I I I t .1 rage : or i Marilyn Kebschull From: jpth [jpth@acsalaska.net) Sent: 07 November, 2006 9:57 PM To: Marilyn Kebschull Subject: Kenaitze Court, Bed and Breakfast To: Ms. Kebschull and the City of Kenai Planning & Zoning Commission, I reside at 4570 Kenaitze Court and am writing to express my opposition to an application for a Conditional Use Permit to operate a Bed & Breakfast for the property described as Lot 2, Block 2, Illiamna View Subdivision, 4520 Kenaitze Court, Kenai, Alaska as submitted by Carol L. McKenzie, 4520 Kenaitze Court, Kenai, Alaska. As a resident of this neighborhood, I am concerned that this bed and breakfast establishment will not be operated in a manner compatible with residential character of the neighborhood and that it will not be secondary or incidental to the residential use of the main building. I'm also concerned that the applicant will not be able to provide adequate off-street parking, especially during periods of peak use. Realizing that these concerns alone do not support orjustify a denial of the application, I respectively request that if the Commission approves the application, that the permit be issued on a temporary basis for the first year. This would allow time to determine if these concerns are unfounded or warrant further consideration by the Planning and Zoning Commission. I appreciate your time and any consideration you may give this request. We would like to make the Commission aware of some of our concerns since this business will be within 300 feet of our property. Our main concern is with parking and increased traffic flow. Kenaitze Court is now a very quiet, unpaved, dead end street. Therefore we would like assurance that there will be no on street parking. Depending on the anticipated number of rental rooms, guests and vehicles, it might be a challenge to comply with the off street parking requirement. When we built the subdivision in 1970, it was zoned residential and has had that distinction since. With only. one entrance off the Spur Highway, limited parking space, no river access the additional traffic, possibly with boats and trailers, could cause a great deal of confusion with street parking and turn around possibilities. Most of the residents in the subdivision are retired and enjoy the peace and quiet we could lose by allowing a business to be established. We are very much opposed to issuing a conditional use permit for this purpose. Our subdivision does not have a through street, so consequently all the traffic would pass by our home, creating more traffic noise and dust. 2. Adequate off street parking for the bed and breakfast customers, including those who will probably be bringing boats down to fish the Kenai River. Our subdivision is a quiet 7 home subdivision and we feel the increased activity of a bed and breakfast would be detrimental to the quality of life in our subdivision. Thank you. It's been brought to my attention that a home owner in our subdivision is planning to start a B &B operation and is seeking approval through Planning and Zoning. Please consider this as a statement opposing such operation. The subdivision was established in the early 70's as a quiet little residential area. It was never intended to be a subdivision for business operations. The road system is limited and is not designed to handle traffic other than local. Even visitors to houses are not easily accomodated for larger gatherings. A B&B will definitely impact traffic patterns and may result in safety issues. This would be especially true during the fishing season when boats and trailers will no doubt be utilizing the road on a regular basis. As there is no river access this can cause problems since there are no turn arounds. If you decide to approve please do not approve on a permanent basis so the impact can be reviewed on a yearly basis with comment from homeowners in the subdivision. This parcel is the result of a civil matter between the current owners, Vernon L. Lofstedt, Sr. and Muriel R. Lofstedt and the applicant, Forest DeWayne Craig. As result of a settlement between the two parties, the applicant is processing a plat to subdivide this parcel from a larger parcel. The property is zoned Conservation. The minimum lot size in this zone is 20,000 square feet. This parcel, based on the preliminary plat, is 12,266 square feet. Applicant is applying for a variance from Kenai Municipal Code 14.24.010, Development Requirements Table for the minimum lot size. The parcel has access to public water and sewer. To issue the permit, the Commission must determine if the variance meets the requirements of KMC 14.20.180: - Special conditions or circumstances are present which are peculiar to the land or structures involved which are not applicable to other lands or structures in the same zoning district. This property is being platted as result of a civil court settlement. Applicant does not have the option to replat an area large enough to meet the minimum lot size. It does appear that there are special circumstances present. - The special conditions or circumstances have not been caused by actions of the applicant and such conditions and circumstances do not merely constitute a pecuniary hardship or inconvenience. This is a settlement based on a civil suit that started with an adverse possession claim by the applicant. This property abuts the applicant's developed parcel and has been used for several years as a front yard. The applicant does not have the legal ability to add additional property to the parcel. This request does not merely constitute a pecuniary hardship or inconvenience. - The granting of the variance shall not authorize a use that is not a permitted principal use in the zoning district in which the property is located. The variance does not authorize a use that is not a principal permitted use. - The granting of a variance shall be the minimum variance that will provide for the reasonable use of the land and/or structure. Based on the legal agreement between the two parties, this is the minimum variance. - The granting of a variance shall not be based upon other non- conforming land uses or structures within the same land use or zoning district. Lofstedt, Sr. ("Lofstedt") and Forest DeWayne Craig ("Craig") to resolve all claims by and between Lofstedt and Craig that were raised or could have been raised in the civil action titled Forest Dewayne Craig v. Vernon L. Lofstedt, Sr. and Muriel R. Lofstedt, filed in the Superior Court for the State of Alaska, Third District at Kenai, Case No. 3NK-03-395-CI (the "civil case"). 1. Disputes and differences arose between Lofstedt and Craig with respect to claims to a parcel of property hereinafter described. The parties have agreed to execute this Settlement Agreement and Mutual release to resolve such disputes and differences, and to provide for certain payments and performances in full settlement and discharge of all claims that have been asserted in the civil case. 2. The Parties release and forever discharge each other, and each other's heirs, agents, assigns from any and all past, present, and future actions, claims, counterclaims, cross claims, third -party claims, and demands of any nature whatsoever for damages or other relief of any kind, whether mature or not mature, relating to or arising in any way from their respective claims to the property hereinafter described. The Parties further agree to stipulate to the dismissal, with prejudice and without costs, or fees, of claims against each other in the civil case immediately upon closing of the transaction as provided in paragraph 4, below. 4 The Parties further agree as follows. a. Lofstedt will convey to Craig that portion of the property depicted on Attachment 1 hereto as Encroachment (the "Property "). He will convey the Property by good and sufficient warranty deed, subject only to easements, reservations and covenants of record. The conveyance will include the rights to quiet enjoyment to the land, air, and sunlight as they are presently situated and he will covenant not to unreasonably block or interfere with those rights. b. Craig will pay Lofstedt a total of $20,000. He will pay $10,000 within 10 days of the execution of this agreement and $10,000 upon receipt of the deed to the property. c .Each party will use best efforts to comply with AS 40:15.010 and applicable Kenai Peninsula Borough platting ordinances and regulations to create a subdivided parcel which can be lawfully conveyed. Craig will pay all surveying or platting costs necessary to create the parcel and all closing costs. D Closing will occur within 30 days after approval of the final plat. 5 .. The Parties acknowledge familiarity with the decision of the Alaska Supreme Court in }'oung v State, 455 P.2d 889 (Alaska 1969)and the protection of that holding is hereby expressly waived. All individuals, corporations, or other entities who could, now or at any future time, be possible defendants in any action arising out of the dispute in question are hereby released as fully as though they were specifically named herein. The parties further acknowledge an understanding of the decision of the Alaska Supreme Court in Witt v. Watkins, 579 P.2d 1065 (Alaska 1978), and enter this Settlement Agreement and Mutual Release with full intent to release each other from any damages or losses which the parties know of, or reasonably should know of, at the present time. 6. In executing this Settlement Agreement and Mutual Release, the parties have not relied on any statement or representation made by the other parties, their agents or representatives, concerning the nature, extent, or duration of the losses or damages, or the liability therefore, or any other statement or representation of any nature by the other parties, their agents or representatives. 7. The interpretation and enforcement of this Settlement Agreement and Mutual Release shall be governed by the laws of the State of Alaska, and any proceedings relating in any manner whatsoever to this Settlement Agreement and Mutual Release shall be conducted in the Superior Court for the State of Alaska, Third Judicial District at Kenai. In the event it is necessary for any party hereto, or its authorized representative, successor, or assign, to institute suit with respect to this Settlement Agreement and Mutual Release, the prevailing party in such suit shall be entitled to reimbursement for its reasonable costs, expenses, and attorney's fees incurred. 8. This Settlement Agreement and Mutual Release has been jointly drafted by the parties hereto following negotiations between them. Each of the individuals signing this Settlement Agreement and Mutual Release on behalf of a party hereto warrants that he or she has the authority to sign the Settlement Agreement and Mutual Release and thereby to bind the party on whose behalf he or she signs. It is the intent of this chapter to permit bed and breakfast establishments by conditional use, which is compatible with other, permitted uses, with the residential character of a neighborhood, and which is clearly secondary or incidental to the residential use of the main building. b) Provided that these establishments shall be owner-operated, not more than one person outside the family shall be employed in the bed and breakfast; rent out no more than thirty percent (30%) of the total floor area; have adequate off- street parking for owner and all guests; and shall meet all other requirements as set forth by the Planning and Zoning Commission at the time of public hearing. (c) The bed and breakfast establishment must meet all area, height, and setback requirements of the zones in which they are allowed according to the Land Use Table. (d) Issuance of the Permit. Following approval by the Commission, the administrative official shall not issue the permit until the expiration of the fifteen-day appeal period contained in KMC 14.20.290. After approval by the Commission and before the issuance of the permit, the administrative official must determine that the applicant is current on all obligations (e.g. sales tax, property tax, lease payments, utility payments) to the city or has entered into an approved payment plan with the city on any obligations owed and the applicant is in compliance with the payment plan and (if the permit is for a use required to collect sales tax) must show a valid borough sales tax account. If a timely appeal is filed pursuant to KMC 14.20.290, the permit shall not be issued unless authorized by the Board of Adjustment. (e) Yearly Reports. The permit holder shall submit a yearly report between October 1st and December 31st to the administrative official. Such report shall include a summary of the on-site activity. (f) Revocation for Noncompliance/Compliance Notices. If the Commission determines, based on the yearly review or any other investigation undertaken by the official, that the conduct of the operation(s) is not in compliance with: 1) The terms and conditions of the permit; 2) The provisions of the Kenai Zoning Code or; 3) The permit holder is not current on any obligations (e.g. sales tax, property tax, utility payments, lease payments) to the city unless the applicant has entered into an approved payment with the city on any obligations owed and the applicant is in compliance with the payment plan, the Commission may revoke the permit. 4) The Commission shall not revoke the permit until the permit holder has been notified and given reasonable opportunity to correct the deficiency(s) or to provide information relating to or rebutting the alleged deficiency(s). Appeals from decisions under this section shall be made in accordance with the provisions of KMC 14.20.290. If the administrative official determines the permit holder is in compliance with the conditions in this paragraph, it shall send a notice of compliance to the Commission and the permit holder. The layout provided with the application shows a master bedroom and two additional bedrooms. It was clarified with the applicant that the area shown as an office on the layout is also a bedroom. That area will be maintained and used by the applicant. To issue the permit, there are two sections of the code that the Commission must review. Chapter 14.20.150 outlines the requirements for a conditional use permit: - The use is consistent with the purpose of this chapter and the purposes and intent of the zoning district. The RR Zone is intended to provide for low- density residential development in outlying and rural areas in a form, which creates a stable and attractive residential environment. Because a bed & breakfast accommodates guest within the constraints of the residence, the use appears consistent with the intent of the zone. - The value of the adjoining property and neighborhood will not be significantly impaired. The proposed bed and breakfast should not affect the value of the neighborhood. - The proposed use is in harmony with the Comprehensive Plan. The comprehensive plan notes, "Small home-based businesses may be accommodated within certain design guidelines. " The proposed B&B should meet this criteria. - Public services and facilities are adequate to serve the proposed use. The home is served by on-site water and septic systems. The systems should have been constructed to meet the DEC requirements for the home and the proposed B&B, using existing bedrooms, should be adequately served. - The proposed use will not be harmful to the public safety, health or welfare. The proposed use should not be harmful to the public safety, health, or welfare. - Any and all specific conditions deemed necessary by the commission to fulfill the above-mentioned conditions should be met by the applicant. These may include, but are not limited to measures relative to access, screening, site development, building design, operation of the use and other similar aspects related to the proposed use. All off-street parking for clients and the home must be accommodated on the applicant's property. In addition to meeting the requirements of KMC 14.20.150, the bed and breakfast must meet the requirements of KMC 14.20.321: - Intent. It is the intent of this chapter to permit bed and breakfast establishments by conditional use, which is compatible with other, permitted uses, with the residential character of a neighborhood, and which is clearly secondary or incidental to the residential use of the main building. ^ Provided that these establishments shall be owner-operated, not more than one person outside the family shall be employed in the bed and breakfast; rent out no more than thirty percent (30%) of the total floor area; have 0675 Comment.doc Page 4 adequate off-street parking for owner and all guests; and shall meet all other requirements as set forth by the Planning and Zoning Commission at the time of public hearing. Applicant understands that she must operate the bed and breakfast and that only one person outside of the home may be employed. Based on the application, it appears the B&B will meet the requirement that no more than thirty percent (30%) of the home may be used for the B&B. Applicant did not provide a site plan; however, has been informed of the requirement that all parking must be on the applicant's property. - The bed and breakfast establishment must meet all area, height, and setback requirements of the zones in which they are allowed according to the Land Use Table. This is an existing home and there is no indication that the residence does not meet all development requirements. - Issuance of the Permit. Following approval by the Commission, the administrative official shall not issue the permit until the expiration of the fifteen-day appeal period contained in KMC 14.20.290. After approval by the Commission and before the issuance of the permit, the administrative official must determine that the applicant is current on all obligations (e.g. sales tax, property tax, lease payments, utility payments) to the city or has entered into an approved payment plan with the city on any obligations owed and the applicant is in compliance with the payment plan and (if the permit is for a use required to collect sales tax) must show a valid borough sales tax account. If a timely appeal is filed pursuant to KMC 14.20.290, the permit shall not be issued unless authorized by the Board of Adjustment. These requirements will be placed on the resolution and the permit will not be issued until a copy of the business license and sales tax compliance has been received by the city. - Yearly Reports. The permit holder shall submit a yearly report between October 1st and December 31st to the administrative official. Such report shall include a summary of the on-site activity. Applicant will be required to submit yearly reports. City En ig Weer: It is the owner's responsibility to provide adequate off-street parking and comply with Alaska Department of Environmental Conservation (ADEC) regulations regarding on-site water supply and wastewater disposal. Building Official: Building Permit B-4253 was issued January 19, 2006 to repair fire damages. To date, no final inspection has been performed. A final inspection should be completed prior to issuing a conditional use permit.
