Vice Chair Bryson called the meeting to order at 7:00 p.m.

Kebschull noted the following:
• The plat will remove a lot line to create one large lot resulting in Lot A,
containing approximately 14.784 acres.
• The resulting lot size would meet lot size requirements for the IL -Light
Industrial and CG -General Commerical zones.
• City water and sewer serve the property.
• City Engineer reports the section line was previously vacated.
• Staff recommended the rezone to eliminate asplit-zone situation.
• Staff recommended approval.

5-a. PZ06-15 -- An application to rezone the parcels known as Tract A,
Ballfield Subdivision 8v Those portions of the NE 1 /4 & the NE 1 /4 NW 1 /4

Kebschull explained the following:
• The application was submitted to rezone the properties described as
Tract A, Ballfield Subdivision and those portions of the NE 1 / 4 and the NE 1 / 4 NW 1 / 4
which lie northeasterly of the Kenai Spur Highway and south and west of ASLS 79-57
amended and north and northwesterly and southwesterly of Ballfield Subdivision from
Rural Residential to Recreation.
• The parcels are located on the Kenai Spur Highway and lie adjacent to
properties zoned Rural Residential and Recreation.
• The rezone is being requested to accommodate a proposed sports field
and outdoor recreation area for the City of Kenai.
• Parks and recreation are a conditional use in the rural residential zone
and a permitted use in the recreation zone.
• The Comprehensive Plan Land Use Plan shows this land as
Neighborhood Residential and the definition states, "Formal public outdoor spaces
(parks) are a critical feature in this district."
• The property abuts the site of the planned Kenai Soccer Facility and
outdoor recreation site. The proposed rezone is to accommodate planned expansion of
the outdoor sporting facility.
• The requested rezone would meet the criteria of Kenai Municipal Code
14.20.270 for an amendment to the official zoning map.
• Staff recommended approval.
Bryson noted a conflict of interest due to his firm being involved in the project and
abstained from voting. The gavel was passed to Commissioner Twait.

Commissioner Twait opened the public hearing. With no comments, the public
hearing closed.
MOTION:
Commissioner Jenckes MOVED to approve PZ06-12 and Commissioner McLennan
SECONDED the motion.
Jenckes asked if the parcel furthest north was usable land and Kebschull replied the
City's long range plans are to develop the entire area. It was noted the site is the
current transfer facility for the landfill.

Kebschull noted Items 7-a through 7-d were related items due to Alaska Lodge LLC
purchasing the property from Michael Kent and the application was submitted in
order to transfer the Conditional Use Permit(s). Kebschull reported the following:
• A Conditional Use Permit was issued to Michael Kent to operate several
businesses from this location, i.e. retail business, office, hotel and guide service.
• As required by KMC 14.20.158, a written request for transfer of the
Conditional Use Permit was submitted.
• The request for transfer states the intent is to use the permit in
accordance with the operations described in the current permit.
• Based on the written request and plan to continue use as currently
allowed under Conditional Use Permit PZO1-03, approval of the transfer was
recommended.
• A copy of Resolution PZO 1-03 was attached to the application and the
requirements for the permit would be noted as required for the permit.

economy within the City with his business.

Ramon Ortiz, 1530 Angler Drive, Kenai, Alaska -- Mr. Ortiz noted one change in
that the existing Conditional Use Permit allowed food service. He stated, his intention
was not to serve food.
There were no further comments from the public.
Kebschull indicated the original owner planned to serve food from a deck or platform
to guides and the applicant had the option to serve food if he desires. If he chooses
not to, that portion of the Conditional Use Permit would expire.

ITEM 9: CODE ENFORCEMENT -- None.
ITEM 10: REPORTS
10-a. City Council -- Council Member Ross provided a report on actions taken
at the March 1 and March 15, 2006 Council meetings.
Ross noted the Landscaping/Site Plan ordinance had been tabled because there was
an issue with financial institutions not accepting temporary certificate of occupancy
permits and the subsequent penalties involved.

Kebschull reported staff had revised the Landscaping/Site Plan and removed the
certificate of occupancy requirement. There were five revisions made and the item will
be on the Commission's April 12 meeting agenda and would be before Council again at
its April 19 meeting.
10-b. Borough Planning -- Bryson provided a brief report on actions taken at
the Borough's February 27 and March 13, 2006 Commission meetings.
10-c. Administration -- Kebschull reported the following:
• Staff had reviewed the Mixed Use Zone and it appeared the overlay zone
could get convoluted and it was possible it would be replaced with a Central Business
District Zone. The Historic District may be excluded as it has a special zone.
• The new Limited Commercial Zone was in place and staff would keep the
Commission abreast of how it is working.

Commissioner Jenckes stated he enjoyed the training in Anchorage and noted there
was a lot of discussion on the Open Meetings Act. He provided a brief report on Mayor
Begich's comments at the training session.
Commissioner Romain stated also attended the training in Anchorage.

ANALYSIS
General Information:
KMC 14.20.150 details the intent and application process for conditional uses. The
code also specifies the review criteria that must be satisfied prior to issuing the permit. The
criteria are:
1. The use is consistent with the purpose of this chapter and the purposes and intent
of the zoning district;
2. The value of the adjoining property and neighborhood will not be significantly
impaired;
3. The proposed use is in harmony with the Comprehensive Plan;
4. Public services and facilities are adequate to serve the proposed use;
5. The proposed use will not be harmful to the public safety, health or welfare;
6. Any and all specific conditions deemed necessary by the commission to fulfill the
above-mentioned conditions should be met by the applicant. These may include,
but are not limited to measures relative to access, screening, site development,
building design, operation of the use and other similar aspects related to the
proposed use.
Marathon Oil Company has submitted an application for a Conditional Use Permit to
authorize the drilling of two new gas wells. The drilling site is located at 500 Childs Avenue,
near the intersection of Beaver Loop Road and Bridge Access Road. An 8-foot security fence
and a visual buffer of trees enclose the 4.77-acre parcel.
The proposed site has been an existing gas production site since 1981. Two previous
Conditional Use Permits were issued to Union Oil Company of California (Unocal) for this
location (PZ 80-16 approved October 10, 1980 and PZ 87-2 approved April 8, 1987). Gas
production was suspended from this pad prior to the exchange of properties to Marathon Oil
Company in 1994. The facility has been maintained but has remained in suspended status.
The applicant intends to drill two new gas wells. Wells will be drilled to a depth of
approximate 8150 feet. Mr. Underwood mentioned the drilling rigs have hospital-type
mufflers for the engines to help eliminate noise as well as OSHA approved strobe lights in
place of the back-up beepers for vehicles.
Planning and Zoning records show no complaints on this location from previous drilling
projects.
To issue the permit, the Commission must determine the following:
The use is consistent with the purpose of this chapter and the purpose and intent
of the zoning district. The property is zoned IH -Heavy Industrial. The intent of the
IH zone was established "to allow for a broad range of industrial and commercial
uses. It is intended to apply to industrial areas that are suff ciently isolated from
residential and commercial areas to avoid any nuisance effect. This type of business
has operated periodically from this location for approximately 14 years before being
suspended. The site appears to have had no effect on the adjoining properties.
The value of the adjoining property and neighborhood will not be significantly
impaired. The land around this parcel is vacant. The closest business to the site is a
welding business. It does not appear the value of the adjoining property and
neighborhood has been impaired by the proposed use.
The proposed use is in harmony with the Comprehensive Plan. The
Comprehensive Plan identifies this parcel as Industrial in the Land Use Plan. "The
Industrial District identifies areas reserved for manufacturing, warehousing, trucking,
marine-related industry and storage, and similar activities. City utilities and safe,
convenient vehicular access is critical. Buffers between industrial uses and adjacent
non-industrial uses are desirable. " A buffer of trees surrounds the property and an 8-
footsecurity limits access to authorized personnel. There should be little to no traffic
other than the employees working at the site.
• Public services and facilities are adequate to serve the proposed use. There are
no public facilities serving this area.
The proposed use will not be harmful to the public safety, health or welfare. An
8 foot locked security fence surrounds the site. The applicants "Plan of Operations"
states there will be no discharge of fluids or waste onsite and all drilling waste will be
removed to the Kenai Gas Fields for processing and disposal at a permitted facility.
Applicant will obtain the appropriate permits needed to operate from the Alaska
Department of Environmental Conservation (ADEC) and the Department of Natural
Resources, Division of Mining, Land, and Water (DNR). Gas production from this
location will be continuously monitored from Marathon's Kenai Peninsula
Operations Center. Alarm systems will be integrated in the event of any unusual
operating conditions. Therefore, the proposed use should not be harmful to the public
safety, health or welfare of the area.

RECOMMENDATIONS
A similar business has operated from this property in the past with no complaints. The
property is zoned IH -Heavy Industrial. This site has operated periodically up until 1994
when drilling was suspended. The applicant proposes to reactivate the site by drilling two
new gas wells. The applicants "Plan of Operations" details the steps they plan to take to begin
drilling at the location. Marathon Oil Company operated a similar facility off Cannery Road
under a Conditional Use Permit. The Company was diligent in operating under the conditions
of the permit and no complaints were received. Based on the applicant's history with the
Cannery Road permit and the previous operations at this site, staff recommends approval with
the following requirements:

Ownership:
The surface ownership for the pad is held by Marathon Oil Company and

The CLU No. 3 Pad is located on the north side of Bridge Access Road, approximately
0.8 miles south of the intersection with the Spur Highway in Kenai. Union Oil Company
of California (Unocal) constructed the pad in 1981 for the CLU #3 well and later drilled a
second well in 1987, CLU #4. Gas production was suspended from this pad prior to the
exchange of properties with Marathon in 1994. The facility has been maintained but has
remained in a suspended status since that time. An area map is enclosed with this
submittal for reference.
The scope of the drilling project remains the same as those previously identified by
Marathon for the Cannery Loop Unit (CLU). For the CLU #11 and CLU #12 wells, no
discharges of fluids or waste will take place onsite and all drilling waste will be removed
to the Kenai Gas Field for processing and disposal at a permitted facility. As required, an
Approval for the temporary waste storage of the drilling waste that will be generated has
been submitted to The Alaska Department of Environmental Conservation. Drilling and
completion operations will require a Temporary Water Use Permit from the Department
of Natural Resources, Division of Mining, Land, and Water. Non-hazardous waste will
be taken to the Borough Landfill for disposal. Holding tanks are used for the break
trailers and the wastewater generated will be removed by an approved contractor for
discharge at an approved disposal facility.
In order to resume natural gas production after completion of the two wells, Marathon
will install new gas processing equipment in the existing buildings. The existing pipeline
from the pad will be used to deliver gas to the Kenai Nikiski Pipeline (KNPL) that in turn
delivers gas to Kenai Peninsula for local utility service and industrial operations.
Installation and operation of the production equipment is not subject to advance air
permitting by the Alaska Department of Environmental Conservation. No flaring of gas
will take place during well completion activities or future remedial well work.
Gas production from the CLU No. 3 Pad will be continuously monitored from the Kenai
Gas Field, which is the center of Marathons Kenai Peninsula operations. Alarm systems
will be integrated into the SCADA system in the event of unusual operating conditions.
Wastewater from the production operations will be collected in adouble-walled tank that
has redundant alarms tied into the monitoring system. Wastewater will be removed via
vacuum truck to the Kenai Gas Field for downhole disposal in an approved Class II
disposal well.

ANALYSIS
General Information:
This is an application to rezone the properties known as Lots A-1 and A-2 Baron
Park Subdivision No. 6 from split zoning (General Commercial and Light
Industrial) to General Commercial. These parcels are accessible off HEA Access
Road and Marathon Road. The City of Kenai is replatting these properties to
create one large parcel to accommodate the proposed Lowe's store. During the
replatting process, it was recommended that the split zone situation be
eliminated.
KMC 14.20.270 describes amendment procedures. Section 2 states,
"Amendments to the Official Zoning Map shall be considered only if the area to
be rezoned contains a minimum of one 11) acre (excluding street or alley rights-
of-way) unless the amendment enlarges an adjacent district boundary." The
proposed rezone enlarges an adjacent boundary and meets the requirements of
KMC 14.20.270.
The Comprehensive Plan Land Use Plan shows this land Airport Industrial and
defines the use as, "The Airport Industrial district identifies airport lands reserved

for the Kenai Municipal Airport and its future expansion, and tracts needed for
present and future aviation-related uses and activities."

RECOMMENDATIONS
This rezone is being requested by the City of Kenai to eliminate asplit-zone
situation. These parcels are being replatted to create one large parcel for the
proposed Lowe's store. Retail uses are permitted uses in both zones.
The Comprehensive Plan identifies this area as Airport Industrial. The City of
Kenai has recently completed a supplemental plan for the Airport. That plan is in
the implementation stages. These properties are not included in the proposed
airport reserve and are not being recommended by that plan as to be reserved
strictly for airport uses.
The requested rezone meets the criteria of Kenai Municipal Code 14.20.270 for
an amendment to the official zoning map. Recommend approval.

WHEREAS, site plans provide for orderly and safe development of the City by protecting the
health, safety and welfare of its citizens, provide for adequate and convenient open spaces, light
and air and avoid congestion of commercial and industrial areas; and
WHEREAS, landscaping plans provide for landscaping and/ or the retention of natural vegetation
in conjunction with commercial and industrial development within the City of Kenai; and
WHEREAS, the general purpose of landscaping is to visually enhance the City's appearance,
provide attractive and functional separation and screening between uses and reduce erosion and
storm runoff; and
WHEREAS, the Kenai Comprehensive Plan recommends revising landscaping standards to
promote siting and design of land uses that are in harmony and scale with surrounding uses and
minimizes impact on established neighborhoods from incompatible, non-residential uses, and to
ensure adequate landscaping and buffering between commercial uses and the highway; and
WHEREAS, the existing landscaping/site plan requirements in the Limited Commercial (LC)
Zone in KMC 14.20.105 should be replaced by the new landscaping/sitepian requirements in
KMC 14.25; and
WHEREAS, the existing landscaping/site plan requirements in KMC 14.25 are outdated and
need replacement.
NOW, THEREFORE, THE PLANNING AND ZONING COMMISSION OF THE CITY OF

(a) Site Plans. It is the intent of this chapter to provide for orderly and safe development of
the City commensurate with protecting the health, safety and welfare of its citizens, and adequate
and convenient open spaces, light and air, in order to avoid congestion of commercial and
industrial areas.
(b) Landscaping Plans. It is the intent of this chapter to provide for landscaping and/or the
retention of natural vegetation in conjunction with commercial and industrial development
within the City of Kenai. The general purpose of landscaping is to visually enhance the City's
appearance, provide attractive and functional separation and screening between uses and reduce
erosion and storm runoff.
14.25.015 Landscaping/site plan.
For property covered under this chapter, submittal of a preliminary landscaping/site plan
and approval by the Administrative Official is required prior to any land clearing and/or tree
cutting where such removal will result in less than fifteen percent (15%) of the lot area having
existing trees, shrubs, or natural vegetation cover.
14.25.020 Application.
This chapter shall apply to all commercial and industrial development within the City of
Kenai and shall apply to both the landscaping and site plans. "Commercial and industrial
development" and "all development" shall be defined as any improvements requiring a building
permit for new construction or any improvements of twenty thousand dollars ($20,000) or more,
which adds square footage, located on properties within the Central Commercial (CC), General
Commercial (CG), Limited Commercial (CL), Heavy Industrial (IH), Townsite Historic (TSH),
Light Industrial (IL) and Education (ED) zoning districts or a change of use as required in KMC
14.20.250 (a). It is unlawful for any person to construct, erect or maintain any structure,
building, fence or improvement, including landscaping, parking and other facilities on property
requiring alandscape/site plan unless such improvements are constructed or reconstructed in a
manner consistent with the approved plan.
Properties zoned residential are exempt from this chapter with the following exceptions:
Structures identified as a commercial occupancy in Title 4 of the Kenai Municipal Code
located in residential or mixed use zones requiring a building permit for new construction
or any improvements of twenty thousand dollars ($20,000) or more, which adds square
footage or a change of use as required in KMC 14.20.250 (a).

14.25.030 Landscaping/site plan-Submittal requirements.
One copy of the landscaping/site plan (eleven inches (11") by fourteen inches (14") size)
shall be submitted for approval to the Administrative Official prior to the issuance of a building
permit. If approved, a zoning permit shall be issued and on file in the Planning Department and
the Building Official will be notified. The landscaping/site plan shall be prepared at a minimum
scale of one inch (1") equals twenty feet (20') and shall include the following information:
(a) Scientific or common name or type of planting materials to be used in the project;
(b) Typical planting details;
(c) Location of all planting areas and relationship to buildings, parking areas and
driveways;
(d) Identification and location of existing vegetation to be retained;
(e) Identification and location ofnon-living landscaping materials to be used;
(f) Identification of on-site snow storage areas;
(g) Drainage patterns;
(h) Description of buildings, including building height and ground floor dimensions;
(i) Physical features of the property including location of all buildings, ingress and
egress, any unusual features of the property which may restrict development or
drainage.
14.25.040 Landscaping plan-Performance criteria.
(a) Objectives for Landscaping Plan. An effective landscaping plan should utilize a variety
of techniques for achieving the intent of this section. The appropriate placement or retention of
vegetation in sufficient amount will provide the best results. Perimeter, interior, street right-of-
way, and parking lot landscaping should be included as components of the overall landscaping
plan.
(b) Perimeter/Buffer Landscaping. Perimeter/buffer landscaping involves the land areas
adjacent to the lot lines within the property boundary. This buffer landscaping serves to separate
and minimize the impact between adjacent uses. Buffer landscaping maybe desirable along the
perimeter of the property to shield vehicular or building lights from adjacent structures and to
provide a visual separation between pedestrians and vehicles. Landscaping adjacent to
residential zones shall have landscaping beds that meet all of the following minimum standards:
1. Landscaping beds -Minimum of 10 feet in width along all property lines, which
adjoin residential zones, exclusive of driveways and other ingress and egress
openings. A 6-feet high wood fence or masonry wall may be used in place of 5 feet
of the required bed width.
2. Ground cover - 100 percent within 3 years of planting and continuous maintenance
so there will be no exposed soil. Flower beds maybe considered ground cover.
3. Trees and/or shrubs appropriate for the climate shall be included in the landscaping
beds.
(c) Interior Landscaping involves those areas of the property exclusive of the perimeter and
parking lot areas. Interior landscaping is desirable to separate uses or activities within the overall
development. Screening or visual enhancement landscaping is recommended to accent or
complement buildings, to identify and highlight entrances to the site, and to provide for attractive

driveways and streets within the site. Landscaping may include landscaping beds, trees, and
shrubs.
(d) Parking Lot Landscaping. Parking lot landscaping involves the land areas adjacent to or
within all parking lots and associated access drives. Parking lot landscaping serves to provide
visual relief between vehicle parking areas and the remainder of the development. It also is
desirable for the purpose of improving vehicular and pedestrian circulation patterns.
(e) Street right-of--way landscaping softens the impact of land uses along street rights-of-
way, but does not obscure land uses from sight. Landscaping beds must meet all of the
following minimum standards; except where properties are adjacent to State of Alaska rights-of-
way, the Administrative Officer may approve alternatives, which meet the intent of this section
but protect landscaping from winter maintenance damage.
1. Landscaping beds -Minimum of 10 feet in width along the entire length of the
property lines which adjoin street rights-of--way, exclusive of driveways and other
ingress and egress openings;
2. Ground cover - 100 percent ground cover of the landscaping bed within 3 years of
planning and continuous maintenance so there will be no exposed soil;
3. Trees and/or shrubs appropriate for the climate shall be included in the landscaping
beds.
(f) Review. The Administrative Official may consider plans for amendments if problems
arise in carrying out the landscaping/site plan as originally approved.
14.25.045 Site plan-Performance criteria.
(a) Objectives. An effective site plan should utilize a variety of techniques for achieving the
intent of this chapter. The appropriate placement or retention and improvements of buildings,
parking lots, etc. should be considered on the site plan.
(b) Buildings. A commercial or industrial use housed in the building is to be compatible with
the surrounding properties, land use plan, and not be hazardous to the health, safety and welfare
of citizens.
(c) Special Permits. The site plan shall list any special permits or approvals which maybe
required for completion of the project.
(d) Parking Lots. Parking lots referenced on the site plan shall comply with KMC 14.20.250.
1. Paving is required when "commercial development" requiring a building permit
valued at one hundred thousand dollars ($100,000) or more for new construction or
any improvements which adds square footage valued at one hundred thousand dollars
($100,000) or more and the property is located between Evergreen Drive and
McCollum Drive/Tinker Lane as shown in the map marked Appendix 1 to this
chapter.
2. Exception to this requirement:
(i) Properties zoned Heavy Industrial are exempt from the paving requirement.
(e) Snow Storage/Removal and Drainage. Snow storage/removal and drainage as referenced
on the site plan shall be compatible with the surrounding area.
(f) Dumpsters. Dumpsters must be screened with asight-obscuring structure made of wood
or concrete. The Administrative Official may approve other construction materials.

14.25.050 Approval.
Unless extended for good cause, the Administrative Official shall review and take action
on a landscaping and site plan within fourteen (14) days of satisfactory submittal. The Building
Official shall issue a building permit upon approval of the associated landscaping/sitep1an
providing all of the other requirements for the issuance of a building permit have been met. Any
appeal of the action of the Administrative Official shall be in accordance with KMC 14.20.290.
14.25.060 Completion-Landscaping plan.
All required landscaping as presented in the approved landscaping plan shall be installed
within one year after issuance of the Certificate of Occupancy.
14.25.065 Completion-Site plan.
All requirements as outlined in Section 14.25.045 shall be installed according to the site plan as
approved by both developer and the Administrative Official.
1. The required parking lot paving shall be completed within two years after issuance of
the Certificate of Occupancy.
14.25.070 Modifications.
Whenever there are practical difficulties in carrying out the provisions of this chapter, the
Administrative Official may grant minor modifications for individual cases, provided the
Administrative Official finds that a special individual reason makes the strict letter of this
ordinance impractical and that the modification is in conformity with the intent and purposes of
this ordinance.
14.25.080 Expiration.
If construction of the project has not started within one year of approval of the
landscaping/site plan, the approval shall lapse unless extended for good cause.
14.25.090 Penalties.
Penalties for non-compliance with this chapter shall be as set forth by KMC 14.20.260.
14.25.100 Definition-Landscaping.
"Landscaping" means the treatment of the ground surface with live planting materials,
including but not limited to, trees, shrubs, grass, ground cover or other growing horticultural
material. Other materials such as wood chips, stone, or decorative rock may also be utilized.

14.20.115 Limited Commercial Zone (LC Zone).
(a) Intent: The LC Zone is established to provide transition areas between
commercial and residential districts by allowing low to medium volume business,
mixed residential and other compatible uses which complement and do not
materially detract from the uses allowed with adjacent districts.
(b) Principal Permitted Uses: As allowed in Land Use Table as long as the
footprint of the building does not exceed three thousand (3,000) square feet.
(c) Conditional Uses: As allowed in Land Use Table.
(d) Accessory Uses: As defined (see definitions section).
(e) Home Occupations: Uses as allowed by this chapter.
(f) Development Requirement: As described in this chapter.
(g) Parking Requirements: As required by this chapter.
(h) Outside storage is allowed for display purposes only unless the storage is in
an area enclosed by asight-obscuring fence.
(i) Landscaping/Site lp ans: As required in KMC 14.25.

RESIDENTIAL USES SHALL BE EXEMPT FROM THIS REQUIREMENT.
(4) LANDSCAPING/SITE PLAN. SUBMITTAL OF A PRELIMINARY
LANDSCAPING/SITE PLAN AND APPROVAL BY THE ADMINISTRATIVE
OFFICIAL IS REQUIRED PRIOR TO ANY LAND CLEARING AND/OR TREE

RIGHT-OF-WAY, AND PARKING LOT LANDSCAPING SHOULD BE
INCLUDED AS COMPONENTS OF THE OVERALL LANDSCAPING PLAN.

LANDSCAPING INVOLVES THE LAND AREAS ADJACENT TO THE LOT

MEET ALL OF THE FOLLOWING MINIMUM STANDARDS:

The applicants have purchased the above-described properties for lodging and guide
service from Clint & Delores Coligan. In 2005, Conditional Use Permit PZ98-45 was
transferred to Clint & Delores Coligan from James H. Cowan. The properties have had
lodging since 1988, with the guide service added in 1998. As required by KMC 14.20.158, a
written request for transfer of the Conditional Use Permit has been submitted. The request
for transfer states that the intent is to use the permit in accordance with the operations
described in the current permit.
Building Official:
No building code issues.
RECOMMENDATIONS
Based on the written request and plan to continue use as currently allowed under
Conditional Use Permit PZ05-56, approval of the transfer should be granted. A copy of
Resolution PZ05-56 is attached and the requirements for that permit will be noted as

WHEREAS, the Commission finds:
1. That a Conditional Use Permit was granted to James H. Cowan in 1988
and amended on September 23, 1998.
2. That KMC 14.20.150 (i) (4) requires that a written request for transfer be
submitted.
3. A request to transfer the permit was received on December 15, 2004.
4. That Mr. & Mrs. Coligan purchased the property from James H. Cowan.
5. That the transfer requires that the permit continue operation under
conditions originally outlined.
6. Applicant must comply with all Federal, State, and local regulations.
NOW, THEREFORE, BE IT RESOLVED, BY THE PLANNING AND ZONING

Use Permit has been submitted. The request for transfer states that the intent is to use the
permit in accordance with the operations described in the current permit.
Building Official:
No building code issues.
RECOMMENDATIONS
Based on the written request and plan to continue use as currently allowed under Conditional
Use Permit PZ98-37, approval of the transfer should be granted. A copy of Resolution PZ98-37
is attached and the requirements for that permit will be noted as required for this permit.
