted conflict with [THE UNIFORM SIGN CODE] A endix H of the International Buildin Code adopted by reference, the provisions of this Code will prevail. (6) Signs shall be erected and maintained plumb, level, and true and kept repaired, painted, and maintained.
