HomeMy WebLinkAboutOrdinance No. 2299-2008~,~~,~'~ ~/ w~~~ SUBSTITUTE Suggested by: Councilor Boyle ca~°Y ~~ xENwr ®RDIN4NCE P7®. 2293-2008 AN ORDINANCE OF THE COUNCIL OF THE CITY OF KENAI, ALAS AMENDING KMC 14.20.200(a)(2) TO INCREASE THE SIZE OF ACCESSORY ST CTURES ALLOWED IN SETBACK AREAS FROM ONE HUNDRED AND TW TY (120) SQUARE FEET TO TWO HUNDRED (200) SQUARE FEET WITH NO SIDE REND OF THE ACCESSORY STRUCTURE LONGER THAN SIXTEEN (16) FEE UNLESS THE BUILDING OFFICIAL GRANTS A WAIVER FOR GOOD CAUS , TO INCREASE THE DISTANCE FROM THE ADJOINING LOT, AND TO CHANG THE BUILDING PERMIT REQUIREMENT FOR RESIDENTIAL ACCESSORY STRU URES FROM OVER ONE HUNDRED TWENTY (120) SQUARE FEET TO OVERT HUNDRED (200) SQUARE FEET. WHEREAS, KMC 14.20.200(a)(2) now allows for ac essory structures of not more than one hundred twenty (120) square feet and not m e than one story in height to be in setback areas provided they are not closer th hree feet to the adjoining lot; and, WHEREAS, limiting the size of such accesso structures to one hundred twenty (120) square feet is too small for many items to stored in; and, WHEREAS, increasing the size of such inside storage without the added exper outside storage in yards; and, structures would allow for more of another out building, thus reducing WHEREAS, increasing the di not adversely affect adjacent side setback would insure larger structures do ~; and, WHEREAS, allowing larger sine storage buildings would decrease the need for additional buildings in yards; d, WHEREAS, existing setbac s for sheds above one hundred twenty (120) square feet cause a significant loss o sable yard space; and, WHEREAS, it is in the est interest of the City of Kenai to amend KMC 14.20.200(a)(2) to increase the size allowed accessory structures in the setback from one hundred twenty (120) to tw undred square feet and to increase the distance from the adjoining lot to f e feet (S'). WHEREAS, residential accessory structures of 200 square feet or less should not require a building permit. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA, that KMC 14.20.200 is amended as follows: Substitute Ordinance No. 2299-2008 Page 2 of 2 KMC 14.20.20® Accessory s4rucfuxes.
