ITEM 1: CALL TO ORDER
Chairman Goecke called the meeting to order at 7:00 p.m.
1-a. Oath of Office/Commissioner Hammelman
Kebschull administered the oath of office to John Hammelrnan.

MOTION:
Commissioner Bryson MOVED to approve the agenda as presented and asked for
UNANIMOUS CONSENT. Commissioner Amen SECONDED the motion. There were
no objections. SO ORDERED.

MOTION
Commissioner Amen MOVED to approve the consent agenda and requested
UNANIMOUS CONSENT and Commissioner Bryson SECONDED the motion. There
were no objections. SO ORDERED.
ITEM 2: APPROVAL OF MINUTES -- May 14, 2003

ITEM 4: CONSIDERATION OF PLATS
4-a. PZ-03-21 -- Preliminary Plat -- Kay Lynn Subdivision No. 3. Submitted
by McLane Consulting Group, P.O. Box 468, Soldotna, Alaska.
MOTION:
Commissioner Bryson MOVED to recommend approval of PZ-03-21 and Commissioner
Arnen SECONDED the motion.
Kebschull noted the code did not allow an accessory structure without a principal
structure so the applicant, who owns both lots, is requesting to remove the lot line to
create one large lot. The lot would meet size requirements for the zone and would
allow hirn to construct a garage.
Amen asked if the neighbors were notified and Kebschull replied, because of the
location, the Borough will do the notification.

7-a. Discussion -- Kenai Spur Highway Addressing
Kebschull explained the purpose of the draft ordinance included in the packet and
Hated 157 properties would be affected by an address change without it. Amen asked
what percentage of the properties would be affected and Kebschull replied, alI
properties would be affected whether they were used or not. After a general
discussion, the consensus was to not subject the property owners to a street address
change. Kebschull stated the draft ordinance did not take into consideration new
development and she wauld consult the City Attorney to assure the numbering
remains consistent with the current system. Kebschull added, a public hearing would
be scheduled for June.

10-a. City Council -- Councilman Osborne provided a reported based on
actions taken at the May 21, 2003 meeting.
10-b. Borough Planning -- Commissioner Bryson provided a report based on
actions taken at the May 27, 2003 Borough Planning meeting.
10-c. Administration -- Kebschull reported the following:
• The Kenai Peninsula Borough will be taking public comment on their
transportation plan.
+ A letter was received from Spencer Devito and Jimmy Segura opposing
the proposed One Stop development. Kebschull reported, there was same clearing
being done in the area and they were asked to stop until a landscape site plan was
provided. Kebschull added, the area is zoned commercial so a Laundromat anal car
wash would be allowed.
• The discussion on the draft Comprehensive Plan has been rescheduled to
the June 25~ meeting.

I received your letter regarding the One Stop development located at 5455 Kenai Spur
Highway. Your concerns are noted, and the information will be provided to the Planning
and Zoning Commission. Yau were correct in stating that the development was launched
without the necessary permits. Since the property is zoned general commercial, the
property owner was notified that the clearing must be stopped until a landscaping
application is received, reviewed, and approved. To date, the City has not received the
application.
The City of Kenai landscaping requirements are minimal. The intent is to provide for
orderly and safe development. The code lists perimeter landscaping to provide buffer to
minimize impact. However, the buffer may not be required. The plan, when presented,
will be reviewed to insure that it meets the code requirements. Specifically, the plan
must provide far planting details, snow storage areas, drainage patterns, locations of
buildings, parking and access. Required landscaping is a maximum of five percent of
project area limiting the amount of landscaping that the City may require.
If the plan as proposed requires additional access to the Kenai Spur Highway, the
applicant would be required to obtain the necessary permits from the State of Alaska,
Department of Transportation. The Department of Environmental Conservation {DEC} is
responsible for the on-site fuel storage. If a car wash or Laundromat is developed at the
site, the development will be required to meet DEC regulations.
Your concern about noise pollution is noted, and the developer will be encouraged to
maintain as much natural buffer as possible when developing the property.
Unfortunately, the City has no control over the State right-of--ways or the recent clearing
of the right-of--ways or the rumble strips that were placed along the Kenai Spur Highway.
Your concerns should be presented to the appropriate State agencies.

The City appreciates your input and wilt work diligently with the property owner to
insure that the City's development requirements are met. The City Administration will
review any proposed development to insure that it meets the City code and
Comprehensive Flan. Because this property is in a commercial zone, a car wash or
Laundromat would meet the development requirements for that zone.

We would like to file a letter of reconsideration concerning the Strawberry Fields Forever
Addition No. 01 (KPB 2003-045). I request exceptions as per KPB 20.24.010 for this replat to be
in compliance with KPB 20.20.03 and KPB 20.20.160 as outlined by staff recommendation.
I testified at the KPB Plat Committee meeting on May I2`~ in apposition to Wolfe Avenue
extension. I supported the exception motion to Wolfe Avenue extension.
My testimony and that of my fellow neighbors that testified was based an the staff
recommendations from previous plat committee meetings to extend Wolfe Avenue to Strawberry
Road. We all agree that a through street to Strawberry Road in our neighborhood would change
the dynamics of this neighborhood. The way the preliminary plot was settled Shell Drive would
be extended across the Northern boundary of tract A all the way to Strawberry Raad. This is
totally against the wishes of those who testified at the meeting. We were all adamant that no
through passage to Strawberry Road be granted.
Towards the end of the public testimony the property owner of the replat suggested a
compromise by offering a half dedication across the North end of the un-divided subdivision.
This same individual gave a verbal OK for the half dedication across John and Bernie V~ensley's
Tract `A'. Mr. Wensley and his son Lincoln testifed earlier in the evening giving no indication
of a possible compromise to the North.
I request than an exception to Shell Drive be granted based an the same findings that the plat
committee found to grant the excep#ion to Wolfe Avenue extension. if the exception can't be met
then I request that the committee look again at the options for dedication along the subdivision
replat.
Fact 1 {That special circumstances or conditions affecting the property have been shown)
Findings:
1.) The neighbors testified that extension through the neighborhood would affect the Iifestyle
that they have become accustomed too.
2.) The larger parcel size (greater than 6 acres) of Tract A and B indicate they can be
subdivided in the future providing road access and dedication. The covenants drawn up
for this property state pazcels must be subdivided into units greater than 3 acres. Any
potential buyer for Tract B easily could subdivide their parcel.
Fact 2 {That the exception is necessary for the preservation and enjoyment of substantial
property right)
Findings:
l.} Extension of Wolfe Avenue and Shell Drive would be detrimental to current property
rights.
2.} An exception is necessary to conserve the space not bisected by roads. Testimony of
cross country skiing, hiking, and sledding on the property is well documented. Traffic
across the land would make that impossible. granting the exception would substantially
preserve a way of life for those of us who live here.
Fact 3 (That the granting of the exception will not be detrimental to the public welfaze or
injurious to other property in the area)
Findings:
1.) As testimony has indicated extension of Wolfe Avenue and Shell Drive would be
detrimental to surrounding property and public welfare in the area.
2.) Drawing through traffic into the subdivision to reach Spur Highway would definitely put
children in peril who now play freely in the streets of 3 W subdivision.
The Shell Drive extension would only have a negative impact on the 3 W Subdivision. This road
will be difficult to build across the swamp easily visible in the aerial photo to the North of 3 W's
subdivision. We are against this idea and feel that it would decrease the value of our property.
One of the reasons we have lived here for 15 years is the quality of the neighborhood. It is quiet
and safe for our children to play, ride bikes, and ga back and forth between their friend's homes.
Please find some other way to solve the Strawberry access issue. We do not want the quality of
our neighborhood destroyed.

The Strawberry Fields Forever Addition No. O1 subdivision replat brought residents of
3 W's subdivision to the last plat committee meeting united in opposition to any through
passage connecting our neighborhood with Strawberry Road. We were all under the
impression that the proposed Wolfe Avenue extension would go straight to Strawberry
Road. We learned differently after that meeting was over.
Yau heard testimony from 5 households (out of 20 in the neighborhood) all unanimously
in opposition to any connection with Strawberry Road. Yau were also presented with a
petition signed by 16 residents of 3 W's who oppose Wolfe Avenue extension to
Strawberry Road. Testimony continued with the increase in traffic proportional to
increasing danger involving 17 children who play throughout the neighborhood.
After the testimony from 3 W residents an alternative plan emerged with Shell Drive
extension to Strawberry Road. None of the 3W residents had an opportunity to discuss
the possibility that this was a viable alternative to Wolfe Avenue.
Shell Drive will never be built through the swamp that borders 3W's to the west and
north as seen on aerial photos (page 89) submitted by staff at the last plat committee
meeting. Staff findings (page 20 unapproved minutes) state that "alternate access will not
be feasible to the north of this current subdivision due to the large swampy area."
Without this extension to Spur Highway all traffic will be routed off Carver Rd., west
down Shell Dr., south dawn DevRay St., then west down Wolfe Avenue through 3 W's
subdivision. This is against the testimony that you have documented from 3W residents.
The Wolfe Avenue extension or an easement on the south side of Tract B are the only
options that you should consider that will effectively postpone future road development
and subsequent traffic through 3W's subdivision. Remember that the residents of 3W's
subdivision are the individuals directly affected by your decision. Shell Drive extension
is not the answer to Strawberry Road ingress/egress.
