City Planner Kebschull reviewed the staff report that was included in the meeting packet along with staff recommendations incorporated into the staff report. PZ06-40 - A resolution of the Planning and Zoning Commission of the City of Kenai, Alaska, recommending to the Council that the Kenai Zoning Code at KMC 14.20.150 be amended to prevent the same or substantially similar conditional use permit applications from being considered by the Planning 8s Zoning Commission more than once in any nine month period. Kebschull reviewed the proposed Resolution No. PZ06-40. She stated this had once been included in code, but during revisions made in 1998 had been left out. Bryson commented he felt this resolution appropriate to approve as it was the prior intent of the Commission. MOTION: Commissioner Bryson MOVED to approve PZ06-40. PZ06-41 - An application to amend PZ05-45 (Lot 21, Block 5, Original Townsite of Kenai) to include Bed 8s Breakfast and to amend the legal description for the property known as Lot 22A, Original Townsite of Kenai, Vozar Addition (510 8s 512 Upland Street). Application submitted by Sandra J. Vozar, 1000 Mission Avenue # 100, Kenai, Alaska. MOTION: Commissioner Fullinck MOVED to approve PZ06-41 and Commissioner Twait SECONDED the motion. Kebschull reviewed the staff report included in the meeting packet along with staff recommendations incorporated into the staff report. Kebschull recommended approving the Conditional Use Permit for the restaurant and catering business and explained the request for a Conditional Use Permit for the bed and breakfast did not meet the requirements of KMC 14.20.321. However, Vozar could operate as a lodge and would not need a Conditional Use Permit. Public Hearing opened. Sandra Vozar, comments included: • She bought the second lot to enlarge the original lot. • The Borough Planning Commission approved the plat. • The address of the building will be 510 Upland Ave. • The business license remains in the Old Towne Village name. • She will have extra rooms in the building and her intent is to rent them out. Kebschull reported Administration has received a request to purchase the above referenced 2.09 acres off S. Spruce Street. City lands can only be sold when not needed for public purpose and the parcel was approved for sale by Council in 1984. Administration is requesting Commissions' recommendations so Council can re- determine whether or not the property is needed for a public purpose. MOTION: Commissioner Bryson MOVED to postpone consideration of sale of land until Parks 8v Recreation is able to review. Commissioner Jenckes SECONDED the motion. The Code also outlines the review criteria that should be used by the Planning and Zoning Commission to determine if a variance should be granted. The Commission shall establish a finding that all of the following conditions exist as a prerequisite to issuance of a variance permit: 1. Special conditions or circumstances are present which are peculiar to the land or structures involved which are not applicable to other lands or structures in the same zoning district. 2. The special conditions or circumstances have not been caused by actions of the applicant and such conditions and circumstances do not merely constitute a pecuniary hardship or inconvenience. 3. The granting of the variance shall not authorize a use that is not a permitted principal use in the zoning district in which the property is located. 0643 Comment.doc Page 2 4. The granting of a variance shall be the minimum variance that will provide for the reasonable use of the land and/or structure. 5. The granting of a variance shall not be based upon other non-conforming land uses or structures within the same land use or zoning district. The applicant leases space from the City of Kenai in the City of Kenai -Conoco Phillips Multi-Purpose Facility and wishes to install a sign to advertise his business. Applicant notes he would like the sign visible from the Kenai Spur Highway and does not believe a wall sign on the building would meet his needs. Because there is already a freestanding sign on this parcel, a variance is needed for the additional freestanding sign. The sign code allows one freestanding sign per parcel. Because the applicant leases space in a City facility, permission of the City of Kenai is required for the application. The City Manager has given verbal permission to process the permit. If the variance is approved, the applicant's lease will be amended to allow for the sign and the City will approve the actual sign location. Chapter 14.20.180 outlines the criteria that must be met for the Commission to grant a variance. The sign code, Chapter 14.20.220 (a) (9) specifically allows for relief from any section of the sign code by applying for a variance. - Special conditions or circumstances are present which are peculiar to the land or structures involved which are not applicable to other lands or structures in the same zoning district. The applicant leases space from the City of Kenai in the multi-purpose facility operating a retail business for sporting goods that provides goods and services for the ice rink consumers. The City of Kenai has placed a freestanding sign on the premise that advertises the facility. That signage does not provide space for the business to advertise. The multi-purpose facility is located in an education zone. The customary businesses in educational facilities area a part of the main facility, i.e. bookstore, etc. Because this is a fully separate retail business, operating within a public facility, it does appear to meet the criteria that it is different from other uses in the same zoning district. - The special conditions or circumstances have not been caused by actions of the applicant and such conditions and circumstances do not merely constitute a pecuniary hardship or inconvenience. Applicant is asking for a variance for an additional freestanding sign for this parcel. The business was not given an opportunity to advertise on the facility sign. The option for a wall sign does not meet the business's needs for visible advertising from the Kenai Spur Highway. During the hockey season, advertising is not necessary as the activity at the facility provides day-to-day business from facility uses. However, during the off-season, the business needs to insure that consumers know the business is open. - The granting of the variance shall not authorize a use that is not a permitted principal use in the zoning district in which the property is located. Freestanding signs are permitted in the district. 0643 Comment.doc Page 3 - The granting of a variance shall be the minimum variance that will provide for the reasonable use of the land and/or structure. Applicant is asking for a variance for an additional freestanding sign for the premise. The sign, as shown on the drawing provided in the application, is 96 square feet. The height of the sign will be 10 feet. It could be argued that a smaller sign would meet the business' needs; however, due to the location of the parcel and with the large Kenai Spur Highway right-of--way, the requested sign appears to meet the requirements for a minimum variance. It should be noted that the applicant has been notified that in the future should the City of Kenai determine that it needs to advertise events in the facility and wishes to place a sign for advertising combined uses within the facility, the City would retract it's permission for the variance and provide an allowance for advertising this business in conjunction with the combined sign. - The granting of a variance shall not be based upon other non-conforming land uses or structures within the same land use or zoning district. This request is not based on any other uses or structures in this district. City En ineer: The sign location should not impair street traffic visibility. Building Official: The location appears to meet sign code regulation. RECOMMENDATIONS The City's sign code provides relief through the variance procedure from any section of the sign code. The location of the facility and the need to provide direction to customers appears to justify the need for a directional sign off the Kenai Spur Highway. Recommend approval with the following requirements: 1. Sign location must be approved by the City of Kenai administration. 2. If in the future, the City of Kenai decides to install a combination sign for the facility, the City will withdraw permission for this sign and the permit would become void. ATTACHMENTS: 1. As you know Red Line Sports has been leasing space at the Kenai Conoco/Phillips Multiple Use Facility. We are coming to the end of our second year in a three year contract I am interested in discussing a lease renewal with a longer term. The facility was recently named the Kenai Conoco/Phillips Multiple Use Facility. In my opinion the current stand alone signage is more to a landmark than a retail advertisement. 1 have many years of experience with building attached signage. For 23 years people would ask where the store was located. A couple areas of interest: since the closing of nay Soldotna store, I am keeping the Kenai location open all year round. , If the facility were to become more active in the summer, I would be interested in discussing the management of such activities if it would help keep the costs down for the city, Red Line Sports, and the user group. The value of the adjoining property and neighborhood will not be significantly impaired; 3. The proposed use is in harmony with the Comprehensive Plan; 4. Public services and facilities are adequate to serve the proposed use; 5. The proposed use will not be harmful to the public safety, health or welfare; 6. Any and all specific conditions deemed necessary by the commission to fulfill the above-mentioned conditions should be met by the applicant. Applicant recently purchased this property and planned to operate his taxidermy business from this location. The property is located in an area with several gravel pits and the Nabor's Drilling Company storage yard. Mr. Wilkerson thought that the use was an allowed use. Mr. Wilkerson worked to clean the area and started operating the business. The applicant painted a wall sign on the end of the building facing Beaver Loop Road to advertise the business. (Wall signs are not regulated by the code.) This signage drew attention to the business. Mr. Wilkerson was notified that the property is located in a Rural Residential zone and a Conditional Use Permit was required. During a review of the application, Mr. Wilkerson advised that he operates a taxidermy business at this location. The taxidermy business does not involve a storefront with a lot of drop-in business. Generally clients make arrangements to drop off the portion of the animal for preservation and then return to pick it up. Mr. Wilkerson advised that he does not tan at the business and there is no hazardous waste. All waste is transferred to the Borough's waste facility. He will not have a dumpster on site. He was notified that if he finds he needs a dumpster in the future, the location must be approved. To issue the permit, the Commission must determine that the application meets the following criteria: - The use is consistent with the purpose of this chapter and the purposes and intent of the zoning district - "The RR Zone is intended to provide for low- density residential development in outlying and rural areas in a form which creates a stable and attractive residential environment. The specific intent in establishing this zone is (1) To separate residential structures to an extent which will: (i)Preserve the rural, open quality of the environment; (ii)Prevent health hazards in areas not served by public water and sewer. (2)To prohibit uses which would: (i)Violate the residential character of the environment; (ii)Generate heavy traffic in predominantly residential areas" Without looking at the historical use of this property, it may appear that the proposed use is not consistent with the purpose of the Rural Residential zone. However, the property is surrounded by industrial uses and in the past has been used as an automotive garage. Because of this, it appears that the use may be consistent with the intent of the zone. - The value of the adjoining property and neighborhood will not be significantly impaired - Mr. Wilkerson has worked on cleaning debris and junk from the property and cleaning garbage from inside the building. The adjoining properties contain a storage yard for oil field equipment and gravel pits. It does not appear that a retail business would impair the value of the adjoining properties. 0644 Comment.doc Page 3 - The proposed use is in harmony with the Comprehensive Plan -The Comprehensive Plan identifies this parcel as Rural Residential in the Land Use Plan. "The Rural Residential district includes areas -that, due to location or site conditions, are best suited for large-lot single family residential development. Homes in this district typically rely on individual on-site water supply and wastewater disposal systems. Compatible institutional uses such as churches, schools, and daycare facilities may be intermixed if they comply with zoning design guidelines. Small home- based businesses may be accommodated within certain design guidelines. " The Plan did not provide allowances for land with prior existing uses within the zone. This property has historically been located adjacent to industrial uses and in the past used as a commercial business. Even though the proposed use does not appear to be in harmony with the Plan, the historical use is in harmony with adjoining uses. It is unlikely that due to the proximity to the industrial sites, that the property would be used for residential purposes. - Public services and facilities are adequate to serve the proposed use - Onsite water and sewer serve the property. Cone Avenue is considered a private driveway under the City's street maintenance guide and the City does not maintain the street. - The proposed use will not be harmful to the public safety, health or welfare -The proposed use will not be harmful to the public safety, health, or welfare. - Any and all specific conditions deemed necessary by the commission to fulfill the above-mentioned conditions should be met by the applicant. These may include, but are not limited to measures relative to access, screening, site development, building design, operation of the use and other similar aspects related to the proposed use. There does not appear to be conditions that need to be placed on the use to protect the public or adjoining properties. City En ig Weer: Adequate area exists for parking and snow storage and drainage can be accommodated. Access to Beaver Loop should not be a problem. Building Official: The building should meet building code requirements; however, if additions or remodels are planned, building permits will be required. RECOMMENDATIONS The applicant purchased this property as a location for his taxidermy business. He thought that due to the industrial-type uses adjacent to the property that the taxidermy business would be permitted. The applicant advised that he spent considerable time clearing debris and garbage from the property and cleaning up the building. The use is not the type of business that generates a lot of traffic. The City does not maintain the street and there are no residences located on the street. The application, as submitted, meets the requirements for a Conditional Use Permit. The proposed taxidermy business is aloes-impact business.
