ITEM 7: NEW BUSINESS 7-a. Discussion -- Amendment to Kenai Zoning Map -Thompson Park Subdivision -- Fireweed Lane area. Kebschull referred to information included in the packet relating to the Commission's consideration of rezoning property in the vicinity of Fireweed Lane from commercial to residential zoning. The information explained, the possible rezone is due to several of the properties located in the area being zoned commercial even though the primary use is residential. Additionally, the residential use is considered anon-conforming use and could limit or restrict development options on the property. Kebschull reported letters had been sent to the property owners in the Fireweed Lane area informing and explaining the possible rezone. Of those written, she had received responses from about half of the property owners and of those, four want their properties to remain zoned commercial. She will follow up with another contact attempt to those who have not responded. PLANNING & ZONING COMMISSION MEETING AUGUST 13, 2003 PAGE 2 Bryson noted, there was an attempt to rezone some properties adjoining the "One Stop" property, which was approved by the Commission and rejected by the council some years ago. The Commission discussed those properties that may be rezoned and which ones would not be included. A request was made to have a map for future discussions with the lot numbers and current zoning delineated. There were no objections to bring the matter back for further discussion. 7-b. ITEM 9: CODE ENFORCEMENT -- None. ITEM 10: REPORTS 10-a. City Council -- Councilman Osborne reviewed the action agenda of the August 6 council meeting which was included in the packet. He also reported administration was investigating the concerns DeWayne Craig voiced relating to building and excavation permits for which he had applied in 2002 and 2003. 10-b. Borough Planning -- Commissioner Bryson reviewed the agendas which were included in the packet and reported on the actions taken at the July 28 and August 11 Borough Planning Commission meetings. 10-c. Administration -- Kebschull reported the following items: • She attended the Western Planners Conference in Las Vegas recently. • She attended a meeting with representatives of the Kenaitze Indian Tribe and the Salamatof Native Association, along with the City Manager, Mayor Williams, and new economic development program director at which they discussed the Comprehensive Plan. Througkl the discussions, Williams suggested council delay final action on their ordinance to approve the Plan until November, giving the groups PLANNING 8v ZONING COMMISSION MEETING AUGUST 13, 2003 PAGE 3 additional time in which to review the document and make suggestions. It was noted, council had already decided more than one public hearing would be held on the ordinance. • Council is reviewing the Borough's Kenai River Projection Area and may consider administering the regulations for properties situated within the city. The code also specifies the review criteria that must be satisfied prior to issuing the permit. The criteria are: 1. The use is consistent with the purpose of this chapter and the purposes and intent of the zoning district; 2. The value of the adjoining property and neighborhood will not be significantly impaired; 3. The proposed use is in harmony with the Comprehensive Plan; 4. Public services and facilities are adequate to serve the proposed use; 5. The proposed use will not be harmful to the public safety, health or welfare; 6. Any and all specific conditions deemed necessary by the commission to fulfill the above-mentioned conditions should be met by the applicant. These may include, but are not limited to 03-32 (93-52) Comment.doc Page 2 measures relative to access, screening, site development, building design, operation of the use and other similar aspects related to the proposed use. In 19$5, the Conditional Use Permit for Gravel Extraction was transferred from River Bend Sand and Gravel, Inc. to Pat and Mary Doyle, Beaver Loop Sand and Gravel. In 1992, the permit was amended to allow a mobile home to be placed at the site for use as a security guard station. In 2002, when reviewing the Doyle's yearly report, it was discovered that several pieces of equipment and materials not used in conjunction with the gravel pit operation were being stored at the site. Mr. Doyle was informed that an amendment to his permit would be required to continue the storage site at the gravel pit. At that time, Mr. Doyle believed the equipment and materials would be moved and an amendment would not be necessary. However, in 2003, the storage area remained. Mr. Doyle was given a period of time to remove the items or to file an amendment. Mr. Doyle is now requesting an amendment to allow the storage of construction equipment and miscellaneous tools. The construction equipment is clearly used as a part of Doyle Construction [Beaver Loop Sand and Gravel). Some equipment stored at the site belongs to a family member`s construction company. That equipment will eventually be moved to a site outside of the city. This is a 52.5-acre parcel and has sufficient space for the storage. The materials and equipment are stored in areas of the parcel that were previously excavated. Et does not appear that allowing the amendment to include storage will adversely affect neighboring properties. City Engineer: The storage area is not visible from Beaver Loop Road. Any and all specific conditions deemed necessary by the commission to fulfill the above-mentioned conditions should be met by the applicant. These may include, but are not limited to measures relative to access, screening, site development, building design, operation of the use and other similar aspects related to the proposed use. 03-33 (PZ0243) Comment.doc Page 2 On August 14, 2002, the Planning and Zoning Commission denied a request from Ms. Henricksen for a conditional use permit. The applicant had applied for a permit to operate a pet grooming business from her residence. During the public hearing it was discovered that Ms. Henricksen periodically boarded pets at her residence. After discussing the issue, Ms. Henricksen agreed to limit the business operation to pet grooming, however the permit was denied. On August 28th, Commissioner Glick moved to reconsider the action; however, the motion failed and Ms. Henricksen filed an appeal with the City Clerk. On September 18, 2002, the Board of Adjustment held the appeal hearing. The Board issued their decision on October 21, 2002 and granted the appeal wi#h a condition that asight-obscuring fence replaces the current fence by June 30, 2002. Ms. Henricksen did not meet the Board of Adjustment's requirements for replacing the fence by the deadline of June 30th. The applicant was advised her options were to cease operation or apply to modify the permit to remove the fencing requirement. She was informed that failure to take one of these steps would result in a revocation hearing before the Commission. An applica#ion to modify the permit to remove the fence requirement was received on July 31, 2003. The grooming business is conducted in the garage. According to the applicant, the pets are only visible when c#ients bring the pets to and from the vehicles to the shop. City ELngineer: None Building Official: No Building Issues. RECOMMENDATIONS During the original public hearing and the appeal hearing, neighbors testified that they were concerned about the business and their property values. Testimony included concerns about dogs in the yard and the disrepair of the fence. If the business were limited to the garage and clients transporting their pets to and from the garage, it would appear that the concerns might be minimized. If the business were limited to the garage, the fence would not be a part of the operation. Recommend approval with the following requirements: 1. Sufficient off-street parking must be available for clients. 2. Pets must be transported directly from the vehicle to the garage and directly back to the vehicle. The tots range in size from ~ 2,330 square feet to 32,300 square feet. City water and sewer service are available tv all lots. The subdivision is located in a level area of Kenai. Lots 2 and 3 are flag tats, accessing onto Kaknu Way. Kaknu Way appears to be constructed. Staff recommends a Hate be placed on the plat to prohibit structures within the panhandle portions of the Pots. A matching dedication is proposed for Kaknu Way. Staff recommends the total right-of-way width be labeled. There is a 50-foot right-of-way easement on the east side of the subdivision. Baker Street proposes to dedicate 30 feet as a half right-of-way. Vacation of the remaining 20-feet will be considered at the August 25, 2003 Planning Commission meeting. Staff recommends approval of this plat be subject to approval of the vacation. Per KPB Resolution 2000-025, the Certificate to Plat indicates a beneficial interest affects this property, They have been notified and given 30 days from the date of the mailing of the notification to respond. They are given the opportunity to notify staff if their beneficial interest prohibits ar restricts subdivision or requires their signature on the final plat. If no response is received within 30 days, staff wii! assume they have no requirements regarding the subdivision and it maybe finalized. The Kenai Planning and Zoning Commission reviewed the plat on June 25, 2043. They recommended approval, subject to approval of the vacation. An installation agreement will not be required. No exceptions have been requested.
