CITY OF KENAI
ORDINANCE NO. 2245-2007
AN ORDINANCE OF THE COUNCIL OF THE CITY OF KENAI, ALASKA, AMENDING
KMC 14.20.125(a) BY DELETING THE REQUIREMENT THAT CONFLICTS BETWEEN
RESIDENTIAL AND BUSINESS USES IN THE CENTRAL MIXED USE ZONE WILL BE
RESOLVED IN FAVOR OF BUSINESS.
WHEREAS, KMC 14.20.125 established the Central Mixed Use Zone (CMU zone); and,
WHEREAS, KMC 14.20.125(a) provides that conflicts between residential and business
use in the CMU zone shall be resolved in favor of business; and,
WHEREAS, conflicts between residential and business uses in the CMU zone should
be resolved according to the best interest of the City according to the principals set
forth in the Kenai Zoning Code rather than automatically in favor of business; and,
WHEREAS, it is in the best interest of the City of Kenai to amended KMC 14.20.125(a)
by removing the requirement than conflicts between residential and business uses will
be resolved in favor of business.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF KENAI,
ALASKA, that KMC 14.20.125(a) is amended as follows:
(a) Intent: The CMU Zone is established to provide a centrally
located area in the City for general retail shopping, personal
and professional services, entertainment establishments,
restaurants and related businesses. The district is also
intended to accommodate a mixture of residential and
commercial uses [WITH CONFLICT BEING RESOLVED IN
FAVOR OF BUSINESSES). The CMU Zone shall be designed
to encourage pedestrian movement throughout the area.
Building and other structures within the district should be
compatible with one another and the surrounding area.
PASSED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA, this first day of August,
2007.
