When noted Spur Drive was spelled incorrectly on the plat, City Planner Kebschull explained the City's records show the spelling to be with one "R" and added, the Borough would have to request the city change the spelling. Commissioner Bryson abstained from voting on both Items 4-a and 4-b due to his participation at the Borough level. Discussion and Recommendation -- Tract A, Park View Subdivision - Determine if needed for a public purpose. (Postponed from June 14, 2006 meeting.) MOTION: Commissioner Bryson MOVED to retain the property for public purpose and Commissioner Fullinck SECONDED the motion. Kebschull reported the following: • An offer was received by the city for the purchase of this property. • The Parks 8~ Recreation Commission recommended the parcel be retained for public use due to its proximity to the beach, indicating potential City uses for the property could be a museum, overflow parking for the dip net fishery, a future park, etc. • City Council would also like a recommendation from the Planning and Zoning Commission. Discussion followed and comments included: Commission. Concurrence with the recommendation of Parks & Recreation • Sell the property because: It is a beautiful lot with nice views and it would be a waste to use it for overflow parking and there are already several parks in Kenai; the location is next to the Care Center/Women's Resource Center, and their confidentiality could be jeopardized. • It should be retained for public use because of its location and current parking problems in the area. Kebschull also noted an appraisal will be done if the property is released for sale; if it is released then it would go out to bid; the person making the offer will have the opportunity to exceed the highest bidder; the City use of the property should not be limited to overflow parking; the property may be appropriate for a new library; and, the adjacent property owner accesses his property by an access trail through the city's parcel. City Council -- Council Member Ross noted that the last motion had failed as four votes are required in order to pass. He will report to Council there were 3 yes votes and 2 no. Administration -- Kebschull reported the following: • The draft Mixed Use Zone ordinance will be scheduled for a public hearing at the July 26~ meeting. • A work session scheduled for July 13, 2006, immediately following the Airport Commission, will be held to review options for the Airport rezone. Malone, R.P.L.S. P.O. Box 124 Kenai, AK 99611 Requested Action: Freliminary Subdivision Plat - Coyle's Landing -Miller Replat Legal Description: A replat of Lot 1, Coyle's Landing, Tract 9, Horseshoe End at River Bend Subdivision & Coyle Tideland Parcel Street Address: 1501 Barabara Drive KPB Parcel No.: 04912043 Existing Zoning: RR -Rural Residential Current Land Use: Residential Land Use Plan: Rural Residential ANALYSIS This plat subdivides three parcels of land into 2 lots. The new Lot 1-A contains 2.48 acres with 1.16 acres above the bluff. The new Lot 1-B contains 1.24 acres with 20,500 square feet above the bluff. Due to topography of the area and the Tideland Parcel, the developable area on the lots is restricted. The parcels are located in the Rural Residential zone. The minimum lot size is 20,000 square feet and the proposed subdivision meets the minimum lot size for the zone. City water and sewer are not available. In 2002 a building permit was issued to construct asingle-family dwelling on the parcel. The plot plan provided at that time did not show the 10-foot utility easement located along the lot line between the current Tract 9 and Lot 1. The confusion may have occurred during the building permit application because these lots (Tract 9 and Lot 1 Coyle's Landing) are parcels that the Borough combined sometime ago. When they combined the lots, the lot lines didn't disappear but the assessing records show one parcel number with a combined legal description. And, the Borough's parcel base does not show the lot line between Tract 9 and Lot 1. During the review of this preliminary plat, staff discovered that the residence built in 2002 was built into the 10-foot utility easement and into the side lot setback. Because an 0653 Comment.doc Page 2 encroachment permit cannot be issued if the structure extends into an easement (KMC 14.20.185(d)(2)) staff recommended the utility easement be vacated. Without the vacation, the City cannot recommend approval of the preliminary plat. Administration discussed options with the property owners to eliminate the encroachment and they have elected to vacate the utility easement. With the vacation approval and the Miller replat, the encroachments will be eliminated. Cit~En ineer: The City has reviewed the vacation and has no objection to the vacation. Building Official: This replat will eliminate aside-yard setback encroachment. RECOMMENDATIONS Recommend the plat not be approved until the existing 10-foot utility easement vacation is approved. PZ06-51 A RESOLUTION OF THE PLANNING AND ZONING COMMISSION OF THE CITY OF KENAI, ALASKA, RECOMMENDING TO THE COUNCIL THAT TITLE 14 BE AMENDED TO ESTABLISH A CENTRAL MIXED USE ZONE AND VARIOUS PARTS OF THE KENAI ZONING CODE BE AMENDED BY ADDING THE PROVISIONS TO ENCOMPASS THE NEW ZONE, AND UPDATING PORTIONS OF THE LAND USE TABLE AT KMC 14.22.010. WHEREAS, the City of Kenai Zoning Code does not have a zone designed for a mixture of commercial and residential use; and, WHEREAS, it is desirable to have a zone designed for a centrally located, pedestrian-friendly area for general retail shopping, personal and professional services, entertainment and restaurants to be mixed with residential uses; and, WHEREAS, the 2003 City of Kenai Comprehensive Plan calls for the establishment of such a central mixed use zone; and, WHEREAS, such a zone would be called the Central Mixed Use zone (CMU); and, WHEREAS, it is in the best interest of the City of Kenai to establish a Central Mixed Use zone as described above; and, WHEREAS, amending the Land Use Table categories of "Automotive Repair/Tire Recapping/Rebuilding" to "Automotive Repair," "Sanitariums" to "Assisted Living," and "Farming/Gardening and General Agriculture" to "Farming/General Agriculture" would aid in better determining which uses are allowed in the various zones within the City; and, WHEREAS, adding definitions of the terms farming, agriculture, assisted living, hospital and assemblages will aid in better understanding land uses in the City of Kenai; and WHEREAS, Footnote 21 of the Land Use Table should be amended to substitute "Development" for "Setbacks" to better regulate lot size in the Central Commercial and Central Mixed Use zones. Central Mixed Use Zone (MU ZONE) (a) Intent: The MU Zone is established to provide a centrally located area with the City for general retail shopping, personal and professional services, entertainment establishments, restaurants and related businesses. The district is also intended to accommodate a mixture of residential and commercial uses with conflict being resolved in favor or business. The MU Zone shall be designed to encourage pedestrian movement throughout the area. Building and other structures within the district should be compatible with one another and the surrounding area. (b) Principal Permitted Uses: As allowed in the Land Use Table. (c) Conditional Uses: As allowed in the Land Use Table and subject to the provisions of this chapter. (d) Accessory Uses: As defined. (Q) Portable si ns. [(fJ) ~ Nonconforming Signs. (1) After the enactment of this section, signs located within the City of Kenai on the effective date of this section that do not conform to the requirements of this code shall be classified as legal "nonconforming" signs if the sign was in compliance with applicable law on the date of adoption of this code. (2) A legal nonconforming sign shall immediately lose its legal nonconforming designation if: (A) The sign is altered in any way in structure which tends to increase its nonconformity with the requirements of this code; (B) The sign structure is relocated; (C) The sign (except for copy on a changeable copy sign) is replaced. Upon the occurrence of subsections (f)(2)(A), (f)(2)(B) or (fJ(2)(C) of this section, the sign shall be immediately brought into compliance with this code with a new permit secured or it shall be removed. [(g)) ~ Specific Definitions Pertaining to Signs. (1) "Applicant" means any for-profit or nonprofit enterprise, or organization, or any individual not acting on behalf of such an enterprise or organization. (2) "Audio sign" means a sign that emits a noise or sound, either spoken words, music, or singing. (3) "Banner" means a sign construction of flexible material, such as cloth, which moves upon being subjected to pressure by the wind. (4) "Beacon sign" means a light with one (1) or more beams capable of being directed in any direction or directions or capable of being revolved. (5) "Combination sign" means a sign incorporating any combination of the features of pole, projecting, and roof signs. PZ06-51 Attachment D Page 3 of 8 (6) "Curb line" means the line at the face of the curb nearest to the street or roadway. In the absence of a curb, the curb line shall be established by the.City Engineer. (7) "Display surface" means the area made available by the sign structure for the purpose of displaying the advertising message. (8) "Electric sign" means any sign containing electrical wiring, but does not include signs illuminated by an exterior light source. (9) "Fence sign" means a sign other than a real estate or home occupation sign displayed upon fences or upon walls that are not an integral part of a building or walls that are used as fences. (10) "Fin sign" means a sign that is supported wholly by a building or partly by poles and partly by a building. (11) "Ground sign" means a sign which is supported by one (1) or more uprights, poles, or braces in or upon the ground other than a combination sign, fin sign, or pole sign as defined by this Code. (12) "Legal setback line" means a line established by ordinance beyond which a building may not be built. A legal setback line may be a property line. (13) "Marquee" means a permanent weatherproof structure attached to, supported by a building, and projecting from the wall of the building. (14) "Pole sign" means a sign wholly supported by a sign structure in the ground. (15) "Political sign" means a sign promoting a candidate for political office, or promoting any position on a ballot proposition. (16) "Portable display surface" means a display surface temporarily fixed to a standardized advertising structure that is regularly moved from structure to structure at periodic intervals. (17) "Portable sign" means a sign other than a temporary sign that is not attached to any building or structure. It may readily be moved from one (1) location to another. It is designed to rest on the ground when displayed and may be with or without its own wheels. It may or may not be lighted. (18) "Projecting sign" means a sign other than a wall sign, which projects from and is supported by a wall of a building or structure. (19) "Real estate sign" means a sign advertising the sale, lease or rent of one (1) or more lots or acreage or the improvements thereon by a real estate company or individual licensed by the State of Alaska. (21) "Sign" means any words, letters, parts of letters, figures, numerals, phrases, sentences, emblems, devices, trade names, or trade marks by which anything is made known, such as are used to designate an individual, a firm, an association, a corporation, a profession, a business, or a commodity or product which are visible from any public street or highway and used to attract attention. (22) "Sign structure" means a structure that supports or is capable of supporting any sign as defined in this code. A sign structure may be a single pole or poles and may or may not be an integral part of a building. (23) "Temporary sign" means any sign, banner, pennant, valance, or advertising display constructed of cloth, canvas, light fabric, cardboard, wall board, or other light materials, with or without frames, designed to be displayed for a limited period of time only. (24) "Wall sign" means any sign attached to, painted on, or erected against the wall of a building or structure, with the exposed face of the sign in a plane parallel to the plane of the said wall. It appears that the proposed lease complies with City's Comprehensive Plan. • Does the proposed use comply with the Airport Master Plan? The 1997 "Kenai Municipal Airport Master Plan" land use identifies the area as General Aviation. The Airport Layout Plan (ALP) was last updated Lease Application -Lot 2, Block 1, General Aviation Apron Sub. #1, Amended Page 2 and approved by the FAA in September of 2004 and should be considered the most up-to-date information. The Airport Exhibit A map identifies the property as "Airport Property Leased For Airport Related Activities." The use, as noted above, complies with the Kenai Municipal Airport Master Plan. • Is the application complete? Ms. Howard has determined the lease application is complete. • Is the proposed used the highest and best use? The highest and best use is a theory used by appraisers when conducting appraisals. In the book, "Real Estate Valuation in Litigation'" it is noted that, "Fundamental to the concept of value is the theory of highest, best and most profitable use....Highest and best use for land is the use that, at the time of appraisal is the most profitable likely use." Appraisers look at uses allowed by zoning to determine the "highest and best use." The proposed use, T-type aircraft hangar building, with an estimated value between $300,000 and $400,000 is the likely use and appears to be the highest and best use at this time because there is no other proposed use. • Does the proposed use meet other goals set by the Commission or City Council? At this time, the Commission has not set goals for lease applications. Attached is a copy of the lease applications and a memorandum from Kim Howard outlining the applications and the process for approving the leases. Kenai Municipal Code requires the Planning Commission to determine the following: • Does the proposed use comply with the zoning ordinance? The parcels are zoned IL -Light Industrial. The proposed use is to construct aircraft hangars on the three lots. On lots 9 and 10 the hangars will be approximately 80' x 100' with an estimated value of $504,00 for each of the hangars. On lot 11, the hangar will be approximately 100' x 100' with an estimated value of $630,000. The Land Use Table identifies Airports and Related Uses as Permitted. The proposed use complies with the zoning ordinance. • Does the proposed use comply with the Comprehensive Plan? The 2003 City of Kenai Comprehensive Plan designates the parcels as Airport Industrial in the Proposed Airport-Dependent Development District. "The Airport Industrial district identifies airport lands reserved for the Kenai Municipal Airport and its future expansion, and tracts needed for future aviation-related uses and activities." Subdivision • Does the proposed use comply with the Airport Master Plan? - The 1997 "Kenai Municipal Airport Master Plan" land use designates the area as Commercial Aviation/ Air Cargo. - The Airport Layout Plan (ALP) was last updated and approved by the FAA in September of 2004 and should be considered the most up-to-date information. - The ALP Airport Exhibit A map identifies the property as "Lots, where subdivided available." - The ALP Terminal Area Drawing (Sheet 9) identifies the property as designated for Cargo. - The ALP Land Use Drawing (Sheet 10) identifies the property as designated for Aviation Related Activities. - The Supplemental Planning Assessment recently completed identifies these parcels as designated for Commercial Aviation within the Airport Reserve. Based on the information provided in the lease applications, it is unclear if the proposed use for Lots 9 and 10 meet the Airport Master Plan. The lease application for Lot 11 notes the hangar is proposed for Grant Aviation, a commercial entity. • Is the application complete? Ms. Howard has determined the lease application is complete. • Is the proposed used the highest and best use? The highest and best use is a theory used by appraisers when conducting appraisals. In the book, "Real Estate Valuation in Litigation'" it is noted that, "Fundamental to the concept of value is the theory of highest, best and most profitable use....Highest and best use for land is the use that, at the time of appraisal is the most profitable likely use." Appraisers look at uses allowed by zoning to determine the "highest and best use." The proposed use, aircraft hangars, with an estimated value between $504,000 and $630,000 are the likely uses and appear to be the highest and best use at this time because there is no other proposed use. • Does the proposed use meet other goals set by the Commission or City Council? At this time, the Commission has not set goals for lease applications. Based on this information, it appears the proposed leases comply with the City's zoning ordinance, Comprehensive Plan, and are the highest and best uses for these parcels. It is unclear, based on information provided in the lease applications for lots 9 and 10 if the proposed use complies with the Airport J.D. Eaton, M.A.I., Real Estate Valuation in Litigation (American Institute of Real Estate Appraisers, 430 N. Michigan Avenue, Chicago, Illinois 60611, p. 62. Subdivision Indcom Properties, LLC (Kenneth Dunbar) has submitted the attached lease applications for the referenced properties. The applications are conceptual and detailed drawings will be provided at a later date, prior to leases being issued. The lots are shown on the attached map. The Supplemental Planning Assessment includes these parcels in the proposed Airport Reserve boundary. Property in the proposed reserve is for short-term and long-term airport-related uses and should not be sold. All uses within the boundary should comply with the airport land use plan and airport layout plan. The City's determination should be based on the land use plan, the Airport Master Plan, airport capital improvement program and sound airport planning. KMC 21.10.080 states the term shall depend upon the durability of the proposed use, the amount of investment in improvement proposed and made, and the nature of the improvement proposed with respect to durability and time required to amortize the proposed investment. According to the schedule currently used, a 55-year term would be allowed for more than $375,000 in improvements. KMC 21.25.010 (b) states the Airport Commission shall observe, oversee and guide in an advisory capacity, any matters relating to use of airport aeronautical lands. The Airport Commission needs to determine: 1. If the intended uses comply with the Airport Master Plan. 2. If the lease applications comply with the airport land use plan and airport layout plan. 3. If they do not, can an interim use be allowed? 4. Is there a determination when the land would be needed for uses that conform with the land use plan? After review by the Airport Commission, the recommendations and applications will be forwarded to the Planning and Zoning Commission. As outlined in KMC 21.10.030 (b)(5) and KMC 21.10.060 (a) the Planning and Zoning Commission needs to determine: 1. If the intended uses comply with the zoning ordinance and comprehensive plan of the City. 2. If the applications are complete. 3. The uses proposed in the applications are the highest and best use and conform to the Airport Master Plan and other goals set by the Commission or the City Council. The applicant is proposing to operate a sign design and production business from a portion of their garage at the above location. Ms. English describes the signs as being designed on a computer and then sent to a vinyl printer for the final product. Use of this structure for a business is allowed under KMC 14.20.230(d)(3). KMC 14.20.230(d)(2) states "no more than thirty (30%) percent of the gross floor area of all buildings on the lot shall be used for the home occupation. " The applicant intends to use approximately 120-square feet of the garage along with an 8-foot x 10-foot metal storage shed (80-square feet) for the business, which is under the allowed requirements. At times there may be one to two clients dropping off or picking up signs from the residence.
