SUBJECT: CONDITIONAL USE PERMIT, APPLICATION (PZ06-71).
This letter is in support of the application to giant the Conditional Use Permit to the
requestor.
I have lived at 604 Davidson Street for just over one (1) year. At which time 601 Davidson
Street has been operated in a similar fashion. There was no difficulty with traffic patterns,
parking or noise. The kitchen and surrounding areas has been kept clean and presents itself
as a professional business. Anyone driving through the neighborhood would not know this
business was present.

Vice-Chairman Phil Bryson called the meeting to order at approximately 7:00 p.m.

City Planner Kebschull provided a report on the preliminary plat which was included
in the packet and noted staff recommended approval. Kebschull also noted Cliff Baker
of Integrity Surveys was present to answer any questions.
Cliff Baker, Integrity Surveys, Kenai, Alaska -- Mr. Baker noted the plat was not
creating this southeast 1/4 northeast 1/4 as it was already there; it would be more of a
record survey of the plat.

4-b. PZ06-61 (Revised) -Preliminary Plat - Bookey's Replat. Plat submitted

Kebschull provided a report on the revised preliminary plat which was included in the
packet. She also noted staff recommended approval with the following
recommendations:

• Verification there are no encroachments remaining.
• If encroachments are identified, property owner must apply for and
receive approval for the encroachments prior to the plat being recorded.
• All former lot lines should be shown on the plat.
• Prior to recording the final plat, owner must apply for an amendment to
the zoning ordinance to rezone the parcels to one zone so as not to allow the plat to
create asplit-zone.
Vice-Chair Bryson opened the meeting to public testimony.
Cliff Baker, Integrity Surveys, Kenai, Alaska -- Baker noted the following:
• A statement in the packet requested a section line be vacated: The plat
indicates the section line has been vacated.
• A paper plat is done to eliminate lot lines. Encroachments are not
created; if anything they are eliminated.
• A paper plat is when everything is done in the office and not in the field
so it does not make sense to require a survey or as-built of all the encroachments
prior to recording a plat as the additional expense may stop the project.
Public testimony closed.
MOTION:
Commissioner Ftiillinck MOVED to approve PZ06-61 with recommendations of staff.
Commissioner Twait SECONDED the motion.
Kebschull was asked how Baker's comments about the encroachment would affect
staff's recommendations. Kebschull responded, the encroachment requirement is
standard and the Code does allow for non-conforming lots and uses of structures to
continue. However, it does not allow for something to be done that would create an
encroachment. Kebschull added, the Commission is advisory to the Borough and
often, they do not consider the requirement.
During discussion regarding utility easements, Baker noted the following:
• It was not their intent to vacate any easements at this time.
• The plat is to identify what is of record
• The section line easement was vacated.
• Eight parcels are being made into one; the original lot lines are indicated
on the plat with dotted lines.
Vice-Chair Bryson noted the following:
• The change would effectively create a half right-of--way within 30' which
is the standard Borough right-of--way.

• The 50' right-of--way created was excessive given that the other side of
the street also has a 50' right-of--way.
• He would vote in favor of the preliminary plat.
• He will not comment at the Borough meeting.
• The Commission should be considering the revised resolution and
comments.
MOTION TO AMEND:
Commissioner Fullinck MOVED to amend the main motion to include the revised plat,
resolution and comments. Commissioner Twait SECONDED. There were no
objections. SO ORDERED.
VOTE ON MAIN AMENDED MOTION:
There were no objections. SO ORDERED.
ITEM 5: PUBLIC HEARINGS
5-a. P206-65 - An application for a Conditional Use Permit for Cabin Rentals
(short-term rental) for the property known as 350 Ames Road (Lot 6,
Block 1, Pelch Subdivision Part 1), Kenai, Alaska. Application submitted
by Katherine Fleck, 31192 Nature Road, Royalton, MN 56373.
Kebschull provided a report as included in the packet and noted the following
recommendations:
• Grant a temporary permit for one tourist season from May 2007 to
September 2007.
• Review the permit after the temporary season to determine if a
permanent permit should be issued.
• Prior to issuing a permit, assure a current State of Alaska business
license and KPB sales tax certificate are on file with the City.
• Prior to issuing a permit, ensure the Fire Marshal conducts an inspection
to insure the residence meets the fire code for the proposed use.
Vice-Chair opened the public hearing.
Katherine Fleck, 350 Ames Road, Kenai, Alaska -- Ms. Fleck made the following
comments:
There should be no difference in the traffic in the area.
• Rentals will be limited to one party at a time with athree-day minimum;
preferably on a week-to-week basis.
• The property is a foreclosure and extensive renovations were preformed;
as a result the value of the property was increased.

Intent is to keep the facility looking like a home rather than a business.
There being no further comments from the public, the public hearing was closed.
MOTION:
Commissioner Jenckes MOVED for approval of PZ06-65, including staff
recommendations, i.e. the granting of a temporary permit of one tourist season (May
2007 to September 2007) at which it would be reviewed prior to issuing a permanent
permit. Commissioner Twait SECONDED the motion. There were no objections. SO
ORDERED.
Kebschull advised of the 15-day appeal process and noted appeals needed to be
submitted in writing to the City Clerk.
5-b. PZ06-68 - A resolution of the Planning and Zoning Commission of the
City of Kenai, Alaska, recommending to the Council that Title 14 of the

Kebschull was asked if existing mobile homes within the City would have to abide by
the new ordinance. Kebschull explained existing mobile homes would be considered
non-conforming, however, if the owner wants to add an addition, the mobile home
would be required to be inspected to insure it would meet the safety standards in the
ordinance. If an unsafe condition is reported, the City will investigate it under the
abatement policy in the building code and notify the property owner if necessary.

Staff had nothing additional but noted the email from Jim Richardson. Vice-Chair
Bryson opened the meeting to public comment.
Steve Voth, Kenai, Alaska - Mr. Voth made the following comments:
• The type of business has been at this location since 1960.
• The number of guides will be limited on both parcels; the maximum
number of clients would be 24 per day.
• The traffic will be reduced.

• Requested action on the application be postponed if there was a
possibility the application would not pass at this meeting.
There being no further comments the public testimony was closed.
Commission comments included:
• Concern expressed of the number of variance requests for the Angler
Acre area.
Suggestion the area should be rezoned.
It would be best if the property owners in the area initiated a rezone.

Staff noted no additional information, however indicated all property owners in the

Kebschull reported the lease had expired for the property and the Commission's action

the Conditional Use Permit would come before the Commission at the next meeting.
Vice-Chair Bryson opened the meeting to public comment.
Laura Ganshow, 1611 Aliak, Kenai, Alaska -- Ms. Ganshow made the following
comments:
• As owner of the Family Table, she had applied and paid for the
Conditional Use Permit.
• There is anon-competitive clause in place and she cannot be assured
there will be no competition with the McLennan's use of the kitchen.
• The Family Table had a signed lease which was prematurely terminated
by Cheney McLennan who wanted to retake control of the kitchen. The action was not
in accordance with the lease agreement.
• The issue is currently in litigation.
• She objected to the transfer of the permit which she felt would be
detrimental to her business.
• She feels the permit may be of use to her in the future because of the
matter not being resolved.
There being no other members of the public wishing to speak, public comment was
closed.
During discussion it was noted that Code states no conditional use permit issued shall
be transferred until the transferee has submitted an application for transfer in writing
to the administrative official. It was also clarified that Ganshow is the current permit

holder; that McLennan owns the property; and, conditional uses run with the property
and cannot be transferred to another location with a request for a new permit.

The applicant had leased this property to Ganshow, the Family Table. That lease has
expired and applicant would like to revert to the original permit and include additional
activities including on-site food preparation, cooking classes, private parties, and private
dinner parties. Applicant has noted in the application that the use would be restricted to
those activities that could meet the parking limitations at the site.
A business has operated from this location since the original permit was granted in 2002.
The City has no record of complaints regarding this commercial activity. The kitchen was
built specifically to commercial standards after the City granted the original Conditional Use
Permit. Adding the additional activities within the constraints of the facility should not be any
more invasive than the meal preparation business. The meal preparation business is a

business wherein individuals sign up for sessions, come to the kitchen, and are guided in
meal preparation for home consumption. With the addition of that business, the site has
hosted additional patrons.

RECOMMENDATIONS
A commercial activity has taken place at this location since 2002 when the commercial

time, the permit has been modified to include meal preparation sessions. Those sessions
involved participants coming to the kitchen. The requested amendment to include on-site
food preparation, cooking classes, private parties, and private dinner parties should not
cause any additional traffic than the meal preparation sessions as long as the activities are
limited to the constraints of the kitchen and the site, off-street parking.
Recommend approval with the following requirement:

ANALYSIS
Applicant is applying to transfer Conditional Use Permit PZ06-09) for off-site catering and
meal preparation from Laura Ganshow, The Family Table. Applicant has agreed to operate
the permit as originally granted and understands that an amendment will require a public
hearing. In addition to the transfer, the applicant is processing an application to amend the
Conditional Use Permit. That public hearing will be scheduled for October 25tH
Mr. McLennan was originally granted a permit to operate a commercial kitchen from with off-
site catering from this site in 2002. The following provides a list of permits issued for this
location since 2002:

RECOMMENDATIONS
Kenai Municipal Code 14.20.158 outlines the requirements for transferring Conditional Use
Permits. The request to transfer this permit meets the requirements of KMC 14.20.158 (a),
which states:
"No conditional use permit issued hereunder shall be transferred until the proposed

transferee has made application for transfer in writing filed with the administrative official,
which application shall state that he intends to be bound by the plan and statements
contained in the application of the permit holder or shall contain the amendments to the plan
his proposed operation would mandate. The Commission shall approve the application for
transfer and in so doing amend the site plan and statements if such amendments as are
contained in the application for transfer would have been approved had they been contained
in the original application."
The requested transfer meets the requirements of Kenai municipal code. Recommend
approval.

3. That Ms. Ganshow purchased the business, The Family Table, and leased
the commercial kitchen from Cheney McLennan and the permit was
transferred to Ms. Ganshow.
4. That in 2006, Ms. Ganshow's permit was amended to include off-site
catering.
5. That KMC 14.20.150 (i)(4) requires that a written request for transfer be
submitted.

ANALYSIS
General Information:
KMC 14.25 specifies the requirements for landscape/site plans within the City of Kenai.
Section KMC 14.25.030 details Landscaping/Site Plan submittal requirements. This is an
existing structure. KMC 14.20.250 requires submission of a site plan when there is a
change in use of the main building to insure there is adequate parking for the proposed
use.
Applicant is applying for a building permit to remodel an existing building located at 135
North Willow Street. The building permit application identifies the use as a flight school.
However, the building floor labels an area for retail space and another area for parts
sales. This would create amixed-use combining retail and office areas for the school.
Trade schools require'/Z space per employee plus one for every five (5) students. Based
on verbal information provided for the school, the expectation is for classes of
approximately (three) 3 students. Based on this description, the school will require 2
parking spaces.
The retail sales area requires'/Z per employee plus one (1) per company vehicle plus one
per three hundred (300) square feet of sales area. There is approximately 928 square
feet of sales area requiring four (4) parking spaces. Total spaces required for the retail
portion of the business would be six (6) parking spaces.
Based on this information, there should be sufficient parking to accommodate the

proposed business(es).

If a dumpster is placed on the property it must be located in an obscured location and
screening will be required. Prior to the placement of any dumpster, the location and
screening construction must be approved by the City.
The Building Official will determine if the sign location meets the code requirements
when the building permit is issued.
City Engineer:
Site characteristics will not change from the previous use. Drainage, snow storage, and
parking appear adequate.
Building Official:
Unavailable to comment; however, the Building Official will review the proposed
alteration and issue the building permit.

WHEREAS, the City of Kenai Planning and Zoning Administration finds this plan provides

Remodel of building located at 135 N. Willow Street
We propose to remodel the inside of an existing 40 X 60 foot steel building to house a
flight school. This building will have room for office spaces, briefing rooms,
computerized testing, and a retail area.
Framing: All interior walls and ceilings will be constructed of 24' O.C. 2X4
construction in order to hold up sheeting and insulation. All exterior walls will have a
minimum of 19-R-value insulation and the ceiling will have a minimum R value of 25. A
vapor barrier will be installed. All walls will be covered with %z sheetrock and the
ceilings will be covered with 5/8 sheetrock.
Window coverings: All original single pane windows will be replaced with double pane,
argon filled glass with an energy star rating.
Heating: Heating system will be replaced with a high efficiency gas fired water boiler.
The heat will be distributed throughout the building with the use of in-floor heat.
Electrical: An outdated 200 amp service panel will be replaced with a new 200 amp
service; minor electrical alterations will significantly decrease the load of the previous
system.
Plumbing: Existing plumbing will be used for this remodel.
Fire Extinguishers: Three 5 lb ABC extinguishers will be located in the building. One
each in the retail area, open area, and one near. the boiler room. (See attached diagram)
x Snow Storage: The grass area in front of the building as well as the area directly behind
the building will be used for the storage of seasonal snow. Drainage for both areas are
towards existing storm drains.
Garbage: Due to the small amount of garbage that is currently being produced by the
business, and no increase is expected, the operator will be responsible for its disposal as
needed.
Handicap Access: A handicap parking space will be provided next to the 5 ft. wide
concrete ramp in the front of the building. One of the two interior bathrooms will be
handicap accessible.
