CHAIRMAN RON GOECKE, PRESIDING MINUTES ITEM 1: CALL TO ORDER Chairman Goecke called the meeting to order at approximately 7:00 p.m. 1-a. Roll Call Roll was confirmed as follows: Present: Bryson, Eldridge, Amen, Glick and Goecke Absent: Tunseth 1-b. There were no additional staff comments. Commissioner Bryson noted the explanation (included in the packet information) indicatING the property was zoned "before the city assumed zoning powers" was true and that zoning had not changed over the years. Bryson stated he would support the motion. Commissioner Glick noted this was the same parcel which had been approved at a recent Commission meeting. He added, he believed the owner was trying to do what he could to make it compliant and he would support the motion as well. PZ03-14 -- An application for a Home Occupation Permit for operating a daycare at the property known as Lot 1B, Block 12, Mommsen's Subdivision Amended Addition #2, 1116 First Street, Kenai, Alaska. Application submitted by Jessica Hartley, P.O. Box 504, Kenai, Alaska. Removed from consent agenda. MOTION: Commissioner Eldridge MOVED for approval of PZ03-14 and Commissioner Glick SECONDED the motion. Department Assistant Carver reported the applicant is renting from a property management company who instructed their tenant only four children could be cared for in the dwelling and for only two months. She added, the city does not police management companies, however the item will be calendared for two months to inquire whether day care is still being provided from the residence and whether an agreement has been worked out with the property management company. Commissioner Amen stated he had requested the item be removed from the consent agenda because the code only allows up to 30% of the dwelling to be used for the day care and by his calculations, the area of the home to be used would exceed the 30%. PLANNING & ZONING COMMISSION MEETING APRIL 23, 2003 PAGE 2 He added, he didn't have a problem with using the home for day care, but was concerned the code requirement was not being followed. A brief discussion followed and Eldridge stated he thought the kitchen would only be used for preparation of food and the primary use for the day care would be the living room. Bryson stated it would be difficult to say exactly where the day care activities would take place, however, because the applicant has two children, he felt only one of the bedrooms should be included in the calculations. Bryson stated he would support the motion. Chairman Goecke stated he felt Arnen had a valid point, however, because it is difficult to tell in what areas of the dwelling the day care would take place, he would support the motion. He noted, because there are so many variables in regard to the areas where day care would be provided, he didn't know if anyone could create a hard and fast rule on it. He reviewed the actions taken, noting anon-smoking ordinance was passed and a new council rzaember was elected (Osborne). 10-b. Borough Plannio.g -- Commissioner Bryson reported a copy of the April 14 meeting agenda was included in the packet. He reviewed actions taken and noted a presentation was made in regard to a multi-year schedule for proposed construction improvements for the Chugach National Forest, i.e. additional parking stalls, lengthening existing parking stalls, additional remote cabins, adding approximately 130 miles of trail and 12 new trail heads; Tern Lake will be improved as a tourist- friendly wayside. PLANNING & ZONING COMMISSION MEETING APRIL 23, 2003 PAGE 3 10-c. Administration -- Carver noted the following items: • A questionnaire regarding historic preservation was distributed to the Commission and she requested the members fill it out and return it to the Planning office. • May 14 will be a large agenda with five public hearings, including the educational zone. • She will discuss the 30% day care requirement with Kebschull and report back to the Gornmission. Thereafter, they shall be inspected every other year by the City Fire Marshal. Failure to comply with the f re code (KMC 8.05) shall be grounds for the suspension or revocation of the conditional use permit. In addition to these requirements, you must satisfy the requirements for a Conditional Use Permit as outlined in KMC 14.20.150. • The use is consistent with the purpose of this chapter and the purposes and intent of the zoning district; • The value of the adjoining property and neighborhood wi11 not be significantly impaired; • The proposed use is in harmony with the Comprehensive Plan; • Public services and facilities are adequate to serve the proposed use; • The proposed use wi11 not be harmful to the public safety, health or welfare; • Any and all specific conditions deemed necessary by the commission to fulfill the above-mentioned conditions should be met by the applicant. These may include, but are no# limited to measures rela#ive to access, screening, site development, building design, operation of the use and other similar aspects related to the proposed use. Applicants are seeking a Conditional Use Permit for a bed and breakfas# and guide service for the above-noted property. The applicants are the owners of the property. Based on the information provided it appears that the proposed bed and breakfast meets the requirements of the Kenai Municipal Code. The applicants recently purchased this property and plan to build asingle- story house with a garage. The house and garage, as proposed, meet the development requirements far the zone. The applicant is requesting a variance to construct a 280 square foot shed in the back yard. The shed will encroach 14 feet into the rear setback. In addition, with the additional square footage for the shed, the lot coverage allowance is exceeded. Thirty percent lot coverage is allowed. The lot is 9,834 square feet. Thirty percent is 2,950 square feet. The house and garage square footage totals 2,769 leaving 181 square feet. With the shed, the lot coverage will be 99 square feet over the maximum allowed, or one percent over the maximum lot coverage. To grant a variance, the Commission should determine that the request meets the requirements of the code. 1. The first condition is that special conditions are circumstances are present which are peculiar to the land or structures are involved with are not applicable to other lands or structures in the same zoning district. This lot appears similar to other parcels in the subdivision. The difference may be that the applicant is proposing to build asingle-story structure that takes up mare lot coverage. 2. The special conditions or circumstances have not been caused by actions of the application and such conditions and circumstances do not merely constitute a pecuniary hardship or inconvenience, The proposed construction on the small lot limit development options. The alternative, building a two-story structure may eliminate the setback and lot coverage issues; however, may affect neighboring property by obstructing views. The applicant is proposing to build on the lot; however, did not subdivide the lot. 3. The use is a principal permitted use in the zone. 4. The variance is not based on other non-conforming structures or uses in the zone. The variance far lot coverage is a minimal variance and appears reasonable. The rear setback is a larger issue. The applicant is requesting a 14-foot rear setback variance. The proposed placement meets the side setback requirements. If the structure measured less than 120 square feet, it would not require a building permit and could be placed in the setback. Because the size of the structure requires a building permit, setbacks must be met. Applicant would like to expand the day care and convert the garage to a Montessori classroom and provide preschool services in addition to the day care. In the future, if the school is successful, the applicant plans to add an addition specifically for the day care and preschool. Applicant has operated the day care since November 2001. There have been no complaints received by the City in conjunction with the day care operation. This house is located on a two and a half acre parcel and there is sufficient on- site parking.
