CHAIR RON GOECKE, PRESIDING MINUTES ITEM 1: CALL TO ORDER Chairman Goecke called the meeting to order at 7:00 p.m. 1-a. Agenda Approval MOTION: Commissioner Glick MOVED to approve the agenda adding the information provided prior to the meeting and requested UNANIMOUS CONSENT. Commissioner Eldridge SECONDED the motion. Chairman Goecke opened the public hearing and announced that photos and artist renditions of the project were available for review. Jack Alexander, Kenai, Alaska -- Mr. Alexander indicated he had no problem with the conditional use permit but expressed concern with the curvature of the road. Alexander reported there had been at least four rollover accidents in that area since he and his wife had moved to the area and was concerned increased traffic will result in more accidents. Alexander stated the property at the curve is going to be built on and suggested the City, Borough or the applicants consider purchasing the lot to keep it vacant for safety purposes. Steve Agni, Anchorage, Alaska -- Mr. Agni introduced himself as one of the two partners in the project and provided a brief explanation of their plans for Ward's Cove and their desire to maintain the historic elements of the property. Commissioner Barrett asked how Angi felt about the concern with the road. Agni stated he was not familiar with the road and thought signage may be appropriate. Agni stated they would be in contact with the Borough. Commissioner Amen asked what three major steps were taken to protect the river. Agni replied, his partner, J'on,Faulkner, had met with the appropriate agencies and they will be involved. Agni continued, there were no plans for bluff excavation and they would protect the wetlands. Commissioner Eldridge asked about the repair and maintenance of the existing dock. Agni stated they want river access and will focus more on access for those who are less ambulatory. Agni added, they would provide river access but have no plans to expand what is already in place. Eldridge asked about a waterfront restaurant and Faulkner stated the project was scaled to what is more realistic, but there is room in the future for a waterfront restaurant. Agni added, the site offers a lot of opportunity and the project consists of a one-year, three-year and long-term plan. Agni stated they hope to have the lodging unit done by spring to accommodate 30 to 50 people. PLANNING & ZONING COMMISSION MEETING OCTOBER 22, 2003 PAGE 2 Barrett asked about ahaul-out for power or drift boats. Faulkner indicated there were no plans far a launch at this time due to the tidewaters. Additionally, a permit is required and no effort had been made to obtain one at this time. After review of the photos and renditions, Barrett asked about the landscaping plans. Faulkner stated they were very pleased with the renditions and the landscaping that is shown. Barrett asked about the exterior of the buildings and Faulkner stated painting was definitely needed but the metal walls and roofs would stay. Faulkner added, the wooden structures would require insulation as they will be used year-round and the original windows will remain. Faulkner reiterated their desire to maintain the historic integrity of the buildings. It was noted the property was not on the historic register. Barrett asked if the names of the buildings would remain and Agni replied, they have no ownership to the names. Discussion ensued regarding a museum and Agni indicated it was their intention to display some of the historic equipment on site. Faulkner added they would pursue a Certified Local Government grant to catalog the assets that exist on site and would also look for assistance from the community to develop historic data. After the public hearing closed, Commissioner Bryson announced he would abstain as there was potential his firm would be hired to perform some work on the project. Kebschull advised the public they had I S days in order to file an appeal with the City Clerk on the decision. ITEM 6: OLD BUSINESS 6-a. Discussion -- Comprehensive Plan/Discussion of Public Comments Bryson recommended the Kenaitze Indian Tribe comments be forwarded to Planning for review to determine where their comments could be incorporated into the Comprehensive Plan. Kebschull noted the information was received at 1.:00 p.m. on October 22 and after a quick review, it was apparent all could be incorporated in the Plan. She added, the City Council would be provided with the areas where the items PLANNING & ZONING COMMISSION MEETING OCTOBER 22, 2003 PAGE 3 could best be incorporated. After a general discussion Kebschull noted the Council had asked far input from all agencies prior to their approval of the Plan. The Plan will be before Council for final approval at their November 5~ meeting. 6-b. Discussion -- November 2b and December 24, 2003 Meeting Cancellation Kebschull reported the November 26 and December 24, 2003 Planning and Zoning meetings have been cancelled. ITEM 7: NEW BUSINESS 7-a. Discussion -- Certified Local Government Guidelines Kebschull stated she reviewed the guidelines and they look fine. She added, after the dissolution of the Historic District Board, the Planning and Zoning Commission was given the responsibility for the reviewing and making recommendations on any applications for the historic district. Kebschull noted, there hasn't been any activity since the Historic Board dissolved. Amen asked how closely the grants are scrutinized once they are awarded. Kebschull explained her previous experience with the two grants the City was awarded. Kebschull noted the State Historic Preservation Office is unhappy with the City's inactiveness, however, the City does maintain the standards for being a Certified Local Government. Kebschull stated a grant was received to send her and her assistant to training in Anchorage next week. Kebschull will meet with the staff at that time and will provide a report to the Commission at the next meeting. 7-b. Discussion/Recommendation -- Lease Application, 20/20 International, Inc. and John C. & Marie L. Parker, Individually -Lots 5 8s 6, Block 1, F.B.O. Subdivision. Kebschull noted staff had nothing additional other than- the use meets the criteria for both the zone and Comprehensive Plan. Commissioner Glick asked if the Airport Commission reviewed the application and Kebschull replied they did and recommended approval on October 9, 2003. Administration -- Kebschull stated a rezone report would be provided at the next meeting. She also reported the Borough comprehensive plan meeting was not very well attended. Commissioner Eldridge was happy to see Ward's Cove rejuvinated. Chairman Goecke congratulated Council Member Ross on his appointment. The Code also outlines the review criteria that should be used by the Planning and Zoning Commission to determine if a variance should be granted. The Commission shall establish a finding that all of the following conditions exist as a prerequisite to issuance of a variance permit: 1. Special conditions or circumstances are present which are peculiar to the land or structures involved which are not applicable to other (ands or structures in the same zoning district. 2. The special conditions or circumstances have not been caused by actions of the applicant and such conditions and circumstances do not merely constitute a pecuniary hardship or inconvenience. 3. The granting of the variance shall not authorize a use that is not a permitted principal use in the zoning district in which the 03-45 Comment.doc Page 2 property is located. 4. The granting of a variance shall be the minimum variance that will provide far the reasonable use of the land and/or structure. 5. The granting of a variance shall not be based upon other non- conforming land uses or structures within the same land use or zoning district. Applicant is applying for a variance from KMC 14.20.190{a], principal structures. The code reads, "Erection of More Than One Principal Structure on a Lot. In any zone more than one {11 principal structure housing a permitted use may be erected on a single lot; provided that, area width and all other development requirements of the zone shall be met for each principal structure as though each structure were on an individual lot except one additional single-family dwelling may be permitted on the same lot provided the principal structure is a single-family dwelling, and the maximum lot coverage and setback requirements for the zone are met." The parcel in question currently has three structures on it: • 36.5' X 20.5' - 2-bedroom house {2 story? • 26' X 20' - 1-bedroom cabin { 1 storyf • 10' X 20.3' Tackle Shed { 1 story) The proposed variance is to build a 24' X 20', 2-bedroom, 2-story cabin. This parcel is 1.01 acres, approximately 43,995.6 square feet. Each principal structure in the Rural Residential zone requires 20,000 square feet. The additional structure can meet all other development requirements {setbacks and lot coveragey. The structure, if approved, will be used as a rental in the lodging business that is allowed by conditional use. The added rental rooms will fall within the requirements for lodging. Lodging allows up to five guest rooms for public lodging. In 1995, when the Bed & Breakfast was approved, the applicant was required to provide a valid wastewater discharge permit from D.E.C. As a requirement of the additional cabin, the system should be certified to insure that it meets the additional use. Over time, the majority of the lots in this area have been developed into a summer commercial recreation area where property owners provide lodging and guide services. The subject parcel is large enough to accommodate the additional structure. Recommend approval with the following requirement: 1. Applicants are applying for a Conditional Use Permit for a daycare to expand the daycare they operate as a Home Occupation Permit to allow them to care for twelve (12} children. Kenai Municipal Code 14.20.230 {Home Occupational limits the number ofi children in the home to eight (g} children under the age of 12 including the caregiver's children. The application provides a thorough description of the proposed activity with floor plans, photographs, and a site plan. The applicants have operated a daycare at this location since January of 2001. As noted in their application, in 2003, they applied to the State of Alaska for a Group Home daycare license from the State in 2002. When receiving that license, they were licensed to care far 12 children under the age of 12 including their own. The applicants state that they did not realize they were in violation of the City's code when they increased the number of children in their daycare. At this time, they dedicated area of their first floor to the daycare. This is a requirement of the state licensing. The home has a large fenced yard for the children's outside activities. The home has sufficient off-street parking for the daycare that meets code requirements for the use. (KMC 14.20.250 regulates off-street parking requirements.} The parking required for a private school would be one-half per employee plus one for every five {5} students. Using this criteria would require a minimum of 5 spaces if you rounded up for students and employees. The minimum required spaces using the criteria for a day nursery are one-half per employee plus one space for every ten t10} students, or 4 required spaces. In either case, there is sufficient parking available. The Conditional Use Permit will allow the applicants to increase the number of children in their care and allow them to employ their three part-time instructors. The daycare con#inues to meet the square footage requirement for a home occupation. The City of Kenai Fire Marshal James Baisden inspected the home on October 16, 2003. During this time we are not aware of any complaints by our neighbors or the community concerning our business. As of the spring of 2000 we were a state licensed daycare facility and by state law we were only allowed to care for 8 children under the age of 12 including our own in our facility at any one time as per 4AAC 62.405 of the Alaska Department of Education and Early Development regulations. In 2002 we applied for a Group Home daycare license from the State of Alaska. Upon meeting all of the requirements set forth in their Child Care Licensing Regulations and Statutes and passing a facility inspection by Marcy Bish the Licensing representative for the Kenai area we received our Group Home license. Having this license allowed us to have up tv but no more than 12 children under the age of 12 including our own in our care at any one time. f-iowever, two qua!ifed child care providers must be present when 9 - 12 children are in care, as skated in 4AAC 62.405 of the Alaska State licensing regulations for daycares. At this time we were under the impression that we were in full compliance with all city, state and federal Codes and regulations. We have always been very vigilant about insuring that we meet or exceed all requirements and regulations. On October 15'", 2003 we were contacted by Marilyn Kebschull from the Kenai Planning and Zoning Administration, she informed us that we were not in compliance with City code 14.2Q.230 fib) (2) which states #ha# a daycare shall have no more than 8 children under the age of 12 including children related to the care giver. We were also out of compliance with 14.20.230 (d) (1) that states not mare than 1 person outside the family shall be employed in the home occupation. We currently have t4ti~o music and movement instructors that come to our facility 1 hour a day, one day a week and we have one lady who is related to one of the children in our care that volunteers occasionally to come into our facility and instruct Spanish and South American culture, history and traditions to ail the children. To be in compliance with 4AAC 62.21Q of the Child Care Licensing Regulations and Statutes we have on file all necessary paperwork including State Criminal History and Background checks for our instructors. We are no4v applying for a Conditions{ use permi# for our in home occupation that u~rould allow us to continue to care for up to 12 children under the age of 12 including our own at any one time and that it would continue to allow us to have our three instructors. As always we will continue to meet and exceed all City, State and Federal codes and regulations. This is our family's only source of income and to be limited to 8 children would greatly affect our family's quality of life and not having the ability to have the 2 music instructors and 1 Spanish instructor would also decrease the quality of care provided to the children. Qur goa€ at Kenai Montessori is to provide the best quality childcare and preschool education to the children in our care as passible. This is also a requirement by the State as stated in 4AAC 62.210 that states a care give must be able to provide children with a variety of age appropriate learning and social experiences. It also states that a care giver must provide an environment that respects the gender, culture, ethnicity, family composition, and special emotional, cognitive, developmental needs of the individual needs of the child. Also stated in 4AAC 62.420. Program in Childcare facilities it states a childcare facility shalt provide structure in daily activities designed to promote a child's individual physical, social, intellectual, and emotional development. A facility has a schedule and daily plan of activities for each group that provides a balance of quiet and active, group and individual activities, and that includes time for meals, snacks, sleep, toileting according to individual needs, and indoor and outdoor play. ft also states in the same regulation that opportuni#ies be provided r~~'%y ~ Page 2 October 20, 2003 for intellectual and social development through use of a variety of activities and materials such as games, toys, books, crafts, puzzles and blocks. In the same regulation part (6) it states opportunities be provided for language development, including encouraging children to talk and read books. Letters were sent to eleven property owners. The City received input from 10 of the 1 1 property owners. No feedback was received from Loretta Frates of 265 Fireweed Lane. The Kenai Peninsula Borough lists the principal use of Ms. Frates' lot as residential. A variance was issued in 1996 allowing the residence to be placed at this location. Based on the input received from property owners and current uses, the attached map shows administration's recommendation for the Commission's review. Administration is recommending that the Commission consider rezoning the first three lots on Fireweed Lane. Kenai Municipal Code 14.20.270 authorizes the Commission to initiate an amendment to the zoning code. This rezone would enlarge an adjacent boundary as provided in KMC 14.20,270{2y. In any incorporated business, the term "ownership interest" mea ownership of any stock of the corporation. 9} "Operator or manager" means any natural pe res nsible far the actual operation and management of an adult business. 10) "Specified anatomical areas" means: i. Less than completely and opaquely cov uman genitals, pubic region, buttocks, and female breast below a point immediately above the tap of the areola; and ii. Human male genitals in a discernible turgid state, even if opaquely covered. 11) "Specified sexual activities" means simulated or actual: i. Display of human genitals in a state of sexual stimulation or arousal; ii. Acts of masturbation, sexual intercourse, sodomy, bestiality, necrophilia, sado- masochistic abuse, fellatio, or cunnilingus; and iii. Fondling or erotic touching of human genitals, pubic region, buttocks, or female breasts. If the applicant is a cozporatio the ame of the corporation, the date and state of incorporation, the name an dress of its registered agent, the name and address of all shareholders owning mare than five percent of the stock in such corporation, and all officers and directors of the co oration; vii. Whether there are adequate p rki facilities to accommodate a reasonably expected increased demand for ing generated by the business; vii. The effectiveness of any measures proposed by the applicant or any other person to reduce any negative effect upon adjace residential neighborhoods by property line buffers and roadway buf nted berms, landscaping, reduction or elimination of abtrusiv r ga signing or other features, lowered building elevation, clusterin of er commercial establishments, and use of frontage roads to reduce the nu ber of entries and exits onto highways, arterials, and collectors, a where surrounding area is predominantly residential in character, site, and building design features that contribute to the residential character of surrounding development; and viii. Whether the proposed site plans and plan of operations, together with any amendments thereto, are consistent with the purposes of this chapter. 3) The Commission may grant a conditional use permit under this chapter only if the applicant shows, and the Commission finds: i. Is physically separated by a wall of at least s' ee igh from adjacent booths, rooms, cubicles, and non public areas; iii. Has at least one side totally open to lic, ighted aisle so that there is an unobstructed view at all times of anyone oc up ng sarne; iv. Is constructed with three walls constructe ithout openings, extended from the floor to a height of not less than six feet high, and finished with a light colored, nonabsorbent, smooth textured, and easily cleanable paint or protective coating; v. Contains a floor that is light colored, nonabsorbent, smooth textured, and easily cleanable; vi. Is illuminated at all times with electric lighting of at least 10 foot candles at all times as measured from the floor when the booth is not in operation; and vii. Any willful violation of this chapter or the terms nd conditions of a permit issued under this chapter by the operator or n r of an adult business, or any person having an ownership intere the ult business; and ii. A material misrepresentation of fact e a erator or manager of an adult business, or any person having an owners ip i terest in the adult business in connection with the original application for nditional use permit. iii. The operator becomes ineligible to obtain a license or permit. iv. Any cost or fee required to be paid by this section is not paid. v. Any intoxicating liquor or other alcoholic beverage is served on the premised of the adult-oriented establishment. vi. The licensee, manager or designated representative, is convicted of the Following offenses at the location to which an adult business license has been issued: 1. Prostitution (AS 11.66.100); 2. Some parcels were foreclosed by the Borough for taxes and subsequently deeded to the City. The City foreclosed on others for delinquent special assessments. Attached please find a list of those parcels and accompanying maps. Review these properties and make a determination if any parcels are needed far public purpose. The City Administration has reviewed the list and recommends that the 11 beach access lots on Map H and the single lot on Map J be retained for public purposes (see notes on list). An ordinance will be prepared for Council approval, naming parcels that are recommended to be retained and those parcels that are not needed for public purpose and can be sold. For parcels that the City is retaining, the City will need to pay the Borough the taxes owed through the judgment date, interest, and any out-of-pocket costs incurred by the Borough through the date of actual payment. The farmer property owners will need to be notified of the public hearing on the ordinance. I anticipate scheduling a foreclosure sale in the spring. March 24, 2003: The first plat with the single new Tract A south of existing Tract A received conditional preliminary approval from KPB Plat Committee subject to extension of Wolfe Avenue south of the south boundary of existing Tract A Strawberry Fields Forever and within the north boundary of the proposed Tract A an the preliminary of Strawberry Fields Forever Addition #1. The owner and surveyor met with staff later that week and due #o the location of Wolfe Avenue extension interfering with a prime building site on the tract, a compromise dedication was agreed upon. This was to be a half right-of-way along the south boundary of the new tract. The revised plat was scheduled for final review during the April 2$, 2003 Plat Committee meeting. ~ril_28, 2003: Prior to the meeting, the landowner submitted a le#ter indicating that she na longer concurred with the relocation of the right-of-way. She provided documentation from neighbors in support of current and future subdivisions of her land that would provide no extension of Wolfe Avenue or other dedication to connect to Strawberry Road. The surveyor requested exceptions to KPB 20.20.030 Extension of Wolfe Avenue and 20.20.160 Maximum Block Length. He provided findings to support the exception requests. The Plat Committee recommended postponing action to the May 12, 2003 meeting to allow staff time to comment on the exception requests. May 12, 2003: At the end of testimony at the meeting, the property owner offered another compromise reached with agreement of the owner of existing Tract A. Shell Avenue half-right-of-way would be extended across the north boundary of Tract A, and the northerly portion of Ms. innes' unsubdivided remainder from Devray Street to North Strawberry Road. Based upon this proposal, the request for an exception to KPB 20.20.160 Block Length was approved with findings made to support the three conditions as required. June 9, 2003: The approval of the exception request for extension of Wolfe Avenue required by KPI3 20.20.030 was clarified, subject to provision of the alternate dedication of Shell Avenue half right-of-way from Devray Street to North Strawberry Raad. A request for reconsideration of the Plat Committee approval of fhe plat wi#h the extension of Shell Drive between Devray Street and North Strawberry Road was considered. Based upon numerous findings, the Plat Committee approval of the preliminary plat was upheld. A final review was started in early August 2003, and staff was informed that another revision was being proposed. The plat currently under review is that revision. All prior revisions had been results of Plaf Committee or staff's redesign or compliance requests. As such, they were not subject to new fees. KPB Resolution 96-22 allows one revised preliminary to be submitted under the original fees. Since this revised preliminary is a new concept proposed by the owners, staff interprets this preliminary #o be the revision allowed under the fee structure. Any additional revisions proposed by the owners will require new fees... This design would subdivide Tract A from the original 1996 Strawberry Field Forever plaf into #wo 3-acre tracts. Each of these tracts will require engineering. Proposed Tract C is 8 acres in size and will not require an engineer's sails report. Staff recommends Note 4 be revised appropriately. The new Tract A proposed in the previous renditions of Addition #1 (the current subdivision) does not appear on this plat. It was located adjacent to the south boundary of proposed Tract A-2, in an area now labeled 'Unsubdivided Remainder'. A new tract, Tract C, is proposed adjacent to the east boundary of Tracts A-1 and A-2. Staff recommends fhe surveyor or owner indicate the reason for the lack of a Tract 13 in the lot numbering scheme, or renumber Tract C to Tract B. Shell Drive is extended as a half right-of-way between Devray Street and North Strawberry Road. North Strawberry Road is dedicated as a 50-foot half right-of-way along the east boundary of Tract C. This provides the potential for a future constructed road between the two rights-of-way and an alternate ingresslegress route. Staff recommends a topographic map be provided as the working map with the soils report. Staff recommends the existing trail outside the dedication be shown and labeled with its use on the plat.
