ITEM l: CALL TO ORDER
Chair Eldridge called the meeting to order at approximately 7:00 p.m.

MOTION:
Commissioner Bryson MOVED to approve the agenda adding an updated Code
Enforcement Second Quarterly Report which would replace Item 11 c in the meeting
packet. Commissioner Fullinck SECONDED the motion. There were no objections.

Commissioner Jenckes MOVED to approve PZ06-53. Commissioner Fullinck
SECONDED the motion.
Chair Eldridge opened the meeting to public comment; there were no comments.
City Planner Kebschull reviewed the staff report and recommendations included in the
meeting packet noting staff recommended approval only if the existing ten-foot utility
easement would be vacated.
Commissioner Twait arrived at 7:06 p.m.
MOTION TO AMEND:
Commissioner Jenckes MOVED to approve PZ06-53 to include the recommendations
of staff which will not approve the plat until the existing ten-foot utility easement
vacation is approved. Commissioner Fullinck SECONDED the motion.
For the record, Commissioner Bryson noted the arrival of Commissioner Twait and
therefore abstained from voting on PZ06-53.

ITEM 5: PUBLIC HEARINGS
5a. PZ06-51 -- Recommending to the Council that Title 14 be amended to

Kebschull reviewed the proposed resolution and noted the following:
• The Commission is also approving the sign code to include the size. Staff
will likely recommend against it to City Council if it is passed by the Commission.
• The map is not included as it will become another step in the process
after it is approved by Council; at that time it will come back before the Commission
for a rezone and public hearing.
The public hearing was opened at 7:13 p.m.
Fred Braun, Freedom Realty, Kenai, Alaska -- Mr. Braun stated he supported the
resolution.
Public hearing closed at 7:15 p.m.
Kebschull noted staff had an issue with the 64 sq. ft. size for afree-standing size,
explaining there is quite a difference from the previous 120 sq. ft. now allowed in the
Central District zone and the 220 sq. ft. allowed by multiple businesses. The Code
was amended to accommodate the sizes because of the variances that were seen for
signs in the zone and some of these were denied by the Commission and then
overturned by Council.
Eldridge stated, even if the sign height would remain the same, there would be many
non-conforming signs; they could exist as long as they last; and, if revised, they would
have to be resized. Kebschull agreed height would also be an issue and noted the
Code always allows for a variance.
The following comments were made by the Commission:
• Jenckes stated he felt the 64 sq. ft. requirement should remain as a
variance request is an option.
• Bryson stated he felt 64 sq. ft. sign is acceptable if the business is in
close proximity to the traffic. However, a number of the properties are 75 to 100 feet
from the centerline and that size would be too small.
MOTION TO AMEND:
Commissioner Bryson MOVED to amend PZ06-53 to change the sign size to 120 sq. ft.
Commissioner Fullinck SECONDED the motion.

7-b. Discussion/Recommendation -- Lease Application/Lot 2, Block 1,
General Aviation Apron Sub. # 1, Amended -- Indcom Properties, LLC
(Kenneth Dunbar) -Discussion and Recommendation.
Kebschull requested a typographical correction in the memo. The third sentence in
the first bulleted paragraph should read, "Estimated value of the improvements is
$300 - 400,000.
Kebschull reviewed the memo included in the packet and stated, based on the
information, it appeared the proposed lease complies with the City's zoning ordinance,
Comprehensive Plan, Airport Master Plan, and is the highest and best use for the
parcels.
Fred Braun, Freedom Realty, Kenai, Alaska provided the following:
• He is a representative of applicant Kenneth Dunbar and provided a brief
history of Mr. Dunbar and the various properties he owns in Kenai and his future
plans for such properties.
• Dunbar's intent on Lot 2 is to build a hangar and noted the proposed
plans will need to be tailored for the lots. The proposed size for this hangar is 40 x
216 x 14 high. Some of the units will be heated.
• They believe there is a true need for hangars in the Kenai area.
Bryson asked if the parcel would have roadway access, as it appeared from the map
the parcel currently is landlocked. Braun indicated he was not sure about right-of-
way or future access but, at this time the parcel parallels the existing parking area
and would join the UPS lot. Bryson noted the City would like to retain the balance of
the parcel and were currently constructing a gate on the west side of the parcel.

Kebschull requested a typographical correction in the memo; the first bulleted
paragraph, fifth line should read, "...$504,000 for the hangars."
Kebschull reviewed the memo and noted the following:
• Based on the information provided, it appeared the proposed leases
comply with the City's zoning ordinance, Comprehensive Plan, and are the highest and
best uses for the parcels.
• Based on information provided in the lease applications for lots 9 and 10,
it was unclear if the proposed use would comply with the Airport Master Plan.
• Lot 11 appeared to comply with the Airport Master Plan.
• Staff recommended, if the leases are approved, the leases require that
any hangars built on Lots 9 and 10 must be used for commercial aviation type
activities.
Fred Braun, Freedom Realty, Kenai, Alaska -- Braun reported the following:
• Currently there are negotiations underway with FedEx and UPS for Lots
9 and 10.
• He is certain they would meet the cargo criteria and added the buildings
would have to be improved and tailored for those lots with different easements, etc.
• Lot 11, Grant Aviation is moving along quite well and it is their intent to
relocate their headquarters from Bethel to Kenai.
• The development timeline includes Lots 9 and 10 to start the summer
and fall of 2007 and Lot 11 is immediate.
• Braun commended the Airport Manager and staff providing Mr. Dunbar
with a tour to the area and available lots.
Fullinck asked if the proposed use would interfere with the airport boundary and
Kebschull replied it did not and met the developmental goals.

ITEM 9• REPORTS
9-a. City Council -- Council Member Ross noted the meeting agenda and
action taken at the last meeting was included in the packet. Commissioner Jenckes
asked how the dipnet season affected the City and Ross replied it would impact the
City with regard to revenue and sales tax.
9-b. Borough Planning -- Commissioner Bryson provided a report on action
taken at the last Borough Planning meeting.
9-c. Administration -- Kebschull reported the following:
• A barge working on the fiber optic cable will be purchasing approximately
6,000 to 7,000 gallons of fuel from the dock.
• Staff has been busy with building permits and subdivision plats.
• The lay down item would provide more information on Code enforcement
items.
There remains a vacant seat on the Commission.

ITEM 12 : COMMISSION COMMENTS & QUESTIONS
Commissioner Twait asked if a phone number existed to call into the Chambers if a
member would be late for a meeting. Kebschull said she would obtain the number
and provide it to the Commissioners.
Commissioner Jenckes indicated he may be absent from the next meeting.
Chairman Eldridge stated he felt there are more areas that should be rezoned to
Limited Commercial, specifically along the Spur Highway (Cliff Baker) to Tinker Lane.
He stated he hoped to have those items on the agenda soon.
Eldridge reminded the Commission they were also considered the Historic District
Board and are tasked to look at buildings and structures in Old Town. Because items
may come up in the future, he requested the Commission to become familiar with that
section of the Code. Kebschull advised the specific code as KMC 14.20.105.

ANALYSIS
Plat removes the lot lines to create two larger parcels from the three lots resulting in Lots
4A1 and 6A1. The resulting lot sizes meet the requirements for the SR2 -Suburban
Residential zone. Public water and sewer service is available to serve these parcels.
There are structures on both of the resulting parcels. The City has an asbuilt dated in
1995 by Whitford Surveying for the structure on the new Lot 4A1. This asbuilt shows the
structure is 7.8 feet from the east property line, which meets the setback requirements.
The shed, also on this lot, is less than 120 square feet and is not required to meet setback
requirements. Based on this information, it appears there are no encroachments;
however, final plat should verify no encroachments exist.

Each new lot will acquire the use, if needed for an additional sewer or water service. (For
owner's information.) No installation agreement is needed.

A RESOLUTION OF THE PLANNING AND ZONING COMMISSION OF THE CITY OF
KENAI RECOMMENDING THAT THE ATTACHED SUBDIVISION PLAT BE APPROVED
SUBJECT TO THE FOLLOWING CONDITIONS:
WHEREAS, the attached plat Inlet View Subdivision Beauchamp Addition No. Two was
referred to the City of Kenai Planning and Zoning Commission on July 27, 2006 and received
from Integrity Surveys.
WHEREAS, the City of Kenai Planning and Zoning Commission finds:
Plat area is zoned SR2 -Suburban Residential 2 and therefore subject to said zone
conditions.
2. Water and sewer: Is Available.
Plat does not subdivide property within a public improvement district subject to special

Plat subdivides Government Lot 39 into two lots, dedicates aone-half dedication of Hutto
Street and vacates a portion of the right-of--way and government easement while retaining
a water and sewer easement. The resulting lots meet the minimum lot size for the Rural
Residential 1 zone. Public water and sewer service is available to serve these parcels.
With the dedication on Hutto Street an encroachment was identified for the shop located
on the new Lot 1. According to the Kenai Peninsula Borough's records, this structure
was built in 1984 prior to the City assuming zoning powers. There is no record of a
building permit for the structure. In addition, the proposed lot line between lots 1 and 2
creates an additional side-yard encroachment for this same structure. The owner of the
parcel has applied for an encroachment permit for this structure and these encroachments
must be approved prior to the plat being recorded.

No installation agreement required. An adequate turn around and street have been
constructed by a City project. City administration does not object to vacating the east-
west right-of--way easement or the north-south right-of--way easement (as shown on the
plat) as long as the water and sewer easement is maintained for possible extension of City
mains.

RECOMMENDATIONS
Recommend approval with the following recommendations:

3. The issuance of the encroachment permit will not authorize a use
which is a not a principal permitted use in the zoning district in
which the property is located.
4. The encroachment is not located across a platted lot line.
In March 2006, the City received a complaint that addition an had been
constructed on the residence at 305 Sterling Court. The Building Official had
not issued a building permit for the addition. In May 2006, the Building Official
sent the registered owner a letter advising that the addition had been constructed

in violation of the City's code and that they were required to contact the City and
apply for a building permit for the addition. The owners of the residence
responded to the letter and the Building Official met with the applicants and
conducted a site visit. During June, HEA conducted a survey in the area and
marked the corners of the lots along the street. Based on these survey marks,
the owner and the Building Official measured the location of the house and the
addition. With this information, it was discovered that the addition was
constructed approximately five feet into the required 25-foot front setback.
The applicant was given the choice to remove the structure or to apply for an
encroachment permit. If the encroachment permit is granted, the Building
Official will issue a building permit for the addition.
To issue the permit, the following criteria must be established:
- An encroachment as defined in KMC 14.20.185 (a) exists. It has been
established that the addition is built into the required 25-foot front
setback.
- The encroachment does not encroach upon a Federal, State or City
right-of-way or utility easement. The encroachment does not encroach
on any right-of-way or easement.
- The issuance of the encroachment permit will not authorize a use
which is a not a principal permitted use in the zoning district in which
the property is located. The addition is a permitted use.
- The encroachment is not located across a platted lot line. The
addition does not cross a platted lot line.
City Engineer: Due to potential errors in measurements, staking, etc.,
recommend approval of an encroachment up to 6-feet.
Building Official: No building code would be violated by grating this
encroachment.
RECOMMENDATIONS
The application, as submitted, meets the criteria for an encroachment permit as
outlined in KMC 14.20.185.
The property owners constructed an arctic entry onto the front of their residence
without a building permit. After being contacted by the City, it was discovered
that in addition to constructing the addition without a building permit, the
structure encroaches approximately 5.1 feet into the required 25-foot front
setback. The encroachment does not seem excessive and the alternative is to
require the structure be removed.
Recommend approval with the following requirement:
1. Encroachment is limited to the addition shown on the application
submitted 7/19/06.

Applicant is in the process of subdividing their property into two lots. This is a
government lot and the subdivision requires dedication of the Hutto Street right-
of-way. This is a 33-foot right-of-way. At the request of the City, the surveyor

conducted an asbuilt of the structures on the lot in order to verify setbacks. This
information reveals the 24X14 square foot shop encroaches into the required
front setback. The shop was built (according to the Kenai Peninsula Borough's
records) in 1984. The front setback is 25 feet and the shop is 14 feet from the
front property line encroaching 11 feet into the front setback.
The proposed subdivision creates an additional encroachment into the side yard.
The side yard setback in the RR-1 zone is 15 feet and the shop will only be 8.5
feet from the side lot line if the subdivision is approved.
The application, as submitted, meets the requirements of KMC 14.20.185 for an
encroachment.
City Engineer:
The platting of Smith Ridge Subdivision will formally dedicate the Hutto Street
right-of-way.
Building Official:
Approval of the encroachment does not violate the building code.
RECOMMENDATIONS
The shop was built in 1984 prior to the City assuming zoning powers. There is
no record of a building permit for the building. Without the subdivision, the
encroachments would probably have not been discovered. Granting the
encroachments should not adversely affect neighboring properties since the
structure has been in this location for over 20 years. Recommend approval.

ANALYSIS
General Information:
KMC 14.25 specifies the requirements for landscape/site plans within the City of Kenai.
Section 14.25.030 of the code details Landscaping/Site Plan submittal requirements.
Applicant has submitted a plan for development showing the parcel, the approximate
location of the proposed building, access, the parking area, and the location of proposed
trees. In addition, water and sewer service, telephone and gas lines are identified.
• Perimeter/Buffer Landscaping -Application notes that only the trees and
vegetation in the area of the building and pavement will be removed.
Other areas will be preserved in the natural state.
• Interior Landscaping -The plan shows the locations of 15 trees that will
be planted at the site. The plan does not show landscaping between the
building and the paved parking area. Landscaping will be required in this
area.
• Parking Lot Landscaping - As noted above, the area between the parking
area and the building must be landscaped.
• Street right-of-way Landscaping -. Plan notes that the rights-of-ways
between the driveways and the parking area will be maintained as a green
belt. Any area that is not paved or retained in the natural state, must be
landscaped with a 10-foot landscaping bed.
The plan does not show a dumpster location. Any dumpster on the site must be -ocated

in an approved screened structure.

The applicant advises that snow storage will be located along the south half of the
southeast property line.
City Engineer:
Adequate area exists for snow storage. Drainage can be accommodated from parking
areas toward. the street. Snowmelt will be towards Ryan's Creek through natural ground
cover.
Building Official:
Parking appears adequate. Minimum number of spaces is three. The available space in
front of the building allows for at least four spaces.
RECOMMENDATIONS
The plan as submitted is approved with the following requirements:
1. Any dumpster on the parcel must screened with a sight-obscuring
structure made of wood or concrete.
2. Any area along the street right-of-way that is not paved or retained in the
natural state, must be landscaped with a 10-foot landscaping bed.
3. One hundred percent (100 %) of ground cover of the landscaping bed
must be planted with continuous maintenance so there will be no exposed
soil within three years of planting.
4. All landscaping shall be installed within one year after issuance of the
Certificate of Occupancy.
5. Required parking lot paving must be completed within two (2) years after
issuance of the Certificate of Occupancy.
6. The approved landscaping/site plan will lapse one year after date of
approval unless extended for good cause.
