ITEM 1: CALL TO ORDER
Chair Eldridge called the meeting to order at 7:00 p.m.

Roll was confirmed as follows:

Commissioners absent: J. Jenckes, L. McLennan
Others present: Council Member Ross, Department Assistant Carver,
Ronald Fullinck, and Contract Secretary Roper
A quorum was present.
1-b. Swearing in of Commissioner Fullinck
Department Assistant Carver administered the Oath of Office to Ronald Fullinck.
Commissioner Fullinck took his seat on the dais.

MOTION:
Commissioner Bryson MOVED to approve the agenda and requested UNANIMOUS
CONSENT. Commissioner Twait SECONDED the motion. There were no objections.
SO ORDERED.
1-d. Consent Agenda
MOTION:
Commissioner Bryson MOVED to remove the minutes from the Consent Agenda to
correct the meeting date from April 5, 2006 to April 12, 2006 and requested
UNANIMOUS CONSENT. Commissioner Romain SECONDED the motion. There were
no objections. SO ORDERED.
MOTION:
Commissioner Bryson MOVED to approve the consent agenda with the correction of
the minutes and requested UNANIMOUS CONSENT. Commissioner Fullinck
SECONDED the motion. There were no objections. SO ORDERED.

ITEM 4: CONSIDERATION OF PLATS
Commissioner Bryson advised he would abstain from voting on both items due to a
conflict at the Borough level. There were no objections from the Commission.
4-a. PZ06-30 -- Preliminary Plat -Sungate Park Subdivision Schweitzer
Addition -- Plat submitted by McLane Consulting, PO Box 468, Soldotna,
Alaska.
MOTION:
Commissioner Twait MOVED for approval of PZ06-30, preliminary plat for Sungate
Park Subdivision Schweitzer Addition. Commissioner Romain SECONDED the
motion.
Department Assistant Carver reported the following:
• The plat would remove lot lines from three parcels to create one large
parcel; resulting in approximately 37,525 square feet.
• The resulting lot size would meet the requirements for the Rural
Residential zone.
• No permanent structures could be built within the 20-foot utility
easement running through the parcel.
• No water or sewer service is available to serve the parcel.
• Staff recommends approval.
There were no Commissioner comments or questions.

Carver reported the following:
• The plat would remove a lot line to create one large parcel; the resulting
lot would be approximately 1.071 acres and would meet the lot size requirements for
the Light Industrial zone.
• City water and sewer is available to serve the parcel.
• The lot line is being removed for the planned development of the parcel.
• The final plat should verify the 1988 utility easement and if it is still in
effect, it should be noted on the plat.
• The subdivision name will have to be changed.
MOTION:
Commissioner Romain MOVED for approval of PZ06-31, preliminary plat for General
Aviation Apron Subdivision No. 4 with the requirement that the final plat verifies the
1988 easement and they are indicated on the plat. Additionally, the subdivision name
will be changed. Commissioner Fullinck SECONDED the motion.
Bryson noted the 100' taxiway A2 designation is no longer used and the new
designation should be noted on the plat.
Brad Zubeck, Kenai, Alaska asked the following questions:
• What is the new designation for Taxiway A2? It was noted the
information could be obtained from City Planner Kebschull.
• Who will rename. the subdivision? It was noted the Borough would make
the change. Carver indicated the new name would be General Aviation Apron
Subdivision No. 5.
There were no additional public or Commissioner comments or questions.

department will attend the next Planning and Zoning meeting to discuss platting.

report on site plans for current projects at the next meeting.

City of Kenai Planning and Zoning Commission on April 19, 2006, and received from Integrity
Surveys.

ANALYSIS
General Information:
KMC 14.20.185 details the definition, intent, and permit application process
for Encroachment Permits. Code also lists the review criteria that should be
considered by the Planning and Zoning Commission when determining if a
permit should be granted. The Commission is to establish that the following
conditions exist before issuing an Encroachment Permit:
1 . An encroachment as defined in KMC 14.20.185 (a1 exists.
2. The encroachment does not encroach upon a Federal, State or
City right-of-way or utility easement.
3. The issuance of the encroachment permit will not authorize a
use which is a not a principal permitted use in the zoning district
in which the property is located.
4. The encroachment is not located across a platted lot line.

Applicant applied for a building permit in May of 2005. During the initial
review of the application, it was discovered that the proposed building didn't
meet the rear setback requirements. Applicant was advised and adjusted the
location of the residence. Building Permit B4189 was issued in May 2005.
The building permit noted the setbacks as: Front yard - 10' (Garage) & 25'
(House); Side yard - 5'; and, Rear yard - 20'.
An as-built survey conducted on February 10, 2006 shows the structure
encroaching two feet in to the required 25-foot front setback. Applicant is
applying for the encroachment permit so a final inspection and certificate of
occupancy can be issued for the residence.
To issue the permit, the Commission must determine the request meets the
criteria of KMC 14.20.185:
- An encroachment as defined in KMC 14.20.185 (a) exists.
o An encroachments means any object or structure above or
below ground and constructed or located in a manner other
than set forth in the Development Requirements Table. The
house is built in the setback and meets the definition of an
encroachment.
- The encroachment does not encroach upon a Federal, State or City
right-of-way or utility easement.
o The structure is not built in an easement or right-of-way.
- The issuance of the encroachment permit will not authorize a use
which is a not a principal permitted use in the zoning district in
which the property is located.
o This type of structure is permitted in the Rural Residential-1
zone.
- The encroachment is not located across a platted lot line.
o The house is 2 feet into the 25-foot required front setback.
City Engineer:
The subdivision plat may have contributed to the building placement. It is
not consistent with the Kenai Municipal Code.
Building Official:
Approval of encroachment will not compromise the building code.
RECOMMENDATIONS
This structure is located on a corner lot requiring two, 25-foot front
setbacks. The applicant was aware of the required setbacks when placing
the structure on the lot and thought the structure had been placed to meet
the required setbacks. Administrative exemptions may be issued for a

maximum of one-foot. This two-foot encroachment does not meet that
requirement and the applicant is requesting the encroachment allow a final
inspection and certificate of occupancy. The encroachment does not appear
excessive. Recommend approval

Section 14.20.185 of the Kenai Municipal Code outlines regulations for Encroachment
Permits which is the relaxation of the Development Requirements Table to remedy
encroachments which do not fall under Section 14.20.050, nonconforming uses and
which satisfy the requirements of financial institutions subject to the following

Center, Inc. -Lots 2 and 3, Block 5, General Aviation Apron
Subdivision No. 1 Amended
The City of Kenai has received an application to assign the lease for Lots 2 and
3, Block 5, General Aviation Apron Subdivision No. 1 Amended. Attached is a
copy of the application and a memorandum from Kim Howard outlining the
application and process for approving the application.
Kenai Municipal Code requires the Planning Commission to determine the
following:
Does the proposed use comply with the zoning ordinance? The
parcels are zoned Light Industrial. The original lease was entered into
in 1976 fora "Commercial Business Establishment and Aviation
Services"; the aviation services were never developed. The current
use is considered a Retail Business. Retail businesses are a permitted
use in the Light Industrial zone. In addition to use, the zoning
ordinance also considers setbacks. In the Light Industrial zone,
setbacks are based on the building code. However, when this building
was constructed, it was built over a lot line and straddles the lots. This
is considered anon-conforming structure as defined in KMC
14.20.050. The building may not be enlarged without removing the lot
line. The proposed use complies with the zoning ordinance; the
building is non-conforming.

• Does the proposed use comply with the Comprehensive Plan? The
2003 City of Kenai Comprehensive Plan identifies these parcels as
being in the Proposed Airport-Dependent Development District. "The
Airport Industrial district identifies airport lands reserved for the Kenai
Municipal Airport and its future expansion, and tracts needed for
present and future aviation-related uses and activities." The parcels
are identified on the Proposed Land Use Plan as Airport Industrial.
The City has not developed nor adopted an Airport Industrial zone.
The draft Airport Supplemental Plan that is under review identifies an
Airport Reserve with similar goals as the Airport Industrial land use.
These parcels are located in the proposed Airport Reserve. Because
the Airport Industrial land use has not been implemented and the
proposed use meets the zoning, it appears that the proposed lease
complies with City's Comprehensive Plan.
• Does the proposed use comply with the Airport Master Plan? The
1997 "Kenai Municipal Airport Master Plan" land use identifies the
parcels as designated for commercial aviation/air cargo. The Airport
Exhibit A map identifies these properties as Airport Property Leased for
Non-Airport Activities. The lease was issued in 1976 for "Commercial
Business Establishment and Aviation Service." The aviation portion of
the business was never developed; however, the adjoining property
owner is using a portion of Lot 2 for aircraft parking. It is not clear that
this aircraft parking is for commercial use. Based on this, it appears
that the current business does not comply with the 1997 Kenai
Municipal Airport Master Plan even though the business existed prior
to 1997.
• Is the application complete? Ms. Howard has determined the
application to consign the lease is complete.
• Is the proposed used the highest and best use? The highest and best
use is a theory used by appraisers when conducting appraisals. In the
book, "Real Estate Valuation in Litigation" it is noted that,
"Fundamental to the concept of value is the theory of highest, best and
most profitable use....Highest and best use for land is the use that, at
the time of appraisal is the most profitable likely use." In this case,
there has not been an appraisal conducted. The appraiser would look
at uses allowed by zoning to determine the "highest and best use."
The current business has been in existence since 1976. The adjacent
property owner is currently using 1,150 square feet of Lot 2 for aircraft
parking. The current uses appear to be the highest and best use at
this time because there is no other proposed use.
Does the proposed use meet other goals set by the Commission or
City Council? At this time, the Commission has not set goals for lease
applications.

Based on this information, it appears the proposed lease complies with the City's
zoning ordinance, Comprehensive Plan, and is the highest and best use for
these parcels. Based on the 1997 Airport Master Plan and original lease, it does
not appear that the current use meets the Airport Master Plan.

Geneva Stasek leases the above referenced property from the City and has requested approval to
assign the lease to her daughters, Wendy McGahan, Lynne Dykema and Gwen Woodard, d/b/a
Kenai Fabric Center, Inc. for estate planning purposes. The parcels are located on North Willow
Street. The lease states the lessee may not assign the lease nor sublease without the written
consent of the City and the assignment shall be accomplished as follows:
a. Submittal to, and approval of, proposed lease assignment by the Kenai Planning
Commission.
b. After approval by the Kenai Planning Commission, final approval of assignment by
the City Council.
Although the lease states that the purpose for which the lease was issued was "Commercial
Business Establishment and Aviation Services", the aviation services that were originally
intended for the property have not developed. However, the adjacent property owner is currently
using 1,150 square feet of Lot 2 for aircraft parking. Both lessees' annual rent is adjusted
accordingly. This lease was entered into in 1976 and the term of the lease expires on June 30,
2031.
As the older leases have come up for assignment, we have been requiring an amendment
updating the insurance requirements. The parties have signed the enclosed Assignment of and
Amendment to Lease.

The parties are in compliance with payments to the City and property taxes to the Borough. The
City Attorney has no objection to the assignment documents.
If Council approves the transfer, the Assignment of and Amendment to Lease and a Consent to
Assignment will be executed by the City Manager. Please make a recommendation to the City
Council regarding the transfer.

ASSIGNMENT OF AND AMENDMENT TO LEASE
This assignment is entered into between GENEVA E. STASEK, whose
address is 115 N. Willow Street, Kenai, Alaska 9961 1, hereinafter referred to
as the Assignor; and WENDY McGAHAN, LYNNE DYKEMA and GWEN
WOODARD d/b/a KENAI FABRIC CENTER, INC., whose address is 115 N.
Willow Street, Kenai, Alaska 99611, hereinafter referred to as the Assignee.
Assignor does hereby assign and transfer all of its interest in the
leasehold estate as evidenced by that certain Lease Agreement with the City
of Kenai as Lessor, recorded June 2, 1976, in Book 97, Page 485, Kenai
Recording District, and covering the following described property:
Lots 2 and 3, Block 5, General Aviation Apron, according to Plat
No. 73-68, in the Kenai Recording District, Third Judicial
District, State of Alaska.
To have and to hold the same from the date hereof, for and during all
of the remainder yet to come of the term of said Lease Agreement.
Assignee agrees to comply fully with the terms and provisions of the
Lease, and to hold the Assignor harmless from any liability arising
thereunder.

That lease is hereby amended to include the following insurance
requirements.
INDEMNIFICATION AND INSURANCE: Lessee covenants
to save the City harmless from all actions, suits, liabilities, or damages
resulting from or arising out of any acts of commission or omission by the
lessee, his agents, employees, customers, invitees, or arising from or out of
the Lessee's occupation, or use of the premises demised, or privileges
granted, and to pay all costs connected therewith.
Lessee, at the expense of Lessee, shall keep in
force, during the term of this agreement, insurance issued by
responsible insurance companies authorized to do business in
Alaska, in forms, kinds and amounts as determined and directed by the
City for the protection of City and/or Lessee.
Insurance requirement hereunder shall be subject to the sole
determination of the City.
Said insurance may include, but need not be
limited to insurance coverages commonly known as, or similar in kind to,
public liability, products liability, property damage, cargo, aircraft, fire,
workmen's compensation, comprehensive, builders risk, and such other
insurance coverage as deemed required in the sole determination of the
City. All policies or endorsements thereto shall in all cases where possible
name City as Additional Named Insured thereunder and shall contain a
waiver of subrogation against the City.
Upon approval by City of all insurance required,
in the forms, kinds and amounts directed to be procured, Lessee shall
deliver all policy originals or duplicate originals and endorsements thereto
to the City for incorporation within this agreement as attachment thereto.
In any event, Lessee is not to commence to exercise any of the rights and
privileges granted under this agreement until such time as all insurance
directed and required to be furnished by Lessee is in full force and effect.
Lessee expressly understands and agrees that any

insurance protection furnished by Lessee hereunder shall in no way limit
its responsibility to indemnify and save harmless Lessor under the
provisions of this agreement.
No policy of insurance shall be cancelled or amended with
respect to the City without thirty (30) days written notice by registered or
certified mail to City by the insurance company.
Until otherwise directed in writing by the City Manager, Lessee
shall provide certificates of insurance within thirty (30) days of the date
hereof as follows:

Combined Single Limit (Bodily
Injury and Property Damage): $500,000
Workmen's Compensation -Statutory Limits
Notwithstanding anything to the contrary, if Lessee fails or
neglects to secure required insurance or if said policy or policies are
terminated, altered, or changed in any manner not acceptable to the City,
then and in that event this lease may be cancelled and terminated, without
penalty, on five (5) days written prior notice to Lessee.

Covenant 42 of the leases include a "preference right to re-lease those lands previously leased if all
other sections of the Kenai Municipal Code are complied with. Re-leasing will not necessarily be
under the same terms and conditions of the prior lease." The Lessees have informed the City that they
would like to renew their leases under this clause.
One of the duties of the Harbor Commission as outlined in KMC 11.10.010 (5) is to review leases of
City-owned tide, submerged, and lands or navigable waters within the City and make
recommendations to the City Council.
KMC 11.20.140 states, "No leased land may be changed in use, nor may any renewal lease be issued
until the proposed use or renewal has been reviewed by the Planning Commission and approved by
the Council."
Historically, shore fishery leases have been renewed on the basis that the lessees had fished the sites
for many years. In the past, the proposed term of the lease was for ten years. Annual rent for the
current leases is $300 for each tract. The leases state that the City may amend the annual rent equal to

that charged by the State of Alaska, if that amount should change during the term of the lease. The
State of Alaska doesn't expect to increase their rents in the near future.
Attached is a map showing the general area of our shore fishery leases. For your information, Kenai
Salmon Company's lease for Tracts 5 & 6, Shore Fishery Plat #71 was renewed last year and expires
in 2015. Anew lease was entered into on March 1, 2006 with Ted Crookston, d/b/a Tide Chaser
Fishery, LLC for City of Kenai Shore Fishery No. 2 and it will expire in 2016.
Please make a recommendation regarding the lease renewals for the Council's consideration.
