HomeMy WebLinkAboutOrdinance No. 2311-2008Suggested by: Administration C%TY OF I{EPIAI o~DrNaNCE No. 2aia_-loos AN ORDINANCE OF THE COUNCIL OF THE CITY OF KENAI, ALASKA, FINDING THAT CERTAIN CITY-OWNED LAND, IDENTIFIED AS TSN R11W SEC 4 SEWARD MERIDIAN KN 0880053--CENTRAL VIEW SUBDIVISION TRACT B, THIRD RECORDING DISTRICT, KENAI, ALASKA, (KPB PARCEL NO. 04901062), IS DEDICATED FOR PARK PURPOSES. WHEREAS, Kenai Municipal Code 22.05.110 provides for the dedication of lands for a public purpose if so determined by the City Council by ordinance; and, WHEREAS, Resolution No. 2007-48 authorized the purchase of the property described above for wetlands mitigation to be retained by the City and reserved for park purposes; and, WHEREAS, on February 2, 2008, the City of Kenai issued and recorded a conservation easement on the property which is recorded at 2008-001421-0 in the Kenai Recorder's Office; and, WHEREAS, the conservation easement restricts and regulates certain activities on the premises in order to preserve conservation values of the property; and, WHEREAS, the property is zoned Conservation and contains wetlands and drainage into the Kenai River. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA, that certain City-owned, identified as TSN R11W SEC 4 Seward Meridian KN 0880053--Central View Subdivision Tract B, Third Recording District, Kenai, Alaska (KPB Parcel No. 04901062), is reserved for park purposes in compliance with the conservation easement on the property. This property was purchased as off--site mitigation for the loss of wetland habitat on the Wal-Mart site.
