STAFF REPORT
To: Planning & Zoning Commission
Date: June 21, 2006
Res: PZ06-47

GENERAL INFORMATION
Applicant: Integrity Surveys 283-9047
8195 Kenai Spur Highway
Kenai, AK 99611
Requested Action: Preliminary Subdivision Flat -Five Irons Heights Block 3 Resub.
Legal Description: A subdivision of Block 3 Five Irons Heights
Street Address: 1700 Lawton Drive
KPB Parcel No.: 04938214
Existing Zoning: R -Recreation
Current Land Use: Residential
Land Use Plan: Neighborhood Residential
ANALYSIS
This plat subdivides 4.39 acres of land into 5 lots ranging from 21,413 square feet to
43,575 square feet. The parcel is located in the Recreation zone. The minimum lot size
is 20,000 square feet. The resulting parcels meet the minimum size for the zone. City
water and sewer are available along Lawton Drive.
In 2002 a building permit was issued to construct athree-family dwelling on the parcel.
With the new lot configuration, it is impossible to determine if the plat creates an
encroachment. Prior to recommending approval of the plat, the City requires an asbuilt
survey of the structure to insure that the building under construction has not encroached
into the setbacks.
Cites ineer:
As city water and sewer are available, Note 3 on the plat is not needed.
Building Official:
Nothing additional.
RECOMMENDATIONS
Recommend the plat not be approved until an asbuilt survey is submitted that certifies the
0647 Comment.doc

structure under construction meets setback requirement with the proposed lot
configuration and that Note 3 be amended to show city water and sewer available.

Addendum - PZ06-47
Preliminary Plat
Five Irons Heights Block 3 Resub
On July 5, 2006, Integrity Surveys submitted an updated preliminary plat showing
the structure under construction. The plat shows the structure 45 feet from the
front property line and 19.7 feet from the proposed side lot line. The plat will not
create an encroachment. In addition, Note 3 has been amended to include the
comment that city water and sewer are available.
The revised preliminary plat, meets all requirements.
Recommend approval.

Date: June 6, 2006
To: Kenai Planning and Zoning Commission (June 14~' meeting)
Kenai Parks & Recreation Commission (July 6~' eeting)
From: Kim Howard, Assistant to City Manager
RE: Tract A, Park View Subdivision (Parcel #04701018)
We have received a request to purchase Tract A, Park View Subdivision. The property consists
of 2.092 acres and is adjacent to South Spruce Street. A vicinity map is attached.
KMC 22.05.010 and 22.05.030 require that disposal or sale of lands shall be made only when, in
the judgment of the City Council, such lands are not required for a public purpose. Ordinance
No. 919-84 allowing the sale was passed by Council and was effective on April 7, 1984. A sale
was never finalized.
Given that the Council determined the property was not needed for a public purpose over 20
years ago, the City Manager has asked for the Commissions' recommendations so that Council
can re-determine whether or not the property is needed, or not needed, for a public purpose.
Sale would be by competitive bid at not less than the fair market value. Please review the
attached and make a recommendation as to whether the parcel is needed for a public purpose or
if it can be sold.

Requested Action: Landscape/Site Plan
Legal Description: Lot 12, Block B, Beaver Creek Alaska Subdivision Amended

ANALYSIS
General Information:
Kenai Municipal Code Chapter 14.25 specifies the requirements for landscape/site plans
within the City of Kenai.
Section 14.25.030 of the code details Landscaping/Site Plan submittal requirements.
The applicant has submitted an application for development of a 2880 square foot
commercial building for the sales of motorcycles, snowmobiles, four-wheelers and
offering parts and repair of the vehicles at the above-noted location. The site plan shows
the proposed building, landscaping, snow storage, drainage, access, and parking. The
code requires the following:
Perimeter/Buffer Landscaping -Proposed landscaping shows natural
vegetation on the rear of the lot and to the west property line adjacent to
the proposed building. The site plan does not show any landscaping to
the east of the building. The adjoining lot (lot 13) is also owned by the
applicant's family and planned for future development.
Interior Landscaping -Proposed landscaping shows an area of grass and
roses along the front of the building separating the parking lot from the
from of the building. The area planned for planting grass is approximately
15'X5' (75 square feet).
Parking Lot Landscaping -There is no parking lot landscaping shown on
the site plan. The parking area is approximately 40'X112' (4480 square
feet). Based on the size of the building and proposed use, 8 parking
0645 Comment.doc Page 2
spaces are required. The parking area is sufficient to meet the code
requirements.
Street-right-of-way Landscaping -There is no landscaping shown along
the Kenai Spur Highway right-of-way.
The plan as submitted meets the basic requirements of the Kenai Municipal Code. Of
concern is the drainage shown between Lot 12 and 13. The site plan shows the
drainage for this development draining toward Lot 13. The family owns the two lots and
there is a plan for future development of Lot 13. However, because ownership of the lots
could change in the future, drainage should be limited onsite as much as possible. This
concern was discussed with the applicant. Mr. Titus advised that he would require the
excavator to direct drainage toward the rear of the lot.
The site plan shows a shared drive off of Kenai Spur Highway for Lots 12 and 13. The
applicants have applied for a permit from the State of Alaska, Department of
Transportation for a driveway permit. The City's Comprehensive Plan encourages
combining access points to minimize traffic congestion.
City Engineer:
Adequate area exists for parking, snow storage, and drainage. City water is available
within the Kenai Spur Highway right-of-way. On-site waste disposal must comply with
ADEC regulations.
Building Official:
The building permit application is under review. The site plan as originally submitted
does not meet the International Fire Code. A letter was sent to Mr. Titus on June 22"d
advising that a revised site plan, "indicating adead-end fire apparatus access road
turnaround" is required.
On June 23~d, a revised site plan was submitted with a fire apparatus turnaround shown
extending onto the adjoining Lot 13. Also submitted was a letter giving permission for the
turnaround from the property owner, Theodore Titus.
RECOMMENDATIONS
The applicant submitted two site plans. The original and then a revised that
accommodated the fire apparatus turnaround. In addition, the second site plan shows
the snow storage with drainage directed toward the rear of the lot. Mr. Titus also
incorporated the landscaping (grass) along the Kenai Spur Highway right-of-way.
The plan is approved with the following requirements:
1. Cleared areas (Street right-of-way) along the Kenai Spur Highway must be
landscaped. Approved landscaping includes grass, low-growing shrubs,
or other acceptable ground cover that will not block the view of traffic.
Applicant must advise City of Kenai staff with the proposed plan for
addressing this area. (Provided in the revised site plan.)
2. Drainage must be contained to Lot 12 as much as possible and drainage
should be directed toward the rear of Lot 12. (Shown on the revised site
plan.)
3. Any dumpster or trash receptacles on the lot must be screened with a
sight-obscuring structure made of wood or concrete. Structure may
require a building permit.

Site Plan
x
Corner of Bidarka Street and Main Street Loop. Address is :115 Bidarka Street Main
Street Loop, Kenai.
Lot is approximately'/z acre, 150'x 150'.. It is zoned commercial.
Present condition overgrowth of vegetation, alders, devils club, dried dead brush
undergrowth to the point one cannot even find the sidewalk. The overgrowth is 4 to 6
feet above the curbline and sidewalk elevation. Simple put it's a jungle, a fire hazard and
a danger to walk on. It is impossible to evaluate the building potential. My site plan is
very simple: Clear off the property so that I can walk across my property. I want this
property safe for my grandchildren to play on, as well as walk perspective tenants out
onto this property, so that I can build to suit their needs. If and when a building
construction is planned a building site plan will be submitted. I have a right to clean this
property up, which will increase its value and allow me to visually access its potential to
build on. This is impossible in its present condition.
In its present overgrowth condition, it is unsafe, a hazard and undesirable to me, the
owner and property tax payer.
I have contracted CIC excavating to commence immediately to clean up this property.
All necessary precautions that are standard practices which are reasonable and customary
will be taken. The lot when completed will be properly reseeded for rapid ground cover.
Ornamental landscaping rocks may be placed near the corner. However trees and shrubs
and flowerbeds will accompany a building site plan if and when a building is planned.
Sincerely,
Owner Alfonso Lamendola June 27, 2006
